A Special. Meeting of the City Council of the City of Clermont was hold
Wednesday, September 7, 1983 in the City Council Chambers. The meeting
was called to order by Mayor. 13cals at 7:30 p.m. with the fol.lowing
Council. Members in attendance: Council Member Dupoe, Mayor Pro Tom
Pool., Council, Member Colo, and Council Member Turville. other City
Officials present were City Manager Forbes, City Attorney Baird, Finance
Director Saunders, and Deputy City Clerk Brandt.
The Invocation was offered by City Manager Forbes, followed by the
repeating of the Pledge of Allegiance to the Flag by all present.
ADOPTION OF TENTATIVE MILLAGE RATE OF 2.595
Mayor Beals explained that the City is not proposing to increase our
millage levy, but to lower the millage from 2.793 to 2.595 mills for
Fiscal Year 1983-1984. Due to the increase in assessed value, the
lower millage rate will generate the same amount of tax dollars for
this fiscal year, and there is no increase over the roll back rate.
Mayor Beals then called for comments from those present in the audience.
It was asked why taxes in Clermont are going up, even with the lower
millage rate. It was explained that the increase in assessed value
plus a school millage increase had caused the larger tax bill. There

RESOLUTION NO. 447 - TENTATIVE GENERAL AND REVENUE SHARING FUND BUDGET
Mayor Beals explained that this Resolution would adopt the tentative
budgets for the General and Revenue Sharing Funds of the City; and that
the General Fund Budget provides for the basic tax supported services
and maintenance of existing services of the City, and the Revenue Sharing
Budget provides funds for Capital Outlays. It was also explained that
the current Revenue Sharing Law expires on September 30, 1983, and if it
was not reenacted, the budgeted funds will not be spent.
Mayor Beals then opened the floor to public discussion of the proposed
budget, and asked for comments or questions from those present in the
audience.
Shirley Ann Ritch, President of the Chamber of Commerce, asked why the
Chamber's requested funds had been cut from $10,000 to $2,000.
Mayor Beals stated that he did not want to become involved in a one on
one dialogue with Mrs. Ritch at this time, but would rather allow all
those present to speak first; and then he would answer any questions
regarding the proposed budget.
Mrs. Ritch stated that the $2,000 would not even cover the Chamber's
expenses for services rendered to the City, which conservatively come
to $11,300; and include: (1) answering 900 letters of inquiry, (2)
answering telephone inquiries for information, (3) providing maps,
brochures, etc. of the area, (4) sponsoring Orange Blossom Breakfasts,
and (5) sponsoring the annual Labor Day Race.
Mrs. Bitch further stated that she felt the City was not aware of the
extent of the services, and asked who would take them over if they were
not provided by the Chamber, since the City had not budgeted extra money
to do so.
Chamber Members Betty Kimball, Joe Washuta, Marino Thomas, Dennis Horton,
Don Tracy, and others spoke in favor of the Chamber, citing its many
positive activities with regards to the business and residential
community, and asked the Council to reconsider its proposed funding.
Don Smith, Ed Klimas, A.W. Schultz, and others spoke in favor of reducing
funds for the Chamber, stating that the Chamber did very little for the
City and citizens who are not business owners to justify the $10,000
funding with taxpayer's money.

Council Member Dupoo stated that she felt the present Chamber was not
active enough. In the past, the Chamber had sponsored a Christmas Parade,
Little Miss Orange Bud Contest, an All States Picnic, and other activities
which were well received by the general public.

sponsor all of the activities for the general public that they would
like to, and the state of the economy with back to back freezes the past

There being no further comments from those present, Mayor Beals stated
that he would now like to respond as to why the Chamber's budget request
had been cut from $10,000 to $2,000. Mayor Beals stated that Clermont is
ideally situated in Central Florida, and like the rest of the State, is
growing in spite of the supposed negativism toward the Chamber. He stated
that historically it had been questionable to use taxpayer's money to fund -
a Chamber of Commerce, and he felt they should be a totally self-sustaining
organization, and should not be involved in politics as evidenced by the
last City Election. Mayor Beals stated that although Mr. Searles, Executive
Director of the Chamber, and he had had their differences, the budget was
not being cut because of this. The services being provided by the Chamber
simply did not merit $10,000 from the City.
Mrs. Ritch asked if the Board of Directors of the Chamber of Commerce removed
Mr. Searles from his position as Director, would the City put the requested

of the annual Labor Day Festivities and stated that the money had been pro-
vided in last year's budget with the understanding that the program would
be presented.

sustaining. However, he felt that this should be done gradually over a
period of time.

