RESOLUTION NO. 210
A RESOLUTION OF THE CITY COUNCIL
THE FLORIDA LEGISLATURE TO ENACT
OF OCCUPATIONAL LICENSES BY EACH
MANNER AND DIRECTING THAT OCCUPA'
VARIOUS COUNTIES OF THE STATE BE
PROPORTIONATE BASIS.
OF THE CITY OF CLERMONT FLORIDA, URGING
LEGISLATION CLEARLY AUTHORIZING THE LEVY
LOCAL MUNICIPALITY IN A DISCRETIONARY
fIONAL LICENSE REVENUE RECEIVED BY THE
DISTRIBUTED TO LOCAL MUNICIPALITIES ON A
WHEREAS, in 1972 the Florida Legislature, as a result of an adverse court
decision, recognized and extended the authority of cities to levy occupational
licenses, and
WHEREAS, the Legislation is scheduled to expire October 1, 1973 and
WHEREAS, recent studies have indicated that municipalities in Florida realize
approximately 26 million dollars per year from the source of revenue, and that the
City of Clermont receives approximately $12,000.00 per year from the same source,
and
WHEREAS, the Florida Constitution and Florida Legislation has severly curtailed
discretionary local sources of revenue to municipal government, and
WHEREAS, occupational license revenue, in many instances, have been pledged
to repayment of bonds, and
WHEREAS, occupational licensing authority is essential for the regulation
of business activity in Florida cities as well as serving as a major source of
revenue;
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Clermont that:
THE FLORIDA LEGISLATURE enact legislation that will clearly authorize the levy
of occupational licenses by each municipality for regulation and revenue in a
discretionary manner based on any fair and equitable method of measurement,
BE IT THEREFORE RESOLVED that in the event occupational licensing authority
to the counties is continued, the revenue received by the counties be distributed
to municipalities based on proportion of population or sales tax collection.
BE IT FURTHER RESOLVED that copies of this resolution be sent to the Governor,
President of the Senate, Speaker of the House and the local legislative delegations.
PASSED AND RESOLVED at Clermont, Lake County, Florida this the 24th day of
April, A.D. 1973.
