on Tuesday, May 22, 1979. The Im'etIag will, called to order. at 7:30 P.M. by Mayor. Claude E.
Smoak, Jr., wLth the following members present: Councl.l.men Byrd, llonuy, and Cole. Other
officials present were: City Manager Forbes, city Attorney Baird, City Clerk Cnr.roll, Finance
Director Sanchez, and Chief of police Tyndal. Others present were: Mrs. Sarah Corbett, Mr.
and Mrs. Dan .Judy, and the Messrs. Czeeh, Sargent, Smith, McKccn, and McMahon.
The Invocation was offered by Councilman Byrd, followed by repeating of the pledge of
Allegiance In unison by those present.
The Minutes of the Regular Meeting hold on May 8, 1979 were approved as written.
PUBLIC HEARING
Council, sitting as a Board of Adjustment, considered a request by Dan II. Judy for a
Variance to Section 26-26 (E)(3)(MI LIGHT INDUSTRIAL DISTRICT - REAR YARD SETBACKS) of
the Zoning Ordinance in order to construct an equipment shed on his property described
as Lots 1, 3, 5, and 7, in Block 112 of Sunset Park Subdivision that would penetrate
11'4a into the required rear yard setback. Mr. Judy appeared before Council in support
of his request, and advised he was making such request in order to salvage a large row
of trees that exist along the back line of his property and serve as a buffer between
his industrial zoned property and the abutting residential area. Inasmuch as the
proposed construction would not be totally enclosed, and the immediate abutting property
to the East is zoned residential, City Manager Forbes advised of a required buffer strip
that would be necessary should the request be granted. He further suggested that such
buffer strip could easily be accomplished in that location with the placing of privacy
slats in the already existing chain link fence along Loth Street. Inquiry was made from -
the Chair as to anyone present who desired to address the matter, and objections were
made by Mrs. Sarah Corbett and Mr. harry McKeen who expressed concern that such proposed
construction might be utilized for auto and equipment repair work such as already exists
in the area and which is obnoxious to abutting residents due to loud noises extending
to late hours at night. Mr. Judy advised the building would be used for shelter of
his plumbing equipment. Mayor Smoak advised that the utilization of Mr. Judy's property
was in conformance with its M-1 Light Industrial Zoning Classification, but inasmuch as
It abuts residential areas, he suggested that Mr. Judy investigate the complaints as
reported to be emanating from his rental mini -warehouse. There being no further comments
on the matter, motion was made by Councilman Honey, seconded by Councilman Byrd and
unanimously carried that the request be granted.
USE OF HIGHLANDER HUT FOR CHURCH SERVICES
Pastor Vernon L. Smith appeared before Council to request the use of the Highlander Hut
for regular church services on every Sunday from 9:00 a.m. to 12:00 noon and 6:30 p.m.
to 8:30 p.m. for up to one year. There was no objection by Council to the proposed
use of the building, but inasmuch as the building had been donated to the City primarily
for recreational and civic organizational purposes, they did not feel it would be in
the best interest to tacitly lease the building for long term religious purposes, but
were agreeable to such use as the existing scheduling procedure provides.
Inasmuch as the existing rules for use of the building for formal religious services
requires advance approval of City Council, motion; was made by Councilman Byrd, seconded

WASTEWATER PLANT
City Manager Forbes reported on his and Councilman Byrd's appearance before the Lake
County Pollution Control Board to request approval of the City's Compliance Schedule
and another zero discharge variance; That the Board had agreed to grant the City a 6
month variance; and, That in a recent contact with Mr. William Bostwick of the Department
of Environmental Regulation Water Engineering Section, he had been advised they would be
recommending approval of a one-year temporary operating permit for the wastewater treat-
ment plant.

