® CITY OF CLwIDNT MINUTES REGULAR CITY COUNCIL MEETING July 12, 1983 A regular meeting of the City Council of the City of: Clermont was held Tuesday, July 12, 1983 in the City Council Chambers. The meeting was called to order at 7:30 p.m. by Mayor Boals with the following Council Members in attendance: Mayor Pro Tom Pool, Council Member Cole, Council Member Dupee, and Council Member Turville. Other City officials present were City Manager George Forbes and City Attorney Baird. The Invocation was offered by Council Member Pool, followed by the reciting of the Pledge of Allegiance to the Flag by all in attendance. MINUTES The minutes of the Regular Meeting held June 28, 1983 were ap- proved as presented. CITY MANAGER'S REPORT COGENERATION It was reported that Mr. Paul Hobensack has scheduled a speaker on cogeneration for the Thursday, July 14th Lion's Club meeting. All Council Members are invited to attend this meeting at noon at the Village Inn. BUDGET WORKSHOP Mr. Forbes suggested that the Budget Workshop scheduled for Wed- nesday, July 20th be changed to July 21st because of a conflict with the meeting of the Lake County League of Cities. It was the consensus of Council to change the meeting date. BRIDGE INSPECTION It was reported that eighteen months after the City agreed to participate with the State Department of Transportation in a bridge inspection program , the contract has been awarded to the engineering firm of HNTB. A pre -inspection meeting with Mr. Dan McGonagle who represents this firm, will be held on July 18th. They will then inspect the bridge, meet with the DOT and issue a written report. WARRANTY INSPECTION FOR THE WATER PROJECT The City Manager reported that the one year warranty inspection of the water main project (Contract Ne.3) turned up ten minor de- ficiencies. The Contractor has sent the City a check for $2500.00 to pay for the repair of these items, and the City Engineer recom- ends that the settlement be accepted. The consensus of Council was to accept the $2500.00 settlement. WASTEWATER TREATMENT PLANT GRANT It was suggested that the status report on the Wastewater Treat- ment Plant Grant be tabled until the Budget Workshop meeting on July 13th, and that the meeting be a combined special and budget meeting. The consensus of Council was to table the report. INDUSTRIAL REVENUE BONDS FOR LAKE HIGHLANDS NURSING HOME The City Manager stated that he had received a call from Mr. Herb Rogers requesting that the City sign for Industrial Reven- ue Bonds to finance the construction of the Lake Highlands Nursing Home addition. Mr. Baird reported that he has been in contact with both the Orlando bank which is providing the funds and the bond counsel in Tallahassee. CHESTNUT STREET PARK It was reported that the question of the fence at the Chestnut Street Park would be treated at a workshop meeting. BOAT DOCKS ON CITY PROPERTY The City Manager reported that requests are received from time to time for permission to build private boat docks on City property. These requests have been denied because of City liability and other legal implications, and each has been treated separately. It was requested that a formal policy be drawn up, and the consen- sus of Council was to do so. CENTER LAKE WEEDS Mr. Forbes reported that the Director of Public Works had con- tacted a firm in Umatilla that specializes in underwater weed cutting. Their estimate for cutting the weeds in Center Lake was approximately $4200.00, and the results would be effective for about three years. It was decided to discuss the subject further at the workshop meeting. SUMMER RECREATION PROGRAM It was reported that Martha Wilson, director of the Summer Ath- letic Program, had requested help with funding of four field trips she would like to offer to the participants in the pro- gram. The total cost of bus transportation for these excursions would be $645.00. After much discussion, A MOTION WAS MADE BY MR. POOL, SECONDED BY MR. COLE AND UNANIMOUSLY CARRIED TO ALLO- CATS $200.00 TO THE PROGRAM AND EVALUATE THE DECISION AT A LATER DATE. City Manager Forbes reported that a donation of $50.00 had been made earlier in the year by Gail Yemington and some friends for the benefit of the Recreation Program. She has requested the use of that money to defray the cost of sets and other equipment for the theater program she is operating in the Summer Program. It was the consensus of Council to make the allocation. MURPHY ACT DEED The City Manager explained that the County Public Works Department had requested right-of-way information on two lots on Linden Street held under a Murphy Act Deed. Mr. Baird stated that he would approve of the letter giving the information, and if it did not meet his approval, the matter would be treated at a workshop meeting. COUNCIL MEMBER DUPEE'S REPORT LIBRARY BOARD Mrs. Dupee reported that the County Commissioners had voted to accept the budget recommendations of the County Library Board and fund the County Library System with $40,000 next year. $12,500 of this goes for the salary of the area director and the rest will be split among the various libraries in the system. CITY OP CL6RAIONT MINUTES REGULAR CITY COUNCIL MEETING July 12, 1983 Pago three EAST CENTRAL FLORIDA REGIONAL PLANNING COUNCIL