A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CLERMONT, LAKE COUNTY, FLORIDA
GRANTING A CONDITIONAL USE PERMIT TO ALLOW
A PLANNED UNIT DEVELOPMENT TO CONSTRUCT 32
TOWN HOUSE UNITS, TOGETHER WITH IMPROVEMENTS
WHICH INCLUDE A POOL, IN
ACCORDANCE WITH THE REVISED SITE PLAN.
WHEREAS, the Planning and Zoning Commission of the City of
Clermont, Lake County, Florida at its meeting held June 7, 1983
recommended the approval of the Conditional Use Permit to allow
the construction of thirty-two town house units, together with
improvements which include a pool and the City Council deems it
advisable in the interest of the general welfare of the City of
Clermont, Lake County, Florida to grant the Conditional Use
Permit;
NOW THEREFORE BE IT RESOLVED by the City Council of the City
of Clermont, Lake County, Florida that:
SECTION 1.
The application for a Conditional Use Permit to construct
thirty-two town house units, together with improvements which
include a pool on that part of Tracts 49A and 50A, Lake Highlands
Company, according to the plat thereof recorded in Plat Book 3,
page 38, Public Records of Lake County, Florida, lying East of U.S.
Highway 27 in Section 19, Township 22 South, Range 26 East, Lake
County, Florida, containing 3.341 acres described as follows: Com-
mencing at the East 1/4 corner of said Section 19, run O~OO'OO" E
along the E line of said Section 19, a distance of 1317.00' to the
Eastern extension of the centerline of DeSoto Street, S 8~39'00"W
along the Eastern extension, a distance of 30.00 feet to the W ROW
of Grand Avenue (Highway) for the POB; S 8~ 39'OQ"W along the center-
line of said DeSoto Street (unopened) a distance of 725.82 feet to
the E ROW of said Highway 27, SEely along said E'ly ROW, through a
curve to the right having a radius of 5849.65 feet an arc distance
of 118.71 feet; S l~ 09'29" E, continuing along said E'ly ROW a
distance of 92.20 feet; N 8~ 39'00" E parallel with said DeSoto St.
a distance of 683.37 feet to said W ROW of Grand Avenue; N or 00'00"
W along said W ROW of Grand Avenue, also parallel with and 30.00 ft.
from said E line of Sec. 19 a distance of 205.92 feet to the POB be
granted subject to the following conditions:
1. The property must be developed in substantial accordance
with the approved site plan. The density of development
shall not exceed thirty-two units.
2. No further expansion of the use or additions to this facility
shall be permitted except as approved by another Conditional
Use Permit.
3. All applicable rules and regulations shall be met, including
final site plan approval, landscaping, parking, sign regula-
tions and all yard setbacks.
4. The final Certificate of Occupancy cannot be issued until
each of the stated conditions has been met.
5. This permit shall expire if construction has not begun
within one year of the date of the Conditional Use Permit.
6. If any of the stated conditions is violated, the applicant
understands and agrees that the City Council may revoke
this Conditional Use Permit by Resolution.
7. All drainage, including overflow devices, must be approved
by the Lake County Pollution Control Director and the City
Engineer.

8. A buffer strip of trees and hedges must be installed on the
north property line, with a sprinkling system to maintain
same.
9. A sewer main must be installed to the north property line in
in accordance with plans approved by the Utilities Director
and the City Engineer. No sewer line shall be installed until
the developer performs all engineering work necessary to de-
termine the proper depth of the line for future extension
north on Grand Highway to Pitt Street.
10. No water service shall be supplied until the assessment for
the water line is repaid.
