AN ORDINANCE UNDER THE CODE OF ORDINANCES OF THE
CITY OF CLERNONT, I.AKE> COUNTY, FLORIDA, CLOSING
AND PERNANENTLY ABANDONING A PORTION OF FOURTH
STREET DESCRBIED HEREIN, ACCORDING TO THE OFFICIAL
NAP OF THE CITY OF CLERNONT, RECORDED IN PLAT BOOK
8, PAGES 17-23, INCLUSIVE, PUBLIC RECORDS OF LAKE
COUNTY, FLORIDA; PROVIDING AN EFFECTIVE DATE; AND
PROVIDING FOR PUBLICATION.
THE CITY COUNCIL OF THE CITY OF CLERNONT HEREBY ORDAINS THAT:
SECTION 1.
That portion of Fourth Street located within the City of Clermont,
All that portion of the Westerly 3' of Fourth
Street, bounded on the North by the South right-
of-way line of Highway 50, and bounded on the
South by the North right-of-way line of Chestnut
Street, according to the Official Map of the City
of Clermont, Florida, recorded in Plat Book 8,
pages 17-23 inclusive, Public Records of Lake
County, Floridå.

We are attaching a photo-copy of the survey which indicates the location of encroach-
ment, and the proposed Ordinance is available for your inspection at the office of the
City Clerk on Monday thru Friday between 8:00 A.M. and 5:00 P.M.
Pursuant to the time requirements for final consideration, City Council, in public
hearing, shall consider the enactment of the proposed ordinance at their meeting to
be held on Tuesday, February 28, 1978. You are invited to be present at the Hearing,
and all interested persons will be given an opportunity to express their views on
the matter.
As an abutting and/or adjacent property owner of the aforesaid portion'of Fourth
Street, you will please be advised that Council was in agreement with the request,
based on their feeling of no forseeable future need of that portion of street right-
of-way by the City, and thereupon took the necessary action to grant the request
by introducing an Ordinance providing for the closing and permanently abandoning of:
All that portion of the Westerly 3 feet of Fourth Street
bounded on the North by the South r-o-w line of State Road
50, &1d bounded on the South by the North r-o-w line of
Chestnut Street.
A recent survey obtained by Mr. Jones on his property described as Lots 1 and 2
in City Block 44, reflected that the existing building on this property had been
constructed in such a location that it encroached on the Fourth Street right-of-
way by 2 feet on the northerly side and 1 foot 11 inches on the southerly side,
which subsequently prohibits him from obtaining a clear title on his property.
Clermont City Council, meeting in regular session last evening, considered a
request by Mr. Aaron Jones, Jr. for the closing and permanently abandoning of
a portion of the above mentioned street.
