CITY OP CLERMONT MINUTES REGULAR MEETING A regular meeting of the City Council of the City of Clermont was held in the Council Chambers on Tuesday, March 25, 1980. The meet- ing was called to order at 7:30 P.M. by Mayor Claude E. Smoak, Jr. with the following Councilmen in attendance: Councilman Lester Cole, Dennis Thomas, Carlisle Byrd, and James Meginley. Other City Offi- cials present were City Manager Forbes, City Attorney Baird, Finance Director Saunders, and City Clerk Sandra Rozar. The Invocation was offered by Councilman Byrd, followed by repeating of the pledge of allegiance by all present. The Minutes of the Regular Meeting held March 11, 1980 were approved as written. The Minutes of the Special Meeting held February 8, 1980 were approved as written. VARIA^ICE REQUEST: Mrs. Lloyd Boliek 80-49 The City Council, acting as a Board of Adjustment, considered a request by Mrs. Boliek for a variance in order to construct a fence 5 feet in height in the front yard of their property at 444 West Montrose Street. Letters from adjoining neigh- bors were presented, stating no objection to the fence being built. Mrs. Boliek stated the fence was to be not only for their protection, but also for persons passing their home. COUNCILMAN COLE MADE A MOTION THAT THE 5 FOOT FENCE BE GRANT- ED SINCE THERE WAS NO OBJECTION FROM NEIGHBORS; 1HE MOTION DIED FOR LACK OF A SECOND. After some discussion it was determined there was no topo- graphical or other exceptional circumstances of this prop- erty that is not generally applicable to other areas. CITY MANAGER'S REPORT GRAND HIGHWAY WELL REPAIR City Manager Forbes reported the Grand Highway Well was re- paired with a bearing being replaced on the well shaft. No complaints were received during the time the well was down and the Utility Department deserved credit for keeping the water pressure up on the east side of town during the repairs. BIKE-A-THON FOR CYSTIC FIBROSIS A letter was received from Mrs. Cunningham requesting the City allow her group to conduct their Annual Bike-a-thon for Cystic Fibrosis around Lake Winona. This event was held around Lake Sunnyside last year, but the course has become too short for many of the older riders. Public Works Director, Bob Smythe, will insure that Barricades will be placed at all streets which intersect the bike route, and all barricades will be manned by volunteers. COMPREHENSIVE PLANNING GRANT City Manager Forbes stated he had received a letter from the State Department of Community Affairs regarding our Comprehensive Planning Grant for the Sewer Study. The purchase of the recording flow meter for this project is not an eligible item cost. Forbes recommended the City go ahead with the Sewer Study, that it would be funded two thirds by the state and one third by the City. The consensus of the Council was to proceed with the sewer study. JAYCEE BEACH FEE COLLECTION City Manager Forbes reported he had conferred with the Jaycee Beach Concessionaire about collecting the fees for entrance to the beach, and after a thorough discussion requested permission to hire three employees to work part-time collecing fees;' AA MOTIONS 80-52 COUNCIL REPORT Councilman Carlisle Byrd reported he had been requested to e srve as a member of a committee to review legislation on the "Florida Resource Recovery and Management Act". The purpose of the committee is to make recommendations to the legislature. The Bill involves the business of issuing permits, collecting fees, and trust funds for the disposing of hazardous wastes. It was recommended that City Attorney Baird review this Bill with Councilman Byrd for possible recommendations for the City to pass on to the League President. Councilman Meqinley, referring to the letter from the Chamber of ommerce requesting action be taken to improve the appear- ance of the back of the local shopping centers adjacent to area residents and suggested the Chamber relate this matter to the tennants of the shopping center. He suggested this would be an appropriate action to take, stating Ordinances have already been adopted, it is a matter of enforcing the existing ones to correct the situation. City Manager. -Forbes stated the South Lake Shopping Plaza will be constructing a fence with the new addition to the Shopping Center, elim- inating the problem at that location. CLEAN COMMUNITY COMMISSION - BOB HERTZ Mr. Wdrtz reported on the work of the Clean Community Commis- sion. He stated many lettershad been written to people in business and industry, and a brochure has been drafted. He explained there will be some changes made in the brochure, and when finalized they will be distributed to all Clermont citizens. LANDSCAPE COMMITTEE It was announced that Mrs. Arlene Hanks has resioned.as chairman of the Landscape Committee. GARBAGE COLLECTION 80-54 City Manager Forbes reported the City is looking for more -- efficient ways of collecting garbage. He advised the Council that on an experimental basis for a trial period of one month, the City use only one truck with a driver and four sanitation workers. On a yearly basis this would save the City a considerable amount of money involved in the operation of a second garbage truck. It would also result in one less person on garbage collection that could be used on the Park crews or for trash collection. As a result of the increased productivity and longer hours involved in this collection Process, there will be a salary increase for the