MINUTES 
REGULAR MEETTNG 
June 24, 1980 
A Regular Mocting of the City Council of the City of Clermont was held in 
the City Council Chambers on Tuesday, June 24, 1980. The meeting was called 
to order by Mayor Claude E. Smoak, Jr. at 7:30 p.m. with the following 
Councilmen in attendance: Carlisle Byrd, Lester Cole and Dennis Thomas. 
Other. City Officials present were: City Manager Forbes, City Attorney Baird, 
Finance Director Saunders, Building Inspector - Harvey Nagel and City Clerk Razor. 
The Invocation was offered by Councilman Byrd, followed by repeating of the 
pledge of allegiance by all present. 
The Minutes of the Special Meeting of June 9, 1980 to prepare the Ballot Box 
for the Special Election were approved as written. 
The Minutes of: the combined Regular City Council Meeting and Town Hall Meeting 
were approved as written. 
RUN-OFF ELECTION 
The results of the Special Election were announced and upon validation, 
80-946 a MOTION 14AS MADE BY COUNCILMAN BYRD,.SECONDED BY COUNCILMAN THOMAS'AND 
---. UNANIMOUSLY CARRIED THAT THE CERTIFICATE OF RESULT OF THE SPECIAL RUN-OFF 
ELECTION HELD JUNE 24, BE ACCEPTED. 
The results of the election were as follows:

Newly elected Councilman Pool was then administered the Oath of Office 
by City Clerk Rozar. 
UPPER PALATLAKAHA RIVER BASIN STUDY: Will Davis 
Will Davis, Project Director for this study gave a status report, stating 
this was the first year of a three year study. Mr. Davis stated this 
study was spearheaded by Mayor Smoak and the City of Clermont, involving 
the combined efforts of eleven different agencies. The objective of the 
study is a determination of the most effective methods for accomplishing 
the land and water management needs in the watershed. Mr. Davis summarized 
the problems concerning these waters, and the action being taken to 
recommend a plan that• assures adequate supplies of surface and potable 
water within the study area. 
COUNTY ROAD/BRIDGE TAX 
City Manager Forbes related the desires of the Lake County City Management 
Association to alleviate the tax assessed by the County and allow each 
City to assess the .82 mill levy, doubling the City's revenues without 
increasing the overall mill levy for County Road/Bridge Taxes. A MOTION 
WAS MADE BY COUNCILMAN BYRD AND SECONDED BY COUNCILMAN COLE REQUESTING

RESOLUTION NO 354: Requesting improvements to Highway 50 
Mayor Smoak stated lie had been to Tallahassee and spoke with persons 
in the Department of Transportation and recommended the City send a 
resolution to the Department stating our request for improvement on 
80-98b State Highway 50 from Twelfth Street to Groveland. A MOTION WAS MADE 
BY COUNCILMAN T112MAS SECONDED BY COUNCILMAN BYRD AND UNANIMOUSLY 
CARRIED THAT RESOLUTION NO 354 BE ADOPTED. 
MAYORAL PROCLAMATION 
Mayor Smoak read his Mayoral Proclamation, proclaiming June 20th. _.... 
through July 5th as Epsilom Sigma Alpha Week. 
UPPER PALATLAKA11A STUDY 
Mayor Smoak commented on the importance of the Study and it was the 
consensus of the Council that $8,000 be appropriated in this year's 
budget, (the same as this past year) for the Study. 
ORDINANCE NO. 206-C: Transition Zones 
City Manager Forbes explained the Ordinance as amended by the City 
Council. There was much discussion regarding the Bell Ceramics 
80-99 property and A MOTION WAS MADE BY COUNCILMAN BYRD, SECONDED BY 
COUNCILMAN THOMAS AND UNANIMOUSLY CARRIED THAT ORDINANCE NO. 206-C 
BE ADOPTED. 
ORDINANCE NO. 210-C: Nonconforming Uses 
Ordinance No. 210-C was discussed w.,ich would allow nonconforming 
uses to be expanded or rebuilt upon City Council approval if a 
80-100 hardship exists. COUNCILMAN BYRD INTRODUCED THIS ORDINANCE FOR 
FIRST READING AND WAS READ BY TITLE ONLY. A MOTION WAS MADE BY 
MAYOR SMOAK SECONDED BY COUNCILMAN THOMAS AND UNANIMOUSLY CARRI 
TO AMEND ADOPTION• TO BE IN EFFECT AT THE TIME OF FINAL READING RED 
ATHER 
THAN 30 DAYS AFTER. 
ORDINANCE NO. 207-C: Sign Ordinance 
City Manager Forbes explained this Ordinance establishes the City 
Sign Regulations as a separate code from the Zoning Ordinance. A 
80-101 MOTION WAS MADE BY. COUNCILMAN BYRD SECONDED BY COUNCILMAN THOMAS 
AND UNANIMOUSLY CARRIED THAT ORDINANCE N0. 207-C BE ADOPTED. The

