A Regular Maoting of the City Council of Cho City of C.lormont wan hold in the Council Chambers
on Tuesday, Novambor 14, 1978, The meeting wan called to ordar at 7.30 P.M. by Acting Mayor
Carlinle A. Byrd, Jr., with tho following mombere pronant: Councilmen Co:Le, Schroodaa, and
Iloney. Others officials preaunt were: City Manager Tiffany, City Attorney linl.rd, City Clork
Carroll, Finance Director Sanchez, and Chtef of ]'oil(!(! Tyndal. Others preacnt were: Mrs. Lucy

The invocation was offered by Acting Mayor Byrd, fo.l.lowed by repeating; of Chc Pledge of

APPOINTMENT to GROUP V VACANCY
In accordance with Section 11 (C)(3) of the City Charter, Acting Mayor Byrd entertained a
motion for appointment of a qualified person to fill the vacant scat in Group V, which
was created when he assumed the sent 1n Croup 'III as Acting Mayor. The name of Claude
E. Smoak, Jr. was placed in nomination by Councilmen Schroedel.. 'There were no further
nominations offered, whereupon motion was made by Councilman Honey, seconded by Councilman
Cole and unanimously carried that Claude E. Smoak Jr. be appointed as temporary Council-
man to fill the vacancy in Group No V until the next regular General Election. The
Oath of Office was administered to Mr. Smoak by the City Clerk, and lie was seated at
the Council table.
PUBLIC HEARINGS
City Manager 'Tiffany advised that the variance request of Mr. Dennis Cannon that was
scheduled for consideration at this time, had later been determined to be not necessary,
and had thereby been withdrawn.
A communication was submitted to Council from Mr. Jack R. Lail wherein he requested that
his previous request for a variance, which was scheduled for consideration on this date,
be withdrawn.
Council, sitting as a Board of Adjustment, considered a request of Thomas G. Legg, Pastor
First Church of the Nazarene, for a Variance to Section 26-21 (D)(R-1 URBAN RESIDENTIAL
DISTRICT - SIGNS) of the 'Zoning Ordinance in order to construct a sign on their property
described as:
A portion of Tract 1 in
Section 19-22-26
N & E of Grand highway
that would be in excess of the permitted square footage of signs in that zoning district.
In a communication from Mr. Legg, he advised it was their desire to construct a sign of
8' x 12' (96 sq. ft.) dimensions to announce the future use of their property as a church
and educational building site, and which would be removed upon completion of the first
phase of the church facility construction. lie further advised of no existing residential
developments in that area. There was no objection from anyone present regarding the
matter, whereupon motion was made by Councilman Honey, seconded by Councilman Cole and
carried that the request be granted.
BOWEN CUP REQUEST
City Manager Tiffany advised of a request by Mr. Razz H. Bowen for a Conditional Use Permit
to use the property at 1155 fifth Street for the "sale of used cars and small repair work".
lie further advised of the Planning & Zoning Commission's consideration of the matter on
November 8th, at which time they voted 4 to 3 to deny recommendation for granting of the
request, citing Section 26-87 of the City Code. Mr. Bowen appeared before Council in
support of his request, advising that the building existed long before zoning restrictions,'`
having been used as business property; That the building was in need of improvements,
which he intended to make; and, That the property was of sufficient size that his business''
would be contained within the property lines. Mr. Richard B. Williams, aonearby property`
owner and resident in the area, appeared before Council in support of the request, opining ''

MUNICIPAL. SELF INSURE,10 S FUND
Mr. nob McKelvey, representative of Risk Management Servlcen, Inc. appeared before Council
to apprise theta of the Workman's Compensation Program for municipalities which is availablo
through the Florida Municipal Self. insurer's Fund and serviced by Risk Management. Ile
advised of. 67 cities presently particlpating in the program; That a Board of Trustees,
composer) entirely of municipal officials of member Cities in the Florida League of Cities
is the administering agency; That the program had been started to save dollars on WC
premiums, provide regular effective safety engineering, enable it closer control over
claim settlement procedures, and provide for participation in any surplus that remains at
years end. It wits the suggestion of. Councilman Smoak, and Council was 1n agreement, that
a further investigation of all the Lnngibles be made in order to compare economic advan-
L•ages and dis-advantages of the self -insurer's fund as opposed to private carriers.
Acting Mayor Byrd requested that City Manager Tiffany, in cooperation with the Finance
Director, the City Attorney, Mr. McKelvey, and the City's present carrier, study the
matter further for report back to Council.
STATE ROAD 50 PROJECT
Acting Mayor Byrd reported on communications forwarded from City Manager Tiffany and
the Chamber of Commerce to officials of the road construction company and the DOT wherein
supervision and job performance on the State Road 50
they commented on the excellent p �
improvement project thru the City, and he desired to concur with their comments-onthe