sanitation workers during this trial period Councilman Byrd discussed the implementation of a can, glass, etc. salvage system for recycling of garbage. The Clean Community Commission was directed to investigate the possibilities of recycling solid waste. INTERLOCAL AGREEMENT WITH ECFRPC 80-55 City Manager Forbes stated on February 26, 1980 the City passed a Resolution in which we declared our intention to participate in the combined entitlement program for LEAA funds. The agreement presented is to set up a system for us to join with other cities in the county to Participate in this law enforcement funding program. ORDINANCE• NO. 203-C FLOOD PREVENTION - FINAL READING City Manager Forbes explained the Federal Flood Insurance Administration has prepared a Flood Hazard Boundary Map for the City of Clermont, and a more detailed Flood In- surance Rate Map is being prepared. It was stated that people wishing to build in Clermont will be informed that in flood prone areas they must build 18 inches above the 99 foot elevation level, which is the base flood water elevation for this area. City Manager Forbes stated he had received some sample Ordinances and will be consulting with the City En- gineer and City Attorney to bring a recommendation to the Council. He stated also that he is going to get an application for an EPA 201 Program, which is a prerequisite for receiving EPA Funding for Waste Treatment Projects, COOLEY PROPERTY City Manager Forbes advised the Council that a preliminary plat for the City's new subdivision which is to be known as Margaree Gardens has been received. This subdivision is on Mrs. Cooley's property which is sometimes called Hooks Point. The Subdivision AIvisory Committee has determined that it would be in the best interest of the City to require money equal to five percent (5%) of the value of the gross area to be subdivided, in lieu of a Park dedication in this area. The Subdivision Ordinance states that the determina- tion of the value of the gross area to be subdivided shall be the value of the land with public improvements, and that the City Council must approve of the exact dollar amount. WASTE TREATMENT PLANT Councilman Byrd stated the Pollution Control Meeting will be April 14th at which time the City is to take certain information concerning alternative methods of disposal. He inquired if the Council would have a work meeting to discuss the City's presentation. -4- CITY on CCF.RHONT MINUTES Mayor Smoak explained there had been a work meeting with the City Engineer and one scheduled to be held one week prior to the Pollution Control Meeting and regretted everyone could not attend, however, it was simply a work meeting of those who were making the presentation. From: City Manager Subject: Garbage Collection Date: March 20, 1980 I have received a memo (attached) from our Public Works Director, Bob Smythe, regarding the realignment of our garbage collection service. We are analyzing various methods to increase the efficiency of our garbage collection services, and the Clean Community Commission is also examining the City's entire trash and garbage collection system. Presently, the City picks up garbage using two trucks each with a driver and two sanitation workers for a total of six employees hired for garbagecollec- tion. On an experimental basis for a trial period of one month, we would recommend that the City use only one truck with a driver and four sanitation workers. On a yearly basis this would save the City approximately $16,500 involved in the operation of a second garbage truck. It would also result in one less person on garbage collection that could be used on the Park crews or for trash collection. We used this system to an extent when both our regular truck and trash truck were being repaired about a month ago. We have discussed this situation with our sanitation workers, and they believe that the one truck concept has merit. In order to reimburse the five workers for the increased productivity and longer hours involved with this system, we would recommend that the salary range for sanitation workers be increased from $3.36 to $4.00 for a sanitation crewman, and from $3.53 to $4.16 for a sanita- tion crew chief. Mr. Smythe and myself believe that this increase would be warranted, not only due to the increased productivity and hours, but due to the substantial savings that the City would accrue from this system. I would recommend that the City Council authorize this pay schedule for a period of one month, from March 31 to April 30, to allow the City to experiment with this system. This Resolution was adopted to comply with the r.equirammiLa of the National Flood Insurance Program. 