RESOLUTION NO. 447 - TENTATIVE SANITATION FUND BUDGET
Mayor Beals explained that the Tentative Sanitation Fund Budget included
$237,059 in expenditures and provides money for garbage and trash col-
lection, and the fees for this service will not increase this year.
Mayor Beals called for comments regarding the proposed Sanitation Fund

Mayor Beals explained that the Tentative Utilities Fund Budget includes
expenditures of $791,649 for water and sewer services of the City, and
that there would be no increase in water or sewer rates to support this
budget. Mayor Beals called for comments on the Tentative Utilities Fund
Budget from those present, and no one spoke for or against the proposed

Mayor Beals explained that this Resolution, if adopted, would allow the
Cooper Memorial Library to obtain matching funds from the Library Services
Construction Act to expand the existing building. City Manager Forbes
explained that there was a wording error in the second paragraph of the
Resolution and the words "City Council of" should be removed to correct

for the dock, and he states that you must maintain $100,000.00
in public liability and property damage insurance that names
and protects the City. There can be no waiver of this require-
ment, pursuant to a now agreement- signed by you holding the
City harmless of any liability because such statements are not
reliable in a court of law.
For these reasons I must respectfully request that you obtain
the proper liability insurance by July 20, 1983, or the City
may be forced to cancel your lease agreement on this property.

Last Tuesday T received a call. from Conmi.ss.ionor Claude Smoak re••
gardi.ng the Courthouse Annex. T. Keith ball., the County Tax
Collector, renewed his lease at the Sunnyside Plaza after. tile:
County Commissioners had agreed to use the old library building.
For this reason, it is my understanding that the County has now
agreed to lease space at Sunnyside Plaza, and respectfully re-
quest that the City allow them to withdraw from our agrcemenL-
for the old library building. While I am disappointed in this
turn of events, I believe that the concept of a Courthouse Annex
in Clermont is more important than the building in which it is
housed. Council direction is requested on this matter. I -ilso
received a call from the Community college and L•hcy are still
interested in using the bu.i.ldi.ng.
1111E SUNSHINE-PLAYERS
As requested by the COUnCil, I have cli.scusc;ed Lite operation or
the summer drama workshop with GoorgctL•e Miller. Phis workshop
was part of our Summer. Recreation Program. Mrs. Miller is now
sponsoring 'rho Sunshine pl ayor.s, a drama group for children aged
eight- through eighteen. Silo intends to sponsor three plays this
year, and has requested t:o use Jenkins for the performances. A
letter explaining the purpose of Lhc group is attached. I would
recommend that the City become a Pounding Patron of the Sunshine
Players with a one time donation of $100. This would assist the
new group and help offset her losses in our summer program with-
out setting a poor precedent.
CLERMONT HOTEL
A copy of a letter which was sent to Nick Duttitta requesting
that he press charges against anyone caught trespassing on hotel
property is enclosed.
ART FESTIVAL
On behalf of the Art League, Sue Mecanick has requested permission
to use the Highlander Hut and the area around Sparkling Water Lake

for the second annual Clermont Art Fosti.val,. 'Phe Fentival. would
be held in February, with a tentative (late of February 11th & 1.2th.
She has also requested permission to conduct a Haunted House for
Halloween. One was sponsored by the Parks and Rccr.eat:ion Board
with help from Barrio Rakow and Suc two ycar.s ago. It was very
successful. Possibly the old library building could be used for
this purpose again. Council direction is requested on this matP.er.
BUDGET HEARINGS
Since the County is conducting its tentative budget hearing on
Tuesday, September. 13th, the City will be required to move the
date of our final budget adoption. I would suggest that we hold
the final budget hearing on Wednesday, September 14, 1983, at
7:00 p.m. This change in dates is required because State Law
does not allow the City to conduct budget hearings on the same
day that the County or School Board conducts theirs.

REGIONAL PLANNING COUNCIL
The "Keynoter" Newsletter from the Council has been placed in all
Council packets. This newsletter discusses in detail. significant
changes in transportation funding.
LEAGUE OF CITIES
Enclosed arc two thank you letters which were sent to our local
legislative representative and senator from the League. They
requested that copies of these letters be distributed to all
Council Members.
BAND BOOSTER CLUB
Arlene Hanks has requested permission to sell chicken dinners at
Jaycee Beach Pavilion during the Art- Festival. Proceeds from the
sale will go to the Band Boosters. She has also requested to use
the City Logo on a game the Band Boosters wish to sell. (See
attached letter).
SENIOR CITIZENS CENTER
I received a call from Jerry McDowell, Executive Director of the
Lake County Council on Aging. He is now training an employee for
our building at Kehlor Park, and will be installing a phone in
this building. The phone number will be 394-5055. Initially, the
center will be manned from one to five each clay.
We are still socking Senior Citizens who would like to serve on an
advisory board for the center. All Council Members should try to

attend the Open House at Jenkins Auditorium on Friday, August 26th
from one to five.
CITY PROPERTY ON MOHAWK ROAD
Several. months ago we discussed it roqucst by real estate broker,
Keith Hogan, to sell City property located just off Mowhawk Road
(about one mile behind Citrus 'lower). The legal description of
the property is Lots 2 through 14, Bennet: Heights Subdivision.
As directed by the Council, I checked with the County and they
have no use for this property as a garbage landfill.
POLICE DEPARTMENT
Last week the Police Department issued 17 traffic citations and
responded to six vehicle accidents. There were no residential
burglaries and only one commercial burglary. Someone broke into
the office at Grandview Apartments and stole $275.
PUBLIC WORKS DEPARTMENT
The Public Works Department has been striping streets with thermal
plastic. Work was stopped on this project for awhile because we
had to order more white striping, but it will be finished next week.

money for advertisi.ne with no reference to Finanacc
Director or Chairman.

review or all activities and monies needed such as
food for dinners, etc. and then come to City worls hop
meeting and beg the other three councilmen to approve
our request. I have told Stokes that I will wort: with
him, but I will nest go to workshop.

THE SUNSHINh PLAYERS is a non-profit, community
org!.nlzation whose primary purposo is to promote
crc,ativo drama by pt•oducing plays for children
that are eithor by children or by adults.
Membership is open to any child age 8 to 18.
A workshop in which the children will share in
learning theater games, mime, improvisations, and - - - - -
other creative drama activities will be conducted
every Tuesday and Thursday afternoon, starting on
August 30th, from 3:30 p.m. until 5:00 p.m. at
the First Christian Church fellowship Hall at 796
Hook St., Clermont. The cost is $20., which includes
the $5. membership fee for the 1983-84 season.
The first formal production will be "Tom Sawyer"
which will be presented in November.

The fourth classification of patron is the Supporting

The Clermont Highlander Band Boostors' project this year is a per—
sonalized game, "The Game of Clermont". This game is set up and
played along the lines of Monopoly. vie would like permission to use
our city logo on the face of the board.
The four corners of the board are designed to personalize the game,
so we will list city hall and it's address, Clermont High School and
it's address and we will want to name a city park and housing area.
If you have any suggestions, we will certainly take them into con-
sideration.
The game is intended to represent our city of Clermont in a very
positive manner and will be available to the community before Christ-
mas. It will sell for 412.UU.
The 13and Boosters would also like permission to use the pavilion area
of Jaycee Beach for the sale of chicken dinners the two days of the

The supporting posts and the deck itself penetrate the side yard
setback requirement. The required side yard in the R-1-A zoning
