City of Clermont MINUTES REGULAR COUNCIL MEETING May 9,2017 The Clermont City Council met in a regular meeting on Tuesday, May 9, 2017 in the Clermont City ,? Council Chambers. Mayor Ash called the meeting to order at 6:30pm with the following Council Members present: Council Members Mullins, Bates, Travis and Goodgame. Other City officials present were: City Manager Gray, City Attorney Mantzaris, and Acting City Clerk Noak. INVOCATION AND PLEDGE OF ALLEGIANCE Council Member Mullins gave the invocation followed by the Pledge of Allegiance. • PROCLAMATION is Acting City Clerk Noak read the Bicycle Month proclamation aloud. Acting City Clerk Noak read the Water Reuse Week proclamation aloud. Mayor Ash presented the proclamation to Environmental Services Assistant Director Reed. I PRESENTATIONS Ij Dreamplex Economic Development and Community Redevelopment Agency Director Schmidt introduced Cameron Gomes; Dreamplex General Manager. Mr. Gomes gave a presentation on the background and the need for Dreamplex. Dreamplex offers rental space to various therapy groups at no cost to the patients and their families. The vision of Dreamplex is to expand the facility to provide a community center with basketball and volleyball courts, a fitness center,two indoor arenas,and other amenities. Mayor Ash thanked Mr. Gomes for their services. Council Member Mullins congratulated Dreamplex on receiving the Oakley Seaver Award. Earth Day Environmental Services Assistant Director Reed gave a presentation on the Clermont Earth Day and lake clean up event held on.April 22, 2017 at Lake Hiawatha Preserve. PUBLIC COMMENTS Jim Purvis; 4206 Hammersmith Drive, spoke in opposition of the recent media comments criticizing the City and City Council for spending money. 1 City of Clermont MINUTES REGULAR COUNCIL MEETING May 9, 2017 REPORTS City Manager Gray announced Item 5, The Daily City's Orlando Food Truck Bazaar Event, would be heard after Item 10, Mason's Ridge Variance Request. The applicant has withdrawn Item 8, Ordinance No. 2017-21 The Shops at WaterBrooke Rezoning. Mr. Gray announced the Council will have an Ethics Training Workshop on May 16, 2017-at 6:30pm. The speed limit'signs on Minnehaha Avenue have been installed. City Manager Gray reported the City received additional grant money for Victory Pointe. The City has rt received more than.$4,000,000 in grant money for the project. The ground breaking ceremony for i} Victory Pointe will be held on June 14,2017 at the Historic Village. f, City Manager Gray reported the Clermont Fire Department has been responding to calls outside of our Interlocal Service Boundary Agreement when the Clermont Fire Department is the closest unit to a call. Mr. Gray will be sending a letter to Lake County providing a 30-day notice that the City will no longer respond outside of our Interlocal Service Boundary Agreement on an ongoing basis. s City Attorney Mantzaris—No report. Council Member Bates commented Jim Harrison; Swimming for Life, was partnering with the City and offering scholarships for swimming lessons. He announced May 20, 2017 is Water Safety Day and there will be events held at the Arts and Recreation Center. Council Member Goodgame reported on attending a foster children event in Winter Park, the Montverde Hawaiian Night event,and the,New Beginnings Dragon Boat Festival. 'I Council Member Mullins commented on attending the South Lake Chamber of Commerce Awards Banquet. He reported Music on Montrose was held on Friday, May 5, 2017 and the Spring Flower Show was held on May 6, 2017. Council Member Travis reported she attended the South Lake Metropolitan Planning Organization meeting, The new Florida Turnpike exchange will have a ribbon cutting ceremony and a 5K run June 10, 2017 beginning at 9`.00am. The Ride.of Silence will begin at the Waterfront Pavilion at 6:30pm on May 17,2017. Mayor Ash commented,she met Little Miss Universe, attended the Montverde Academy Gala, the South Lake Chamber of Commerce Awards Banquet, the Annual Kiwanis Prayer.Breakfast, the Dragon Boat ; Festival,the Uncanny Comic Shop ribbon'cuttiing ceremony, and the opening of the PDQ restaurant. I i UNFINISHED BUSINESS Item No.8—Ordinance No.2017-21 Final, The Shops at WaterBrooke Rezoning The applicant withdrew the rezoning request. k 'i Item No.9 Variance Request, Hartle Groves Apartments LLC/Veve at Castle Hill Senior Planner Kruse presented the request for a variance to allow for a non-drought tolerant ground cover. Staff noticed the St. Augustine 1 sod during a:building-sign-off inspection, The owner removed-the recently replaced St. Augustine sod; however,•the _owner, did not want:to remove the St. Augustine sod which had taken root. Staff 1 recommended denial of the variance request. Frank Hamner; Hartle Groves Apartments, stated the original plans submitted showed St. Augustine sod ;f and the sites were inspected and approved by the City. There were no public comments. Mayor Ash closed the public hearing. 