R-63-022• RESOLUTIONS NO. 22 • N° 32 WHEREAS, the Council of the City of Clermont, in order to clarify certain matters pertaining to Rules of Order, Presiding Officer, and Order of Business, find it necessary to adopt the following Rules of Order to be- come effective at the first meeting of the Council in January A . D. , 196 BE IT RESOLVED by the Council of the City of Clermont that the following Rules of Order of the Council sha1.1 take effect at the first meet- ing of the Council in January A . D. , 1964, to-wit: RULE 1: The Council shall meet in the Council Chamber as established and designated from time to time by the Council at 7:30 o'clock P. M. on the first Tuesday of each month. If this meeting date shall fall upon a legal holiday it shall be held on the following day at the same time. If a quorum is not present, those in attendance may adjourn the meeting to a subsequent date not more than 15 days thereafter. As of the close of business on Friday before any regular monthly meeting (including an adjourned regular meeting) the City Clerk shall prepare an Agenda for the meeting and the following order shall be observed in the transaction of business: First - Approval of Minutes of previous meetings Second - Visitors with business to be heard Third - Reports of Mayor, Chief of Police, Building - Inspector and Superintendent Fourth - Reports of Regular Committees Fifth - Reports of Special Committees Sixth - Unfinished or 01d Business Seventh - Communications Eighth - Resolutions and Ordinances Ninth - Payment of bills Tenth - City Clerk -Correspondence Eleventh - New Business By a ma jority vote of the Council any person not on the Agenda may be heard. In the same manner any person to be heard on any matter may be restricted as to time to present same. • • RESOLUTIONS N o 3 3 NO. 22 RULE 2: The Mayor shall preside over a.l.l meetings of the Council. He shall appoint all regular and special committees of the Council. He may fill a.11 vacancies on committees . The Mayor shall not under any circumstances have a vote. RULE 3: At the first meeting of the Council held after the election of any council member in each year, the Council shall elect one of their members as President of the Council who sha.l.l preside over the Council in the absence of the Mayor. A President pro tem shall also be elected in like manner to serve during the absence or disability of the President and the Mayor. When the President or President pro tem are presiding, they sha1.1 vote on all matters requiring a vote of the Council members . RULE 4: A1.1 ordinances must be in writing and introduced at a regular or adjourned regular Council meeting, and sha.l.l receive two read- ings (the second may be by title only) previous to its passage. That is, once upon the date of its introduction and once at the succeeding regular or adjourned regular meeting in the fo,l.lowing month (30 days apart). By unanimous consent an ordinance may be ordered to the second reading on the date of its introduction, and may be passed. Nothing herein shall prevent an ordinance being intro- duced at a special meeting held for that purpose upon notice being duly published or posted for two full weeks prior to the date of the special meeting. The ordinance may then be finally adopted and passed in the same manner as if introduced at a regular meeting. RULE 5: Every ordinance passed by the Council sha1.1 be signed by the President or President pro tem of the Council, attested by the City Clerk and before becoming a law shall be presented to the Mayor for his approval or disapproval as required by Section 11 of the Charter of the City of Clermont (~11 of Ch. 8926, Acts of 1921 Legislature of Florida as amended by ~ 3 of Ch . 10432, Acts of 1925) . RULE 6: A11 resolutions shall be in writing and may be adopted at any regular or adjourned regular meeting or at any special meeting called for the purpose of considering same. Notice of the special meeting must be published or posed for two full weeks prior to the date of the special meeting . RULE 7: The presiding officer of the Council shall decide all questions of Order, but any member dissatisfied with any of the decisions sha1.1 have the right to appeal to Council. RULE 8: A mo tion to reconsider any of the proceedings of Council will not be entertained unless it be made by a member who pre- • • RESOLUTIONS N ° 3 4 NO. 22 vious.ly voted in the majority; nor shall it be entertained at any meeting other than the one at which the proceedings were had or the meeting immediately succeeding. RULE 9: Any additional rule or rules may from time to time be made by Council but no alteration of a rule, or adoption of anew rule shall take place without the consent of two-thirds of the members present, and upon one month's notice. RULE 10: In all other matters pertaining to the orderly conduct of all Council meetings, Robert's Rules of Order shall prevail in a1.1 parliamentary procedure. RULE 11: By unanimous vote of Council the foregoing rules may be suspended for the meeting then in session.
