MINUTES
REGULAR MEETING
A Regular Meeting of the City Council of the City of Clermont was held in
the Council Chambers on Tuesday, August 14, 1979. The meeting was called
to order by Mayor Pro -Tom Byrd at 7:30 P.M. with the following members
present: Councilmen Honey, Schroedcl, and Cole. Other officials present
were: City Manager Forbes, City Attorney Baird, City Clerk Carroll.,
Building Official Nagel, and Chief of Police Tyndal. Others present were:
Miss Tracey Smoak; Mr.. & Mrs. Ben Blackburn, Mr. & Mrs. W. B. Perry, Mr.
and Mrs. Jerry Meilan, Mr. and Mrs. A. W. Schultz, Mr. and Mrs. Ralph
Roane; Mesdames Hunt, Hanks, Smoak, Mitchell, Rathwick, Shaw, Brice, Allison,
and the Messrs. Mcginley, Czech, Carroll, Fleming, Jones, Wilcox, Searles,
Johnstone, Reynolds, Jackson, Cantwell, Law, Boney, McMahon, Terry, Seitz,
Matthews, Harris, Shepard, Post, Evans, Belie, Thomas, Washuta, Tracey,
Neilson, and Kelley. A representative of the Sentinel/Star was also
present.
The invocation was offered by Councilman Byrd, followed by repeating of the
Pledge of Allegiance in unison by those present.
The Minutes of the Regular Meeting held on July 24, 1979 were approved as
written.
VARIANCE REQUEST
City Council, sitting as a Board of Adjustment, considered a request
by Mr. William A. Kelley for a Variance to Section 26-21 (E)(3)
(R-1 URBAN RESIDENTIAL DISTRICT -REAR YARD SETBACKS) of the Zoning
Ordinance in order to extend and enclose a patio on his property
located at 261 Edgewood Drive. Mr. Kelley appeared before Council
in support of his request, and advised that he desired to extend
and enclose an existing patio of sufficient size to accomodate
standard porch furniture, and in order to do so, it would be
necessary to penetrate the rear yard setback by 318". Inquiry was
made from the Chair as to anyone present who desired to address the
matter, and there being none, motion was made by Councilman
Schroedcl, seconded by Councilman Cole and unanimously carried
that the request be granted.
Continuing to sit as a Board of Adjustment, Council considered
a request by Mrs. Esther S. Fox for a Variance to Section 26-20
(C)(2) (R1A URBAN RESIDENTIAL DISTRICT -LOT WIDTH) of the Zoning
Ordinance in order to sell a vacant portion of her property as
a buildable lot. In the absence of Mrs. Fox due to illness, City
Manager Forbes advised that Mrs. Fox is the owner of Lots 6 and
7 in Clermont Heights Subdivision, with her residence being located
on Lot 7 and Lot 6 being vacant; That she desires to sell the lots
separately, but inasmuch as the vacant lot width is only 96 feet,
it would be necessary that a 4' variance be granted in order for
it to be buildable; and, That all other setback requirements could
be met. Mr. Forbes further advised that a variance for this same
request had been granted to Mrs. Fox in January, 1974, but she had
decided to not sell the property at that time, and the variance
had expired after one year. Following inquiry from the Chair as to
anyone present who desired to address the matter, and there being
none, motion was made by Councilman Schroedel seconded by Council-
man Honey and unanimously carried that the request be granted.
Still continuing to sit as a Board of Adjustment, Council con-
sidered a request by Mr. Ralph A. Roane for a Variance to Chapter
20-Subdivision, and Section 26-21 (C)(2)(R1 URBAN RESIDENTIAL
DISTRICT -LOT WIDTH REQUIREMENTS) of the Zoning Ordinance in order
to allow him to plat three lots with a building width of 73.3'
instead of the required 75' in Oakhurst Subdivision. Mr. Roane
was present in support of his request, and advised that each of

the three lots would have over 20,000 square feet and be at a
depth of 288 foot, which is substantially above that of Rl zoning
requirements, and, that all other provisions of the Ordinance
could be met. Following inquiry from the Chair if there be any-
one present who desired to address the matter and there being none,
motion was made by Councilman Hone seconded by Councilman
Sc roeco.. an unanimous y carr o t 1t t e request UL granted.
Mayor Smoak arrived at the meeting at this time and assumed the Chair.
CONDITIONAL USE PERMIT
City Council considered a request by Mr. Charles E. Arnett for a
Conditional Use Permit to utilize Building No. 3 in the Winn Dixie
Shopping Plaza at 731 East highway 50 in order to conduct church
services. The Reverend Darryl Jackson, representative of the
petitioner, appeared before Council to advise that they wished to
utilize the building to establish a district headquarters for the
Workers of the World Pentecostal Church which would conduct church
services, air radio programs, offer use of the building for a
social service center, and offer senior and youth group services
such as bridge games, bingo, and other like activities. Mr.
Richard R. Reynolds, owner of the Shopping Plaza, appeared in support
of the request, advising that he felt use of the building for
church services and other church related activities would be an -