11 Council Member Mullins asked if the St. Augustine sod would dominate the Bahia sod in the future. Planning Manager Henschel stated it would be difficult to determine which sod would dominate. Council.Member Goodgame moved for approval of the variance request; seconded by Council Member Bates:°The motion passed with all members presentvoting aye. Item No. 10—Variance Request Mason's Ridge ` Senior Planner Magruder presented the request to reduce the required tree replacement fee and allow for 3-inchcaliber replacement trees: The applicant has revised the request and is seeking to pay 10 percent of the tree`mitigation'fee. Staff recommended denial of the variance request. Attorney Jimmy Crawford; Attorney for ALP Investments, LLC., stated the project was able to reduce the number of trees to be mitigated,to 1,975 inches of trees at a mitigation fee of$28,637.50. Denise Pyke; Denise Pyke Construction,partnered,with the Florida Native Plant Society and harvested plants which were relocated to Oakland-:Nature'Preserve and Lake.Louisa State Park. Attorney Crawford requested approval to pay 10 percent of the$28,637:50 tree mitigation fee. Mayor Ash opened the public hearing. is Willie Montgomery; 419 East Desoto Street, spoke in favor of the request. Mayor.Ash closed the public hearing. Council Member Travis asked how the trees were measured. Attorney Crawford indicated the process is done by a survey according to City Code: The survey expenses were$12.00 per tree. Tim Greene; Greene Consulting Group, stated the property is heavily wooded and the plan places as many trees as possible on the site. aI Council Member Goodgame inquired if any of the larger trees would remain on the site. Attorney Crawfordstated all of the-26(twenty-six)6-inchcaliper trees will be replanted. Council Member Goodgame moved to approve the variance without any financial !! penalties. I Parks and Recreation Director.Davidoff presented the request of The Daily City's Orlando Food Truck i I it Bazaar-to be held at Waterfront Park from 6:OOpm to 9:OOpm every third Wednesday of the month j' beginning June 21, 2017 through'April.-18, 2018. ,The events will.have approximately 10 trucks, with additional trucks-added in,the future. The organizerhas agreed to comply with all City regulations, rules, fees,and staffingrequirements. Mayor Ash.opened the.public hearing. Erika Shanoff Clermont-Downtown Partnership Board President, commented adding another food truck I event would create confusion with the current food truck events. 1 f 11 Doug Travilion; 940-Tildenville School Road, Winter Garden, stated he.has organized the current food truck events for the Clermont Downtown Partnership and recommended keeping only the current food r truck event. Ron Smart;.;Clermont Downtown Partnership Executive Director, commented the downtown merchants ; see an additional number of people in the downtown area with the current food truck events, at no cost to 11 the merchants. Mr.Smart expressed concern of saturating Clermont with additional food truck events. Abigail Santiago; Livi and Tate, spoke in favor of approving the new food truck event. Barbara Rajcula; The Broom Tree, expressed concern of adding another food truck event. I Mark Baratelli; Applicant,.stated the city would gain $6,000 annually in fees and the City's population could support both The-'Daily City'.s Orlando Food Truck Bazaar and the Clermont Downtown Partnership food truck events: Jim Purvis; 4206 Hammersmith Drive, asked the City Council to consider the long term goal and vision of the City. i i Mayor Ash closed the public hearing. Council Member Mullins expressed concern of the music disturbing the neighboring residents and the food truck vendors:taking their earnings to Orange County. I Council Member Travis was in favor of the request. 