FUNDING. 
Councilman Thomas made a motion to amend this motion by striking number 
(1) and the portion of number (2) stating that no other site be con- 
sidered at this meeting; the motion died for lack of a second. Council- 
man Pool then commented more than one site should possibly be considered 
at this meeting and made a motion that more than one site be considered, 
seconded by Councilman Thomas. Councilman Byrd voting nay, Councilman 
Cole voting nay, Councilman Pool voting yea, Councilman Thomas Voting 
yea and Mayor Smoak voting nay and the motion failed. VOTE WAS TAKEN ON 
THE ORIGINAL MOTION AND CARRIED WITH COUNCILMAN BYRD VOTING YEA COUNCIL- 
MAN COLE VOTING YEA, COUNCILMAN POOL VOTING NAY AND COUNCILMAN THOMAS 
VOTING NAY, MAYOR SMOAK VOTING YEA. 
Mayor Smoak explained his stand on the wetlands alternatibe and re- 
quested his memo dated June 24, 1980 be attached and made a part of the 
Minutes. A MOTION WAS MADE BY COUNCILMAN BYRD, SECONDED BY COUNCILMAN 
COLE AND UNANIMOUSLY CARRIED THAT THE CITY MANAGER BE AUTHORIZED TO 
DISCUSS THE POSSIBILITY OF FURTHER STUDY BY THE UNIVERSITY OF FLORIDA 
IN CLERMONT. It was clarified that the research is not to be linked 
to the City's effluent disposal plans and before any experimentation, 
there would have to be Council authorization. 
ORDINANCE NO. 129-M: CLOSING OF UNNAMED STREET ADJACENT TO LAKE DOT 
City Manager Forbes explained the request from Richard Reynolds to 
close a portion of street right of way around Lake Dot. He stated 
the request is being made since Mr. Reynolds wishes to develop this 
property and believes that the right of way should be eliminated to 
allow for the full potential use of this property. Dennis Thomas 
stated the record should show Mr. Bob Thompson, his partner is the 
selling agent to Mr. Reynolds. Councilman Byrd introduced this Ordinance 
for First Reading. The Ordinance was read by Title Only. 
ORDINANCE NO. 131-M: CLOSING OF BROOME STREET 
City Manager Forbes explained the request for the closing of this street 
for the construction of twenty four apartment units; coinciding with 
the closing of the unnamed street mentioned above. Councilman Byrd in- 
troduced this Ordinance for First Reading. The Ordinance was read by

ORDINANCE NO.209-C: Amendment to Subdivision Ordinance 
City Manager Forbes stated this Ordinance would amend the City's 
Subdivision Ordinance to allow roadside nwai.es upon approval of the 
City Council providing soil conditions and topography, etc. warranted 
their une. Councilman Thomas introduced this Ordinance for First Reading. 
The Ordinance was rend by 'title Only. 
Councilman Byrd discussed his position on the MarshInnd Alternative and 
stated his concern on the action Councilman Thomas had taken on this matter. 
The meeting adjourned at 9:45 p.m.