asset to the building and the community as opposed to use of the
building for a roller rink, a disco dance hall, game room, etc.
which would be allowed in that location, and for which he had
previously refused numerous requests inasmuch as he did not feel
such uses would be compatible with the existing businesses in the
area; and, That in contacting all the existing tenants in the Plaza
regarding the matter, only a single tenant, the Sun Bank, had voiced
opposition at the P&Z Commission hearing. City Manager Forbes advised
of the Planning & Zoning Commission's recommendation following their
Public Hearing held on the matter on August 7th at which time they felt
the proposed location lends itself more toward a business/retail
district as presently exists, and thereupon recommended that the
request be denied. City Clerk Carroll read a communication from
Mrs. Mary P. Rook, an abutting property owner, in opposition to
the request. Mr. Ray McMahon submitted a photograph and written
description of a like facility as operated by the Workers of the
World Pentecostal Church in the Orlando area for Council's use in
their consideration of the matter. Mr. Jim Meginley, a member of
the P&Z Commission, expressed concern that the proposed use is not
to meet an existing need in the community inasmuch as they have
no existing organized congregation in the City. Mr. Meginley
further expressed concern as to the proposed function of the organi-
zation based on their request to utilize the building for church
services inasmuch as an on -site observation of their location on
West Colonial Drive in Orlando has revealed the advertisement for
Bingo in large bold letters as opposed to a small designation of
"Old Country Church", and his advisement of parking and traffic
problems created at another of their locations in the Eastland
Shopping Center in Orlando which he was fearfulof happening in
the City due to the increased seating capacity of the building
since its initial construction to house a Pharmacy. Councilman
Byrd opined that a church in the proposed business area location
is not required; That it would not be desirable in that location;
That, in fact, it might possibly be detrimental to the business
community in which it is sought to be located; and, That he would

LAND PILLING
Mr. William J. Bello of Lot 167 in Emerald Lakes Mobile Home Park
appeared before Council to solicit their approval of :Land filling
which he has completed along the shorolino of Lake Palatlakaha to
the rear of his residence, That the filling had been done without
benefit of proper permits as required by the State Department of
Environmental Regulation, and, That he had been notified that app-
roval must be obtained from the City Council for filling waterward
of the existing mean/ordinary high water line prior to any further
consideration of his after-thc-fact• application to DER. Mr. Bolin
further advised he had made the fill in order to level and raise
the sod level as the rear of his lot was waterlogged by the Palat-
lakaha Marsh. A copy of his Permit Application Appraisal was
submitted for Council's consideration, and it shall become a part
of these Minutes. Following consideration of the biological comments
as forwarded by DER, and in agreement with their recommendation to
a stipulation that no additional fill can be added to that which has
already been deposited and no material be deposited in the future
waterward of the line of ordinary high water to replace erosion,
it was the consensus of Council that the filling would have no
detrimental effect, whereupon motion was made by Councilman Schroedel,
seconded by Councilman Honey and unanimously carried that the
necessary approval be granted.
COMPREHENSIVE
City Manager Forbes advised of communication from the State wherein
they indicated that the proposed second part of the City's Comprehen-
sive Plan meets the State Law and they have no objections to the
Elements of the Plan; That it would not be necessary that public
hearings be held to allow the public to consider the Plan, and he
had set these dates to be September llth and September 25th.
SOUTH LAKE PLAYERS
City Manager Forbes advised of a request by the South Lake Players
for use of the Jenkins Auditorium at no cost for their next series
of plays in the new season. Motion was made by Councilman Byrd,
seconded by Councilman Honey and unanimously carried that the South
Lake Players be granted use of the Jenkins Auditorium for their
second season of plays under the same provisions as granted for the
initial season.
LAKE SHORE DRIVE
A communication was submitted to Council from Mrs. Catherine Rathwick
of 160 East Lake Shore Drive wherein she expressed concern to the
City's proposal for abandoning certain parcels of property between
Lake Shore Drive and Lake Minnehaha, and requested that a Public
Hearing be held prior to any action by the Council. Mayor Smoak
advised that due to the construction of the road, there are existing
city utilities on private property in several areas along Lake Shore
Drive, and in order to alleviate this problem the City is proposing
to negotiate Quit Claim Deeds between the City and adjacent property
owners for property on both sides of the street in an exchange
thereby adding to the ad valorem tax roll and relieving the City
from encroachment on private property. City Attorney Baird advised
that the pertinent information and instruments had been delivered
to the owners of the 12 parcels of property in question, and as soon
as they have been considered, executed, and returned, he would
submit the matter to Council for consideration. Mayor Smoak advised a
public hearing would be held at that time. He further suggested, and
Council was in agreement, that City Manager Forbes keep in contact
with Mrs. Rathwick as to progress in the matter.

WATER QUALITY STUDY STATUS
With regards the proposed comprehensive water study which was
initiated through the City of Clermont-, Mayor Smoak reported on
a very positive attitude todate from the various agcnclea which
he had contacted, committing themselves to either man hours or
financial assistance, and in some instances, both; That the Ok.la-
waha River Basin Board had committed $2000 to help fund a project
director, and the technical areas in which they will participate
will be forthcoming; That the City of Mascotte had unanimously
agreed to support the project on a priority basis, and had committed
$1500; That the Lake County Soil and Water Conservation District
had set- it up as their first priority and committed up to one-half
man year of Lime within budgetary constraints; That the Lake County
Pollution Control Board had set it as a number one priority and had
unanimously appointed Mr. Ted Wicks to serve on a technical advisory
committee within the agencies; That he had appeared before the City
of Minneola, who had elected to consider the matter further; and,
That he would be appearing before the Groveland City Council and the
Lake County Waterways Authority within the next week.
TRAFFIC CONTROL
Councilman Cole advised of a need for additional traffic control
signs in the Lincoln Park area, particularly for Speed Limit signs
on Bloxam and Highland Avenues, and East Desoto and Pitt Streets,
and, Stop signs on Disston Avenue and Scott Street. It was the
suggestion of Mayor Smoak, and Council was in agreement, that City
Manager Forbes be instructed to conduct a complete survey of the area
as to the adequacy of the signalization and signs, and report back
to Council as to his recommendations for rectifying any deficiencies
in that area.
RECREATION AND LANDSCAPE COMMITTEE REPORTS
Mayor Smoak expressed commendation to the Recreation and Landscape
Committees for their tremendous efforts in compiling special reports
of their findings and recommendations in those areas which will be
used by the City Council as a guide in decisions that relate to
parks and recreation facilities, and landscaping throughout the
City. Mayor Smoak introduced the chairpersons of those committees,
Mr. Dennis K. Thomas and Mrs. Arlene Hanks, who in turn introduced
the members of their committee, followed by an in-depth review of
their report which was well received by all present. Motion was
made by Councilman Byrd seconded by Councilman Schroedel and
unanimously carried that the reports be accepted, and City Manager
Forbes be instructed to proceed with working with the committees
closely to instigate implementation of the immediate and short term
objectives as recommended. Copies of these reports are a part of
these Minutes and are available to the general public.
CHAMBER OF COMMERCE
Mr. Phil Searles, Executive Director of the Chamber of Commerce
appeared before Council in support of the Chamber's request for
financial assistance in fiscal year 1979-80, and presented a
Resolution wherein the primary effort of the Chamber would be
directed toward increasing the economic base of the community,
and to support community activities, but not necessarily be the
primary sponsor. Mayor Smoak advised .that funding in the amount
of $5000 as request is included in the proposed 79-80 budget,
which he intended to support, but in order to more directly identify
and justify public funding to the Clermont-Minneola Area Chamber of
Commerce, he would request that a more closely working relationship
be established between the Council and the Chamber as to how the

funds are distributed. Mayor Smoalc opined that a mutual and of: the
Council and the Chamber .is to ach.icve growth in the community, but
to assure that such growth is with the retention of the character of
the community that the people in the community want retained.
SAFETY EQUIPMENT
City Manager Forbes advised that following an on -site safety
survey by a representative of the State Industrial Safety and
Health Division, communication had been received from the State
requiring that certain safety equipment for use in the Utilities
Department be obtained within 30 days; That the estimated cost
for the necessary equipment is $2100, and he recommended authori-
zation be granted to immediately purchase same. Motion was made

FLORIDA LEAGUE OF CITIES, INC.
City Manager Forbes advised of a request from the Florida League
of Cities, Inc. to designate a voting representative from the City
at the annual convention to be held in Kissimmee on October 25th
thru the 27th. Motion was made b Councilman Schroedel, seconded
by Councilman Honey and carried that Mayor Smoak be so designated.

Councilman Honey introduced AN EMERGENCY ORDINANCE OF THE CITY ----�-
OF CLERMONT, LAKE COUNTY, FLORIDA, ADOPTING THE UTILITIES FUND
BUDGET FOR TI1E CITY OF CLERMONT FOR THE FISCAL YEAR 1979-80;
AUTHORIZING RECEIPTS AND DISBURSEMENTS CONTAINED HEREWITH, and
the Ordinance was read for a first reading by City Clerk Carroll
by title only. Due to existing bond requirements that the Utilities
Budget be adopted 45 days prior to the new fiscal year, Councilman
Rvrd offered and moved the adoption of AN EMERGENCY ^ORDINANCE OF

the motion was seconded by Councilman Schroedel. The ordinance w
read for a second and final reading by title only by City Clerk
Carroll, and upon roll call vote on passage of the motion, the
result was: Ayes: Honey, Cole, Schroedel, Byrd, and Smoak. Total
Ayes: Five. Nayes: None. So the Ordinance was adopted the the
Number 120-M assigned to it.
Councilman Honey introduced AN ORDINANCE PROVIDING A BUDGET OF
EXPENSES FOR THE GENERAL OPERATIONS OF THE GOVERNMENT OF THE
CITY OF CLERMONT FOR THE FISCAL YEAR OF 1979-80 AND MAKING
APPROPRIATIONS THEREFORE; PROVIDING A TAX LEVY ON ALL PROPERTY
IN THE CITY OF CLERMONT FOR THE YEAR 1979 FOR THE GENERAL OPER-
ATION EXPENSE OF THE CITY OF CLERMONT, and the Ordinance was read
for a first reading by City Clerk Carroll by title only.

RESIGNATION
With deepest regrets, Councilman Honey announced his resignation
from the City Council, effective the last of August, due to his
relocation in the Jacksonville area. lie further advised of his
pleasure in serving on the City Council, and the splendid co-
operation afforded him by fellow members of Council and the City
Staff. Motion was made by Mayor Smoak that the resignation be
accepted with regrets, an' an appropr ate_pl�ue be obtained for
presentation to Mr. 11one command3n 1-im for his dedication, warK,
and services while serving as a member of the C t Council. The
motion was seconded by Councilman Byrd and carr ed._
There being no further business to be brought before the Council at this
time, the meeting was adjourned by Mayor Smoak at 10:50 P.M.