LAKEVIEW HILLS SUBDIVISION
City Manager Forbes reported that considerable damage hold been clone to the uncompleted
construction work in the Lakeview 11111s Subdivision no it result of. the recent heavy
rains, and following an inspection of: the property by h:Lnujalf sad Mr. Sampson of
Springstead and Associates, Inc., in conjunction with the Project contractors, they had
requested that all new construction work on the project be ha.ltecl subject to rehabilitation
of damage done to existing work.
CHAMBER OF C=IERCE
City Manager Forbes advised of a request from the Chamber of Commerce for the City's
support in their request to the County Commission for paving portions of Mohawk Road
east of the Citrus 'Power to assist in attracting industry to the Clermont/Minnoola area.
There was no action taken on the request following reportof Mayor Smoak that tile entire
area in question is zoned for Agriculture excepting the small parcel where Mobilplacer
is located, and, there is disputed land ownership along the existing clay road west
from Mobilplacer to Grand highway, which would prevent the County from paving that portion
until such time as the right-of-way dispute is resolved. It was the suggestion of Mayor
Smoak to Chamber President Sargent, that a proposal be drawn and studied for use of that
area as an indistrual base prior to approaching the County Commission regarding paving,
and to encourage cooperation of the Town of Minneola who has adjacent city limit boundaries'
to the area as well as the City of Clermont.
JACKSON vs CITY OF CLERMONT
Mayor Smoak inquired of City Attorney Baird as to the status of the suit filed against
the City following an accident at West Beach. Mr. Baird advised the last pleadings which
were filed with the court were interrogatories and motions to produce, which have been
filed, but that the plaintiff had not pursued the matter for the past 2 1/2 months.
LAKE SHORE DRIVE RIGHT-OF-WAY STATUS
Mayor Smoak inquired of City Attorney Baird as to the status of the Lake Shore Drive
right-of-way, and he advised of a delay due to the way the road had been constructed
requiring a wider right-of-way, on some lots. He further advised that he would meet with
Utilities Director Davis within the next few days to determine the extra footage needed,
and submit a proposal for Council's consideration at the next meeting.
SURPLUS PROPERTY
Finance Director Sanchez advised that the City's surplus equipment had sold for $3275 at
the combined Clermont/Leesburg/Lake County auction held in Leesburg on May 19th, which
he felt was considerably more than if offered at sealed bid.
MARSHLAND STUDY
Mayor Smoak reported that the preliminary report on the marshland study is expected to
be ready by June 15th at which time a meeting will be called to review the report with
the researchers.
GREEN SWAMP
Mayor Smoak advised of a second inter -agency meeting of the various regulatory agencies
concerning Green Swamp water quality, quantity, and direction of flow to be held in the
Council Chambers on Thursday, May 24th at 1:00 P.M., and he urged that Council members
attend if possible.
�RUBBISHCOMPLAINTS
Councilman Cole advised of complaints received regarding an excessive amount of trash
and rubbish concentrated in the area of 540 East Minneola Avenue where the house recently
burned and is being torn down, and, in the vicinity of the Roane Apartments on East
Desoto Street.' The matter was referred to City Manager Forbes.

LAKE CORRECTIONAL LNSrI_TUTION
City Manager Forbes advised of an Inquiry from off.icLaln of LCI regarding the possibility
of the City treating and disposing of the institution's sewage due to their existing
disposal point having been declared non -acceptable by the regulatory agencies, and he had
informed them that this would be impossible at the present time due to existing problems
with the C1ty's effluent disposal. City Manager Forbes inquired of Council's desire to
have the City Engineer meet with LCI's engineers to discuss the possibility of such a
proposal in the future, and it was their determination that it would not be feasible
due to the distance involved, and the probable need for expansion of the plant in the
not too distant future to satisfactorily serve City users.
STATE ROAD 50 TRUCK 'TRAFFIC
Councilman Honey reported on concern expressed by several citizens regarding speeding
trucks on State Road 50 and their dis-obeyance of the traffic signals, and that he had
personally observed such action several times in the past few days. Mayor Smoak advised
of his observation also, and thereupon moved that City Manager Forbes be requested to
communicate with all the known trucking companies that regularly utilize SRSO through
the Citv stating to them Lhe problems as have been observed in the City and notifying
them Chat all speed limits and laws within the City will be strictly enforced, and
repectfully request a written response The motion was seconded by Councilman Honey
and unanimously carried. It was the further suggestion of Mayor Smoak that a Police
Officer be present at the East Avenue/State Road 50 intersection during the hours it is
used by children going to and from the schools. The matter was referred to City Manager
Forbes in conjunction with Chief Tyndal.
REQUEST FOR QUIET ZONE
City Manager Forbes advised of a request by the South Lake hospital Administrator for a
quiet zone to be placed a block from the hospital in all directions with appropriate
signs; and it had been the unanimous recommendation of the Planning and Zoning Commission
at their meeting held on May 1st that the request be granted. Motion ^was ^made by Mayor
the appropriate signs.

