10-18-2016 Code Enf Minutes City of Clermont MINUTES CODE ENFORCEMENT HEARING October 18, 2016 The City of Clermont Code Enforcement Hearing for October 18, 2016 took place in the Council Chambers at City Hall beginning at 3pm with Special Magistrate Leigh Kyer presiding over the hearing. Also attending were Evie Wallace, Code Enforcement Supervisor, Lori Crain, Code Enforcement Officer, Barbara Hollerand, Development Services Director, Dan Mantzaris, City Attorney, and Rae Chidlow, Planning Specialist. Code Enforcement Officer Crain, along with any of the public who may testify, was sworn in. City Attorney Mantzaris stated that Case No. 2016-000389 and 2016-000557 have complied and will not be heard. He stated that the City did not receive notice for Case No. 2016-000561 and will be moved to the November 15, 2016 hearing. Case Number: 2016-000261 Respondent: KRV Clermont Corp. City Attorney Mantzaris explained the case and stated that the City is in agreement to waive the fine that has accrued to $1500. The Respondent was present and sworn in. Disposition: Waiver provided. Case Number: 2015-000292 Respondent: KJP Florida Investments LLC Code Enforcement Officer Crain presented the case. The Respondent was present and sworn in. Renee Neuciler with Orlando Property Management presented invoices showing that work is being done on the property. AND Case Number: 2016-000152 Respondent: KJP Florida Investments LLC Code Enforcement Officer Crain presented the case. The Respondent was present and sworn in. Renee Neuciler with Orlando Property Management stated that she will have the property cleaned up by the November 30, 2016 deadline. Disposition: In violation of Chapter 14, Section 304.13, 304.13.2, 304.7, 305.3, 305.6, 505.3, 605.1, 605.2, 701.2, 704.1, 704.2, 302, 304.1, 304.14, 305, 108.1.3, 108, 108.1.3, 108.1.5 (9), 504.3, 302.2, 302, 302.4; Chapter 34, Section 34-61 (1, 2, 3, 10), 34-62; Chapter 122, Section 122-344; with a fine of$250 per day for every day in violation past November 30, 2016. Case Number: 2016-000299 Respondent: Suntrust Mortgage Inc. Code Enforcement Officer Crain presented the case. The Respondent was present and sworn in. Attorney Hashi Richards, attorney for Suntrust, stated that Suntrust obtained title to the property on July 11, 2016. She stated that each time the maintenance company went out to make repairs they said the property was occupied. She stated that the property is vacant now and they are actively working on the property. She stated that they are requesting 60 days to come into compliance. City Attorney Mantzaris stated that the City would agree to allow 45 days for compliance Disposition: In violation of Chapter 34, Section 34-62, 34-61, 34-95; Chapter 14, Section 303.1, 303.2, 304.1, 302, 302.8; Chapter 122, Section 122-344; with a fine of$250 per day for every day in violation past January 1, 2017. 1 City of Clermont MINUTES CODE ENFORCEMENT HEARING October 18, 2016 Case Number: 2015-000310 Respondent: William Fenn The Respondent was not present. Mr. Mantzaris stated that the fine has accrued to $35,300 and continues to accrue at$100 a day. Disposition: Create and record a lien on property located at 415 Rob Roy Drive. Case Number: 2015-000409 Respondent: Jeffrey A. Bratta Code Enforcement Officer Crain presented the case. The Respondent was not present. Disposition: In violation of Chapter 14, Section 302.7, 302, 302.4, 303.1; Chapter 122, Section 122-343 (a)(e. 1, 2, 3); Chapter 34, Section 34-61 (1, 2, 3)with a fine of$250 per day for every day in violation past October 31, 2016, and the violation constitutes a serious threat to the public health, safety, and welfare due to the pool being unsecured and unsanitary. With no further scheduled hearings, the hearing adjourned at 3:55 pm. 2
