REGULAR Mls'ETING
A Regular Mooting of: the City Council of the City of Clermont was held in
the Council Chambers on 'Tuesday, September 11, 1979. The meeting was called
to order at 7:30 P.M. by Mayor Claude E. Smoak, Jr., with the following
members prasant•: Councilman Cole, Schroedol, and Byrd. Other officials
present were: City Manager Forbes, City Attorney Baird, City Clark Carroll,
Finance Director Sanchez, Building Official Nagel, and Chief of Police
Tyndal. Others present were: Ms. Rana Clark; Mesdames Styles, Smoak, Blake;
Mr. & Mrs. Chris Giachetti, Mr. & Mrs. Bob Ray; and the Messrs. Barnard, Evans,
Thomas, Harder, Fleming, Booher, Mitchell, Mallory, Sargent, Searles,
Matthews, Sullivan, Seitz, Horton, and Meginley.
The invocation was offered by Councilman Byrd, followed by repeating of the
Pledge of Allegiance in unison by those present.
The Minutes of the Regular Meeting held on August 28, 1979 were approved as
written.
CUP REQUEST: FIRST BAPTIST CHURCH
City Manager Forbes advised of a request by officials of The First
Baptist Church for a Conditional Use Permit to utilize their property
described as:
W 1/2 Lot 7;
Lots 9, 11, 13;
N 50' of Lots 12, 14;
Lots 15, 17, 19;
N 62' of Lots 16, 18, 20;
City Block 48

in order to allow a nursery school and grass parking in an R-2 and R-3
zoning district, and, That the P & Z Commission had considered the
matter in a Public Hearing held on September 4th, and had voted to
recommend that the request be granted with the following conditions:
1. That the outdoor play area be enclosed with a fence at
least 4' in height;
2. That the nursery school meet all State and County requirements;
3. That the use not be expanded except with a Conditional Use
Permit;
4. That all applicable rules and regulations are met; and,
5. That a Certificate of Occupancy be issued only after all
conditions are met.
The Reverend Monroe Barnard appeared before Council in support of the
request, and advised he was aware of the conditions as recommended by
the P & Z Commission, and was in agreement with them. Following inquiry-`
from the Chair as to anyone present who desired to address the matter,
and there being none, motion was made by Councilman Byrd, seconded
by Councilman Cole and unanimously carried that the request be granted
as recommended by the P & Z Commission.
CUP REQUEST: ST MATTHIAS EPISCOPAL CHURCH
City Manager Forbes advised of a request by officials of the St.
Matthias Episcopal Church for a Conditional Use Permit to utilize
their property described as:
Lots 5 and 6
City Block 56
(574 Montrose Street)
in order to construct an addition to an existing building for use as
administrative offices, library, and covered breezeway in an R3 zone.
Mr. Jack Matthews, representing the Church officials, appeared before
Council in support of the request. City Manager Forbes reported that
the P & Z Commission, in their meeting held on September 4th to
consider the matter, had voted to. recommend that the request be

