A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLERMONT, LAKE
COUNTY, FLORIDA GRANTING A CONDITIONAL USE PERMIT TO ALLOW
CONSTRUCTION OF A SHOPPING CENTER IN THE C-2 GENERAL COMMERCIAL
DISTRICT.
WHEREAS, the Planning and Zoning Commission of the City of
Clermont, Lake County, Florida at a meeting held June 6, 1989,
recommended approval of the Conditional Use Permit to allow
construction of a shopping center in the C-2 General Commercial
District.
PROPERTY: All of that portion of the following described land lying
west of the western right-of-way of State Road 25 (U.S.
Highway 27).
The east 578' of Tract 50, and the south 30' of the west
82' of Tract 50 and the north 30' of the west 82' of
tract 50 and tracts 50A and 63,' Lake Highland Company,
Section 19, Township 22 south, Range 26 east, as recorded
in Plat Book 2, Page 38, Public Records of Lake County,
Florida.
LOCATION: NW corner of intersection of US 27 and Highland Avenue.
ZONING:
C-2 General Commercial District
The City Council deems it advisable in the interest of the general
welfare of the City of Clermont, Lake County, Florida to grant the
Conditional Use Permit;
NOW THEREFORE BE IT RESOLVED by the City Council of the City
of Clermont, Lake County, Florida that:
SECTION 1.
The application for a Conditional Use Permit to allow con-
struction of a shopping center in the C-2 General Commercial
District granted subject to the following conditions:
CONDITIONS:
1. The property must be developed in substantial accordance with
an approved site plan.
2. No further expansion of the use or additions to this facility
shall be permitted except as approved by another Conditional
Use Permit.
3. All applicable rules and regulations shall be met, including
final site plan approval, landscaping, drainage, parking and
sign regulations, and all yard setbacks. All required
landscaping must be served with a permanent irrigation system
and must be properly maintained. The drainage and storm water
retention requirements of the appropriate regulatory agencies
must be met, and approved by the City Engineer. These area
must be properly maintained.
4. The property may be used for a shopping center with uses
normally associated with shopping centers and other Permitted
C-2 Uses.

5. The final certificate of Occupancy cannot be issued until
each of the stated conditions has been met.
6. This permit shall expire if construction has not begun within
one year of the date of this Conditional Use Permit.
7. Parking spaces may be reduced from the required 10' x 20' to
10' X 19' provided aisle width is maintained at a minimum of
24' ,
8. A six foot high wooden fence shall be constructed along the
western boundary from the northern right-of-way to Juniata
street to Highland Avenue. The fence shall be in compliance
with landscape requirements except the 5' setback requirement
may be reduced only at the south east corner of the adjoining
Odom property as presented to city Council. The loading area
along Highland shall be buffered with landscaping, however,
if the required buffering is not provided or maintained, the
City may require placement of the fence at a letter date. All
landscape areas shall be provided with permanent irrigation.
9. A sidewalk along the north side Highland Avenue will be
constructed as part of Phase I~ A sidewalk along the south
side of Desoto street will be constructed at the time DeSoto
Street is completed. Sidewalks will run the full length of the
property.
10. A complete phasing plan will be submitted to city staff as
part of the final site plan review process. Any deviations
from this plan will require an amendment to this Conditional
Use Permit.
11. All utilities will be constructed in accordance with an
approved site plan.
12. A deceleration lane and a acceleration lane will be
constructed on northbound US 27. Acceleration lane and a
deceleration lane will be constructed on southbound US 27 at
the project's main entrance. The existing left turn lane
southbound on US 27 at Highland Avenue will be reconstructed
into a acceleration lane northbound onto US 27.
13. The existing billboard on the site shall be removed before a
certificate of Occupancy will be issued.
14. The developer will be responsible for any Department of
Transportation (DOT) required improvements associated with the
project up until final approval of Phase II.
15. If any of the stated conditions are violated, the applicant
understands and agrees that the City Council may revoke this
Conditional Use Permit by resolution.
DONE AND RESOLVED BY THE CITY COUNCIL OF THE CITY OF CLERMONT,
LAKE COUNTY, FLORIDA THIS 13th, DAY OF JUNE 1989.