SPECIAL REPORT
LANDSCAPE' COMU TTEE

I . 1'uRl'OSR.
The Clermont Landscape Committee was appointed by the Mayor ns all independent advisory
committee for City lnndscaping projects. Specifically, the Committee was to review public
properties in the City of. Clermont, and Blake recommendations for landscaping projects.
The objectives of the Lnndscaping Committee were to make recommendations to the Clermont
City Council that will compliment the natural benuty of the City, and encourage Clermont
citizens to beautify their property.
The landscape Committee is composed of private citizens that are familiar with the
community, and have a background and interest in landscaping. Committee members included:
Chairman Arlene Hanks, Nancy Pederson, JnmeH Bissell, Noll Hunt, Oakley Seaver, Willis
Perry and Ethel Perry. This committee was appointed to obtain citizen involvement in the
decisions that will effect our community.
if. METHODOLOGY.
The Landscape Committee first reviewed the City's Creenseape Guide, and inventoried
public properties In the City to determine landscaping needs. Maps were prepared for each
member that showed publicly owned properties.
The Committee then conducted meetings with the County Forester, City Manager, and
Public Works Director. The County Forester advised the committee of plant selections,and
landscaping guidelines. The Public Works Director and City Manager showed the committee
the City nursery, and briefed members on City manpower, equipment, and watering constraints.
As a result of these meetings, the committee prepared the landscaping recommendations
discussed below.
III. RECOI-IMENDATIONS_
The Landscape Committee's recommendations include projects for the City and civic
groups. It is the belief of the committee that the City can, and should provide yearly
landscaping projects to beautify the City, and encourage civic pride. However, the
Committee also beliovus that calling proJeetn muvt: not rely ly on the City, but -

1) Landscape Citv Ilnll Aran.

2) Intrance Sians.
Tito entrance nignn will be replaced on Ilighwayu 50 and 27. The entrance signs
on East highway 50 would be moved to the median ou Highway 50 Just onst of the
Highway 27 overpass. Each entrance area will then be landscuped.
3) Trees on Highway 50.
Trees should be planted along Highway 50 where permitted by state regulations.
As a start, trees would be planted on public property on the north side of Ilwy. 50,
Just east of East Avenue. It was the consensus of the Committee that for the greatest
visual impact, Ilighway 50 should be the primary area for this year's landscaping pro-
jects. Most other public properties already are adequately landscaped, but need
better maintenance, such as trimming trees and plants.
4) Nursery.
The City should continue the present practice of potting seedlings each year and
planting them when rooted, on City property. Expansion of the nursery should be con-
sidered in the future.
5) Citizen Involvement.
Citizens should be encouraged to landscape their properties by continuing the

enforcement of City ordinances that require landscaping.
Public awareness of the values of landscaping could also be achieved by con-
ducting an Arbor Day promotion to be coordinated by the Landscaping Committee. Such a
program would include:
A.. Landscaping contest;
B. Distributing seedlings to Clermont residents;
C. Distributing copies of the CLERMONT GREENSCAPE GUIDE;
D. Landscaping classes;
E. Establish an Official City 'free

this reason, the City ohould continue a long-range Landscaping Program that includus:
A) A yearly program of funding Lwdactiping projects on nclected City propertica.
Such n program aumL take into connideratio❑ manpower, funding, equipment, and
watering constraints. Such a program would include an a minimum, planting trecrt
along public areas.
H) Civic organizations should also be encouraged to landscape and maintain
selected public properties.
7) Tree City, USA Program.
The City should fulfill the requirements to be recognized by the 'free City, USA
Program. This program is designed to recognize communitien that are effectively managing
their tree resources. To be eligible for n 'free City, USA award, n community must:
A) Have a legally constituted tree body (such ns the Public Works Dept. and
Landscaping Committee) charged with the responsibility of developing and adminis-
tering a comprehensive community tree program.
g) Have an ordinance that regulates tree planting, maintenance, and removal on
public property in accordance with accepted forestry principles.
C) have an active comprehensive community forestry program supported by a mini-
mum of $1 per capita public funds, exclusive of donations of labor and money.
D) Have a formal Arbor Day proclamation by community officials, and a public
commemorative tree planting on Arbor Day each year.
These standards were established so that Tree City awards could be made to communities
with working forestry programs. The award is not given just for pretty trees, but for a
program that uses trees to produce a healthy, beautiful environment.
Some nearby cities which have received the 'free City, USA award include Winter Park,
Pt. Lauderdale, and Orlando.

REQUEST: City approval of state application for filling land.
COMMENTS: Mr. Bolin has already deposited 72 cubic yards of fill
material along his 64 feet of shoreline at the Emerald Lakes
Mobile Home Park. He did this to extend his property
waterward since the rear of his lot was waterlogged by
the Palatlakaha Marsh.
This work was finished and completely sodded without
any of the proper permits. For this reason, the State
Department of Environmental Regulation (DER) is requiring
Mr. Bolin to receive the proper permits,or remove the
fill from his property.
The permit requires local comments on this project. A
copy of the application is enclosed.;.
RECOMMEN-
DATION: DER, recommends that this application be approved on the
condition that no additional fill be added.