11 Council Member Goodgame stated the food trucks should have to get a City Business Tax Receipt. Mr. Goodgame asked if the food trucks would have health .certificates. Parks and Recreation Director Davidoff stated the food trucks have health certificates. ;d Council Member Goodgame was opposed to the request. Council Member Bates spoke of limiting the number of trucks and shortening the term to four or five months. Council Member Travis was in agreement with Council Member Bates. Council Member Mullins commented the profits from the current event stay in the City and expressed concern of possible confusion with having two different food truck events. Council Member Travis inquired if Council Member Mullins had a voting conflict. City Attorney Mantzaris stated it would be a conflict if Council Member Mullins individually gained a special benefit. Council Member Travis moved to approve Item Number 5 Event Request through December 20,2017. it Council Member Bates asked ofthe number of food trucks for the event. Parks and Recreation Director Davidoff stated the request was for 10 food trucks in the beginning and additional food trucks would be based on the demand. ,i Council Member.Travis amended-the motion to include limiting the number of food trucks to 10;seconded by. I Mayor Ash moved to postpone both requests for two months until there was a working relationship with'the downtown businesses. Council Member Bates was in favor of approving for several months. Mayor Ash amended the motion to postpone the requests for three months and allow the Clermont Downtown Partnership,to continue the events and return before Council for the remainder of the-request. • City Attorney Mantzaris suggested approving for two months. Council Member. Mullins.stated the Clermont Downtown Partnership was not given an opportunity to •I present their side of the issues at the March 21,2017 Council workshop. Council Member Travis commented on the City possibly operating the Farmer's Market and Merchant Faire. Council Member Mullins.:stated the Farmer's Market and Merchant Faire was a private enterprise operated by Clermont Downtown Partnership. i; Council Member Goodgame commented street closures steer people away from businesses. f Council .Member.Bates spoke of continuing the discussions with the businesses and the Clermont Downtown Partnership. ;l Mayor Ash moved to approve Item 11 and Item 12 for two months; seconded by Council Member Goodgame. it Council Member Mullins requested a three-month approval. Council Member Travis opened the public hearing. i Ron. Smart; Clermont Downtown Partnership Executive Director, thanked Council for extending the events for two.months. Mr. Smart commented;the Clermont Downtown Partnership has been working with local businesses to,expand the;footprint for the First Friday Food Truck and Music on Montrose 'e event to west of 8th Street and haveadded more food trucks. The Clermont Downtown Partnership met with Brian Broadway's church and the church will.be bringing in a number of churches and praise band events: Mr. Smart stated the Clermont Downtown Partnership is working with non-profits for free display spaces. The'Farmer's Market and Merchant Faire has expanded to 63 vendors who set up in i approximately 70 booth'spaces. • Marcella Imbesi; Livi and.Tate, expressed concern of the Clermont Downtown Partnership's management of the Farmer's Market and Merchant Faire,the First Friday Family Food Trucks and Music on Montrose, and the effect the Clermont Downtown Partnership has on the downtown businesses. Ms. Imbesi commented the Clermont Downtown Partnership is not accepting of new ideas and continues to exclude certain merchants. ; ,r ; tI 7 r -- t City of Clermont MINUTES REGULAR COUNCIL MEETING May 9, 2017 Barbara Rajcula; The Broom Tree, spoke of the positive effects the Clermont Downtown Partnership events have had for the merchants. David Guess, Encore Home Decor, commented the First Friday Food Trucks and Music on Montrose event is expanding and the merchants are experiencing an increase in business. Mr. Guess stated the Clermont Downtown Partnership has not had a chance to respond to merchant concerns. Lisa Harris; South Lake Art League, spoke of the positive comments she hears regarding the Farmer's Market and Merchant Faire. Erika Shanoff; Clermont Downtown Partnership Board President, stated the Clermont Downtown Partnership is looking for solutions to grow the businesses and bring awareness to downtown. The Farmer's Market and Merchant Faire has more than 50 vendors on a weekly basis. Doug Travilion; 940 Tildenville School Road, Winter Garden, spoke of the benefits in locating the food trucks close together. Mila Shanoff; Erika's Tea Room, spoke of working together to improve the downtown area. Abagail Santiago; Livi and Tate, spoke in opposition of providing the extension. Jim Purvis; 4206 Hammersmith Drive, and Charlene Forth; 939 West Desoto Street, spoke in favor of granting the extension. Council Member Mullins requested allowing a three-month extension as people have had to miss the workshop meetings. Mayor Ash stated additional extensions can be provided in the future.
