AN ORDINANCE PROVIDING A BUDGET OF EXPENSES FOR THE GENERAL OPERATIONS OF THE
GiOVERNMEliT OF THE CITY OF CLERMONT FOR THE FISCAL YEAR OF 1973-74 AND MAKING
APPROPRIATIONS THEREFORE: PROVIDING A TAX LEVY ON ALL PROPERTY IN THE CITY OF
CLERMONT, LAKE COUNTY, FLORIDA FOR THE YEAR 1973 FOR THE GENERAL OPERATION
EXPENSE OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA
The City Council of the City of Clermont, Florida, hereby ordains that:
SECTION 1
It is hereby found and determined by the City Council of the City of
Clermont, Lake County, Florida, that the following sums of money, or as much
thereof as may be authorized by law, as may be needed or deemed necessary to
defray all expenses and liabilitiE!S in the general operation of the government of
the City of Clermont be and the Sðlme are hereby appropriated for the corporate
purposes and objects of said city hereinafter specified for the fiscal year
commencing on the first day of October, 1973 and ending on the 30th day of
September, 1974.

and that a portion of the revenue described above must be raised from the assess-
ment and levy of ad valorem tax on each dollar of taxable property in the City
of Clermont, Florida as hereinafter provided.
SECTION 3
It is hereby found and determined by the City Council of the City of
Clermont, Lake County, Florida, that the assessed value for 1973 for the City of
Clermont, Florida as prepared by the Tax Assessor of the County of Lake and
confirmed by the Board of Lake County Commissioners is:

and that the Tax Assessor of the County of Lake has certified that a tax rate of
$6.95 per $1,000 valuation will ~ield the same amount of tax revenue as that
levied during the previous year.'
SECTION 4
It is hereby found and determined by the City of Clermont, Lake County,
Florida, that to raise the sum of Five Hundred Fifty Thousand Five Hundred Seventy
Four Dollars ($550.574.00) requi y'ed for general government operati on of thi s
city, an ad valorem taxation of all taxable property of this city, anticipating
uncollected taxes, a tax levy of eight mills is required to be levied as follows:
*Including allocation for Cooper Memorial Library
*Including allocation for Chamber of Commerce
SECTION 5
There is hereby levied and shall be collected on each dollar of taxable
property in the city of Clermont, Florida, for general government operation of the
said city a tax of eight mills.
SECTION 6
The Tax Assessor of the County of Lake is hereby directed to extend the
Assessment Roll of the City of Clermont heretofore equalized, confirmed and
approved, in accordance with the millage provided in Section 5 of this Ordinance
and to deliver same to the Tax Collector of the County of Lake, and the aforesaid
Tax Collector is hereby directed to collect the said taxes at the time and in the
manner hereby provided by law and the General Ordinances of the City of Clermont,
Florida.

Dear Mr, Hopkins:
I represent Tom K. Dougherty and Valentine S, Dougherty, his wife, who are pur-
chasing Lot 283, Clermont Heights. The purpose of this letter is to call your
attention to mistakes on your Sewer Assessment map and other maps and papers
dealing with the above property,
All of the records in the Clermont City Hall with the exception of minutes of
two previous council meetings and two ordinances show Lot 283 to be 69 feet wide
from the North line to the South line, On December 17, 1924, the Clermont City
Council passed an ordinance reducing Highland Avenue from 80 feet to 60 feet and
gave the extra 20 feet to the property owners along the southern edge of Highland
Avenue. Section 1 of the ordinance following the preamble reads as follows:
"That the width of the said Highland Avenue be reduced from eighty
feet to sixty feet, by moving the south line thereof northwardly a
distance of twenty feet, and that the said twenty feet strip shall
enure to the benefit of the presentowners (sic) of the property along
the southern edge of said Highland Avenue."
The Clermont City Council passed another ordinance (Ordinance No, 42) confirming
the ordinance of December 17, 1924, yet in some respects modifying the previous
ordinance, The Clermont City Council minutes for June and July 7, 1939, as well
as Ordinance No, 42 show that there was some confusion concerning property owners
in certain blocks facing Highland Avenue - more specifically property owners
facing on Chestnut Street, After the preamble, which I don't completely under-
stand, the Clermont City Council ordained in Section 1 as follows:
"Section 1 That the action of the City Council in passing the ordinance
reducing the width of Highland Avenue from eighty feet to sixty feet on
December 17, 1924, be and the same is hereby ratified and confirmed,"
On behalf of Mr, & Mrs. Dougherty, I am requesting that you correct the dimensions
on every map and paper in the City Hall to show that Lot 283, Clermont Heights,
is eighty-nine feet wide from the North boundary to the South boundary and further
that the actual assessment be corrE!cted from an assessment of $276,00 to an assess-
ment of $356,00,

should be notified that the assessment should be on eighty-nine feet in width.

lot in question is still shown to be sixty-nine feet in width, The Map of Cler-
mont was filed for recording on February 4, 1926,

RE: LOT 283, CLERMONT HEIGHTS
Dear Mr, Hopkins:
My wife and I are owners of Lot 283, Clermont Heights, This lot abuts the
southern right-of-way line of Highland Avenue. The maps and surveys show
our lot to be 69 feet wide and Highland Avenue to be 80 feet wide, However,
our house and yard occupies 89 feet and Highland Avenue measures 60 feet,
The City Council passed an ordinance moving the southern edge of Highland
Avenue 20 feet to the north and giving the 20 feet to the property owners
along the southern edge, The problem is that the Public Records of Lake
County do not clearly reflect the Council's intention,
We request that the City correct this title defect as it pertains to us and
the many other property owners along the southern edge of Highland Avenue,
We would be happy to present the City attorney with our findings should he
desire.