SPECIAL MEETING. A Special Meeting or the City Council will he 
held at 5 p.m. next Monday, .June 23rd in the City Mannge.r'n office to pre- 
pare Lila ballot box for Tuesdays election. 
Tuesdays Council Meeting will be held in the regular City Council Chambers. 
UPPER PALATLAKAHA RIVER BASIN STUDY. Will Davis, the Project 
Director will be attending Tuesdays Council Meeting to give a status report 
on this study. As you may recall, this is the first yenr of a three year study, 
and a copy of the Project Synopsis is enclosed. 
BUDGET AMENDMENT. Enclosed is a memo from the Finance Director 
regarding an amendment to this years budget that is necessary for the City 
to comply with the new Governmental Accounting Practice Standards. 
As you may recall, the City used funds from both the last and present fiscal- - - 
year to construct our street repair program. The expenditure was encumbered 
last year to be paid this year; however, ti:e new accounting standards require 
encumbrances to be budgeted in the current fiscal year. Therefore, a budget 
admendment is necessary to comply with these standards, and this in simply an 
accounting procedure that will have no monetary effects to the City. 
UTILITY DEPARTMENT. Thursday and Friday the City water mains were 
flushedo and we are assisting the City Engineer with the Infiltration Study 
on the City's sewer system. We also replaced a broken seal in Lift Stati.o:i 21 
on Pitt Street, and made repairs to the expansion joint at the Highland Avenue 
water tank. Expansion joints allow the water tank to expand and contract without 
breaking rivets as the tank expands to fill with water, and contracts when water 
is�withdrawn. This joint is still leaking slightly and we will be forced to 
re -fill the joints within the next few weeks. 
PUBLIC WORKS. The Public Works Department is patching streets, 
constructing the Bloxam Avenue sidewalk and constructing drainage improvements 
at the Middle School Park. 
I J WASTEWATER ALTERNATIVES. Wastewater Alternatives is again on the 
Agendalfor the next Council Meeting. Since time is beginning to get short on 
our icompliance schedule, 'the City Manager needs some clear directives to allow 
ltim to, research Engineering and Financing options. 
POLICE DEPARTMENT. Twelve traffic tickets were issued in various 
parts of the City last week.

DEPARTMENT OF TRANSPORTATION. Enclosed is a letter from DOT 
regarding a speed limit change on Highway 50 to reduce the limit from 50 to 45 
at Emerald Lakes. 
COUNTY ROAD AND BRIDGE 'PAX. The Lake County City Managers and 
Clerks have been conducting meetings recently to discuss matters of mutual 
concern. One of the isaues that has been discussed is the County Road and 
Bridge Tax. 
Presently the County assesses a .82 mill levy against the Cities as a Road 
anti Bridge Tax, yet only returns to the Cities one half of the monies 
collected. This year we have budgeted $18,000 in County Road and Bridge 
Revenues, yet the County will have received $36,000 in taxes from City 
residents. It would not cost our taxpayers any additional money if the 
County would drop this levy against Cities and allow each City to assess 
the .82 mill levy. This would double the City's revenues from this mill 
levy without increasing the overall mill levy.

FACTS OBTAINED BY FIELD STUDY 
a. The studied portion of SR 50 lies in Section 11070 and extends from SLO MP 
10.881 to SLO MP 11.310, a distance of 0.429 miles. 
b. The roadway across this section is a two lane facility extending in a west - 
east direction from Groveland to Clermont. 
c. The roadway in the study area is relatively level prior to a vertical curve 
with no horizontal curves that restrict sight distance. 
Sight distance is adequate. 
d. Roadside culture along the studied roadway is rural with three entrances to a 
major Mobile Home Park for retirees. 
e. Records of this office show the 1978 AAT along the studied portion of SR 50 
to be 9231 vehicles. 
f. Speed checks were taken at 2 points with the following results:

h. According to the records submitted by the City of Clermont the subject location 
experienced 8 accidents accounting for injury to three persons and estimated 
propertydamages of $58.675.00 for the 14 month study period ending 4-30.80. 
The accidents by type are as follows:

One of the accidents involved speeds of 85 MPH. 
Four of the accidents occurred on dry road surface and four on wet road surface. 
ANALYSIS 
A. The above results and the speed distribution curve at each check point indicates 
that in consideration of the accidents and other unusual circumstances. a 
reduction in the maximum speed is justified. 
B. Field examination determined definite points of speed change and driving tests 
of the recommended speed zones showed them to be reasonable and safe.

This statement is an attempt to clarify the City's any/m#yNpersonal position on 
finding an acceptable solution to the community prob em of disposal of the 
City of Clermont's secondarily treated wastewater. 
Beginning in 1975, the City began to investigate the feasibility of wetlands 
disposal of Clermont's wastewater with the Lake County Pollution Control 
Board and the Florida Department of Environmental Regulation. This investiga- 
tion was undertaken primarily because a similar study of the City of Wildwood's 
disposal of wastewater into wetlands, which feeds Lake Panasoffkee, had shown 
no adverse effects on the surface waters of Lake Panasoffkee even though Wild - 
wood had been using this disposal method for more than twenty (20) years. 
After numerous meetings, Clermont officials, the Lake County Pollution Control Board 
and the Florida Department of Environmental Regulation agreed that wetlands 
disposal might be an acceptable alternative. The City was subsequently auth- 
orized by the regulatory agencies to conduct.a pilot study of wetlands disposal 
of secondary treated wastewater from the Clermont Sanitary Treatment Plant. 
The Study was begun in early 1971 and the completed final report titled, "Removal 
of Nutrients From Treated Municipal Wastewater By Freshwater Marshes" was 
presented to the City in October 1979. The Study results concluded that wet- 
lands disposal in Clermont was an acceptable method of disposal while still 
protecting our lake water quality. 
The opinion of the Researchers, the City Engineers, and other qualified scien- 
tists who reviewed the study, convinced the Clermont City Council to pursue 
wetlands disposal. A Town Hall Meeting was held in Jenkins Auditorium on 
January 22, 1980 to present the wetlands disposal concept to Clermont residents.

One of the principal researchers, Dr. John Zoltek, made p 
approximately one hundred fifty (150) interested citizens. Numerous questions 
were asked of Dr. Zoltek concerning potential harmful effects to lake quality. 
All questions were answered to the satisfaction of the audience on the proposals 
complete safety. Mr. Ted (dicks, director of the Lake County Pollution Control 
Board was in attendance at this meeting but declined to ask any questions y. — 
Dr. Zoltek or make any statements concerning the proposal known as Concept 
The newly elected Councilman Dennis Thomas also attended the Town Hall Meet- 
ing, but elected not to ask the researchers any questions or make any statement. 
The last question asked at this meeting was, "Should the City continue to pursue 
the concept of wetlands disposal?". The overwhelming response from the audience 
was, "Yes". Not a single NO vote was heard.

