M I N U T E S Regular Meeting A Regulnr Meating of. the City Council of the City of Clermont was hold 1.11 tl:e Council Chambers on Tucnday, April 25, 1978. The meeting wan called to order. at 7:30 P.M. by Mayor Pro-Tem Carlisle A. Byrd, Jr., with the following members present: Councilmen Cole, Schroedel, and Honey. Other officials: present were: City Attorney Baird, City Clerk Carroll, Finance Director Sanchez, Chief of Police Tyndal, and Building Official Nagel. Others present were: Mesdames Beason, Morrywenthcr; Mr. 6 Mrs. Clint Webster; Messrs. Sargent, Czech, Searles, and Evans. The invocation was offered by Mayor Pro -Tom Byrd, followed by repenting of the Pledge of Allegiance in unison by those present. The Minutes of the Regular Mecting held on April 11, 1978 were approved as written. SURPLUS EQUIPMENT Finance Director Sanchez advised that the city owned ARPS Trencher, Vehicle No. 5349 has been determined to be surplus property, and he inquired of Council authorization to place it for public auction on April 29th. Motion was made by Councilman Schroedel seconded by Councilman Cole and carried that it be so authorized. ELEMENTARY SCHOOL SITE RECREATIONAL FACILITIES Mayor Pro-Tem Byrd advised of a communication received from an adjacent resident to the recreational facilities which the City is constructing at the elementary school site, wherein great concern was expressed regarding the adverse effect to the-------- residential area abutting the facilities, which is without benefit of a buffer zone. Mr. Byrd further advised of certain actions which had already been taken by City Manager Tiffany to alleviate some of the problems as reported, and the full assurance of the City Manager that all possible steps would be taken by the City to make the facilities more acceptable to the nearby residents once they are completed. Mr. Byrd requested that the records show that he is desirous of full cooperation on the part of the city to be extended to the residents in that area. LOCAL MAIL DELIVERY Councilman Schroedel advised of a complaint received wherein there are three streets in the Lincoln Park area of the city that are on rural route mail delivery routes requiring mail boxes on the street, but are surrounded by the various other streets in the same area that are services by door mail delivery; That upon his inquiry to local postal officials regarding the matter, he was advised that nothing could be done about it; and, he queried if it would not behoove Council to pursue the matter further with higher ranking postal officials. Councilman Cole advised of a recent communication from the City Administration to the District Postal Inspector in Orlando, following a previous complaint regarding the same matter, but that a reply had not been received as yet. It was the suggestion of Mayor Pro-Tem Byrd that Council be kept posted regarding the matter for possible further action by communication from Council. POLICE STATION IMPROVEMENTS In a previous communication from City Manager Tiffany, Council was presented with the proposed architectural plans and cost estimate for the major remodeling project to { renovate the jail area to offices. Mr. Tiffany further advised of needed painting and repairs to the balance of the building interior, and recommended that authorization 1 be granted to proceed with advertising for bids for these improvements. Motion was made by Councilman Honey, seconded by Councilman Cole and carried that the City j Manager's recommendation be accepted. M I N U T LA LOT REQUIREMENTS Following considerable discussion regarding the recommended changes of lot requirements In the zoning regulations as presented by the Planning & Zoning Commission. Council was in unanimous agreement to all the proposed changen excepting those of lot coverage and front setback in the 111A zoning districts. Inasmuch an there was a Lie decision on those mutters, Mayor Pro -Tani Byrd requested that the matter be deferred and the Clerk be instructed to place it on the regular meeting agenda for May 9, 1978. SIGN ORDINANCE REVISIONS City Manager 'tiffany forwarded the recommendations of the Planning & Zoning Com- mission for revisions to the existing sign ordinance, and advised it was their concensus that the existing ordinance is fundamentally sound with need of relatively few changes, and those were primarily word changes and of a minor nature. City Attorney Baird briefly reviewed the recommended changes, whereupon motion was made by Mayor Pro T'em Byrd seconded by Councilman Honey and carried that the P&Z Commission's recommendations be accepted and the City Attorney be instructed to prepare the necessary amending ordinance. BEACH HOUSE CONCESSION - JAYCEE BEACH _ City Manager Tiffany in conjunction with City Attorney Baird, prepared a Beach House Concession Agreement for Council's consideration, and advised that following -- a review of persons having expressed an interest in the concession, recommended that Mr. Clint Webster of Orlando be granted the concession under the terms as proposed. Finance Director Sanchez briefly reviewed the proposed agreement. Inquiry was made from the Chair to Mr. Webster who was present, if the agreement as proposed was acceptable to him, and he replied in the affirmative. Motion was then made by Councilman Honey, seconded by Councilman Schroedel and carried that the agreement be --i An nwarded to Mr. Clint Webster. BEACH HOUSE CONCESSION - WEST BEACH Finance Director