'rile purpose of the Federal Flood Insurance Program is to provide a federal sub- sidy to assist private companles in writing flood insurance. The government does not get directly involved in the flood insurance business, but guarantees private insurance companies that they will not suffer massive losses in case of a disaster. - llawever, persons within the city limits are generally not eligible for federally backed flood insurance unless the City Council authorizes participation by agreeing to comply with the Federal. Flood Regulations. Therefore, City Council authorize - Lion .is a prerequlsi.tu to participation by private cltLzons. City participation In this program is important because the Federal Government generally requires Federal Flood Insurance for any mortgages on property located in a Plood Hazard Area. FLOOD INSURANCE PROGRAM The Federal Flood Insurance Administration has prepared a Flood (Hazard (foundry Map for the City of Clermont. This map was prepared by the best available infor- mation that the Federal Government could obtain, and is only intended as a tem- porary map until a more detailed Flood Insurance Rate Map is prepared. Engineers hired by the Flood Insurance Administration will perform a detailed survey of the City from which flood elevations for a 100 year flood will be determined, and the final rate map composed. Until the rate map is prepared, the City is participating under the Emergency Program, which permits the sale of Flood Insurance in the City limits of Clermont until the rate map is complete. The city's Flood Hazard goundry Map only delineates areas of special flood hazard without giving base flood water elevations for a hundred year flood. In other words, it allows areas of flooding but does not give the elevation of the height of the flood water. The flood hazard maps are based on what is known as a hun- dred year flood, or a flood Chat has a probability of occuring once in a 100 year period. Requires the City to title the best available informntion to insure that all new buildings or subdivisions are safe from flooding. Commercial structures can be flood proofed or have the .lowest floor elevated at least 18" above the flood elevation. 3. IMPLEMENTATION These regulations require the City to use the best available data to determine the 100 year flood elevations until the Flood Insurance Administration Engineers prepare a final Base Flood Elevation Map. In order to determine the 100 year flood elevation the City Engineer and the City Manager have coordinated our efforts with the County. For the Clermont Chain of Lakes, 99' above sea level, is considered the one hundred year flood elevation. New buildings must then have the lowest floor elevated 18" above this level. The City Engineer also obtained from the County the Comprehensive Drainage Plan for Lake County. This plan has hydrolic evaluations for all the Lakes within Clermont. The attached regulations should be considered to give the City Staff more guidance and control over development in flood hazard areas. AN ORDINANCE ADOPTING FLOOD PREVENTION REGULATIONS AS REQUIRED BY MUNICIPALITIES IN THE FEDERAL INSURANCE PROGRAM; PROVIDING FOR SEVERABILITY; PROVIDING AN EFFECTIVE DATE. THE CITY COUNCIL OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA, HEREBY ORDAINS THATi ARTICLE I. PURPOSE It is the purpose of this ordinance to promote the public henith, safety, and general welfare by minimizing the loss of property or life due to flood conditions. ARTICLE II. DEFINITIONS Unless specifically defined below, words or phrases used in thin ordinance shall be interpreted pursuant to the zoning regulations of the City of Clermont, or as to give them the meaning they have in common usage. (1) Flood Hazard Boundar'j Fktp (F➢➢M): Tile official map issued by the Federal Insurnnce Administration where the areas of special flood hazards have been designated as Zone A. (2) Habitable Floor: Any floor usable for living purposes, which includes working, sleeping, eating, cooking,or recreation, etc. A floor used only for storage purposes is not a "habitable floor". (3) Substantial Improvement: Any repair, reconstruction, or improvement of a structure, the cost of which equals or exceeds 50% of the market value of the structure either: a. Before the improvement or repair is started; b. If the structure has been damaged and is being restored, before damage secured. The term does not include: a. Any project for improvement of a structure to comply with existing state or local health, sanitary, or safety code specifications which are solely necessary to assure safe living conditions. b. Any alteration of a structure listed in the National Register of Historic Places or a State Inventory of historic places. (4) Base Flood Elevation: A flood having a 1% chance of being equalled or exceeded in any given year. (5) Development: Any man-made change to improved or unimproved real estate, including but not limited to: buildings, structures, dredging, filling; grading, paving, etc. (6) Area of Special Flood Hazard: Land subject to a 1% or greater chance of flooding any given year, and located in Zone A of the Flood Hazard Boundary Map. No structure or land shall hereafter be constructed or structurally altered without full compliance with the terms of thin ordinance. Ilowever, where this ordinance and nnother conflict or overlap, whichever imposes the most stringent restrictions shall•prevail. Sic.HON 2. Building Pormitu. Building permits shall be required for all proposed construction within n spacial flood hazard area. The Building Official shall review all building permit applications for compliance with this ordinance. All applications for building permits within Zone A of the FIIBM shall contain tl:e following information no applicable: a. Elevation in relation to mean sea level (mal) of the lowest floor (including basement) of all proposed structures. b. Elevation in relation to mean sea level to which any non-residential structure will be flood -proofed. C. Certification by a registered professional engineer or architect that any non-residential flood -proofed structure meets the flood -proofing criteria of Article IV. Section 7 of this Ordinance. d. Description