City Manager Forbes advised of the following sealed bids received for drapery and carpet

required by the State prior to official adoption, it would be necessary to request an
extension. It was the suggestion of Mayor Smoak, and Council was in agreement, that
City Manager Forbes be authorized to communicate with Cho proper State agency, formally
requesting an extension and slating the City's formal plan will be submitted prior to
the July I deadline, and the reason for Cho request being that the City will not have
received back Clio State comments by that time.
FISCAL YEAR 79-80 BUDGET PRIORITIES
Mayor Smoak advised of the following projects that have been discussed previously for
consideration in the 79-80 budget:
1. Tennis Court renovation
2. Replace sidewalks on the south side of the Elementary School
3. Landscape Plan
4. A fence between the basketball court and school building
at the Elementary School
5. Combination tennis/basketball court for the Lincoln Park
area to be located at the Middle School
and he urged that Council communicate any other projects they desire to be considered
to the City Manager prior to the initial budget workshop meeting.
CLERMONT/GROVELAND AIRPORT
City Manager Forbes advised of a communication from Engineer M. J. Martin of the Florida
DOT wherein he advised of their attempt to update the Florida Avaition System Plan, and
requested a response from Council as to their desire for retention or deletion of the
new planned Clermont/Groveland area airport in the FASP. Motion was made by Councilman -

CITY ENGINEER FEES
City Manager Forbes advised of a request by Springstead & Associates, Inc., the City's
consulting engineers, for a revision to their existing contract of February 28, 1977 to
provide for the addition of two classifications between Professional Engineer and - -
Design Draftsman as follows:
1. Engineer at $25.00 per hour
2. Engineering Technician at $22.50 per hour
in order to delegate responsibilities to them for a greater efficiency in serving the
City, that were previously required by the Professional Engineer; and, That he recommended
approval of such revision. Motion was made by Councilman Byrd seconded by Councilman
Cole and unanimously carried that the City Manager's recommendation be accepted.
CIVIL DEFENSE DIRECTOR
Mayor Smoak advised of a request from the Lake County Emergency Services Department for
the appointment of a Civil Defense Director to fill the vacancy created following the
resignation of Gordon Tiffany, former City Manager. It was the suggestion of Mayor
Smoak, and Council was in agreement that due to the continuing heavy work load in the
office of the City Manager, and the desire for a fully activiated civil defense plan,
that City Manager Forbes be appointed to serve as Interim Director, and a concentrated
effort be made to find a volunteer willing to accept the appointment that could devote
the necessary time to fully activate a plan.

barrier to be provided on the south nick of hin parking lot, and which was indicated on

Councilman Honey offered and moved the adoption of A RESOLUTION OF THE CITY OF CLERMONT,
FLORIDA GRANTING A CONDITIONAL USE PE[tP'IT TO ALLOW THE CONSTRUCTION AND OPERATION OF
A MINI WAREHOUSE STORAGE FACILITY and the motion was seconded by _Councilman Cole and
unanimously carried. The Resolution was then read by city Cleric Carroll by title only,
and the Number 330 assigned to it.
Councilman honey introduced AN ORDINANCE UNDER THE CODE OF ORDINANCES OF THE CITY OF
CLERMONT, FLORIDA, AMENDING THE OFFICIAL ZONING MAP; REZONING THE REAL PROPERTY
DESCRIBED AS LOTS 4, 5, and 6 IN HIGHLAND TERRACE SUBDIVISION FROM TIS EXISTING R-1
ZONING CLASSIFICATION TO R-2 ZONING CLASSIFICATION, and the Ordinance was read for a
first reading by City Clerk Carroll by title only.
There being no further business to be brought before the Council at this time, the meeting
was adjourned by Mayor Smoak at 8:50 P.M.