Clermont City Council meeting was called to agal.n give Clermont residents the 
opportunity to review 
all the alternatives considered by the City for waste- 
water disposal. After several hours of public discussion, the Council voted 
three (3) to one (1) to pursue wetlands disposal under Concept IV with Council- 
man Thomas in the negative. Councilman Cole, who could not attend the meeting, 
sent word through the City Manager, Mr. Forbes, that he also supported wetlands 
disposal. 
At the next Lake County Pollution Control. Board meeting, a presentation was 
made by the researchers and two additional wetlands scientists, including Dr. 
Thomas Odum. Dr. Odum, an internationally recognized authority in wetlands 
ecology, categorically stated his support of Clermont's proposal. The Lake 
County Pollution Control Board voted two (2) to two (2) to permit Clermont's 
proposal. Again, at this. public hearing, with approximately one hundred (100) 
in attendance, Mr. Thomas elected not to ask questions of the researchers or 
to make a statement concerning his opposition to the proposal. 
In time it became apparent that a considerable amount of misinformation was 
being circulated in the community concerning Clermont's proposal. The problems 
In Orange County and Lake Tolnopekaliga were erroneously equated to be directly 
comparable to what would happen to our lakes if wetlands disposal were imple- 
mented. Nothing could be further from the facts. 
In order to clarify the feeling of the community, I requested a non -binding straw 
ballot be taken on the issue on the June 10th special election. -Mr. Thomas--- ------ 
was the only Councilman who wanted assurance that the straw vote would be non- 
binding. 
1 personally committed to abide by the results of the straw ballot, feeling that 
without visable community support, agency approval would be extremely difficult-, 
if not impossible. The straw ballot resulted in a negative vote on wetlands 
disposal. In my opinion, the negative vote was due in part to an unsigned, 
inaccurate, deliberately misleading and emotionally charged handout which was 
distributed the night before the election. A copy is attached. In my opinion, 
several employees of regulatory agencies, acting on their own, assisted in 
formulating the ideas contained in this handout. I consider their actions 
regretable and unprofessional. 
At the Town Hall Meeting, I restated my intention to discontinue support for 
wetlands proposal stating that without visable community support, I felt it 
impossible to obtain necessary permits. In response to a question by a member 
of the audience on what could people in favor of pursuing wetlands disposal do 
to influence the Council to continue; I stated that I felt nothing could be done. 
But being the eternal optimist, if a petition were presented to the Council 
with four hundred fifty (450) names on it, the Council might consider holding 
an additional public hearing with the researchers to answer questions. I did 
not then, nor have I since actively promoted such a petition. Again in response 
to several requests from the audience, I withdrew my second of Mr. Thomas' motion 
until a full Council could be seated.

It is now time for the Clermont Council and for. the Community to reunite in 
seeking a permanent solution to wastewater disposal.

proceed with all due haste in selecting the best alternative method available.

SPECIAL MEETING 
A Special Meeting of the City Council of• Clermont was held in 
the Office of the City Manager on Monday, June 23, 1900. The 
meeting was called to order at 7:50 p.m. by Mayor Cluade E. Smoak, Jr. 
with the following members present: Councilman Byrd and Councilman 
Thomas. others present were City Manager Forbes and City Clerk Rozar. 
Mayor Smoak advised that the purpose of the meeting was to prepare 
the Ballot Box for the Run -Off Election of the City of Clermont 
to be held on Tuesday, June 24, 1980. - 
A motion was made by Couniciman Thomas, seconded by Councilman Byrd 
and unanimously carried that the Ballot Box be declared in order, 
that it be locked, along with the Registration Rolls of the City 
of Clermont, for delivery to the Clerk of Election on the morning 
of the Run -Off Election. 
The meeting was adjourned by Mayor Smoak at 7:51 p.m.