of the extent to which any watercourse will be altered or relocated as a result of the proposed development. SECTION 3. Building Permit Review, The Building Official of the City of Clermont must review all building permits or subdivisions to insure that: a. The permittee has been advised that additional federal or state permits may be required, and if specific federal or state permits are known, require that copies of such permits be provided and maintained on file with the building permit. b. Review all development permits to determine if the proposed development will adversely effect the flood carrying capacity of the flood plain. For the purposes of this ordinance, "adversely effects" means damage to adjacent property due to rises in flood stages attributed to physical changes of the channel and the adjacent overbank areas. If it is determined that there is no adverse effect, then development may proceed within the provisions of this ordinance. If it is determined that there is an adverse effect, the development may not proceed unless technical justification by a registered professional engineer for the proposed development is provided by the permittee. C. The development of building is in with Article IV, CONSTRUCTION STANDARDS of this Ordinance. • RECTION 4. Racordo. ilia ➢uilding Official sl:all maintain the following rocordn: a. When base flood elevation datn has not been provided by tl:e Flood Insurance Administration, the Building Official shall review, obtain, and reasonably utilize any base flood elevation data available from a federal, state, or other source to administer this ordinance. CONSTRUCTION STANDARDS In all areas of special hazard, the following provisions are required: SECTION 6. Residential Construction. New construction or substantial improvement of any residential structure (including mobile home) shall have the lowest floor, including basement, elevated at least eighteen inches (18") above base flood elevation. SECTION 7. Non-residential Construction. New construction or substantial improvement of any commercial, industrial or other non-residential structure (including mobile homes) shall either have the lowest floor, including basement, elevated at least eighteen inches (18") above the level of the base flood elevation or, together with attendent utility and sanitary facilities, be flood -proofed no that below the base flood level the structure is water tight with I walls substantially impermeable to the passage of water and with structural components having the capability of resisting hydrostatic and hydrodynamic loads and effects of I buoyancy. A registered professional engineer or architect shall certify that the standard; of this subsection are satisfied. SECTION 8. Mobile Home Parks and Anchoring. A. Mobile Home Parks. (1) No new mobile home parks shall be built or placed within Zone A of the Flood Hazard Boundary Map (FHBM). � (2) M evacuation plan indicating alternative vehicular access and escape routes must be filed with appropriate disaster preparedness authorities for existing mobile home parks located within Zone A of the FHBM. x '_s B. SECTION 9. Construction Materials and Methods. A. All new construction and substantial improvements shall be constructed with materials and utility equipment resistant to flood damage. B. All new construction or substantial improvements shall be constructed- --- by methods and practices that minimize flood damage. SECTION10. Utilities. A. All new and replacement water supply systems shall be designed to minimize or eliminate infiltration of flood waters into the system. B. New and replacement sanitary sewage systems shall be designed to minimize or eliminate infiltration of flood waters into the systems and discharges from the systems into flood waters. C. Onsite waste disposal systems shall be located to avoid impairment to them or contamination from them during flooding. SECTION 11. Subdivision Proposals. A. All subdivision proposals shall be consistent with the need to minimize flood damage. B. All subdivision proposals shall have public utilities and facilities such as sewer, gas, electric and water systems located and constructed to minimize flood damage. C. All subdivision proposals shall have adequatedrainage provided to reduce exposure to flood hazards. D. Alteration of Watercourses. A. VARIANCES AND EXCEPTIONS SECTION 13. Variances. Variances from this ordinance may be granted by the City Council of the City of Clermont for new construction or substantial improvements to be erected on a lot, only if the following conditions are met; a. A determination that failure to grant the variance would result in exceptional hardship to the applicant. b. A determination that the granting of a variance will not result in increased flood heights, additional threats to public safety, extra -ordinary public expense, create nuisances, or victimization of the public. C. Variance shall only be issued upon a determination that the variance is the minimum necessary, considering the flood hazard, to afford relief. d. Variances may be issued for the reconstruction, rehabilitation, or restoration of structures listed in the National Register of Historic Places or State Inventory of Historic Places, without regard to the procedures set forth in this section. SECTION 14. Notification to Applicant. The City shall notify all applicants for variances in writing that: 1 I a. The issuance of a variance to