LOCAL PERMITS
A permit frpm the local governing body is required for your
application to place fill below the line of mean high water
of coastal waters or ordinary high water line of lakes and
inland rivers.
Chapter 253.124, Florida Statutes, states in part:
11253.124 Application for f ding land. -
"(1) Any private person, firm or corporation desiring to con-
struct islands or add to or extend existing lands or islands
located in the unincorporated area of any county bordering on
or in the navigable waters of the state, as defined in
0253.12, by pumping sand, rock or earth from such waters
or by any other means shall make application in writing to
the board of county commissioners of the county wherein such
construction is desired for a permit authorizing such person,
firm or corporation to engage in such construction; provided
that where it is desired to construct islands or add to or
extend existing lands or islands within the territory of any
municipality such application for a construction or fill per-
mit shall be made to the governing body of such municipality.
"(2) In each instance the written application herein provided
for shall be accompanied by a plan or drawing showing the - .-
proposed construction and the manner in which said construc-
tion will be accomplished and also the area from which any
fill material is to be dredged if the proposed construction
is intended to be created from dredged material. In the
event the board of county commissioners or other authorized
body shall find that such proposed extension or filling of
land or such proposed dredging is not violative of any
statute, zoning law, ordinance, or other restrictions which
may be applicable thereto, that no harmful obstruction to
or alteration of the natural flow of the navigable water,
as defined in §253.12, within such area will arise from the
proposed construction, that no harmful or increased erosion,
shoaling of channels or stagnant areas of water will be
created thereby, and that no material injury or monetary
damg'e"C"adjoining land will accrue therefrom, the same
shall be granted to the applicant, subject to the approval
of the board of trustees of the internal improvement trust
fund, who shall have the power to approve, reject or issue;
provided, however, that prior to the issuance of such per-
mit, the board of county commissioners or other authorized
body shall determine whether the granting of* such permit
and the construction to be done pursuant thereto would inter-
fere with the conservation of fish, marine and wildlife or
other natural resources to such an extent as to be contrary

"(3) No construction permit shall be issued or approved until
the board of county commissioners or other authorized body
shall have obtained, at the expense of the applicant,a
biological survey, an ecological study, and, where deemed
necessaces, a hydro -

struction or dredging is wholly shoreward of a previously
established bulkhead line which was fixed after consideration
by the bulkhead authority of a biological survey and ecological
study previously made by the department of natural resources or
under its supervision in connection with the fixing of such
line or if the proposed construction or dredging is wholly
within lands or islands heretofore purchased from the board
of trustees of the internal improvement trust fund under
0253.12 and in the consummation of such sale the board had
before it a biological survey made by or under the supervision
of the department of natural resources.
"(S) Any riparian upland owner of land bordering on or in
the navigable waters of the state who desires to repair,
rebuild, replace, or reconstruct coastal structures in the
nature of seawalls, revetments, retaining walls, bulkheads,
or other similar protective structures installed upon his.
riparian upland, or who desires to restore such uplands
after damage by avulsion or by artifically induced erosion,
shall, before undertaking such project, obtain a permit for
such work from the board of county commissioners or
other
authorized body or from the governio

if the work proposed shall be within the territory of such
municipality. Such a permit shall be subject to the approval
of the board of trustees and shall not be valid without such
approval. The riparian owner making application for such a
permit may not be required to comply with 0253.122. A
biological survey and ecological study may not be required
if the proposed work lies at no greater distance than twenty-
five feet into the waters where such work is proposed from
the existing and established line of mean high water or
existing coastal structure. A permit issued under the pro-
visions of this subsection shall not be construed to allow

may be subject to the provisions of chapter 161."
Action cannot be taken concerning fill permits by the Board of
Trustees until such time as evidence is received showing the
city or county commission granted a permit pursuant to thin
statute.

REQUEST: Uttlize existing building in order to conduct church services.
COMMENTS: The Pentecostal Church wishes to use this building for Sunday church
services and a radio program. The Church will also use the building
for a nocia.l service center; senior and youth group services; bridge
games, bingo and other like activities.
Section 26-87 of the zoning ordinance states that conditional use
permita may be granted if it is found that:
1. The proposed use is desirable at the particular location.
2. Such use will not be detrimental to the health, safety, or
general welfare of persons residing or working in the
vicinity.
3. The proposed use will comply with the regulations and
conditions specified in the code for such use.
4. Granting of the conditional use permit will not adversly
affect the officially adopted comprehensive plan.
I would suggest that if this CUP is approved, that it be done on the
following conditions:
1. The old Webb Pharmacy sign be taken down that is on the building
that the Church will be using.
2. A 6' high wood privacy fence be constructed across the rear of
this building to conform with the site plan provisions. The
original site plan for this building required buffer landscaping
across the rear of this building. Since this landscaping has not
been maintained, a fence should be required to buffer the rear of
this building from residential uses.