1. That all applicable r.ulon and regulations arc met;
2. That the use not be expanded except with a Conditional Una
Permit; and,
3. That a Certificate of Occupancy be issued only after all
conditions are met.
Inquiry was made from the Chair as to anyone else present who desired
to address the matter, and thore was none. Mayor Smoak advised of a
communication from Mr. and Mrs. R. J. Delano, abutting property
owners, who were in favor of the request subject to waiver of a general
requirement that a buffer strip be planted at the rear of the building
which would block their view and air circulation. City Attorney
Baird advised that if Council felt it would be appropriate, they
could remove that requirement in this CUP request without affecting
the Ordinance; That under a CUP, each individual permit is considered
from an individual standpoint, and that general Ordinance requirements
are not applicable except as outlined in the CUP. Motion was made
by
Councilman Schroedel seconded by Councilman Cole and unan m_ousl
carried that the CUP be granted as requested.
FINANCE DIRECTOR'S RESIGNATION
City Manager Forbes advised of the resignation of Finance Director
Tom Sanchez, effective September 28th, to accept the position of
Assistant Finance Director for the City of Daytona Beach. Mayor. Smoak.._ _
advised the resignation would be accepted with regrets, and he com-
mended Mr. Sanchez on his services while with the City. Mr. Sanchez
commented that he had enjoyed living and working in the City, but
felt this was a time for a career move.
WATER QUALITY STUDY
Mayor Smoak reported that the needed $30,000 in funding to pursue the
Interagency Water Study of water flow, quantity, and quality of water
in the Green Swamp had been realized, and the next step would be to
engage the services of a project coordinator who would Chair a
technical advisory committee composed of an individual from each of
the different agencies participating, coordinate the efforts of the
individual agencies, submit financial reports, and keep the public,
the Press, and the participating agencies informed as to the progress.
RECREATIONAL FACILITIES
Mayor Smoak reported on his appearance before the Lake County School
Board to request their participation in funding of the proposed
recreational facilities at the Clermont Middle School, and upon the
recommendation of School Superintendent Commander, they had
unanimously agreed to fund up to 50% of the cost of the project; That
he felt such action was a vote of confidence in the type of attitude
the Board holds, particularly after the initial joint venture at
the Clermont Grammar School; and, That he desired to publicly commend
the efforts of Councilman Cole and City Manager Forbes for their
pursuit of the matter in cooperation with, and in conjunction with,
Principal Cockcroft of the Middle School. He further advised that
Mr. Charles Beals, Clermont's representative on the School Board,
had been very helpful in his presentation to the Board.

COMPREHENSIVE PLAN
Mayor Smoak announced the first of two required Public Iicarings to
consider the Second Part; of the City's proposed Comprehensive Plan
which includes Conservation, Potable Water, Sanitary Sower, Drainage,
Intergovernmental Coordination, and Economic Feasibility; That
favorable reviews of the proposed elements had been received back
from the various regulatory agencies required to consider them, and
inquired if anyone present desired to address the matter, and there
were none. City Manager Forbes advised that summaries of the Plan
were available for public distribution, and that the second required
public hearing on the Plan would be held on September 25th during
the next regularly scheduled City Council meeting. Mayor Smoak advised
that through the efforts of the Lake County League of Cities in
negotiating with the County Commission on dual taxation, the County
Commission agreed to furnish to the Cities most of the planning
function, and a majority of the work on the Plan had been done by
the Lake County Planning Department which saved the individual cities
a considerable outlay in cash, and felt recognition was due that the
County Commission, again,has been very responsive to working with
local municipalities in trying to solve mutual problems.
COUNCIL VACANCY APPOINTMENT
Mayor Smoak announced that Council would consider for nomination any-
one present who desired to seek appointment to the vacancy existing on
the City Council; That Council members could nominate as many as they -----
chose; That each Council member will have two votes on each ballot;
and That the person to obtain 5 votes or a majority, will be selected
to serve on the Council until the next Regular General Election to
be held on December 4th at which time the seat would be up for election
for a one year term. Mrs. Ruth Ray, Mrs. Lucie Styles, Mr. H. James
Meginley, and Mr. Rufus Sullivan presented themselves to Council as
interested candidates. Following request from the Chair for nominations,
Councilman Schroedel nominated the aforementioned candidates. A
secret ballot was taken by Council and the tabulations were recorded
and accounced by City Clerk Carroll as follows: Meginley 5; Ray 2;
Sullivan 1; Styles 0. So Mr. Meginley was appointed, he was administered
the Oath of Office by City Clerk Carroll, and he assumed his seat on
Council.

PROPOSED EMPLOYEE PAY SCALE
City Manager Forbes reported on his written Memo to Council wherein
he advised that in a meeting with some of the City's employees on
Monday, they had expressed dis-satis faction with the proposed 7% pay
increase on October 1st, plus a proposed 1$ additional increase
if
merited on their respective anniversary dates due to the rise in the
cost of living at a rate higher than 8%, and their request that he
relate to Council their feeling that a 10% increase is warranted. Mayor
Smoak inquired of City Manager Forbes, that, after having researched
the anticipated budgetary increases, how the City stands with like
agencies in the area, and statewide, as compared with the results of
the Florida League of Cities annually published payroll guides. Mr.
Forbes advised that the cities in Lake County which he had contacted
were proposing increases between 7 and 10 percent, and the statewide
guide reflected that the city's wages, depending on the position, were
in line or slightly below other cities in our classification, and, that
some cities provide for longevity hikes which he would not be aware of.