tremendous improvement in the City.
COOPER DEMORIAL LIBRARY
Councilman Schroedel, liaison representative to the Library Board, reported on his recent
attendance at their regular meeting wherein they were advised that a recent appraisal of
the library's books had reflected a value of $100,000, and, that the book circulation
for the month of October had been 0 2700 books, an increase of 300 over the month of
October 1977.
COMPREHENSIVE PLAN - STATE COWIENTS
City Manager Tiffany submitted a "draft" letter in answer to comments on the City's proposed
first four elements of the Comprehensive Plan by the Division of State Planning, wherein
lie advised that various specifics of the elements had not been included in the final
documents, but were a part of our public records and available for review in the master
plan at City Hall. Ile further advised the elements submitted were purposely concise to
avoid unduly constraining the City in its future planning and regulatory activities in
reaction to changing local conditions. Motion was made by Councilman Smoak that City
Manager Tiffany be authorized to transmit this letter under signature of the City Council

SUPRLUS EQUIPMENT
City Manager Tiffany advised that the newly acquired mini -attack fire pumper had replaced
the 1956 International Harvester Truck, now surplus, and he recommended that it be offered
for sale by sealed bids. It was the consensus of Council that this recommentation be
accepted.

CLERMONT/MINNEOLA MERGER „
Councilman Smoak reported that he had received responses from three interested persons
who were willing to serve on a potential study committee to determine if there are areas
of joint interest ultimately leading up to investigating the possibility of merging the
two communities, but in his recent contact with Mayor ward of Minneola, it was their
mutual suggestion that a work session of the two Councils be held to provide, in writing,
an outline of basic objectives for such a committee to follow, prior. to appointment of
such a committee. Acting Mayor Byrd requested that the City Manager arrange for such
a meeting of the two Councils for a later date in January.

Dear Mr. Tiffany:
Pursuant to a.163,3184, Florida Statutes, the Division of
State Planning has conducted a review of the Land Use, Housing,
Recreation/Open Space, and Transportation Elements of the Clermont
Comprehensive Plan.
Our review indicated that the Transportation Element of
your plan is adequate to meet the minimum statutory requirements.
The other three elements do not appear to meet the statutory
requirements and we have noted objections in the attached comments.
Specific comments which provide the basis for your objections are
shown in the attachment for your consideration and possible use,
as well as additional general comments on the plan. Comments of
other state agencies are also attached.
In order for the Division of State Planning to comply with
the provisions of a.163.3184 (1)(a), Florida Statutes, we request
that you provide us with the date, time and place of public hearings
to consider adoption of this portion of the Comprehensive Plan for
the City of Clermont. Further, we request that we be provided a
copy of,the adopted plan once the adoption process has been completed.
We look forward to receiving additional elements of your
comprehensive plan. If we may be of assistance do not hesitate

COMMENTS ON PROPOSED COMPREHENSIVE PLAN ELEMENTS
FOR THE CITY OF CLERMONT
I. OBJECTIONS
1, The land use element contains adequate goals, objectives
and policies. This element does not, however, indicate the
proposed future general distribution, location and extent of
the uses of land as required by s.163.3177(6)(a), Florida Statutes,

goals and objectives. It does not address the standards, plans
and principles outlined in s.163,3177(6)(f), Florida Statutes,

II. GENERAL COMMENTS
1, The proposed plan elements appear to be good policy
documents, but, lack detailed data necessary for implementation
and to satisfy statutory requirements.
2. Under the provisions of s.163.3211, Florida Statutes,
the adoption of a local comprehensive plan does not exempt developers
from DRI review nor does it preclude the designation of an Area of
Critical State Concern pursuant to Chapter 380, Florida Statutes.

