REGULAR MEETING

The third regular scheduled meeting of February 1977 was held in the Jenkins Auditor-
ium on Thursday, February 24, 1977. The meeting was called to order at 7:30 P. M.
by Mayor Claude E. Smoak, Jr., with the following members present: Councilmen Honey,
Byrd, Blackburn, and Schroedel. Other officials present were: City Manager Tiffany,
City Attorney Baird, City Clerk Carroll, Finance Director Sanchez, Director of
Community Services Smythe, Director of Public Utilities Davis, Director of Community
Development Nagel, and Chief of Police Tyndal. The meeting was held immediately prior
to a city sponsored "Town Hall" meeting, and there was a large group of interested
citizens present.
The invocation was offered by Councilman Byrd, followed by repeating of the Pledge
of Allegiance in unison by those present.
The Minutes of the Regular Meeting held February 15, 1977, were approved as written.
CITY MANAGER'S REPORT
City Manager Tiffany reported that the street name replacement
program had been completed this week with the exception of a
very few that wouldbe replaced as soon as posts for them had been
received; That another chemical treatment of the Seminole Well
had been completed, and water sampling was now underway; That
physical construction of the marshland study project had begun on
Tuesday, utilizing prison labor as an economy measure; and, That
on bid deadline date of February 22nd for the street leveling
portion of the street improvement program, only a single bid had
been submitted, however it appeared to be a favorable one, and -
would be on the March 8th council meeting agenda for consideration.
MAYOR'S REPORT
Mayor Smoak reported on the progress of the Tax Equalization
Committee, advising the next meeting would be held on Monday at
which time the budgeted line items of the offices of the sheriff
and engineer would be reviewed. Mayor Smoak further advised that,
hopefully, upon completion of the Committee's work, some relief
will be generated to city tax payers who are paying county ad
valorem taxes while at the same time are not receiving the same
level of services as county residents.
PAYMENT OF BILLS
Motion was made by Councilman Blackburn, seconded by Councilman
Byrd and unanimously carried, that the bills be paid. A copy is
attached hereto.
COMMUNICATIONS
City Clerk Carroll advised of a request received from the Clermont
High School FhA Chapter to sponsor a dance in the Jenkins Auditorium
on March 26, 1977 between the hours of 8:00 P. M. and 12 midnight.
Motion was made by Councilman Byrd seconded by Councilman Hone
and unanimously carried that the request be granted pruviueu a,i
rules and regulations as pertains to dances held in the auditorium
are met.
City Clerk Carroll advised of a request received from the Apostolie
Fiel Club (Jesus H. Lazana) to sponsor a dance in the Jenkins
Auditorium on March 12, 1977 between the hours of 8:00 P. M. and

City Clerk Carroll advised of a request received from the Kiwanis
Club of Clermont, Inc. to use the portion of Montrose Street between
Lake Avenue and West Avenue on April 30th to sponsor a "Flea Market".

CONSULTING ENGINEER SC•LECTION
City Attorney Baird advised that the Florida Consultant's Competitive
Negotiation Act does not prohibit approval of a contract for a City
Engineer without following procedures in the Act as long as no
single project exceeds $100,000 for construction or $5,000 for
planning. The immediate and near future projects of the city are
within these figures, however it was the recommendation of City
Manager Tiffany that procedures of the State Act be followed, and
he submitted a recommended ranking of three applicant firms as
follows:
(1) Springstead & Associates, Leesburg
(2) Bowyer -Singleton & Associates, Orlando
(3) Dawkins & Associates, Orlando
Motion was made by Councilman Byrd seconded by Councilman Honey and
unanimously carried that the Manager s recommendation to follow
procedures of the State Act in engaging an engineer be accepted.
Mr. John Springstead of Springstead & Associates, the recommended
top ranking firm, was present at the meeting and was invited to
review the proposed agreement for engineering services as submitted
by his firm. During review of the proposal, the following amendments
were requested by Council and agreeable to Mr. Springstead:
Section 1-02. Project Area
The Project area shall consist of the Corporate
Limits of the City and any other area served by
the City or in which the Cit undertakes a Project
which neeTs engineering services.
Section 2-01. Compensation for Services
(g) On any Project undertaken by the City for which engineer-
ing services are provided, City may, at its option,
retain a sum of 10% of the total engineering fee until
such time as all governmental and regulatory agencies
have approved the Project and the City accepts same.
Motion was made by Councilman Byrd seconded by Councilman Honey and
unanimously carried that the proposed agreement as submitted and
amended2 be accepted and executed by the appropriate persons.

RESOLUTIONS ORDINANCES
Councilman Blackburn offered and moved the adoption of a RESOLUTION
of THE CITY COUNCIL OF THE CITY OF CLE•RMONT, LAKE COUNTY, FLORIDA,
RECOMMENDING ROAD PRIORITY IMPROVEMENTS TO BE SUBMITTED TO THE BOARD
OF COUNTY COMMISSIONERS, LAKE COUNTY, FLORIDA, IN CONNECTION WITH
THE DEPARTMENT OF TRANSPORTATION FIVE-YEAR ROAD PLAN and the motion
was seconded by Councilman Schroedel and unanimously carried. The
RESOLUTION was read by City Clerk Carroll, and the Number 209 assigned
eo it. The recommended improvements as contained in the RESOLUTION
are:
(1) The scheduled improvements to State Road 50, including
new traffic signals at the Highways intersection with
Bloxam Avenue, East Avenue, and Eighth Street.
(2) Improvement to SR 561 by relocating the highway onto
the abandoned railroad right-of-way between 2nd
Street and West Avenue, and by rerouting the section
now on Eighth Street to West Avenue.

OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA, REGULATING SOLICITATIONS
FOR CHARITABLE, PATRIOTIC, PHILANTHROPIC AND OTHER PURPOSES: REQUIR-
ING REGISTRATION OF THOSE ENGAGED IN SOLICITATIONS FOR ANY PURPOSE:
PROHIBITING SOLICITATIONS BY FALSE OR FRAUDULENT STATEMENTS: REPEALING
ALL ORDINANCES IN CONFLICT HEREWITH: PROVIDING FOR SEVERABILITY: PRO-
VIDING FOR AN EFFECTIVE DATE: AND PROVIDING FOR PUBLICATION, and the
ORDINANCE was read for a first reading by Mayor Smoak, by title only.
There being no further business to beLrought before the Council at this time, the
meeting was adjourned by Mayor Smoak to a "Town Hall Meeting", and all present were urged
to remain and participate.

Sire:
We would like to request the members of the Council
and the City of Clermont for the use of public street for
a Kiwanis Club Project.
We are taking on the project of a Plea Market type
event to promote community interest in Clermont and to
attract other people to our area.
The area involved would be on Montrose Avenue between
West Avenue and Lake Avenue and the lot next to Cooper
Memorial Library. The date of the request would be for
April 30th, 1977.
We hope that the council will act favorably on our
request.

Several weeks ago 1 sent notices to seven Lake and Orange County engineering
firms listed as doing municipal engineering work. An announcement appeared in the
FLORIDA REGISTER (engineering newsletter) and thirteen firms have responded to date.
We need a ConsultingEngineer for three current projects: (1) design of the

plans, and advice on operations and ordinance review.
I believe that we should retain an engineering firm as City Engineer. The ad-
vantage of having an engineer on retainer is that he would be available to us at
any time including advice on day-to-day operations. The engineer would be familiar
with our City operation and with rapidly -changing materials and methods.
The City Attorney advises that the Florida Consultant's Competitive Negotiation
Act does not prohibit approval of a contract for a City Engineer without following
procedures in the Act as long as no single project exceeds $100,000 for construction
or $5,000 for planning.
You may wish to follow the procedures set out in the Act, however. Require-
ments for notice and advertisement have already been met. The next step is for the
top three firms to be identified, and then to negotiate (interview) starting with
the top -ranked firm.
If you elect to follow this procedure, I recommend the following ranking of
the applicant firms:
(1.) Springstead and Associates Leesburg. This is a one -engineer firm. Mr.
Springstead impressed me as having knowledge in the wide range of municipal engineer-
ing areas. His location and familiarity with local agencies with which we deal are
advantages. By retaining a one -engineer firm, we are assured that our work would
not be delegated to less qualified staff engineers as in a large firm.
(2.) Bowyer -Singleton & Associates Orlando. This is a fairly larqe firm
providing comprehensive engineering and surveying services. They have a branch office
in Tavares. The advantage of employing this firm would be their extensive in-house
capabilities.
(3.) Dawkins and Associates, Orlando. Dawkins is knowledgeable about our
Clermont utilities operation by virture of their work here in the past, and have
apparently done a good job. We have developed a good working relationship with the
engineer assigned to us, Ron Rector.
Ten other firms applied for our engineering work. Those firms are (in no order
of preference): (1) Sverdrup & Parcel, Gainesville; (2) Kuhrt & Associates, Orlando;
(3) Craven, Thompson & Associates, Pompano Beach; (4) George F. Young, Inc. St.
Petersburg; (5) Glace and Radcliffe, Inc. Winter Park; (6) Briskey Engineering Co.,
Winter Park; (7) Initial Industries, Inc., Orlando; (8) Watson and.Company, Orlando;
(9) Richard 0. Newman, Leesburg; and (10) VTN Inc., Orlando.

(Also expressing an interest was the firm of Post, Buckley, Schuh, & Jernigan,
Orlando. However, since this firm is working on a proposed subdivision in Clermont
they did not apply to avoid a conflict of interest.)
Any of the above firms could do a good job as our engineer. It was difficult
to select the top three. Materials submitted by the firms are available in my office
for your inspection.
I recommend that you elect to follow the procedures outlined in the State law,
and that you accept the ranking of the top three firms as recommended above. I
would then notify the top three firms of their ranking, and invite the top firm to
meet with you at a public meeting (probably a work session) during the week of
February 28 - March 4, for an interview. If you decide to retain the top -ranked
firm, there is no need to interview the other firms.

SUBJECT: DOT 5-Year Road Plan
DATE: February 22, 1977
Monday we received a letter from the County Engineer requesting pro-
posed State road projects for the UOT 5-year plan. We must submit our proposals
by March 1, in resolution form. Because of this deadline it is necessary to
bring this matter up for discussion even though it is not on the agenda.
Last year we submitted three requests: (1) four -lane SR 50; (2) traffic
control at Bloxam - 50 and East - 50; and (3) uniform 35 M.P.H. limit on SR 50
through the City. The first of these two requests are expected within the
next two years. Number 3 should be looked into after the road is improved.
We have the following State Roads in the City:
(1) SR 25 (Highway 27)
MSR 50
SR 561 (Lake Minneola Drive to 8th to Minneola Avenue to 12th
Street to Minnehaha.)
(4) SR 561A (12th Street north of Minneola Avenue)
Our major problems (except for SR 50 which is programmed for improvement --
already) are on SR 561. This route passes Jaycee Beach with considerable parking
and traffic problems in the summer months. The 90 degree turn at the fishing pier
is bad. There are structural problems in the West Lake area.
I propose that we request the State to reconstruct SR 561 between 2nd
Street and 8th Street on the old railroad right-of-way. (We would retain the
majority of the existing pavement as parking.) The curve at the fishing pier
should be improved,or preferably, the road should be extended through to West
Avenue and from there to Minneola Ave.
Requests must be in resolution form in order of priority.