construct a structure below the base flood level will result in increased premium rates for flood insurance up to amounts as high as $25 of $100 of insurance coverage. b. Construction non -conforming to the provisions of this ordinance increases risks to life and property. SECTION 15. Record of Variance Actions. The City shall maintain a record of all variance actions, including justification of their issuance and notification letter to applicants, and report all variances issued in the annual report to the Federal Insurance Administration. ARTICLO WARNING AND DISCLAIMER OF OILI'iR. Tile degree of flood protection required by this ordinance in considered ruasonablo for regulatory purposes and is based on scientific and engineering considerations. Larger floods can and will occur on rare occasions. Flood heights may be increased by man-made or natural causes. This ordinance does not imply that land outside the areas of epeeinl flood hazard or uses permitted within such areas will be free from flooding or flood damages. Thin ordinance shall not create liability on the part of the City of Clermont or by any officer or employee thereof for any flood damages that result from reliance on this ordinance or any administrative decision lawfully made thereunder. SUCTION 16. Should any section or part of this section be declared invalid by any Court of,competent jurisdiction, such adjudications shall not apply or affect any other provision of this Ordinance, except to the extent that the entire section or part of the section may be inseparable in meaning and effect from the section to which such holding shall apply. Cunningham requesting that the City alLow her group to conduct their Annual Bike - a -that for Cystic Fibrosis around Lake Winona. Last year this event was held around Lake Sunnyside, but it has become too short of a course for many of the j older riders. Mr. Smythe has agreed to assist this group by placing barricades at all of the streets that will intersect the bike route, and all barricades will be manned by volunteers. Residents will he allowed to travel to their homes, but through traffic would be discouraged. This event would take place on Sunday, April 13th from one to four p.m. .� BLOXUM WELL. As requested by the City Council, I investigated the possibility of placing ❑ new well at the Bloxum Avenue site. The City Engineer does not recommend that this be done since this well would be too close to the present Bloxum Well that does not meet federal safe drinking water standards. Pollutants are often transmitted from one acquifer to another by an old abandoned well. There has already been two wells drilled at this site, and we would not recommend a third. They have Informed me that the purchase of it flow meter for the Sewer Study is not an eligible program expense. The State will still fund two thirds of the project cants, 11 the City one third. IIIGIILAND AVENUE WATER TANK. A few weeks ago, when the overflow valve crocked due to the cold weather, the va,Lve repairmen had it chnuce to look inaidc of the tank. Enclosed is it Letter to us stating that the inside of the tank in in need of repairs. This comes as a complete surprise to us since up until a year ago, the Odum Tank Company for many years has Inspected this tank and reported that it was in good shape. however, since we were not satisfied with tice services and costs of the Odum Company, we terminated their agreement last April. In December, we signed an agreement with the Watertown Tank and Repair Company for inspection services. Within a few months this company will be inspecting the tank, and we can take appro- priate action once their inspection is complete. ORANGE IW.OSSUM BREAKFAST. Next Tuesday at 7:70 a.m., the Orange Blossom Breakfast will be held in Jenkins Auditorium. All Councilmen are encour aged to attend. FIRE DEPARTMENT. Fire Chief. Smythe is continually conducting tours and Fire Safety Classes for children at the Fire Department. Friday, a tour was held for the Methodist Church Kindergarten. With these tours, we are trying to instill a respect for fire safety in the children, and Mr. Smythe is to be commended for his efforts. RECREATION COMMITTEE. The Recreation Committee is busy implementing the Summer Youth Programs. Within a month we plan to have the Recreation Super- visor hired and a list of programs complete. We have also further investigated the collection of fees on Jaycee Beach. After meeting with the Concessionaires, I would recommend that the City hire three part time employees for the job. George Forbes Dear Mr. Forbes, We plan to have our Spring C F Dike a Thon on Sunday afternoon, April 13, 1980, from 1 to 4 P. M. and request permission from the City of Clermont to use a bike path beginning at the corner of Rosewood Drive and Lake Shore Drive going East on Lake Shore Drive and negotiating each Left turn thereafter back to the start- ing point. Streets included are Rosewood, Lakeshore, Settle, Chest- nut,Linden, 7th, West and W. Minnehaha. Younger riders will use 1/2 mile of the course on W. Lake Shore Drive. Our Foundation workers will notify all residents involved and clean the route after the event is over. The East side of Peter Pool Park will be used for the refreshments and the workers only. Seven residents in the area are workers. For those who may not be familiar with the Cystic Fibrosis Foundation, 872 of the funds raised go to research and treatment of all childrens