R-84-465 e CITY OF CLERMONT e RESOLUTIONS No. 465 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA GRANTING A CONDITIONAL USE PERMIT TO ALLOW CONSTRUCTION OF A 3D-UNIT TOWNHOUSE DEVELOPMENT IN THE R-3 RESIDENTIAL/PROFESSIONAL ZONE. WHEREAS, The Planning and Zoning Commission of the City of Clermont, Lake County, Florida at its meeting held April 3, 1984 recommended approval of the Conditional Use Permit to allow construction of a 3D-unit townhouse development in the R-3 Residential/Professional zone on the property described as: Lots 3, 4, and 5, Block 2D; all of Block 19; a portion of Juniata Street closed by City Ordinance No. 47-M; and a portion of Crystal Lake Drive closed by City Ordinance No. 61-M; the City Council deems it advisable in the interest of the general welfare of the City of Clermont, Lake County, Florida to grant the Conditional Use Permit; NOW THEREFORE BE IT RESOLVED by the City Council of the City of Clermont, Lake County, Florida that: SECTION 1 The application for a Conditional Use Permit to allow construction of a 3D-unit townhouse development in the R-3 Residential/Professional zone on the above described property be granted subject to the follow- ing conditions: 1. The property must be developed in substantial accordance with an approved site plan. 2. If, at a future date, parking at this site proves inadequate, the applicant understands and agrees that the City may require more parking or rescind this Conditional Use Permit (CUP). 3. No further expansion of the use or additions to this facility shall be permitted except as approved by another CUP. 4. All applicable rules and regulations shall be met, including final site plan approval, landscaping, drainage, parking, and sign regulations. All required landscape buffers must be served with an underground sprinkling system and be properly maintained. Fire hydrants must be installed as recommended by the Fire Chief and a buffer strip of fifty (50) feet must be maintained between the northernmost unit and the north property line. s. This property may be used only for thirty (3D) residential town- house units. 6. The applicant is responsible for installing, at his expense, a six (6) inch water line from Broome Street to DeSoto Street to serve this development. The applicant is also responsible for connecting to the City's sewer system in a manner approved by the City Engineer, at the owner's expense. 7. The owner must sign an agreement and covenant stating that if Broome Street is completed in the future, the assessment for the improvement will not be protested. A driveway and easement will be permitted using the Broome Street right-of-way to serve the e CITY OF CLERMONT e RESOLUTIONS No. 465 Page two development. No driveway will be permitted from Second Street. A "No Left Turn" sign must be placed at the exit from the project. 8. The lowest floor elevation of all buildings must be at 101.5 feet to comply with the CityOs flood regulations, and required rear yards must begin twenty-five (25) feet from the water mark of 97.5 feet. 9. No vegetation will be pulled from the lake without the express written permission of the City of Clermont, except for the beach area shown on the approved plans. 10. A fifteen (15) foot easement centered over the existing line must be given to the City for the storm sewer line near the north property line. 11. The buildings and drives should be situated to avoid headlight glare or any other nuisance to abutting property owners. 12. The City Engineer must approve all drainage and retention areas, which must also meet the requirements of the Lake County Pollution Control Board and FAC 17-25. 13. Principal driveways will be required to run parallel to the con- tours of the land. 14. The northerly units on the beach side shall be brought parallel to the contour lines as much as possible. 15. The dock shall be restricted to a total length of thirty-five (35) feet, and a width of six (6) feet measured from the 93.5 water mark with a 10' x 10' (100 sq. ft.) turnaround on the end. The total length of the dock, including the turnaround, cannot exceed 35'. 16. No Certificates of Occupancy can be issued until each of the stated conditions in each phase has been met, including completion of all driveway, parking and drainage requirements, which must be properly maintained and operated by the owner. Phasing will be allowed only after a performance bond is issued for the public improvements required for the entire project. 17. This permit shall expire if construction has not begun within one year of the date of this Conditional Use Permit. 18. If any of the stated conditions is violated, the applicant under- stands and agrees that the City Council may revoke this CUP by resolution. 19. The north buffer zone of 50' shall be rezoned to R-l Single Family Residential before any Certificate of Occupancy can be issued.
