A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLERMONT,
LAKE COUNTY, FLORIDA GRANTING A CONDITIONAL USE PERMIT TO
ALLOW EXPANSION OF EXISTING AGRICULTURAL SERVICES OPERATION
IN THE C-2 GENERAL COMMERCIAL BUSINESS DISTRICT.
WHEREAS, the Planning and Zoning Commission of the City of
Clermont, Lake County, Florida at a meeting held July 5, 1988,
recommended approval of the Conditional Use Permit to allow
the expansion of an existing agricultural services operation in
the C-2 General Commercial Business District.

grant the Conditional Use Permit;

NOW THEREFORE BE IT RESOLVED by the City Council of the City
of Clermont, Lake County, Florida that:
SECTION ~
The application for a Conditional Use Permit to allow the
expansion of existing facilities to include a refridgerated
warehouse, office and paved parking/loading area in the C-2
General Commercial Business District in the C-2 General
Commercial Business District be granted subject to the following
conditions:
1. The property must be developed in substantial accordance
with an approved site plan.
2. If, at a future date, parking at this site proves inade-
quate, the applicant understands and agrees that the City
may require additional parking or rescind this Conditional
Use Permit.

No further expansion of the use or additions
facility shall be permitted except as approved by
Conditional Use Permit.

4. All applicable rules and regulations shall be met, including
final site plan approval, landscaping, drainage, parking and
sign regulations, and all yard setbacks. All required
landscaping must be served with a_permanent irrigation
system and must be properly maintained. The drainage and
stormwater retention requirements of the appropriate
regulatory agencies must be met, and approved by the City
Engineer. These areas must be properly maintained.
5. This property may be used only as an agricultural services,
retail and wholesale operation with professional offices. No
other business operation may be conducted from this
facility. This Conditional Use Permit is not transferable to
any other business use, person or corporation.

6. The final Certificate of Occupancy cannot be issued until
each of the stated conditions has been met.
7. This permit shall expire if construction has not begun
within one year of the date of this Conditional Use Permit.
8. If any of the stated conditions are violated, the applicant
understands and agrees that the City Council may revoke this
Conditional Use Permit by resolution.
9. Construction of exceleration and deceleration lanes shall be
completed within eighteen (18) months subject to the
Florida Department of Transportation (FDOT) requirements.
Should FDOT not require excel-decel lanes at this time, the
owner agrees to install lanes at a future date as required
by the City subjet of FDOT requirements.
10. No paving or grade change of any kind will take place closer
to trees than what is designated on the site plan. Posts
shall be used as protective barriers to the roots and trunks
of every tree to be saved. Absolutely no equipment of any
kind will be stored within the protected area and any
landscaping activity within this area shall be by hand labor
only.

12. Applicant will tie into City sewer when available and septic
tank use will be discontinued. Impact fees will be assessed
at that time.
13. Refrigerated warehouse will operate as a "dry operation"
only.
14. The reconstruction of access points shall include one sixty
(60) foot access point and one forty (40) foot access point.
15. Road improvements will be based on final FDOT approval.
16. The location of the refrigeration units on the proposed
site plan is acceptable in a effort of preserve the 28" tree
south of the proposed building. Should removal of the tree
be required for other construction reasons, the
refrigeration units should then be setback a minimum of
twelve (12) feet from the property line.
