RESOLUTION N0. 312
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLERMONT,
LAKE COUNTY, FLORIDA, ACKNOWLEDGING "208" MANAGEMENT
AGENCY RESPONSIBILITIES AND INTENT TO PROCEED WITH OTHER
GENERAL PURPOSE UNITS OF LOCAL GOVERNMENT IN THE ORLANDO
METROPOLITAN "208" PLANNING AREA IN THE IMPLEMENTATION
OF THE "208" PLANNING PROGRAM.
WHEREAS, pursuant to Section "208" of the Federal Pollution Control Act
•
Amendments of 1972, Public Law 92-500 (hereinafter called "the Act"), the Admin-
istrator of the United States Environmental Protection Agendy has by regulation
published guidelines for the preparation of 208 Planning Programs in those areas
which, as a result of urban-industrial concentrations or other factors, have sub-
stantial water quality control problems; (40 CFR Part 131); and
WHEREAS, the Orlando Metropolitan "208" Planning Area (hereinafter called "the
Planning Area") has been designated as an appropriate area for the preparation of
the "208" Plan and establishment of a "208" Continuing Planning Process; and
WHEREAS, certain federal guidelines require, among other things, that trhe affected
general purpose units of local government within the Planning Area indicate their
awareness, through formally adopted resolutions, of their responsibilities as manage-
ment agencies in the "208" water quality management planning process for the development
and implementation of activities which will result in an integrated water quality-
management program for the Planning Area; and
WHEREAS, the "208" Planning Program, to include the "208" Plan and Continuing
Planning Process, is intended to identify coordinated, cost-effective procedures for
preventing, abating, and solving existing and potential substantial water quality
control problems, determine appropriate measures to control present point and non-
point sources of water pollution, and to guide future development and growth in the
planning area which may effect water quality; and
WHEREAS, certain responsibilities have been identified in the "208" Plan for
application by each general purpose unit of local government; and
WHEREAS, the "208" Plan identifies numerous techniques to improve overall water
quailty, improved water quality condition will be greatly impeded since local funds
are generally not available for use in implementing "208" Programs compounded by the
lack of federally-aided programs; and
WHEREAS, these comments are made upon the December, 1977 draft of the "208" Plan
and are subject to change based upon modifications to subsequent drafts; and

WHEREAS, additional activities and responsibilities may be identified in the
"208" Continuing Planning Process.
NOW, THEREFORE, IT IS RESOLVED THAT, the City Council of the City of Clermont,
recognizing that certain responsibilities have been identified in The "208" Plan for
specific application, understands these responsibilities to be:
Stormwater Management
1. Accept designation as the Stormwater management agency within
the jurisdictional boundary of Clermont.
2. Support the general nonpoint source management recommendations
outlined in the General Nonpoint Source Management Recommenda-
tions Section.
3. Endorse and support the percolation/retention pond leachate
study to determine the capability of various soils to remove pol-
lutants from retention pond leachate prior to mixing with the
groundwater.
4. Endorse and support the detention system study to determine design,
efficiency and cost information for detention systems.
Wastewater Management
1. Support the recommendations outlined in the General Wastewater
Management Agency Recommendations Section.
2. Endorse and support the septic tank leachate sutdy to determine
the acceptability and capability of various soils to remove pol-
lutants from the leachate prior to mixing with the groundwater.
3. Continue to serve as the operator/manager of the Clermont
Wastewater Treatment Plant.
Water Quality Management Planning
1. Accept designation as the water quality management planning agency
within jurisdictional boundaries.
2. Support the recommendations made in the General Recommendations
Section relating to water quality management planning.
IT IS FURTHER RESOLVED THAT the City of Clermont, recognizing that designation as
a "208" management agency entails the performance of the above-mentioned responsibilities,
as well as any additional mutually agreed upon by adoption of a similar resolution,
responsibilities identified in future "208" Plan updates and/or revisions, understands
the above-mentioned responsibilities as identified in The "208" Plan and this Resolution.

IT IS FURTHER RESOLVED THAT the City of Clermont is indicating a willingness
to proceed with the implementation of the identified responsibilities, provided that
sufficient financial resources (to include requested state and/or federal financial
assistance) are available, and that the priorities for implementation be the sole
prerogative of the City according to local needs and financial capabilities.