Sanchez advised of an inquiry received regarding a concession at the West Beach facility. Notion was made by Councilman Schroedel seconded by Councilman Cole and carried that the City Manager and the City Attorney pursue negotiations with any prospective concessionaires for West Beach. ANTI -RECESSION FUNDS In a previous communication to Council, City Manager Tiffany advised of Federal Government regulations requiring that anti -recession fund monies be expended to maintain basic services, generally payroll, and he thereon recommended that Council take action to obligate all anti -recession fund payments received during fiscal year 77-78 to general fund payroll. Notion was made by Councilman Schroedel, seconded b Mayor Pro Tem Byrd and carried that the City Manager's recommendation be accepted and the AREA fund payments be so obligated. The Ordinance was read for a second and final reading by City Clerk Carroll, by title only, and upon roll call vote on passage of the motion the result was: Ayes: Honey Cole, Schroedel, and Byrd. Total Ayes: Four. Nayes: None. Absent: Smoak. So the Ordinance was adopted and the Number 170-C assigned to it. ORDINANCE VIOLATION STATUS Councilman Schroedel inquired of City Attorney Baird as to the status of the City of Clermont vs Betsy Carter Wilkes case wherein a fence Ties been constructed on street right-o-way in front of her home at 1059 Nest Minnehaha Avenue in violation of existing City ordinances. City Attorney Baird advised the proper affidavits had been prepared and filed with the States Attorney. CARROLL - CITY CLERK TO: C1ty Council FROM: City Manager SUBJECT: Antirecession Funds DATE: April 14, 1978 So far this year we have received over $25,000 in Antirecession Fiscal Assistance (AREA) funds from the Federal Government. This temporary aid program provides local governments with monies based on the unemployment in the area and the government's Federal Revenue Sharing allocation. ARFA rules call for the funds to be spent "to maintain basic services", generally for wages. We have spent past checks for payroll. The rules also say that the funds are to be obligated and spent according to local and state laws. The Federal government in a recent letter said "this means that in most cases the funds must be obligated by the legislative body". Our current budget anticipated only $5000 in these funds, which, following regular budget procedures, you obligated for our General Fund program. To insure that we are complying with the law, I recommend that you obligate all current and future ARFA payments received during the current fiscal year for general fund payroll. The plans call for converting the north half of the jail area to an Investigator's office (with evidence locker) and to an Officer's squad room, and converting the present holding cell on the south side of the jail to a booking room. Since the County accepted responsibility for housing our prisoners last year, we now only need two small cells in the jail. Estimate for the work is $16,155. In addition to this major remodeling, the building interior needs painting and repairs, the present Booking Room will be converted to the Chief's Office, and the present Chief's/Investigator' s Office will be converted to a Records Room. Adequate space for the Police Department is an urgent need. Our officers now do not have a place to do their paperwork; the Chief and Investi- gator share a small office; and there isinsufficient storage for evidence and supplies. The building was constructed in 1964 when we had only four officers: - These plans were not prepared for inclusion in this year's budget because of an uncertainty over continued need for the present Council Chambers in light of our discussions on moving the City Hall. Money is available for this high -priority improvement. Iry April ll!, 1978 Mr. Gordon Tiffany City Manager City Hall Clermont, Florida 92711 Dear Sirs As a Clermont taxpayer and owner of property bordering Carroll Street, I fool I have romminod silent much too long. I have complained only once about the City Recreation facility facing my property, which is located directly across the street from the Clermont Elementary campus. I complained only after being verbally abused by people parking on the edge of my property. After the parking had been going on for several weeks, a number of shrubs in my yard had been torn down. At least the parking restriction has alleviated a portion of that problem. I did not complain when the bleachers were placed practically on the sidewalk, even though the people attending the games in many cases seem to think my lawn is a thoroughfare to the field and their children use my yard for a playground. I did not complain when the Pepsi Wagon was brought in, even though on days following the games I have to pick up the trash in my yard. It is always cluttered with popcorn bags and Pepsi cups. But now -- the last straw. THE CITY IS BUILDING A PUBLIC TOILET RIGHT ON THE ROAD, PRACTICALLY IN TV BACK YARD. This is really too muohll How much more do I have to take! Surely you cannot be blind to the abuse public facilities of this type are subjected to. I also feel there is a definite safety hazard involved. The bleachers are so close to the road and there is virtually no supervision, so much of the time the little ones play in the road. Some night some child is going to be injured. I am not anti -athletic -- quite the opposite. This is evidenced by the fact