COUNTY, FLORIDA, ADOPTING PERMANENT RELOCATION
GUIDELINES FOR TIlE COMMUNITY DEVELOPMENT BLOCK
GRANT PROGRAM

OBJECT OF PROGRAM:
A.
To provide housing replacement payments to low and
very low income homeowners to replace their
dilapidated residence with units that meet minimum
property standards and standards set forth in the
Standard Building Code currently adopted by the City
of Clermont.
B.
To improve the condition of the housing stock while
maintaining housing costs at levels affordable by
low & very low income households.
C.
To reverse the physical deterioration of the
City of Clermont by eliminating dilapidated housing
stock.
ELIGIBILITY:
A.
Properties must be within the incorporated areas of
the City of Clermont, Florida. The properties
qualifying must be recommended by the CATF and
approved by the Clermont City Council.
B.
Homeowners must fall within the income guidelines as
outlined in Appendix #1 attached herein or as
updated by the Federal Department of Housing and
Urban Development (HUD) and the Florida Department
of Community Affairs (DCA) periodically.
C.
Only owner-occupied dilapidated properties in the
incorporated areas of the City of Clermont are
eligible. Units of rental property will not be
eligible under this activity. Units must have been
occupied by the current owner at the time of
submission of the original application or the most
recent amendment which included changes to the
Permanent Relocation category being submitted to the
Department of Community Affairs in order to qualify
under this activity.
Priority will be given to property owners in the
following order:

E.
To select participants in the permanent relocation
activity, steps IV-E-l through IV-E-3 and IV-G of
the City of Clermont Rehabilitation Guidelines shall
be followed. Those units falling into the
replacement category either because the estimated
cost of rehabilitation or existing structural
conditions shall be considered for this activity.
Preliminary application shall be taken on each
potential participant. The C.A.T.F. shall rank the
potential applicants and the City Council shall then
select the applicants based upon the criteria
established in section IV-E & G of the
Rehabilitation Guidelines.
A.
3. ELIGIBILITY CRITERIA:

For a unit to be eligible, one of the following
criteria must be met:
1.
Cost of rehabilitation of the housing unit must
exceed eighty percent (80%) of the cost of new
construction. Current costs for new construction
based on Standard Building Code Congress is over
$38.00 per square foot for a single-family
residence.
2.
Less than seventy-five percent (75%) of the
exterior structural envelope is salvageable.
4. OPTIONS OF OWNER:
A. Once an owner has been deemed eligible for the
Permanent Relocation program, He/She shall have the
following options:

To locate to an existing standard property which is
adequately sized for the family and utilize the
permanent relocation payment toward the purchase of
same.
2.
If the permanent relocation payment is not
sufficient toward the purchase of the desired
property, the owner may utilize other means of
financing to add to funds provided by the City of
Clermont Community Development Grant to provide the
balance of the purchase.
3.
Permanent Relocation Funds may be utilized to
correct code deficiencies in the property being
purchased in order to bring the property up to
current code standards.

4.
All code violations must either be corrected or
contracted for correction prior to any funds being
disbursed.
5.
All units must be certified as meeting minimum
property standards prior to occupancy.
B. The owner may elect to have a conventional home placed
on the property where the house is currently located.

1.
New housing must be constructed meeting all of
the City of Clermont's zoning and building code
requirements.
2.
If the owner selects this option, the procedure will
begin as follows:
The City of Clermont Community Development
Consultant will place legal notice in a local
newspaper to solicit interested contractors to
participate in the program. (Contractors must be
either State certified or meet all local building
department requirements to be eligible to obtain a
building permit.)
Each interested contractor will present the owner
with a set of plans and specifications that he or
she (the contractor) is willing to provide for the
amount of the relocation payment plus any
additional funds the owner may provide.
The owner will select a contractor to build His/Her
home based upon plans, specifications, and options
available.
The contractor will fill out a detailed set of
Description of materials forms and submits plans
prior to a Pre-Construction Conference being held.
A Pre-Construction Conference will be held between
the owner, the contractor, the City of Clermont
and the City of Clermont Community Development
Consultant to review the project in detail.
The following contracts will be executed
simultaneously:
Agreement between the City of Clermont and the
property owner to provide a relocation payment in
exchange for removal of the existing dilapidated
property.

Agreement between the owner and the contractor to'
provide for the construction of a new dwelling for
the amounts of the approved relocation payment plus
any additional amount (if any) to be provided by the
owner. (Any additional funds must be guaranteed in
a manner which is acceptable to the City of
Clermont) .
The owner authorizes the City of Clermont to act as
His/Her agent to escrow funds for the construction
of His/Her residence in a separate account in the
name of the owner, the contractor, and a
representative of the community. It shall take two
(2) signatures to receive funds.
Agreement between the property owner and the City 0
Clermont stating that the owner will live in and
agree not to sell the property for three (3) years.

C.
The owner may purchase property at another location
and contract to have home placed there.
5. SIZE OF UNITS
A.
Size of units shall be based upon the following
criteria concerning the current permanent residents of
the existing dwelling:
No more than two (2) persons of the same sex may
occupy the same bedroom.
Two (2) persons of the opposite sex may not
occupy the same bedroom (excluding husband and
wife) .
Only the husband, wife, dependent children
(including those who are mentally and/or
physically handicapped), and family members 62
years of age or older and currently residing in
the household will be counted in calculating
family size and the minimum number of bedrooms
and square footage allowance.
6. SQUARE FOOTAGE AND RELOCATION PAYMENT ALLOWANCE:

7. TYPE OF FINANCING:
All funds will be allocated as a relocation payment (lump
sum). In order to assure that the homeowner does not
immediately vacate the property or sell the new
replacement housing unit, the homeowner will be required
to execute an agreement with the City of Clermont stating
He/She will occupy the replacement unit for a minimum of
three (3) years.

8. APPROVAL:
The Citizens Advisory Task Force (CATF) will review and
recommend to the Clermont City Council all applications
for relocation payments, which will include the following
information:

1.
The Community Development Consultant's outreach
worker makes the initial contact with the homeowner,
explains the program, and leaves "General
Information to Homeowners" forms.
2.
The Outreach worker takes the application on the
owner and the family.
3.
The Outreach worker verifies all information,
including the following:

The property is inspected by the Community
Development Consultant's estimator and determined to
be beyond rehabilitation.
The owner indicates that He/She wish to participate
in the demolition/relocation program.
The relocation project is approved by the CATF and
recommended to the City Council.
The relocation payment and client are authorized by
the City Council.
The owner makes a decision whether to relocate or
build on the property currently occupied by
his/her existing dwelling unit.
The City of Clermont Community Development
Consultant advertises for contractors interested in
participating in the New Construction program.
The City of Clermont Community Development
Consultant advertises for contractors interested
participating in the demolition of the existing
units.
The owner meets with each interested contractor and
signs the forms selecting His/Her choice of
contractor.
The contractor prepares detailed plans and
"Description of materials" form and submits these to
the City of Clermont Community Development
Consultant.

13.
A meeting between the owner, the contractor, the
City of Clermont Planning Department, and the
City of Clermont Community Development Consultant is
held.
14.
Contracts between the City of Clermont, the owner,
and the contractor are executed (the owner
authorizes the City of Clermont to act as His/Her
agent to set up and manage their escrow account).
15.
The homeowner is relocated, if required.
16.
The contract for demolition of the structure is
awarded.
17.
The demolition takes place.
18.
The Notice to Proceed for new construction is issued
to the contractor.
The new dwelling is constructed.
The owner signs an acceptance of the new structure.
The owner occupies the new structure.
. NOTE: The Community Development inspector and the City of
Clermont's building inspector shall make regular
inspections on the work as it progresses.
