O-185-M-As • ORDINANCE N0. 185-M A AN ORDINANCE UNDER THE CODE OF ORDINANCES OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA; ADOPTING REGULATIONS FOR THE REMOVAL OF SHOPPING CARTS FROM PUBLIC PROPERTY; PROVIDING FOR STORAGE AND ABANDONMENT; PROVIDING FOR PAYMENT OF COSTS; PROVIDING FOR SEVERABILITY AND PROVIDING AN EFFECTIVE RATE. -- r 2 _p .1~,:~ r t t WHEREAS, the City Council of the City of Clermont has become aware of 8 (~ - g'7'~ an increase in shopping carts abandoned on public rights-of-ways and public property; and WHEREAS, abandoned shopping carts constitute a public nuisance and a threat to the health and safety of the community; and WHEREAS, it is within the governmental interests to alleviate such nuisance and protect the public health and safety. NOW THEREFORE, the City Council of the City of Clermont, Lake County, Florida, hereby ordains that: CF('TTf1TT l No shopping carts shall be left unattended or abandoned on public rights-of-ways or upon public property of the City of Clermont. CF!'TT(1TT 7 Any such shopping cart left unattended or abandoned on public rights-of-ways or upon public property may be removed by the City of Clermont and stored for a period of thirty (30) days. SECTION 3. The rightful owner of the shopping cart may redeem the shopping cart by payment of storage and administrative costs of $25.00 for each shopping cart. CF!'TTfll\T /~ In the event the shopping cart is not redeemed within thirty (30) days, it shall be presumed to be abandoned and shall be disposed of by the City, either at public auction to reimburse the City for the costs, or by disposal, at the City's discretion. CR('TT(1N S All ordinances or parts of this Ordinance in conflict herewith are hereby repealed. c>:rTTnT.T ti Should any section or part of this section be declared invalid by any Court of competent jurisdiction, such adjudications shall not apply or affect any other provision of this Ordinance, except to the extent that the entire LEONARD H. SECTION 7. This Ordinance shall be published as provided by law and it shall become law and shall take effect on the date of its Second Reading and Final Passage. First Reading this day of 1987.
