RESOLUTION NO.2020-19R
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CLERMONT, FLORIDA, EXTENDING THE TEMPORARY
MORATORIUM RELATED TO MULTI -FAMILY DEVELOPMENT
ADOPTED BY ORDINANCE 2019-39 FOR A PERIOD OF NINETY (90)
DAYS; FINDING THAT THE EXTENSION OF THE MORATORIUM IS
NECESSARY TO ACCOMPLISH THE PURPOSES AND FINDINGS SET
FORTH IN ORDINANCE 2019-39; AND PROVIDING FOR
SEVERABILITY, CONFLICTS AND AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Clermont adopted Ordinance 2019-39 on
September 10, 2019 establishing a temporary moratorium related to multi -family development
within the incorporated limits of the City of Clermont;
WHEREAS, Section 3 (b) of Ordinance 2019-39 authorized the City Council to extend
the temporary moratorium for a period of ninety (90) days;
WHEREAS, the City Council finds that problems giving rise to the need for the temporary
moratorium established by Ordinance 2019-39 continue to exist and that reasonable progress is
being made in carrying out a specific and prompt plan of corrective legislative action, but that
additional time is reasonably needed to adequately address the issues facing the City; and
WHEREAS, the extension of the temporary moratorium established by Ordinance 2019-
39 is in the best interests of the public health, safety and welfare.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF CLERMONT, FLORIDA, as follows:
SECTION 1. Purpose and Le>slative Findings
The above recitals and such Legislative Findings adopted as the legislative basis for
Ordinance 2019-39 are hereby adopted as the findings supporting this Resolution.
SECTION 2. Temporary Moratorium Extended
The temporary moratorium adopted by Ordinance 2019-39 is hereby extended to and
including July 10, 2020. All conditions and terms of the moratorium adopted by Ordinance 2019-
39 shall remain in full force and effect until July 10, 2020, unless terminated earlier by Resolution
of the City Council.
SECTION 3. Severability
It is declared to be the intent of the City Council that, if any section, subsection, sentence,
clause, phrase, or portion of this Resolution is for any reason held invalid or unconstitutional by a
court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent
provision, and such holding shall not affect the validity of the remaining portions thereof.

SECTION 4. Conflict
All codes and ordinances of the City in conflict herewith are hereby repealed to the extent
of the conflict.
SECTION 5. Effective Date
This Resolution shall take effect immediately upon its adoption.
