Regular meeting of Clermont Council adjourned from June 3rd 1920 until June 18th 1920 called to order by Pres Goodenough. Roll call, all members present. Moved by Mr Johnson that rules be suspended and ordinance be prepared by Atty Hunter be passed to second reading. Carried. Moved by Mr Sharp that Sec 3 be amended to read $100.00 and $500.00 bonds and change dates in said section from Jan 1st 1921 to Sept 30th 1920 and instruct to be paid semi annually on the 1st day of Sept and the 1st day of March of each year. Clermont, Fla, June 18, 1920 Ordinance 33 The following Ordinance was introduced by Councilman Wilson and passed by the Council. An Ordinance providing for the calling and holding an election in the Town of Clermont, Lake Co, Fla authorizing the issuance of Bonds of said town for the purpose of constructing and maintaining or purchasing water works and for the purpose of erecting or purchasing a Town Hall for use of said municipality creating a department of Bond Trustees and providing for their election. Be it ordained by the Town Council of the Town of Clermont, Lake Co, Florida. Sec 1, That it is deemed advisable to issue bonds for the purpose of raising money to be used in constructing, maintaining or purchasing water works and for the purpose of erecting or purchasing a Town Hall for the use of the municipality of Clermont, Fla. Sec 2. That the proper officers of the Town of Clermont, Lake Co, Fla when so authorized as herein after provided shall issue in the name and under the seal of said town $30,000.00 of negotiable coupon Bonds of said town for the purpose of constructing, maintaining or purchasing water work s for said Town and $5,000.00 for the purpose of erecting or purchasing a Town Hall for the use of said Town of Clermont, Florida. Sec 3. The Bonds to be issued shall be in the denomination of $500.00 said bonds as may be issued shall herein after provided shall be dated as of the first day of Sept AD 1920 and shall bear interest at the rate of %6 per annum payable semi annually on the first day of Sept and the first day of March of each year and shall become due and payable 30 years after date of said bonds. Said bonds shall be signed by the Mayor countersigned by the Pres of the Council and attested by the Town Clerk and the seal of said town shall be placed thereon. The principal of said bonds and the interest shall be payable in gold coin of the United States of America of Standard weight and fineness or at the American Exchange National Bamk of New York, New York as the holder there of may exist, and for the payment of the principal and interest of said Bonds there shall be levied and collected annually a special tax on all taxable property in said town sufficient to pay said interest as it falls due and to create a sinking fund for the fragment of the principal of said bonds a maturity. Sec 4. There shall be a board of Bond Trustees composed of three qualified electors of said town who are free holders therein to be elected at the election to be held for the approval of the Bonds under the terms of this Ordinance. Said trustees shall be elected for a term of 30 years. They shall be allowed reasonable clerical help at reasonable compensation for such help and shall give bond payable to the Town of Clermont, Lake Co, Fla in a sum determined by the Town Council of Clermont Florida. Condition for faithful performance of such duties and fulfill and time accounting to said Town for all money and property of said Town that may come into their hands by service of such duties as such trustees. It shall be the duty of such trustees as soon as the bonds herein authorized shall be executed by said Town to offer the same or any part thereof as directed by the Town Council for sale by publication of notice stating the amount of bonds for sale, the rate of interest, when and where the interest and principal shall become due and payable in a newspaper published in Clermont, Florida for a period of 30 days prior to the sale and also for a like time in two other newspapers in cities known to be money centers. The trustees may receive the bids for the purchase of said bonds or any part thereof that may be offered for sale from time to time on or before the expiration of 30 days from the first appearance of said advertisement published as above specified. The trustees shall have the right and in all advertisements for bids for bonds shall reserve the same. To reject any or all bids and to advertise the bonds or any portion remaining unsold and the acceptance or rejection of any bids by said Trustees shall not become effective until ratified and approved by the Town Council. Said Trustees shall serve without compensation and vacancies in said board of Bond Trustees shall be filled by the Town Council by a majority of the votes of said Council. Said trustees may be removed for cause by the Town Council with the approval of the Mayor. Sec 5. The proceeds arising from sale of said bonds shall be applied to the proposed purposes herein proposed and for which the issuance of Bonds may be authorized at said election and should the use of any such bonds that may be authorized for the above mentioned Be subsequently declared by ordinance to be unnecessary then the surpluses of the Bonds not be disposed of in the hands of the trustees shall be by them surrendered to the Town Council of the Town of Clermont, Florida and by said Town Council shall be destroyed. All proceeds arising from the sale of said bonds shall be deposited in a bank to be designated by the Council. Sec 6. An election shall be and the same is hereby called to be held at the Council Chamber in said town on the 3rd day of August, AD 1920 for the approval of the issuance of bands mentioned in Sec 2 of this Ordinance. Said election shall be conducted as other town elections are conducted as for as practical, except that only such electors who in addition to such qualifications prerequisite to voting in Town elections are free holders in said town shall be allowed to vote at such election. The Mayor of the Town of Clermont, Florida shall appoint three inspectors and one clerk and Inspectors shall canvass the ballot and make (********) of same to the Town Council who shall not later than the sixth day after said election canvass the returns and declare the result of said election. The Registration Officer of said town shall open the registration books 30 days before said election for the purpose of registering the qualified electors in said town and keep said books open for registration of votes until and including the day proceeding said election. He shall give notice that said books are open by publication in a newspaper published in Clermont, Florida or by posting in three conspicuous places in said town. Sec 7. The form of ballot to (**********) shall be substantially as follows. Town of Clermont, Lake Co, Florida A special election to be held for the purpose of approving the issuance of negotiable coupon bonds of the town of Clermont , Lake Co, Florida for the purpose of maintaining or purchasing water works for said town for the purpose of erecting or purchasing a town hall for use of said town of Clermont, Lake Co, Florida and for the election of a Board of Bond Trustees to consist of three members. Each voter shall express his choice for or against said bonds. For said purposes and for three members of said Board of Bond Trustees by making a cross (x) mark for the affirmative or negative of the question before and to the left of same and for each Bond Trustee by making a cross (x) mark before and to the left of the name of each Bond Trustee. In favor of the issuance of $30,000.00 of negotiable coupon bonds for the purpose of constructing, maintaining or purchasing water works for Clermont, Lake Co, Florida. Against the issuance of $30,000.00 negotiable coupon bonds for the purpose of constructing or maintaining of purchasing water works for the Town of Clermont, Lake Co, Florida. In favor of the issuance of $5,000.00 of negotiable coupon bonds of the Town of Clermont, Florida for the purpose of erecting or purchasing a Town Hall for said town. Against the issuance of $5,000.00 of negotiable coupon bonds of Clermont, Lake Co, Florida for the purpose of erecting or purchasing a Town Hall for the use of said town. For members of the Board of Bond Trustees vote for three making a cross (x) before the name of each person of your choice. For names of candidates and three additional blank lines. Sec 8. The Town Clerk is here by authorized and directed to open the Town registration book for the registration of Electors as provided for in other elections. It shall be the duty of the Town Clerk to secure from the Clerk of the Circuit Court or from the Tax Collector for Lake Co, Florida. A certificate as to all registered voters in the Town of Clermont, Florida who have paid their poll tax and who are free holders within said town on the on the day previous to the date of the election to be used by the inspectors of said election for determining whether or not an elector is qualified to vote at such an election, but such certificate shall not be conclusive evidence as to qualifications. Sec 9. This ordinance shall be published in the Clermont Clarion a newspaper published in the Town of Clermont, Lake Co, Florida for not less than 30 days prior to the date set for holding the election specified in the ordinance and shall be posted for a like period of time in three of the most public places in said town. Sec 10. Of the issuance of bonds for one of the purposes mentioned in this ordinance should become defeated at such election, such action shall not in any manner effect the issuance for a purchase which may be authorized at said election. Sec 11. If the issuance of Bonds is authorized for one or more of the purposes authorized in this ordinance at said election said Town Council is here by authorized and directed to pass such further and other ordinances not in conflict with this ordinance as may be deemed necessary to carry the results of said election into effect. To provide for the issuance, negotiation and sale of such bonds as may be authorized and the application of the proceeds of such part as maybe needed to accomplish the purpose intended. The form of the bonds and matters of detail not inconsistent with the provision of this ordinance shall be such as may be set forth in any subsequent Ordinance which said council shall deem necessary or expedient in carrying the results of said election into effect. Sec 12. This ordinance shall become effective upon its passage by the Town Council and the approval by the Mayor of said Town.
