WHEREAS, the following owners of the propert.f set opposite
their respe ctive names, located in the City of Clermont, Lake County,
Florida, have petitioned the City Council of the City of Clermont to
grade am pave DISSTON AVDroE between Minnehaha. Avenue and Lake Dr! ve, as
represented on the Official Map of the City of Clermont, duly filed aDd re-
corded in the Public Records of Lake Counv t Florida:

and, although they have been frequently contacted by this Council, or by
some of it s members, and/or by other property owners, owning lands so abutt.-
ing Diu ton A venue, who have so petitioned said City and its Council, they
have failed, refused, or neglected, for reasons unknown, to join in said
peti 1:i on; and, those so petitioning, together wi th those not pet! tioning,
W. R. Walton and H. E. Schramae1 and wife, Mary SchrUUle1, are the owners
in fee simple of all of the propert.f abutting, adjoining and oontiguous to
said Disston Avenue; and,
WHEREAS, it baa been determined by the Ci ty Council of the Ci ty
of Clermont, with the full knowledge of all petitioners and those not peti_
tioning, that a 24 foot paved street with a 6 inch Sand-Clay stabilized
·
sub-grade and with a 6 inå1 Sand-Clay packed base thereon primed with cut-
back asphalt or tar applied at the rate of approximately 0.20 gallons per
square yard with Asphaltic Concrete Surface 1 inch thick, together with
curbs, gutters, storm sewers, catch basins, clearing, grading, driveways,
drainage and engineering, will cost these property owners $5. fn per lineal
foot (which represents only two-thirds of the entire cost, the remaining
one-third of the total cost being paid by the City of Clermont from its
General Improvement (Capital) Fund - the total cost thereof being $17,081.29)
which cost per foot does not exceed 25% of the total 1956 assessed valua-
tion of all of said property adjoining, abutting and contiguous to said
Disston Avenue; and,
WHEREAS, the owners of the property which is abutting, adjoining
ani e:rmtiguous to said Disston Avenue, and said owners represent more than
75% of the total 1956 assessed valuation of s aid property so abutting, ad-
joining and oorxtiguous to said Disston Avenue. have petitioned the City
Council of the City of Clermont ani/or said City to improve said street
by paving same from said Minnehaha Avenue to said Lake Drive, and the total
cost thereof to all of said property owners does not exceed 25% of the total
assessed valuation of said property abutting Disston Avenue for the last
taxing year 1956 and likewise does not exceed 25% of the total assessed
valuation for the taxing year of 1957, which assessed valuations aId Tax Roll
for real property for 1957 were equalized, confirmed and adopted prior to
the introduction of this Resolution, by this City Council duly si tting as
a Board of Equalization, therefore, under the authority of Section 33,
Chapter 8926, Special Legislative Acts for 1921 (the Charter of the City of
Clermont) and under Chapter 170, Florida Statutes 1957 the City Council
of the City of Clermont may i.prove said portion of Disston Avenue by clear-
ing, grading and paving same, may designate the portion thereof to be paid
by special assessment, the m&mer in which said assessmen 1:8 shall be made,
the portion to be paid by this City, and the manner in which said assess_
ments, together with interest on all unpaid portions thereof, shall be paid
and designate the lands against which said special assessments shall be
levied. and,
WHEREAS, som.e of those so petitioning this Council and/or City
have evidenced their good faith and intention to pay said special assessments,
the 00 st to them. of s ai d improvements, by deposi ting with the Ci tizens Bank
of Clermont as Escrow Agent for themselves and the City of Clermont an
8JII.ount equal to the cos t thereof to their respe cti ve parceJs of property,
which is the amount contemplated to be equal to 'the total of any special assess-
ment, thereby paying in advance their respective costs of clearing, grading,
draining and paving Disston Avenue in front of and adjacent to their res_
pective owned parcels of property first above described; therefore,
BE IT RESOLVED by the City Council of the City of Clermont, Lake
Coun't;y p Florida:
(a) That they do hereby assess against each and every of the
following described lots, pie c.. or parcels of property located in the City
of Clermont, Lake County, Florida, and abutting, abouniing and contiguous to
Disston Avenue in said City between Minnehaha Avenue and Lake Drive, as repre-
sented on the Official Hap of the City of Clermont, filed 2/4/26 and recorded
in Plat Book 8, Pages 17-23, inclusive, Public R.eccrds of Lake Coun't;y, Florida,
to-wit:

being all of the real property abutting, abounHng and contiguous to
said Disston Avenue between said Minnehaha Avenue am Lake Dr! ve, the
total cost of said proposed improvement being $17.081.29, and the total
cost to be assessed against the respe ctive above described parcels of prop.
erty being less than 25% of the total assessed valuation of said property
for 1956, as assessed by the Tax Assessor of the Cit,y of Clermont.
(b) That they do hereby direct the City Clerk and/or Tax
Assessor of 1he City of Clermont to immediately enter each assessment, as
set forth in particular hereinabove against each respective parcel of proper_
ty in the Street Improvement Lien Book of the City of Clermont, which lien
shall beam is hereby de c1ared to be a first lien until paid upon and
against each respective parcel of property described in said assessment,
subject only to State, County, and City of Clermont taxes; ani, the City
Clerk of the Ci t,y of Clermont is hereby dire cted to publish a Notice of
these assessments (Assessment Roll) for at least one (1) issue in the
C1ermon t Press, a newspaper of general circulation published in the City
of Clermont, Lake County, Florida, giving therein due notice of the assess_
ment against each am e verT parcel or lot adjoining, or abutting, said por-
tion of Disston Avenue above described, by listing each parcel or lot of
real property separately and giving, if available, from his rea>rds, or
from those of the Tax Assessor's and/or Tax Collector's the names of the
oWDer(s) of each lot or parcel of property against which an assessment has
been made, the front footage of each lot or parcel of property and the total
assessment made against each lot or parcel of property, and gi. ving each per_
son, or others that may be interested in any of said lots or parcels of
property an opportunity to complain to this City Council against the res-
pective assessment at a meeting (special or regular) of the City Council
(meeting as an Equalization Board) to be he1d in the City Hall in the City
of Clermont at the hour of 7:30 o'clock p. H. on a date not less than ten
(10) days frOll the date of the first publication of said notice of meeting.
(c) That if II) complaints be made, or if any adjus'bnent or
correction be made by said Council at said meeting based on a complaint,
the special assessments as originally made, and/or as adjusted or corrected
b,y said Council sitting as an Equalization Board, or at an adjourned meeting
thereof, shall then stand cronfirmed at the final adjournment of said meet.

(d) That if said assessments, together with said interest, be
not paid as same becomes due and payable, the City may, at its option, de.
clare all sums fully due and payable, and shall thereafter foreclose said
lien or the payment thereof shall be enfQrced in a œordance with the Charter
and the laws and Ordinances of the City of Clermont, but not~ng herein con.
tained shall pre vent the enforcement of the p~ent thereof, or the fore..
closure thereof, by any other alternative or substitute manner as provided
under the general laws of the State of Florida, in such cases made and pro-
vided.

The City Council of the City of Clermont, Lake County, Florida,
hereby give Notice that the lots, pieces or parcels of land hereinafter
described, and being s i iuate wi thin the boundaries of the Ci 1¥ of
Clermont, have been assessed in the amounts set opposite each lot, piece
or parcel of property as the cost of the improvement of DISSTON A VENUE
on a per front foot basis and/or as the value of the benefit and advan-
tage to such lot, piece or parcel of property, beyond the general ad.
vantage to all the real property within said City, frOJll the clearing,
grading, draining and paving of DISSTON A VENUE from Minnehaha Avenue to
Lake Dri vet as represented on the Official Hap of the City of Clermont,
such assessments in no case exceeding two-thirds of the expense of such
improvement.
And notice is hereby given that the City Council of the City
of Clermont will meet at the City Hall in the City of Clermont on September
24, 1957 at 7:30 o'clock p. M. and then and there hear any complaints
which the owner(s) or other person(s) interested in any real estate m~
wish to make against the assessments thereon.
If there be no complaint, the assessments as originally made,
shall stand confirmed at the adjournment of said meeting, but if any cor.
rections be made upon complaint, the assessments as corrected shall then
stand confirmed upon the adjournment of said meeting.
The property assessed and the amount of such assessment is as
follows:
