HomeMy WebLinkAboutR-75-248 • • RESOLUTIONS N °_ 3 7 7 RESOLUTION NO. 248 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA, ASSURING THE FEDERAL INSURANCE ADMINISTRATION TIiAT THE CITY OF CLERMONT WILL ENACT AND MAINTAIN AD- EQUATE LAND USE AND CONTROL MEASURES: AUTHOR- IZING AND APPOINTING THE CITY MANAGER OF THE CITY OF CLERMONT FOR ADMINISTERING THE FEDERAL FLOOD INSURANCE PROGRAM WITHIN THE CITY OF CLER- MONT. WHEREAS, certain areas of the City of Clermont are subject to periodic flood from RIVERS and LAKES, causing serious damages to properties within these areas; and WHEREAS, relief is available in the form of Federally sub- sidized flood insurance as authorized by the National Flood Insurance Act of 1968; and WHEREAS, it is the intent of the City Council of the City of Clermont to require the recognition and evaluation of flood hazards in all official actions relating to land use in the flood plain areas having special flood hazards; and WHEREAS, this body has the legal authority to adopt land use and control measures to reduce future flood losses pursuant to Chapter 166, Florida Statutes, and Chapter 67-1217, Laws of Florida, Special Acts of 1967; NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Clermont, Lake County, Florida hereby: 1. Assures the Federal Insurance Administration that it will enact as necessary, and maintain-in-force for those-areas ha~r~ng flood or mudslide hazards, adequate land use and control measures with effective enforcement provisions consistent with the Criteria set forth in Section 1910 of the National Flood Insurance Program Regulations; and 2. Vests the city manager of the City of Clermont with the responsibility, authority, and means to: • R E S O L U T I O N No. 378 (a) Delineate or assist the Administrator, at his request, in delineating the limits of the areas having special flood hazards on available local maps of sufficient scale to identify the location of build- ing sites. (b) Provide such information as the Administrator may request concerning present uses and occupancy of the flood plain area. (c) Cooperate with Federal, State, and local agencies and private firms which undertake to study, survey, map and identify flood plain or mudslide areas, and cooperate with neighboring communities with respect to management of adjoining flood plain and/or mudslide areas in order to prevent aggravation of existing hazards. (d) Submit on the anniversary date of the community's initial eligibility an annual report to the Administrator on the progress made during the past year within the community in the development and implementation of flood plain management measures. 3. Appoints City Manager to maintain for public inspection and to furnish upon request a record of elevations (in relation to mean sea. level) of the lowest floor (including basement) of all new or sub- stantially improved structures located in the special flood hazard areas. If the lowest floor is below grade on one or more sides, the elevation of '' the floor immediately above must also be recorded. 4. Agrees to take such other official action as may be reasonably necessary to carry out the objectives of the program. Under the expanded program, broader coverage can be obta.ned for all buildings and their contents. The limit of insurance for single-family homes is now $35,000, and $100,000 for other residential and nonresidential buildings, at the subsidized rate of 25 cents per X100 of coverage. The rate goes to ~+0 cents per/°x'100 for non- residential buildings. The contents of all residential buildings can be insured up to $10,000 per unit at 35 cents per X100 of coverage, and the rate goes to 75 cents per $100 for the contents of all nonresidential structures up to a maximum of X100,000 in coverage per unit. Policies are effective irrunediatel.y during the first 30 days the insurance becomes available, After the first 30 days, there is a 15-day waiting period. The policies can be purchased from. any licensed local property insurance agent or broker. The Travelers Indemity Co. 1516 least, Colonial Drive Orlando, I~'l. 32803 has been designated as the flood insurance servicing company for this area. Agents and broker:, may obtain policy forms, .rates, flood insurance mamzals and any other necessary information from this company. The program is designed to stimulate individual participr;.tion in it as protection against natural disasters, and to lrel.p promote sound flood plain management on the part of local governing au!;horities.