Enclosed is Ordinance No. 206-C as amended by the Planning and 'Zoning Commission. 
This Ordinance reflects the change in the Blue Goose Property from R-3 Multiple 
Family to I-Induntrial, and the Ball Cernmics properly from I -Industrial to 11-3 
Multiple Family. 
An we have di8cussed,in June of 1969, the City established three 'Transition Zones 
as part of: the City's Zoning Ordinance. The purpose of these Transition Zones 
were to allow existing Uses within these zones to remain for a period of fifteen 
years, after which time all Uses were to conform with the requirements of the 
R-3 Multiple Family Zone. 
This means that in June of 1984, all of the Uses in the Transition Zones must 
conform to the Uses permitted in the Multiple Family Zone. This does not allow 
for the Industries and Businesses presently located within these 'Zones, many of 
-- - -- which have been expanded or improved since.1969. ±. 
It is the intent of this Ordinance to remove the Transition Zones from the Zoning 
Ordinance, and rezone those properties in a manner that would reflect the highest 
and best Use in our community. 
SIGN ORDINANCE 
All Council members have previously received a copy of Ordinance No. 207-C 
which establishes the City Sign Regulations as a separate code from the Zoning 
Ordinance. This has several advantages in that it would allow us to place the 
code in an easily readable format that makes the Sign Code much easier to' 
understand than breaking the code up under all of the various Zoning Districts. 
The other major revisions are that the Off Premise Signs Provisions have been 
clarified to only allow such signs on vacant property. Off -site signs sixty- 
four (64) square feet in area or less must be a minimum of 200' from any other 
off -site signs on the same side of the street. Off -site signs greater than 
64 square feet must be 1,000 feet from any other off -site sign. 
The Ground Sign Provisions were also modified to allow Ground Signs lower than 
9' in height to be located in front of the building setback line.. However, these 
signs cannot exceed 32 square feet in area and must not be closer to the street 
than one-half of the required front yard setback.

At the May 27th City Council Meeting, the Council directed the Planning and 
Zoning Commission to review the feasibility of roadside swales, and recom- 
mend a change in the Subdivision Ordinance that would net• parameters for 
the possible use of swales as opposed to curb and gutter streets. Presently 
the Subdivision Ordinance requires curb and gutter streets, and swales are 
not allowed. 
The Planning and Zoning Commission has recommended that the enclosed Ordin- 
ance be adopted. 
This Ordinance would amend the City's Subdivision Ordinance to allow 
roadside swales upon approval of the City Council providing soil conditions 
and topography, etc. warranted their use.

REQUIREMENTS FOR SWALE ROADWAYS 
B-1. Lowest portion of swale must be more than 12" 
above the seasonally high water table. 
0-2. Soil must have a permeability greater than 6.3 
inches per hour. 
B-3. Slope of swale flow line shall not exceed 1%. 
B-A. Soil borings shall be made at 600 feet intervals 
to a depth of 2 feet below the design swale flow 
line. There shall be at least one soil boring on 
each street swale. 
B-5. When the Swale is to be used as part of a water 
retention system, the high water line shall be 
below the lowest point of the pavement subgrade. 
B-6. Driveway culverts prohibited, 
B-7. A complete subdivision grading plan shall be 
submitted. The grading plan shall show design 
swale flow line elevations at 50 feet intervals 
to facilitate setting driveway elevations. 
B-8. Cross sections at 200 feet intervals along each 
street shall be submitted. Cross sections shall 
extend from rear lot line to rear lot line. At 
least one cross section shall be prepared for each 
street. In cases of extreme topography, cross 
sections may be required at closer intervals. 
Cross sections shall show existing and finished 
grades. 
B-9. Swales and driveways shall be designed to allow 
for passage of vehicles without striking the 
underside. 
8-10. A four (A) foot wide stabilized shoulder shall be 
constructed between the edge of pavement and 
swale.

WHEREAS, the City Council. of: the City of Clermont, P1or..i.da 
recognizes the urgent nero,sity of four .laninq :;into highway 50 
from Twelfth Street in Cl.or.mont to the City of Groveland, Florida. 
WHEREAS, this is a hazardous roadway in which over 196 
accidents have occured since 1974. 
WHEREAS, the Twelfth Street intersection on this highway must 
_. be redesigned and include a traffic signal. _. 
NOW THEREFORE, Be it resolved the City of Clermont urgently 
requests that the State Department of: Transportation rearrange its 
construction priorities to install traffic signals on Twelfth Str.eeL 
and four lane highway 50 from Twelfth Street to Oroveland; and be 
it further resolved that if those improvements cannot be inmiediaL•ely 
commenced, the State Department of Transportation is requested to 
immediately install traffic lights at the Twelfth Street intersection, 
and complete the enginceri.ng plans and construction of this project 
to the West end of the Clermont city limits.