ACTION: Planning and Zoning Commission meeting - August 6, 1979
Recommended that the request be denied inasmuch as the proposed use is
not desirable at this particular location.
At the P&Z meeting, there were many questions as to the appropriateness
of this use at this location. I would suggest that if possible, the
church's other locations, the "Pillar of Truth" at 6106 E. Colonial .
Drive, and the "Old Country Church", at 6100 W. Colonial Drive, be
investigated by Council members prior to the consideration of this request..;`

The promise❑ will house 'the Clermont Country Church and from it
the church will air a radio program via area radio stations. These
programs may be aired live or protaped. A congregation will usually

Clermont City Council:
Attached please find a photo of the Commorcial
Building, housing a Church, that will hold services as wall as gamos
and Bingo, to be open to their congregation as well as the general.
public.
Inside, the largo room will oast appx 350 to 500
persona to play games, dine or other activities, that do not need tho
seats to face towards the speaker. The seats face east and west, while
the speaker faces towards the north. Building is amplified.
There is no visible sign of religious, pictures,
forms, statues, papers or booklets to the eye, necessary to carry on
a Church !-�ervico.
There is a sign on the roof of the building, "Old
CountX7 Church". (This is not tyre name of the Church holding services
and games)
Pictures were taken of the inside, but failed to
be bright enough to offibr for your observation. (Can be identified as
of long tables and seats present)
There are other stores in this facility, and more to.`'.
follow, however the space allotted them for parking in front, would allow
appx 20 vehicles, they probably have use of the entire parking area, a
total of several hundred maybe.
The above mentioned Church Group, recently applied
to the Park and Planning Board for occupying a building in a local shop—
ping center.
It is a known fact, that a person may get a certif—
icate o£"Preacher" Minister" etc without any problem, schooling, knowledge
of the ministry etc, simply by applying through the many cheaper magazines
published throughout the country, and/paying a small fee.

We have received comments from the State and other agencies regarding
the second part of the city's Comprehensive Plan.
The State indicates that the proposed plan meets the State Law, and
that they have no objections to the elements of our plan. A few
comments were offered by the St. John's Water Management• District and
the East Central Florida Regional Planning Council, which are attached.
Also attached is a copy of my proposed letter in response to these
comments.
The City must now set two public hearing dates to allow the public to
consider our Plan, after which it can be adopted by ordinance.

Thank you for your comments regarding the City of Clermont's proposed
Comprehensive Plan.
Pursuant to Florida Statutes, the following reply is made to the
comments of the following agencies:
A. ST. JOHNS RIVER WATER MANAGEMENT DISTRICT.
1. The area covered by the public water supply system is
basically the city limits of the City of Clermont, maps
of which are enclosed in the Comprehensive Plan.
2. The City recognizes the fact that the use of the
Palatlakaha Marsh for tertiary treatment requires
state and federal regulatory approval, and we are
working towards that end.
B. EAST CENTRAL FLORIDA REGIONAL PLANNING COUNCIL.
The Conservation and Drainage sections of the Com-
prehensive Plan reflect local as well as county needs.
Since the problems of conservation and drainage do not
stop at the city limits, the City has coordinated its
efforts with the County in an effort to achieve some
county -wide consistency, as well as reflect local goals.
The City is a member of the "208" Water Quality Program
and supports their objectives.
Public hearings on the Comprehensive Plan have been scheduled for
September 11 and September 25, 1979.

Sanitary Sewer Solid Waste Drainage Potable Water Element
1. While the area covered by the public water supply system is described
verbally, a map outlining the areas of service would bephelpful.
2. Concerning the use of the Palatlakaha Marsh for tertiary treatment,
the town should be made recognize that state and federal regulatory agencies
have been unwilling to create rules for the implementation but they support
its use on a case by case basis.
It should be noted that this review by the District staff is advisory in
nature and does not have any bearing on the disposition of possible future
permit applications that may be required as per Chapter 373, Florida Statutes.

Dear Mr. Forbes:
Pursuant to the requirements of the Local Government Comprehensive
Planning Act of 1975 (I1.0. 782), this office has completed its review
of the subject plan and offers the following comments and recommenda-
tions for your consideration:
1. The Comprehensive Plan for the City of Clermont
appears to be generally in conformance with the
East Central Florida Regional Planning Council's
adopted plans, programs, and policies.
2. The Conservation Element appears to be oriented
towards a countywide assessment rather than city
specific. The recommended policy statements
within the element represent a comprehensive
base from which to proceed with plan implementa-
tion. Flowever, if policies are to be effective,
they should be formulated as a result of local
needs.
3. The drainage section of the Public Services Element
fails to address the local situation much in the
same manner as discussed in Comment No. 2 above.
Also, it does not appear that the results of area -
wide water quality planning conducted in conjunction
with the 208 program were considered in the formu-
lation of long-term drainage strategies.

As you may recall, it our .initial workshop meeting monies were budgeted
for safety equipment for sewer plant personnel. This equipment includes
an emergency oxygen inhalator, harness, pressure demand air pack, and
gas detector. This equ.i.pment• is needed to work in the dangerous environ-
ment of sewer gasses. -'
On July 20, 1979, a Safety Inspector from the State of Florida performed
a safety inspection of the City and found that we had none of the above -
safety equipment. The State has given the City only 30 days to correct
this situation.

For this reason, I recommend that the City Council allow the Utility !-
Department to immediately purchase the above equipment.
The estimated total purchase price for all of the above items is $2100,
and I have taken this equipment out of the proposed budget.