that my husband's entire life has been dedicated to athletics. He has been the head football coach at Clermont High School for nine years. I realize the City does not have to abide by the same zoning laws that we more citizens do. But I do understand that there are landscape ordinances that they must adhere to. I understand there must be fencing or landscaping to block these facilities from the view of established residences. The tennis courts have boon in operation two years and no landscaping has begun. They are beginning the second spring on the softball field and no landnoaping of thin nature has boon started. So now I ask -- Am I going to have to look at public toilets ovorytimo I go out in my yard? Rae any consideration boon given to the property owners on Carroll Street? Apparently not. Have you even thought of what thin will do to the value of our property, or do you even oars? Perhaps my alternative in to ank the City if they wish to place a bid on my home for use as a dressing facility. I would have thought that someone would have given the property owners come small consideration. In closing I wish to ask one more question. Foster 420 East Avenue Clermont, Florida 32711 Dear Mrs. Foster: Thank you for your April 14 letter expressing your concerns about the recreational facilities which the City is constructing with the cooperation of the School Board across Carroll Street from your home. Your letter pointed out several problem areas which I hope we can alleviate. I was not aware that users of the facilities had damaged your landscaping. We accept responsibility to replace damaged plantings. Please contact our Director of Public Works, Robert Smythe, and he will make those arrangements. I am asking softball league officials to help you by trying to keep child- ren away from your yard and other private property and out of the street in your block, and to pick up all trash from use of the field. Our Police Department will step up their patrol in this area during game times. If you have problems with people on your property during games, please call our Police Department so they may help you. During construction of the restrooms and concession stand, we have tem- porarily removed the fence. We plan to replace the fence with a more attractive one, and will landscape to make the area more attractive. When the City Council decided to construct these facilities on School property last year, they realized that publicly -owned, flat, and accessible property is very rare in Clermont. The school property was selected as the best site available. We regret that the facilities have been a problem for you, and we hope that when they are complete you will be satisfied with them. The Commission stated that their study confirmed that we have a fundamentally good sign ordinance that needs relatively few changes. They considered most of the proposed changes to be of a minor nature. Please note that the attached proposal is intended to be read along with the existing ordinance, not by itself. Underlined words or phrases are new, except that all of Section 26-79.10 is to be re-enacted. Roof signs shall relate to the business conducted on the premises or in the building on which such roof sign is located. 26-79.10 LIGHTING STANDARDS: SIGNS OR SIGN FEATURES PROHIBITED a) No sign will be permitted within fifty (50) feet of a street or highway paving which includes lighting which appears by approximate size and color to be a traffic signal or emergency vehicle light. The colors specifically prohibited are: red, amber or yellow, green or blue. No rotating or flashing signal lamp similar to those used on emergency vehicles is permitted regardless of location or color. No sign shall be erected or maintained at any location where, by reason of position, illumination, shape or color, it may interfere with, obstruct the view of, or be confused with any authorized traffic signal, sign or device; nor shall it make use of the works, "STOP,' "LOOK", "DANGER", or any word, phrase, symbol or character in such manner as to interfere with or confuse traffic. No sign of any description shall be erected or placed in any location where its presence will interfere with clear sight distances of either motor vehicles or pedestrian traffic. The above standards shall be applied as determined by the City Traffic Engineer. b) The illumination of any sign located so as to be visible from any street or thoroughfare shall not exceed three (3) foot candles at any point along the paving or curb. The brilliance of moving or intermittent lighting at any location shall conform to the standards of the Commercial Zone at the borders of residential property. c) The folloiwng signs or sign features are prohibited: 1. Bullseye, sequential or flashing lights designed to focus attention to a single point. ri 2. Flashing or intermittent lighting. 3. Signs constructed in such a manner as to feature rotating or movinq extremities. 4. Paper signs other than exempt and political signs, bumper stickers, and strings of lights, except for temporary use at locations permitted by the City Manager. 5. Paper signs other than exempt political signs and bumper stickers are prohibited on vehicles. 26-79.190 A sign painted on the door or show window limited to the following information when all letters and characters are no more than 4 inches in height: Name of proprietor, name or nature of business, hours of operation and emergency telephone numbers.