Mayor Smoak advised of a Resolution as unanimously adopted by the
City Council on April 24, 1979 in support• of anti-inflation measures
as espoused by the President of the U.S., and he felt that the Council
had stated their position on the matter in their unanimous vote for
adoption. Councilman Cole expressed concern of the employees as
contacted him as to the proposed 10% increases for some employees
but not all employees. Councilman Byrd advised he felt there was
some misunderstanding by the employees as to what is provided in the
proposed budget regarding wages, such budget having been agreed to by
Council in the work sessions held to consider it, and in lieu of
changing the budget figures and beginning anew, he would be in support
of the budget as proposed. Councilman Schroedel advised he was in
agreement with the percentage increases as proposed. Councilman Cole
advised that he would be in favor of the 7% increase plus a 38 merit
increase on anniversary dates, as originally presented by the City
Manager, in order to cope with increasing inflation. It was the
opinion of Councilman Meginley, not having considered the matter pre-
viously, that the framework had been established in the budget work
session considerations,, but that the proposed budget could be amended.

ORDINANCES
Councilman Schroedel offered and moved the adoption of AN ORDINANCE
PROVIDING A BUDGET OF EXPENSES FOR THE GENERAL OPERATIONS OF THE
GOVERNMENT OF THE CITY OF CLERMONT FOR THE FISCAL YEAR OF 1979-8I AND
MAKING APPROPRIATIONS THEREFORE; PROVIDING A TAX LEVY ON ALL PROPERTY
IN THE CITY OF CLERMONT AT 4.50 MILLS, and the motion was seconded b
Councilman Meginley. The Ordinance was read for a second and final
reading by City Clerk Carroll, by title only, and upon roll call vote
on passage of the motion, the result was: Ayes: Schroedel, Byrd, Cole,
Meginley, and Smoak. Total Ayes: Five. Nayes: None. So the Ordinance
was adopted and the Number 121-M assi ned to it

The congregation of the First Baptist Church of Clermont
has a need for overflow parking of cars during the Sunday
morning services, primarily during the winter months.
To relieve our parking situation we hereby request per-
mission t❑ construct a One -Way Drive beginning at Fifth
Street south of our sanctuary continuing behind the building
and exiting on Montrose Street east of the newer educational
building. The driveway would facilitate grass parking for „I
approximately 44 cars as per the attached plans. - ---
Since the property slopes to the southeast we also need
t❑ construct a retaining wall to hold the dirt so we can
somewhat level the area for parking and overall beautification.
The retention areas should protect adjoining property owners
during periods ❑f heavy rainfall.

First Baptist Church, Clormont, Day Care usoage.
We request zoning to allow use of existing church facilities for the oper-
ation of a Day Caro Center. The center will be a part of the total min-
istry of the church, owned and operated by the church.
The Day Care Center will operate on a daily schedule from 7 A. M. to 6 P. M.,
offering care for children from six weeks of ago to six years old. In
addition, limited care will be provided for children in grades k-5, after
school. The Center will be open year round, five days per week, except
for major holidays.
TRAFFIC to and from the facility will be handled through .on street parking
on Montrose Street, adjacent to the church property, as well as by means
of the adjoining parking lots of the church.

COMMENTS: This is an existing church of many years, that has used
street parking on Montrose and Lake Avenue, both streets
having a 100' right-of-way. The church has no off-street
parking.
Church officials request that they be allowed to construct
this building without constructing any off-street parking.
They believe that since the addition will only be for a
library and administrative offices, no additional parking
demand will be generated.
PREVIOUS ACTION:
At their September 4, 1979 meeting, the Planning & Zoning Com-
mission voted to recommend that the request be granted with

There was much discussion at the P&Z meeting regarding the
fact that the Zoning Ordinance requires a buffer strip to be
planted along the rear of the building. Reverend Seitz
stated that the neighbors would not appreciate such a buffer
strip. A letter from a neighbor is enclosed.