lung diseases, Cystic being the name of the Foundation because it is (presently) always fatal. According to the City Ordinance establishing the Clermont Clean Community Commission, we have two principal areas of responsibility, namely (1) to reduce litter, and (2) assist the city in improving its trash management practices. Much of what we do to reduce litter will require a good deal of time to produce discernible results. However, assignments such as the one we have just received from the City Manager gives us a great oppdTiu- nity to develop some meaningful ideas and recommendations that will be of almost immediate assistance to the city administration. This letter is in follow tip to a field trip which was conducted by the City of Clermont, and was attended by Mr. Senkcvich and his staff, and myself. The area referenced in the letter is the south marsh area which I pointed out to the Board at the Regular Meeting last week. I have attached a copy of a map showing the area. The response by DER is significant in that they are considering this area as open water, and, consequently it does not qualify under the provisions of Chapter 17-4, which would allow the use of wetlands for experimental wastewater recycling. Any project which the City would choose to implement in this or similar areas would be considered a discharge to surface waters, and would be subject to normal permitting requirements and water quality criteria. This would support the staff's position that the areas contiguous to the Palatlakaha River are essentially open water bodies, and are simply extensions of the surface waters of the system. Consequently, any project proposed for this area would be considered the same as any other proposal to discharge to surface water. I am also enclosing] a copy of Section 17.4.2,13 (4), which is referenced in the letter. It outlines the criteria in Chapter 17-4 that would have to be met in order for a project to qualify under the exempt criteria for experimental use of wetlands. We will be providing additional information to the Board as it becomes available. Exemptions to Provide for the Experimental Use of Wetlands for Low -Energy Water and Wastewater Recycling. (a) To encourage experiments which are designed to lead to the development of new information regarding low -energy approaches to the advanced treatment of domestic, agricultural, and industrial wastes and to encourage the conservation of wetlands and fresh waters, the Secretary may, upon petition' of an affected person, and after public notice in the Florida Administrative Weekly and in a newspaper of general circulation in the area of the waters affected, and after public hearing pursuant to Chapter 120, Florida Statutes, issue an order, for a period not to exceed five (5) years, specifically exempting certain sources of pollution which discharge into restricted areas of wetland::, as approved by the Secretary, from the water quality criteria contained in Section 17-3.121. provided, that: 1. The discharger affirmatively demonstrates that the wetlands ecosystem may reasonably be expected to assimilate the waste discharge without significant adverse impact on the biological community within the receiving waters; and, 2. granting the exemption is in the public interest and will not adversely affect public health or the cost of public health or other related programs, and, cent. . . 2 3. tlw public is restricted from access to, tile waters under consideration; and, A. the waters are not used for recreation; and, S. the applicant affirmatively demonstrates that presently specified criteria are unnecessary for the protection of potable water supplies or human health; and, G. the exemption will not interfere with the designated use of contiguous waters; and, 7. scientifically valid experimental controls are provided by the applicant and approved by the Department to monitor the long-term ecological effects and waste recycling efficiency. (b) The Petitioner shall affirmatively demonstrate those standards which the Petitioner believes more appropriately apply to the waters for which the exemption is sought. (c) The Secretary shall specify; by Order, only those criteria which the Secretary determines to have been demonstrated by the preponderance of competent substantial evidence to be more appropriate. When we replaced your overflow valve and light bulbs I had a chance to briefly view the condition of your water tank. The exterior is in need of cleaning and painting, in order to prevent further rusting on the legs, balcony, shell and roof. I While changing the light bulbs, I had a chance to look at the inside through the manhole. "are I could see, there was an -- extreme amount of rust. I could also see a good bit of sed- iment of the floor. The spider rods, which run from the in- side shell to the spider hub in the center of the tank, had 1 rusted in two at the spider hub, except for approximately five or six still intact. The rest of the rods are hanging from the shell only. I cannot, however, determine the extent of damage rust has caused ,to the inside and outside without conducting a proper inspection, which would include a complete examination of the outside and power wash of the inside in order to accurately estimate the condition of the tank. The charge for me to inspect it is $400.00. In my opinion, you should have the tank inspected, cleaned adsiderablencost,nwhich aited n�c0uldtbey eliminated bymediael.