Item 1 38C-43.03-1928.57(b)(1)(i) All power take -off shafts,
including rear, mid or side -mounted shafts shall be
guarded either by a master shield or by other pro-
tective guarding.

The following are the Hazards observed during the on -site consultative
survey conducted at your establishment on July 20, 1979, and discussed
with you at the closing conference:
Item 1 CFR 1910.24(h) Standard railings shall be provided on
the open sides of all exposed stairways and stair
platforms.
..'A standard railing or heavy duty safety chain shall be
used to guard the opening leading into the comminutor.
Item 2 CFR 1910.106(g)(8) Conspicuous and legible signs
prohibiting smoking shall be posted within sight of the
person using the city gas pump.
A "No Smoking" sign will be posted on/or near the city
gas pump.
Item 3 CFR 1910.106(g((3)(iii) The emergency power cutoff
,_AL for the city gas pump shall be clearly identified to
facilitate cutoff in case of emergency.
Item 4 CFR 1910.134(f)(2)(ii) Self-contained breathing ap-
paratus shall be inspected monthly. Air and oxygen
shall be fully charged according to the manufacturer's
instructions. It shall be determined that regular
and warning devices function properly.
The Scott Airpac located at the Waste Water Treatment
plant shall be inspected monthly and a record shall be
maintained of inspection dates and findings.
Item 5 CFR 1910.157(d)(2)(i) All city fire extinguishers shall
be inspected monthly or at more frequent intervals when
circumstances require to insure that they are in their
designated places, to insure that they have not been
actuated or tampered with and to detect any obvious
physical damage, corrosion or other impairments.
Item 6 CFR 1910.157(d)(3)(i) At regular intervals not more
than one year apart or when specifically indicated by
inspection, fire extinguishers shall be thoroughly
examined and/or recharged or repaired to insure opera-
bility and safety; or replaced as needed.

1. PURPOSE:
The Recreation Committee was appointed by the Mayor to inventory the City's
recreation facilitien, and analyze their adequacy. The Committee wan also to deter-
mine City residentu vn. non -City ronidants use of sueh facilities', and recommend
policiea to improve the recreation progrnnin in Clermont.
Recreation Committee members: appointed were: Chairmnn Dennin Thomas, Beth
Allison, Adolphos Church, Ray McMahon, Cernld Shepard, and Mary Shaw.
The objective in appointing the Recreation Committee was to obtain citizen
involvement in community affairs. It is believed that not only improved decisions,
but a better community results when citizens are involved in the decisions that
affect them.
II. METHODOLOGY:
The Committee first reviewed the City Comprehensive Plan to analyze existing
facilities and obtain a general review of recreation planning. The Committee believed
that the best way to analyze city recreational facilities was to conduct an in-depth
survey to obtain local input on Clermont's recreational needs.
Two surveys were conducted. One on Jaycee Beach and a General Recreational
Survey. The Jaycee Beach Survey was conducted on June 16th and 24th, 1979. The
General Recreational Survey was published in the June 14th SOUTH LAKE PRESS, and
June 28th SENTINEL STAR. Committee members also distributed questionnaires to service
clubs and local groups, and made every effort to reach all interested citizens.
The results of the surveys were encouraging: 228 Clermont citizens responded
to the General Questionnaires, as did 73 non-residents. The tabulated responses to
each survey question are shown in the appendix to this report.
III. BODY OF REPORT:
A. Existing Recreational Facilities. The survey responses showed that the

fair (44%) with 22% responding they aye good and 217, atnting they wore poor or didn't
know. Individual existing facllltios that ranked vary Ihlgh were the bancbnll fleldn,
Lennie courts, fishing pier, and ahuf.fleboard courts. ExlntLng facilition rated fnLr
included Jaycee Beach mid the bent rump. P•acilitics that rated poor were youth pro-
grams, open spaces, outdoor basketball courts, and West Beach.
B. Jaycee and West Bench. The Jaycee and West Beach surveya were conducted
by interviewing people on the benches.
The majority of those interviewed on Jaycee Bench (over 50%) believed that
this facility was good, while the majority at Wcst Beach (79%) believed It to be fair.
The most common crltisism of these facilities were the poor condition of
the washrooms, need for trash receptables, more supervision, and that the restaurant
is in poor condition with flexible prices. Also, a large percentage at both beaches
! stated that they would be willing to pay a small entrance fee to pay for bench
" maintenance.
Of those at the Beach, 76% were from Orange County, 13% from lake County,
and the rest from other counties. Two percent (2%) lived :In the city limits of Clermont.
C. New facilities needed. Questions regarding new facilities needed that
ranked high were: parks and open spaces, beach facilities, basketball courts, teen
center, and ball diamonds. In addition, a large number of respondents indicated a
need for handball and racquet ball courts, a recreation director, summer programs,
children's playgrounds, and a swimming pool.
Interestingly enough, 47% of those responding stated they would be willing

to pay a small fee or additional taxes, if necessary, to construct these facilities.
Only 15% responded NO and the remainder did not answer the questions.
IV. RECOMENDATIONS:
After a thorough review of City recreation facilities, and the survey results,
the following long and short term objectives are recommended:

city parks is that much of tile. land contnins no facilities or identification, and
citizens are not even aware that it Is public property. For this reason, it is recom-
mended that city park identifications signs be placed on public property, rind that
recreational facilities be constructed nt the following locations:
1) orange Hill - 'rhe City owns two pnrks In thin area, one on Tower Street,
and one on North Street. Thene nre small properties that should be
developed as piny lots and picnic areas.
2) Sunnyside Lake - The property at the corner of Pine and Sunnyside Drive
should be developed with picnic benches and a play lot.
3) City property between Magnolia and Seminole, and Holly and Fourth Street
should be developed with picnic tables, small basketball court, and
possibly handball/racquetball courts or soccer field.
B. Improve Existing Fncilities.
1) Beaches - Both Jaycee and West Beach must be kept free of trash slid the
restrooms kept cleaner. Trash cans should be placed on the beach, and
Police patrol whenever possible. Provide additional picnic areas and
recreation facilities (i.e. handball courts, etc.) at the beaches.
Weeds should be cleaned out of West Beach, and casements or right-of-way
for access to West Beach obtained.
2) Resurface Kehler Park tennis courts.
3) Baseball and Softball - Before each season, all leagues should meet to
discuss scheduling to avoid conflicts.
C. New facilities or programs.
1) Construct recreation facilities (i.e. combination tennis/basketball courts,
softball field) in the Lincoln Park area.
2) Purchase a pool table for the Senior Citizen's Center.
3) Begin a Summer Youth Program with daily activities to be sponsored by area
civic organizations in 1980. The City presently has no summer youth

program. Many .Ivities nurh all bowling, swimrt, lessons, dnncon, tannin
lessons, basketball tournaments, field trips, noccer leagues, and n host
of other activities could be run for our children and teenngern. The
needs and interests of the children and tecaegern should be surveyed before
the program begins. Service clubs, sororities, and other groups could
sponsor one or two activities that would be coordinated by joint meetings
of representatives of civic organizations and the City.
D. Peen.
1) Jaycee Beach - The Committee believes that a small fee should be charged
to use Jaycee Beach. The fee should be in the vicinity of 509 for
adults and 25C for children, and should not apply to Clermont residents.
(Clermont residents include persons that reside in the city limits or
own property within the City of Clermont.) It is recommended that a fee
be charged, and that the City Manager further investigate this matter
with the City Attorney as to its feasibility.
2) Charge fee for boat ramp of $1.50. A100
3) Baseball programs - It is recommended that a fee for adult softball of
$10 be charged for non-residents. Little League and Babe Ruth programs would
not be charged, since they already pay fees, part of which goes to park
maintenance. An investigation of the baseball programs found that
approximately 50% of the players are non-residents.
Long Range Objectives - within 5 years
A. Purchase a minimum of 20 acres of land for an outdoor recreation com-
plex to include as a minimum, two softball diamonds and other recreational
facilities as discussed below.
B. Provide in an outdoor recreation complex or other City property, the
following facilities as soon as feasible:
1. Basketball Courts
2. Tennis Courts
3. Handball Courts
4. Shuffleboard Courts

V. CONCLUSION:
The above long and short• term objuctiven should not he considered as final
or exclusive, but rather as a composs to guide the Clty Council and Staff in decisions
that relate to perks and recreation facilities. We believe that the implementation
of Lha above objcctivon would greatly improve Lhe parks and recreational opportunities
in Clermont.

As you may be aware, the City Recreation Committee was appointed by
the Mayor to analyze the adequacy of the City's recreation facilities.
In order to complete this task, the Committee conducted citizen surveys
on the recreational needs of the City, and has prepared long and short
term recommendations for the City Council's consideration.
One of the recommendations of the Committee involves youth programs. ---..:.------'-
Most of our citizens identified summer youth programs as one of the most
important needs of our younger'citizens. We believe that with the City's
and other organizations support such as yours, summer youth programs
could be organized and in operation by the summer of 1980.
I would like to personally invite you and members of your organization
to attend the Public Hearing on the Recreation Committee's recommendations
for the City. This hearing will be held at 7:30 P.M. on August 14, 1979
in the City Council Chambers, located on the corner of West Avenue and
DeSoto Street (the Police and Fire Department building).

which dead ends at the South boundary of this proposed subdivision. All other
provisions of the ordinance can be met.
Seven (7) copies of all necessary floor plans, plot plans, and other pertinent infor-
mation are attached hereto, on paper size 83z' x 14" minimum size.
I submit that I qualify for this variance because I have an exceptional and unique
hardship on my particular parcel of land that is not shared by property owners in my area.
A strict application of the zoning ordinance deprives me of the reasonable use of my land
and the granting of this variance will not alter the essential character of the area.
I have been notified that this Variance Application must be filed with the City Clerk

Seven (7) copies of all necessary floor plans, plot plans, and other pertinent infor-
mation are attached hereto, on paper size 811" x 14" minimum size.
I submit that I qualify for this variance because I have an exceptional and unique
hardship on my particular parcel of land that is not shared by property owners in my area.
A strict application of the zoning ordinance deprives me of the reasonable use of my land
and the granting of this variance will not alter the essential character of the area.
I have been notified that this Variance Application must be filed with the City Clerk
no later than 5:00 P.M. on Friday, two (2) weeks prior to the Council meeting at which time
Variance will be considered. I also understand that when any variance is granted, construction
of the structure must be completed within one year from date of grant.