Dear Mr. Forbes,
Mr. Jack Mathews, Senior Warden of St. Matthias
Church, tells us that the city council will be asked
to approve an addition to the church building next
Tuesday, September nth.
We think this proposed addition will be very nice
and we are happy that the church is able to do it.
Mr. Matthews also tells us that there is an ordinance
requiring a screen of bushes between the church property
and ours. Such a screen would block the view from our windows
and cut off a breath of fresh air for us. We would not
like it at all. We like it just as it is and ask you not
to require any changes.

Plan, and attached is a short summary of the elements of the Plan.
State Law requires that the City have two public hearings on the
Plan before it can be adopted by ordinance.
The Public Rearing dates as set by the City Council are next
Tuesday, September llth, and September 25th.

Drainage:
The Drainage Element involves the development of: adequate facilities
and legal mechanisms to control surface water runoff. Lake County has
developed detailed drainage studios for tho County.
Tile recommendations of the Drainage Elemont include:
1. Reviewing City regulations designed to control
surface water to insure that they are satisfactory.
2. Examine flood Plain Regulations to protect residents
from flood waters, and determine what, if any,
improvements would be necessary to control storm
water drainage.
INTERGOVERNMENTAL COORDINATION AND ECONOMIC FEASIBILITY ELEMENTS
Intergovernmental Coordination:
Intergovernmental Coordination as proposed by the Comprehensive Plan
is to insure the coordination with other units of local governments
in Plan preparation and implementation. This involves an open line
of communication with other governmental agencies, as well as insuring
citizen participation in our Plan.
Economic Feasibility:
Economic feasibility is an important consideration in any Comprehensive
Plan. Much of the recommendations in the Plan can be accomplished
through legal mechanisms and coordination as land use, housing, con-
servation, electric utilities, and intergovernmental coordination.
Insuring adequate water, sewer, drainage, and transportation will be
accomplished by a combination of capital expenditures and regulations.
The Comprehensive Plan recommends that the City consider long-term
capital improvements programs.

These elements are designed to insure that the City can continue to
provide adequate potable water supply, treatment- of sewage, solid waste
collection, and drainage.
Water:
The City water supply is provided by the Seminole and Grand Highway
Wells. The combined capacity of the wells is approximately three
million gallons per day. While these wells are adequate to meet the
City's present needs, the City's entire distribution system and future
well sites must be analyzed to insure that future water requirements
can be met.
In working towards this end, the City has and should continue to:
1. Schedule an engineering study of the water system.
2. Support the Regional "208" Study to identify sources
of bacterial contamination of the underground acquifer.
-- 3. Encourage conservation practices.
Sewer:
The Wastewater Treatment Plant was constructed in 1972. The design
capacity of the Plant is 600,000 gallons of flow per day. Currently
the Wastewater Plant is being operated under temporary operating
permits issued by the Lake County Pollution Control Department and
State agencies. In January, 1980, the City will be required to choose
a waste treatment alternative between land or marsh application of
treated effluent.
To assist us in making this decision, the University of Florida is
completing a two-year study on the marshland alternative that should
be complete by the end of September.
If the City continues to grow at its present rate, the peak 'daily
demand of the Treatment Plant will be approaching capacity around
1985. However, the Treatment Plant was engineered to allow an addition
to be easily constructed to double the design capacity.
Solid Waste:
The City of Clermont provides for twice weekly pickups of garbage
generated by households and small commercial establishments. About 60
commercial businesses are serviced by a private hauler, Dump -All, Inc.
of Orlando. Soild waste is disposed in a sanitary landfill on
Loghouse Road, one-half mile east on SR561. Lake County operates the
landfill which serves the South Lake County area.