Under either the Residential Land Use Goals (pages 5 & 6)
or the Parks and Recreation Land Use Goal (pages 7 & 8),.it
would be good to include a policy on manditory dedication for
developers before Clermont becomes too developed.
The Recreation and Open Space Element is a good outline
and has good information so far, but lacks a great deal. There
is no information as to: (1) past recreation and open space
efforts; (2) current supply: a) public, b) private'(non-profit
and profit), (3) how current needs are being met. The Goals,
Objectives and Policies are fine. We could find no standards
nor any statement citing other standards which would be used
(i.e., NRPAPRPA, SCORP). In addition, the financing and
Implementation section was lacking a great deal.
The Division of Recreation and Parks has a comprehensive
planning Handbook available upon request. This is a relatively
simple and good guide for those doing a comprehensive plan and
could provide assistance in,Clermont.

Our staff has reviewed the Housing Element of the above
referenced plan. We offer the following comments:
1. There are no standards, plans and principals to be followed - --- -
in the provision of housing for existing residents and antici-
pated population growth (163.3177(6)(f)l).
2. There are no specific standards, plans and principals to be
followed in the elimination of substandard dwelling conditions
(163.3177(6)(f)2).
3. There are no standards, plans and principals to be followed
in the improvement of existing housing (163.3177(6)(f)3).
4. There are no standards, plans and principals to be followed
in the provision of adequate sites for future housing including:
a) housing for low and moderate -income families;
b) mobile homes; and
c) supporting infrastructures and community facilities
(163.3177(6)(f)4).
5. There are no standards, plans and principals to be followed
in the provision of relocation housing and the identification of
housing for the purposes of conservation, rehabilitation, or re-
placement (163.3177(6)(f)5).
6. The standards, plans and principals to be followed in the
formulation of housing implementation programs (163.3177(6)(f)6)
are very general and no specific programs are identified.
7. There is no evidence of coordination of housing planning and,
development activities with other local governments, regional agencies,
and the state (163.3161(4)).

B. No data is provided in the housing element except the current
number of single family and multi -family housing units or the
number of mobile homes.
The plan would be greatly improved if it would identify how
many total and low and modorate-income housing units will be
needed in future years, identify existing housing conditions,
and identify proposed sites for future housing. Also, there
should be an analysis of the city's housing problems upon which
the housing goals and objectives are based. Next housing imple-
mentation programs to help achieve the objectives should be identi-
fied. Also, because the objectives are so general, they will not
provide much direction for program development nor the evaluation
of programs once they are developed.

Thank you for your October 18 letter, which we received on October 27, commenting
on the Land Use, Housing, Recreation/Open Space, and Transportation elements of the
Clermont Comprehensive Plan. At their meeting on November 14, the Clermont City Council
considered the objections, and submits this reply.
We note that the three listed objections are not in the context of the relationship
and effect of our comprehensive plan on the lawful responsibilities of state agencies,
but instead reflect your judgement on matters of local concern.
The four elements are based on considerable data not included in the final documents.
This data is part of our public records and is available for review.
The elements are purposely concise to avoid unduly constraining the City in its
future planning and regulatory activities in reaction to changing local conditions.
Replies to your specific objections follow:

Following the guidance of the September, 1976 State publication A
LOCAL OFFICIALS GUIDE TO THE LOCAL GOVERNMENT COMPREHENSIVE PLANNING
ACT, we find that on page 3-8 it advises that "in communities where
growth is a major factor, the comprehensive plan may be aimed toward
managing and phasing growth (indicating, in more general terms, a
desirable pattern of future land use). The need to be general should
not be considered a weakness. One test that may be applied is how i
well the comprehensive plan and the information it contains assists
local officials in their day-to-day decision making."
The Clermont City Council finds that our Land Use Element, as submitted,
indicates the distribution, location, and extent of land uses as required
by law.
2. "The proposed housing element contains only general goals and objectives.
It does not address the standards, plans and principles outlined in
s.163.3177(6)(f), Florida Statutes."
The housing element refers to the enforcement of building codes, housing
codes, and related ordinances which provide specific standards and prin-
ciples which exceed the requirements of the law. The Clermont City Council
finds that this element meets the requirements of the Act.

This element sets specific standards for acquisition and development of
future recreation and open space sites. The reviewing agency overlooked
a standard quoted from the National Recreation and Park Association. The
City Council finds that the element as submitted adequately indicates a
comprehensive system of public and private sites without restricting
necessary flexibility in implementing the plan.

A representative from Risk Management Services, Inc. is scheduled to make a
presentation to the Council on Tuesday regarding the Florida Municipal Self Insurer's
Fund.
The City is required to carry Worker's Compensation Incurance (VIC) in
amounts required by State Statute. W.C. pays for medical expenses of employees injured

cost consists of the following factors:
Standard rates are established by the Florida Compensation Rating Bureau as
a percentage of payroll for our various job categories. The rates vary
considerably depending on the hazards of the job. For example, our rates
range from 12% for our sanitation crews to 0.34% for office workers. Pay-
roll data and job classifications are determined by an insurance company
auditor.
Experience modification factor is established for each employer by the
Florida Compensation Rating Bureau. The factor is directly related to our
employee's safety record. A factor of 1.00 would indicate an average
safety record. Our current factor of 0.90 indicates a better than average
safety record and reduces the standard rate by 10%.
Premium discounts is a discount based on the size of the premium. Our
discount with our current insurance is about 13.3%.
Dividends represent a return of premium based again on employee safety
record.
Standard rates and the experience modification factor are identical for all
insurers. For comparative purposes, only the premium discounts and dividends need be
considered. Unfortunately, dividends are never guaranteed. We do, however, have a
track record with our current insurer. We have received dividends for 8 of the last
9 years. The dividends above averaged 12% of the premium.
The Florida Municipal Self Insurer Fund offers a 15% premium discount and an
opportunity to participate in a distribution of surplus. Additionally it offers
assistance in safety programs which would help keep costs down if they are effective.
Attached is a schedule showing premiums, losses, and dividends for the last
nine years. The schedule was provided by Axel Olivenbaum.

SUBJECT: Automobile Purchases
DATE: November 9, 1978
Our current budget includes purchase of three vehicles: one administrative
car ($5,000), and two patrol cars ($10,500).
The State cooperative purchasing contract for automotive equipment was
received on November 6. Last year, even though the State price was available, we
went through a formal competitive bidding procedure, and found that the State price

Dear. Mr. Mayor and City Council, Members:
Over the past six years, with very limited funds and in
the Lime available, it has been my sole purpose to upgrade, to
the best of my ability, the existing property located at 472
Carroll. Street.
After years of hard work i.n the area of my employment-, I
have finally reached a salary level that would permit me to hire
a building contractor to build a $15,000 addition, including
inlaying 'natural stone on exterior walls with cedar siding and
a new type roof, thereby increasing the property value
considerably.
Unfortunately, there are those who prefer to see this property
remain in its present state. This may be understandable inasmuch as
those protesting mow their lawn only three or four times yearly.'
What is,'not understandable, however, is their objection to covering
the parking space I have been permitting their downstairs rental
tenant (on one electric meter and one water meter) to park in
under my bedroom window at ti.mes over the past year or so.
They had no objection to getting me down off my roof to
spend three hours repairing the plumbing in their rental unit,
at no charge, or to having me -stop my work to lay carpet in their
bedroom - carpet made of small pieces with many seams - again at
no charge. Nor was there any objection to my supplying a wheelchair,
vehicle, gas, time, tickets, etc., for them and (his) out-of-state
parents to have an enjoyable time at Disney World at no expense
to themselves - or on other occasions to borrow my car for the
purpose of getting into Disney World free with several members
of their family and with me also supplying the gas and many, many
dollars worth of tickets at no cost to them.
Therefore, in an effort to preserve peace and tranquillity j
in the neighborhood, I respectfully withdraw my application for
variance request scheduled for Tuesday, November 14, 1978.

The Church of the Nazarene would like to erect a sign II' tall
by 12' wide, which would announce the future use of the above mentioned
property as a church site. We realize that the R1 zoning of the property
does not allow such a sign but ask for a variance in that at present there are
no residential developments In the area. The sign would be removed upon
completion of construction of the first phase of church facilities. It
would meet all safety specifications such as wind resistance, height above
ground, etc.
We feel that this type of sign would be of benefit to the church by
calling attention to the future development. It would be large enough to be
seen by anyone entering or existing from the Citrus Tower as well as by those
using Grand Highway.
The sign is to be constructed of one inch exterior plywood supported on
three utility poles with 2 inch by 6 inch cross ties 12 feet long. The poles will
be set in the ground at least 4 feet deep and will extend up at least 2/3 of the
sign or approximately 15 feet.
