No. 615
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLERMONT, LAKE
COUNTY, FLORIDA GRANTING A CONDITIONAL USE PERMIT TO ALLOW THE
EXPANSION OF A NON-CONFORMING USE IN THE C-l LIGHT COMMERCIAL
DISTRICT.
NOW THEREFORE BE IT RESOLVED by the City Council of the City
of Clermont, Lake County, Florida that:
The City Council deems it advisable in the interest of the general
welfare of the City of Clermont, Lake County, Florida to grant the
Conditional Use Permit:
PROPERTY LOCATION:
City Block 72, Lots 1, 2, and the east 1/2 of lots
18 and 19.
LOCATION:
661 West Highway 50
and
604 Chestnut Street
SECTION 1.
The application for a Conditional Use Permit to allow the
expansion of a non-conforming use in the C-l Light Commercial
District.
1. The property must be developed in substantial accordance with
an approved site plan.
2. If, at a future date, parking at this site proves inadequate,
the applicant understands and agrees that the City may require
additional parking or rescind this Conditional Use Permit.
3. No further expansion of the use or additions to this
facility shall be permitted except as approved by another
Conditional Use Permit.
4. All applicable rules and regulations shall be met, including
final site plan approval, landscaping, drainage, parking and
sign regulations, and all yard setbacks. All required
landscaping must be served with a permanent irrigation system
and must be properly maintained. The drainage and stormwater
retention requirements of the appropriate regulatory agencies
must be met, and approved by the City Engineer. These areas
must be properly maintained. Landscaping buffer shall not be
required adjacent to existing parking space in the southeast
corner.
5.
The property described as City Block 72 Lots 1 and 2, may be
used only as a service station. No other business operation
may be conducted from this facility. This Conditional Use
Permit is not transferable to any other business use, person
or corporation.

7. The property described as the east 1/2 of lots 18 and 19 may
be used only as either a residence or as two (2) professional
offices. This building may· not be enlarged or expanded to
occupy a greater floor area unless an amendment to this
Conditional Use Permit may be applied for and granted.
8. Temporary grass parking shall be allowed to meet requirements
for use on lots 18 and 19. All landscaping requirements shall
be met regarding parking on lots 18 and 19.
9. In lieu of a permanent Certificate of Occupancy, a temporary
certificate of Occupancy shall be issued for a period of one
(1) year for any office use occupying the structure on lots
18 and 19. Prior to the expiration of the one-year period,
the applicant shall construct the parking area to city
specification, that is, either asphalt paving or concrete.
At that time, a permanent certificate of Occupancy may be
applied for and granted.
10. No vehicle storage of any kind nor automotive repairs, will
be allowed on lots 18 and 19, other than employee parking,
which may be grass for a temporary basis as described in
Condition No.9.
11. Prior to the issuance of the certificate of Occupancy for the
expansion, the entrance to the employee parking area shall be
constructed to the City's specifications to the property line.
12. Dumpster to be located on private property.
13. If any of the stated conditions are violated, the applicant
understands and agrees that the city Council may revoke this
Condi tional Use Permit by resolution and or be subj ect to
action by the Code Enforcement Board.