The City of: Clermont's Compreiicns.ive Plan was prepared to meet the
requirements of the Local Government Comprehensive Planning Act of
1975. The purpose of the Comprehons.ivo Plan is to guide the future
development of the City, and a brief summary of the Plan is as follows:
LAND USE ELEMENT
The Clermont future Land Use Plan .is designed to facilitate the
development of land in areas best suited for development, and to
insure that these areas are subdivided according to minimum standards.
It discourages the use of land that is unsuitable for. development.
Towards this end, the Plan was developed to encourage a future land
use pattern that achieves the most appropriate balance of private
market factors, public interest, and preservation of natural resources.
Standards were developed for residential and commercial areas that are
based on distance from major streets, utilities, impact on City
services, development of surrounding areas, and environmental impact.
These standards are designed to insure that abutting land uses are
compatible, and will not create problems with the neighbors.
HOUSING ELEMENT
Based on an opinion survey of Clermont residents, the following over-
all housing goal was formulated:
"Provide for a full range of housing choices, located
in a suitable living environment for all incomes,
races, and life styles."
To carry out this objective, the City will:
1. Continue the systematic enforcement of building
codes and related ordinances.
2. Provide the full range of community services and
facilities to meet the needs of residents.
3. Require new residential developments to be con-
ducive to economical public services, and prohibit
construction in flood prone areas, except as specified
by flood regulations.
TRANSPORTATION ELEMENT
The major goal of the Transportation Element is to continue the develop-
ment of a major street system that insures safe and efficient transpor-
tation. This system must adequately serve commercial, industrial and
other omploymont arose. It must ,.jlso pron:oto an efficient future
land use pattern with a minimum disruption of existing land uses.
To work toward this end the City will:
1. I)iacourage through -traffic in residential areas.
2. Iligh traffic areas, such as commercial districts
and schools, should be served with properly
designed streets.
3. Adequate parking regulations should be strictly
enforced.
RECREATION ELEMENT
The goal of the Recreation Element is to encourage the development
of public recreational facilities, and the preservation of open
spaces in response to the needs of the community.
The City will meet this goal by improving and expanding existing
facilities where needed throughout the community.
The City Recreation Committee is presently working to implement this
goal.
CONSERVATION ELEMENT
The Conservation Element is based upon maintaining Clermont's assets
and resources in a manner that will benefit present and future
residents of our City.
To this end, the City will support policies to protect and improve
air quality, water resources, wetlands, natural habitats, environ-
mentally sensitive areas, soil resources, and agriculture.
Since the problems of conservation do not stop at the city limits, the
City will work with the County and other agencies to insure that the
natural resources of the community are not lost.
ELECTRIC UTILITIES ELEMENT
Florida Power Corporation provides electrical service to the City of
Clermont. The Electric Utilities Element is included to insure the
provision of reliable electric service to existing and future develop-
ments in Clermont.
This can be accomplished by cooperation between the City of. Clermont
and Florida Power Corporation to insure that:
1. Reliable sources of energy will be available.
2. The location of future electrical utilities will not
adversely affect land use patterns.

At the August 28th City Council meeting, the Council members
agreed that the selection process would work as follows:
A. Each Councilman has unlimited nominations;
D. Each Councilman will have two votes on each
ballot; and,
C. The person to obtain 5 votes or a majority
will be selected to serve on the Council
until the December election.
Section 11 of the City Charter states that "If a vacancy for
Seats 1, 2, 4, or 5 occurs within a six-month period prior to a
general election, the Council shall appoint a qualified person
to fill the vacancy until the general election, at which time the
seat will be up for election".
The City Attorney has reviewed the selection process and finds it
acceptable.

SUBJECT: Employee Wages
DATE: September 11, 1979
Yesterday at 8:00 a.m., I attended a meeting of the Public
Works Department employees. There was a problem in that
the men did not want to go to work until they had an oppor-
tunity to discuss with me the proposed pay plan for the
1979-80 fiscal year.
The men were upset that an employee had placed an article in
the paper that they were satisfied with the proposed cost of
living pay increases. The increases in the proposed budget
allow a 7% cost of living increase on October 1, 1979, and
they are eligible for a 1% merit increase on their anniversary
date.
The men stated that since the cost of living has increased at a
rate higher than 8%, a 10% pay increase is warranted.
They stated that they would not be satisfied with anything less
than 10%, and asked that this conversation be called to the
attention of the City Council.