My appeal to your Board is based on my contention that this decision creates a
hardship on me for the following reason, or reasons:
Due to a row of large trees along the back line of this property, a
back entrance is not possible, and to use the present entrance of
Desoto Street, the twenty five foot setback would make most of the rear
storage area inaccessible.
Seven (7) copies of all necessary floor plans, plot plans, and other pertinent infor-
mation are attached hereto, on paper size 81j" x 14" minimum size.
I submit that I qualify for this variance because I have an exceptional and unique
hardship on my particular parcel of land that is not shared by property owners in my area.
A strict application of the zoning ordinance deprives me of the reasonable use of my land
and the granting of this variance will not alter the essential character of the area.
I have been notified that this Variance Application must be filed with the City Clerk
no later than 5:00 P.M. on Friday, two (2) weeks prior to the Council meeting at which time
Variance will be considered. I also understand that when any variance is granted, construction
of the structure must be completed within one year from date of grant.

REQUEST:
Mr. Judy requests a rear yard variance for a storage building from
the required 25' setback to 13'8". This building would be a pole
building with only a roof and no floor or sides.
COMMENTS:
Mr. Judy requests this variance since there is a large row of trees
along the back line of this property that he would be forced to
remove if this request were not granted. 'these trees presently help
serve as a barrier between this property and the residential uses
located on the property in back of this building.
Since this pole building would not be totally enclosed, a buffer strip
along loth Street should be required if approved. This buffer strip
is presently required by Section 26-49 of the zoning ordinance whenever
an industrial use abutts a residential use. This could be easily
accomplished by Mr. Judy if he simply placed privacy slats in his
already existing chain link fence along loth Street.

I have received a request from Pastor Vernon L. Smith that lie be allowed to use the
Highlander Hut on Sundays for a new Church group, the Calvary Baptist Church.
As the attached letter explains, this group is pronently meeting in private homes. They
wish to use the Highlander Hut every Sunday from 9:00 a.m. to 12:00 noon, and from
6:30 p.m. to 8:30 p.m. for up to one year. By that time, they expect to grow out of
the building and seek larger facilities.
The rules for the Highlander But require that the use of the building for formal religious '
services must be approved in advance by the City Council. If this request• is approved,
I recommend a fee of $2.00 per hour be charged for the use of this building.

the Calvary Japtist Church. Ile indicated IrLs approval, but
also advised me it would be nccessary to secure the permission
of the Clermont City Counc--Ll.
I am writin,, to request permission to use the buildint; on Sunday
mornings from 9 A.N. to 12 11oon, and as the church grows, we
would desire to start an evening service and use the facility
from 6:30 to 8:30 P-1. each Sunday evening. `ae request to use
it for up to one (1) year. In that time, we expect to grow out
of the building and will seek larger facilities.
Perhaps a few words of background will be helpful.
At the request of a small group of people interested in such a
church, our family moved to Clermont in .January 1978,_bought a. _
hone and have been seekito reach others vti.bh the gospel of
ng
Christ. Presently, our ministry included calling on the people
of the Clermont-biinneola area, to find those who are unchurched
or interested in the establishment of a fundamental, independent
Bap tist church. We are using; our home on Oak Drive to hold a
Sunday School/Bible study each Sunday morning. Since January
1979, we have been using the Hut on Thursday afternoons from
3:00 to 1+:45 P.I1. for a children's Bible club. The emphasis of
this club has been games, teaching and a Bible .lesson. Atten-
dance has grown to a high of 23. The Hut''s facilities have
been more than adequate and we enjoy using the building.
We labor under the sponsorship of the Hiawatha Baptist I.issions,
1526 Plainfield II.E., Grand rapids, Michigan.

These bids, if awarded, would be slightly over the total amount budgeted for the City
Hall remodeling. PrascnLly $3,491 has been spent primarily for caulking and painting
the building. 'fhe carpetand drape work would add $4,315.30, for a total cast ec City
Ball remodeling of $7,806.30. $7500 was budgeted for the total remodeling project.
As you may recall, this is the second time the drapes and carpet have been bid, and I - +1
recommend that the low bids above for drapes and carpeting be accepted. I also recom-
mend that the notice of award stipulate that all work is to be completed within 90 days
after award.

While it could not hurt to place quiet zone nigns around the Hospital, the
following fnetors should be taken into consideration:
1. Chapter 14-25 of the Municipal Code of Ordinances already
prohibits noise and states in part that "The creation of
unreasonably loud disturbing, and unnecessary noise
on n ! � B

in the City is prohibited. Noise of such character,
intensity, and duration as to be detrimental to the life
or health of any individual is prohibited".
The Ordinance also goes on the prohibit various types of noises
that are not legal.
2. Since noise is already covered in the municipal Code of
Ordinances, a special noise zone around the Hospital would
-- make people aware that they are near a hospital, but.. would.._.
be no more enforceable than in any other section of the
City.

The City Planning & Zoning Commission, at their May 1, 1979 meeting, unanimously
recommended that quiet zone signs be placed a block around the Hospital in all directions.
The general consensus of the P&Z was that while these signs make the noise ordinance
no more enforceable, it at least reminds persons that they are near a hospital.

State law requires the City to adopt a Comprehensive Plan by July 1, 1979, The first
four elements of thin Plan on Land Unc, (lousing, Transportation, and Recreation have
been approved by the City Council. The Conservation, Electric Utilltiea, Intergovern-
mental Coordination, and Economic Feasibility elements have been completed by the Com-
prehensive Planning Committee but not yet approved by the City Council.
It is my understanding that the Council, at their May workshop, discussed the fact that
the second part of the Comprehensive Plan should be more concise. This could be done
by the City Manager and presented to the Council at the June 12th Council meeting. We
could then submit the last set of Comprehensive Plan elements to the State before July
1st. It is my understanding that the State requires a minimum review period of up to 120
days before local public hearings and adoption can be officially conducted. However,
I will investigate the State law on this matter to see if there is a way we can officially
adopt the Plan pending the State review. If this is not possible, we will be required
to ask the State for an extension.
If an extension is required, it will be because of the State's lengthy review requirements'-s
and not because the work was not completed in time.

General Location and Market Area
This plan recommends a general loc-
ation for the planned Clermont/
Groveland Airport in Lake County
approximately equidistant from the com-
munities of Clermont and Groveland.
The airports market area includes
essentially the southern half of
Lake County.
Area Characteristics
In the center of the proposed search
area is low density residential dev-
elopment, numerous lakes and a rec-
reational and environmentally sensi-
tive area. However, to the north
near the Leesburg Clermont Inter-
change (Florida's Turnpike) or to
the south near State Road 5650,
existing and planned land use is ag-
ricultural and vacant.
Examination of the airspace has shown
that the new airport will share VFR
airspace with two or three surround- -
ing airports. However, activity
levels at the surrounding airports
are expected to remain so low as not
to reduce the capacity of the new
airport. There are no identifiable
IFR airspace conflicts or restric-
tions to publishing an instrument approach.

Recommendations
Forecast demand for the East Central Region and the system analysis
discussed in Section 5 (System Alternatives), defined the need for
a new airport in the area between Clermont and Groveland.
The system plan recommendation is that a Site Selection and.Air-
port Master Plan study be undertaken immediately so`that a new
airport will become available for use during the short-range plan-
ning period. The airport should be planned as a general utility
facility throughout the long-range planning period (1990).
Approach aids recommended include a TVOR (to be shared by Tri-City
Airport (new)) and a VASI-2. General aviation facilities are plan-
ned to accommodate 52 parked aircraft, 94 parked automobiles and
72 busy hour pilots and passengers.

I have received a requent from the City Engineer, John Springs Lend, that two additional
hourly rate pay classifications be established as follows:
1. Engineer nt $25.00 per hour
2. Engineering Technician at $22.50 per hour.'
These fee schedules would be in nddition to the four clnssifications presently established l
as Professional Engineer, $30 per hour; Design Draftsman, $20 per hour; Draftsman, $15
per hour; and Secretarial, $10 per hour.
The purpose of the two additions are to include the pay classification of personnel in
Mr. Springstend's firm that now also do work for the City.
Basically, these new fees are designed to save the City money since Mr. Springstead
wishes to charge $30 per hour only for his time, and $25 for other professional
engineers. It should also be noted that Mr. Springstead has not asked for a raise in
his present fee schedule since it was adopted by the City Council in February, 1977.
I recommend approval of adding two new pay classifications.

This will confirm our conversation in our Leesburg office
on May 4, 1979 regarding our billing for Engineering services
to the City. As a result of adding additional personnel since
the signing of our contract dated February 28, 1977, please be
advised that we requrest the addition of new catagories in our
contract under Section 2, Paragraph 2-01, (e). We would like
to add two (2) classifications between Professional Engineer
and Design Draftsman and those are as follows:
