07-25-1978 Supporting DocumentsCITY OF CLiiRhiONT MINUTES REGULAR MEETING A Rogue Ir meeting of the City CouneII of the City of Clermont was held In the Council Chambers on Tuesday, July 25, 1978. The meeting was called to order at 7:30 P.M. by Mayor ProTem Carlisle Byrd with the fillowing members present: Councilmen Cole, Schroedol, and Honey. City officials present were City Manager Tiffany, City Attorney Baird, Finance Director Sanchez, and Chief of Police Tyndal. Others present wore: Mrs. J. Smith; Mr. a Mrs. F. N. Edington, Mr. s Mrs. Mallory; and Messrs. Sheldon, Wright, Downs, Lufsy, Jackson, Czech, Gross, Searles, Sargent, and Sokol. The Invocation was offered by Mayor ProTem Byrd, followed by repeating of the Pledge of Allegiance in unison by those present. The Minutes of the Regular Meeting hold on July 11, 1978 were approved as written. PUBLIC HEARING Council, sitting as a Board of Adjustment, considered the request of F.N. Edington for a variance to Chapter V, Article 11, Section 5-15 (RESTRICTIONS ON ERECTION OF FENCES) of the Code of Ordinances in order to erect a 5 foot fence on property described as Lot 91, N} of Lot 92, S} of Lot 95, Lot 96, in Hillcrest Subdivision (730 Drew Avenue). City Manager Tiffany advised that a similar request for variance on fence requirements was approved at the May 23rd meeting but that the S} of Lot 95 and All of Lot 96 were omitted, and since that the additional property had been purchased. Mr. s Mrs. Edington appeared before the Council stating that the new fence would be an extension of the existing fence and would further enhance the property. City Manager Tiffany advised there had been no response from abutting and/or adjacent property owners, and, following inquiry from the Chair, there was no one present who voiced objection. Motion was thereupon made by Councilman Honey, seconded by Councilman Cole and unanimously carried that the request be granted. SEMINOLE WELL City Manager Tiffany reported that the needed parts were on order to make necessary repairs to the chlorinator booster pump and after receipt, the Utilities Department would make the necessary corrections to be followed by an on -site inspection by the Project Engineer to further observe the well for additional recommendations. SEWAGE PRETREATMENT City Manager Tiffany reported on a letter received from Dr. John Zoltek wherein he recommended that the city not proceed with plans for Odophos Pretreatment. He further advised that Ted Wicks of the Lake County Pollution Control Board was in agreement with Dr. Zoltek's recommendation. INFILTRATION City Manager Tiffany reported that infiltration of water into the sewage collection system had been discovered at Emerald Lakes Mobile Home Park and that corrective measures were underway. INSURANCE COSTS Finance Director Sanchez advised he was pleased to report on a $4400 refund on the City's Workmen's Compensation Policy. t CiTY OF CLi NIONT MINUTES LIBRARY TASK FORCE Councilman Schroedel reported his attendance July 17th at a meeting of the Library Task Force Committee In Tavares to further discuss a proposed county wide library system; That no affirmative action was taken, and; That he forsaw additional meetings, Mr, Henry Cezch advised the Council of two proposals submitted, one from Clermont, the other from Leesburg, which were referred to the County Attorney. KEHLOR PARK SHUFFLEBOARD COURTS Mr. John Sokol appeared before the Council to express his views on the use of the Kehler Park Shuffleboard Courts. He suggested that a sign be posted showing that the courts are open to the public, for public use, and expressed his dissatisfaction on the City Charter regarding referrendum ballot procedures, Mayor ProTem Byrd suggested, and Council was in agreement, that the matters be referred to the City Manager and City Attorney, POLICE STATION RENOVATIONS City Manager Tiffany presented a proposed employment contract with Mr. George Powell for the remodeling work to convert Jail space at the Police Station to offices, negotiated at the instruction of the Council at the June 13th meeting. He briefly reviewed the proposed contract provisions advising that Mr. Powell would personally supervise construction, would cooperate with the City and Architect to ensure that all plans and specifications are met, and would assist the City in obtaining the necessary labor, materials, and subcontractors; That in return for these services payment in the amount of $250 per week, not to exceed $1000, - would be rendered. The City Manager recommended that the proposed contract be accepted and the work begin immediately. He further advised of the architect's estimate of total cost for improvement to be $1L325, however', by deleting some cabinet work and using City labor, this estimated cost could be decreased. Following discussion of the proposed contract, motion was made b Councilman Honey, seconded by Councilman Cole and unanimously carried that the city Manager's �ecommeneatlOn be accepted i CITY HALL REMODELING i City Manager Tiffany reported on proposals received for construction of a 1 service counter for the City Hall as follows: new Gene Hogue $1175 3 weeks I Kirkland's $1250 4 weeks and recommended that the low quotation from Gene Hogue be accepted. Motion was then made by Councilman Honey that the proposal from Kirkland's be accepted inasmuch as this company has been established in the Clermont area for some time. S`r. The motion died due to failure of a second. Motion was thereupon made by Council- man Byrd, seconded b Councilman Schroedel and carried that the Clt Mana er's recommendation be acce ted. Councilman Hone voted in the negative on assa e of th_ a motion, s, BID AWARD: ALARM MONITORING SYSTEM City Manager Tiffany reported that 5 bid proposals were received for a central alarm j... monitoring system to be installed at investigated the Police Station; That all had been in order to ensure for compliance with UL regulations, service, reliability, and price, and; That following this investigation, two firms had been selected as follows: CITY OP CLERMONT MINUTES Eloctro-Protective Protective Alarms Transfer (for existing systems) $ 0 � 30 Installation (for now systems) 115 Annual Fee 0il 84 Rates guaranteed for 5 yrs. 5 yrs. Ha further reported that all costs would be borne by the subscriber, not the City, and recommended that the proposal from Electro-Protective be accepted inasmuch as this was an established national firm with good financial backing, had more Lake County and local service, and had 5 year guaranteed rates. Messrs. Sheldon and Wright of Electro-Protective and Mr. John Downs of Protective Alarms, Inc. appeared before the Council to answer questions about their firm's system. With regards Inquiry from Councilman Schroodel concerning annual fees to subscribers inasmuch as there were currently no fees charged, City Attorney Baird opined that inasmuch as these systems were monitored by the Police Department at no cost to subscribers and this service caused increased liability on the City wherein extreme legalities could be involved due to the current inefficient and confusing system, he felt the fees were justified. Following discussion regarding notification of subscribers of pending action being taken regarding a centralized alarm unit, wherein City Attorney Baird opined that It was unnecessary inasmuch as this service was initiated by the subscribers for their personal security and it was desirous of the City to reduce legal liabilities, motion was made by Councilman Honey. seconded b Councilman Cole and unanimously carried that the proposal of Electro-Protect ve be accepted. JACKSON REQUEST Mr. Jimmy Lee Jackson appeared before the Council to again discuss lot mowing of his vacant property, requirements to obtain a liquor license at his business establishment, and removal of several internal signs at his business establishment. With regards a liquor license, Mr. Jackson was again advised that the State, not City, issued liquor licenses. With regards to lot mowing, Mr. Jackson again opined that inasmuch as he personally cut his vacant property when notice was received from the City, he felt the lot mowing charges were unjustified. It was the consensus of Council that inasmuch as the lot was found in need of mowing when the city's contractor cut same, the charges were justified. With regards several interior electrical signs that he was instructed to remove due to safety hazards wherein he stated that the signs were not activated in an effort to reduce electrical costs, Mayor ProTem Byrd referred the matter to the City Manager Tiffany. Councilman Cole inquired of sufficient off-street parking at Dot's Cafe inasmuch as this was an existing hazardous condition, and if a liquor license was obtained it would cause an influx of more traffic, Mr. Jackson replied he was aware of the situation and would cooperate with the City to alleviate same. 1978-79 FISCAL YEAR BUDGET Mayor ProTem Byrd called a Special Meeting of Council to be held at 6:00 P.M. Friday, July 28 in the City Manager's office to discuss the 1978-79 Budget. ORDINANCES/RESOLUTIONS Councilman Honey offered and moved the adoption of AN ORDINANCE UNDER THE CODE OF; ORDINANCES OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA, AMENDING CHAPTER 5; PROVIDING FOR ADOPTION BY REFERENCE OF CERTAIN STANDARD CODES RELATING TO BUILDING CONSTRUCTION;, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE; AND PROVIDING FOR PUBLICATION, and the motion was seconded by Councilman Cole. Mayor ProTem Byrd offered and moved the adoption of a RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA, IMPLEMENTING CHAPTER 5 OF THE CODE OF ORDINANCES RELATING TO BUILDING CONSTRUCTION; DEFINING OCCUPATIONAL TITLES; PROVIDING FOR SCHEDULE OF FEES AND PENALTIES: AND PROVIDING FOR REGISTRATION, and the motion was seconded by Councilman Honey and unanimously carried. The Resolution was read by Deputy Clerk Smith by title only, and the number 315 assigned to it. A proposed Ordinance providing for the repeal of Chapter 22 "Taxicabs and Vehicles for Hire" was reviewed by Council. Councilman Schroedel introduced AN ORDINANCE UNDER THE CODE OF ORDINANCES OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA, REPEALING CHAPTER 22 OF THE CODE OF ORDINANCES RELATING TO TAXICABS AND VEHICLES FOR HIRE; PROVIDING FOR PUBLICATION; AND PROVIDING FOR AN EFFECTIVE DATE, and the Ordinance was read for a first reading by Deputy Clerk Smith by title only. CITY OF CLERAIONT MINUTES OTHER BUSINESS Mr. Phil Searles appeared before the Council to advise that• the County Commission, Department of Pollution Control, County Engineer, and other concerned agencies would meet on August 9 at 2:00 P.M. on the hth floor of the old county courthouse to hear a proposal by a blo-dymanlcs company on the possibility of locating a waste disposal plant in Lake County to accept and process solid and liquid waste. There being no further business to be brought before the Council at this time, the meeting was adjourned by Mayor ProTem Byrd at 9:00 P.M. CLAUDE E. SMOAK, JR. - MAYOR DOLORES W. CARROLL - CITY CLERK TO: City Council FROM: City Manager SUBJECT: Police Station Renovations DATE: July 21, 1978 At your June 13 meeting you authorized me to negotiate with a contractor to do the proposed remodeling work to convert unneeded jail space at the Police Station to much needed offices. Attached is a revised cost estimate from the architect giving the estimated total cost of the work to be $18,325 based on a negotiated contract. However, we may delete some cabinet work to hold the cost lower than the estimate. Also attached is a proposed contract with George Powell who will supervise the work as stated in the agreement. The City would provide labor and materials with Mr. Powell providing supervision and assistance in obtaining labor, materials, and subcontractors. This work is a serious need. It has our highest priority. I recommend that the Council accept this agreement and authorize the work to proceed immediately. We propose to replace the old service counter with one that has two built-in desks to reduce disruption of clerical work, to allow the Administrative Secretary to be inside the counter, and to control traffic into the Building Official's and other offices. The new counter would increase our useable space and allow a more efficient office arrangement. Chief Tyndal investi- gated the proposals and summarized his findings on the attached memo. Note that two of the five firms are not UL certified companies. It is important that we have a UL approved company and system to satisfy bank alarm requirements. The top two firms are Electro-Protective of Orlando and Protective Alarms of Melbourne. The following is a summary of the charges in their proposals (there are no charges to the City): Electro-Protective Protective Transfer (for existing systems) �a 0--- 30 Installation (for new system) 60 45 Annual fee 84 84 Rates guaranteed for 5 yrs. 2 yrs. We consider these fees to be essentially the same, with Electro-Protective giving a break to existing systems that would be made up from slightly higher ins- tallation fees for new systems. Both firms have a good reputation and are capable of providing good serivice. However, we feel that Electro-Protective has a slight advantage in being owned by a financially stable national firm with a good reputation, by having more Lake County and local service, and by having 5 year guaranteed rates. BOX 507 • CIVIVIONT, FLORIDA 32711 • PHONE 004/394.4740 To: City Manager Prom: Police Chief Subj: Bids for Installing Alarm Systemn in the Police Department Date: July 18, 1978 Because Insurance Companies racognirre certain Alarm system Companies, we first contacted Mr. Axel olivenbaum as asked him which of the five companies submitting bids were listed in the Insurance Services offices manual as approved companies. Mr. Olivenbaum stated that three of the submitting companies, Electro Protective Corp, protective Alarms, Inc. and Mosler Safe Co. were all listed as having Underwriters Laboratory approval. This approval by the Insurance Companies simply means that the company agrees to properly maintain all installed systems on a regular basis and is licensed to issue a Certificate so stating. We, therefore, concentrated on the three listed companies. 1. Protective Alarms, Inc. --- 2, Electro Protective Corp. .. 3. Mosler Safe Co. We eliminated the Mosler Safe Company as their cost was much higher than the other two. We then checked references given for both the other two companies for respond time to maintenance problems, ease of operation of the system and what type and how many complaints are received. Protective Alarms, Inc. City of Palm Bay Police Department The telephone number listed on the bid was incorrect. After obtaining the correct number, we spoke to Kathy Gantz, Secretary to the Chief of Police. She advised that the company responded immediately to maintenance calls and that the system was easy to operate. Their only complaint were with customers who failed to properly monitor their own systems, resulting in false alarms. City of Groveland Police Department Chief Merrill is -very satisfied with the performance of the system in his office. He said the system is easy to operate -:and maintenance is not a problem. City of Melbourne Police Department In speaking to officer Jones of the Department, he advised that the system installed in their Police Department was not Protective Alarms, Inc., but rather Electro Protective, Corp. (See comments listed under Electro Protective Corp.) Elactro Protective Corp.. City of Eustis Police Department Speaking to Chief Burrows, he advised that the Police Department is very happy with the system. They have no maintanence problems, the system is easy to operate and there are no complaints from the subscribers. Chief Burrows highly recommends the system. City of Melbourne Police Department officer Jones stated that there are two units in their Police Department. Each unit holds 84 connections. The Department is pleased with the service they are provided, the units are simple to operate and the subscribers are satisfied. City of Leesburg Police Department Chief Perry indicated that the main problem with the system (as with any such system) is false alarms caused by electrical storms. otherwise, he is pleased with the system, fools that it is easy to operate and the subscribers are satisfied with the service. For our current subscribers, Protective Alarms, Inc. would charge a transfer fee of $30.00 each with an annual fee of $84.00. Electro Protective Corp. would have no transfer fee and their annual charge is also $84.00. For new customers, Protective Alarms, Inc. would have an installation charge of $45.00 with an annual charge of $90.00. Electra Protective Corp. would charge a $60.00 connection fee and an annual charge of $84.00 to--'- new customers. Protective Alarms, Inc. proposes to increase their rates based on any increase in the Consumer Price Index after two years. Electro Protective Corp. would keep the same rate for five years. Protective Alarms, Inc. is a local Florida company while Electra Protective Corp. is a nationwide company. Also, in discussing the various companies now in the Clermont Police Department with Dispatcher Doris Bishop, she advises that Electra Protective Corp. is the most prompt with service. Box 219 Clermont, Florida 32711 Dear Sir; Electro-Protective proposes to install and maintain a 50 zone alarm receiving panel. The receiving system is U. L. Listed for fire and burglary. The system can be installed in approximately four days after authorization. The display which is 15" wide, 421 high and 2" deep would be installed at the dispatchers location and the main control would be installed remote. Operation of the unit is uniquely simple. There is one button to silence .the complete panel and one button to test the complete panel. It will have a sixty hour rechargeable standby as required for fire. Installation will be completely coordinated with the subscribers or other alarm companies so none will be out of service. Electro-Protective operates the only U. L. Listed and F. M. approved Central Station in Central Florida. All dispatching is done from our Orlando office by radio (300 watt base 100 watt mobile) or telephone. Our Central Station is a 24 hour operation and service on the receiving panel would be within four hours. We feel four hours is an extreme but have found that some take as long as 2 to 3 days. To transfer those existing subscribers, there would be an annual service charge of $84.00. To connect new subscribers, there would be a $60.00 connection fee and $84.00 annually for service. The receiving system would be inspected monthly for operation. This rate would be guaranteed for a five year period. Page 2 June 21, 1978 Electro-Protective presently has the mini -mac receiver installed at Winter Garden, Melbourne (2), Sanford (2) Eustis, Kissimmee, Leesburg Police Departments. We also have other types installed in numerous cities and counties such as New Smyrna, St. Cloud, Lake County, Wildwood, Cocoa, Ocoee and Winter Park. These regulations are badly outdated. There are no taxi operators licensed in Clermont now. Several months ago a taxi operator inquired about beginning service here. We gave his a copy of our regulations, and he did not return. I suggest that Chapter 22 be repealed entirely, thus deregulating the business until regulations are needed.
