R-70-163 RESOLUTIONS RESOLUTION N0. 163 r~ U N~ 235 THIS AGREEMENT, P~ade this 21st day of May, 1970, by and between the SEABOARD COAST LINE RAILROAD COMPANY, a Virginia Corporation, herein- after referred to as Licensor, and the CITY OF CLERMONT, a municipal corporation under the laws of the State of Florida, hereinafter referred to as Licensee, bJITNESSETH: WHEREAS, by an agreement dated February 11, 1970 between the parties hereto, the Licensor granted unto Licensee the right or license to install and maintain, for the purpose of sewer mains, lines of pipe across and/or along the right of way and underneath tracks of Licensor at Clermont, Florida, at locations as particularly described in Exhibit "A" of said agreement; and WHEREAS Licensee desires and Licensor is willing that said agree- ment be amended to permit Licensee to install and maintain an extension of the pipe line crossing described in Item (4) of said Exhibit "A" underneath a spur track of Licensor and the right of way therefor; NOW THEREFORE, Licensor, for and in consideration of the sum of One Dollar to it in hand paid by Licensee, the receipt of which is hereby acknowledged, and of the covenants and agreements hereinafter made and contained on the part of Licensee to be kept and performed, hereby agrees that said agreement dated February 11, 1970 shall be and is hereby amended to permit Licensee to install and maintain, for the purpose of a sewer main, a line of 10-inch cast iron pipe (encased in a 20-inch steel pipe conduit) across the right of way and underneath a spur track of Licensor at a point 200 feet northwardly measured along the center line of said spur track from its point of switch at the junction with Licensor's main track, which point of switch is 450 feet southwardly measured along the center line of said main track from Mile Post AT-911; as shown in green right of way for said spur track being 10 feet wide on each side of the center line thereof. And the parties hereto herby agree that, except as hereby amended, said agreement dated February 11, 1970 shall remain in full. force and effect and all of the covenants and agreements contained therein to be kept and performed by Licensee shall apply equally to the additional pipe line crossing described in this supplemental agreement. It is understood and agreed that this supplemental agreement shall not be binding until it has been authorized or ratified by a proper ordinance or resolution of the City Council of the City of Clermont, Florida, a certified copy of which ordinance or resolution is attached hereto and made a part of this agreement.