Council Member Dupcc reported that she will be attending the Board of: Directors' meeting for the ECFRPC on Wednesday, July 20th. COUNCIL MEMBER POOL'S REPORT Mr. Pool slated that he had received a letter from Mr. Ernest Schuman complaining of dogs barking at night. The City Manager said he had received a copy of the same letter and would answer it, stating that the Code Enforcement Board had been successful in handling such situations. FLORIDA LEAGUE OF MUNICIPALITIES Mayor Deals announced that the 57th Annual Convention of the Florida League of Municipalities will be held from October 13th to October 15th at the Orlando Myatt Hotel, and that the cost to attend is $65.00 for City Officials and $25.00 for spouses. He urged Council Members to attend. The Mayor then read a letter from mayors of four cities request- ing help in finding a candidate for President of the Florida League of Cities to oppose Larry Kelly. Mr. Forbes asked which Council Members, will attend the League of Cities meeting next Wednesday, and received positive responses from all but Mr. Cole, who will call in his decision. TRAFFIC PROBLEM AT HOOK STREET - HIGHWAY 27 Mayor Beals read a letter addressed to the State Department of Transportation Traffic Engineer requesting installation as soon as possible of the flashing light which has been approved for the intersection of Hook Street and Highway 27. VISITORS WITH BUSINESS MR. BERNIE LEVIN - REQUEST FOR OPEN-AIR NEWSSTAND The Mayor explained that a request had been received for estab- lishment of an open-air newsstand in the Winn Dixie shopping plaza, and that open-air sales permits may be granted by the City Manager for periods up to 30 days, but that Council approval was necessary for longer periods. He read a letter from the Clermont- Minneola Lions Club in support of the venture. Mr. Richard Reynolds, owner of the shopping center, spoke for Mr. Bernie Levin, who will operate the newsstand, explaining that he will stock big -city papers and other publications not available except in Orlando. It was stated, in response to a question, that no pornographic materials will be stocked. It was sug- gested by the City Attorney that the words "or a recommendation by City Staff" be added to item six. It was the consensus of Coun- 83-116 cil to make the amendment. NEW BUSINESS IN`1'RODUCTION OF ORDINANCE 155-M Mayor Beals explained that this Ordinance is for the annexation of land east of the present City Limits owned by Bob Wade. The City Manager pointed out that the legal description had not yet been rewritten to exclude a portion of• land at the east end of the property under consideration because Mr. Wade's attorney is out of town. COUNCIL MEMBER POOL INTRODUCED ORDINANCE 155-M LAKE COUNTY PLANNING AND ZONING MEETING Mr. Adelbert Evans reported that after the Lake County Planning and Zoning meeting, the County Commission acted on a request by Jahna Industries for a Conditional Use Permit, and that all. of the City's requests were addressed by the Commission, and were satifactorily resolved. RIiQDEST: For a C.U.P. to expand Emerald Lakes Mobile Home Park by the addition of approximately 35 units. COMMENTS: Mobile home parks are a conditional use in an R-3 zone, and any expansion or additions to a mobile home park require a Conditional Use Permit. The Zoning Ordinance classifies two types of uses - Permitted and Conditional. Permitted Uses require the City to issue a building permit on the basis of an ap- plication for a permit alone, without any further review, as long as all the conditions of the City's Zoning'. Ordinance are met. Permitted uses are allowed throughout a particular zoning district. Conditional Uses require special approval by the City Council after a recommendation is made by the Planning and Zoning Commission. Conditional Uses are uses that may be appropriate in some locations within a zoning district, but only if certain conditions can be met. The Clermont Zoning Ordinance states that a Conditional Use Permit may be granted only if the following condi- tions are met: 1. The proposed use is desirable at the particular location. 2. The use will not be detrimental to the health, safety, or general welfare of persons working or residing in the vicinity. 3. The proposed use will comply with the regulations and conditions in the City Codes for such use. 4. The Conditional Use will not adversely affect the Emerald Lakes CUP Page two officially adopted Comprehensive Plan of the City. In granting a CUP the City may impose conditions deemed necessary and desirable to protect the general welfare in accordance with the interest of the Zoning Ordinance. Section 26-26 of the Zoning Ordinance is attached. This section provides for specific standards which must be met before a CUP can be issued for a mobile home park. The City Zoning Ordinance also states that a mobile home park must have a minimum of ten (10) acres. If this CUP is granted we would recommend that the fol- lowing conditions be met: 1. The property must be developed in accordance with the attached site plan. 2. No further expansion of the use or additions to the mobile home park shall be permitted except as -,ap- proved by another CUP. 3. All applicable rules and regulations shall be met, including final site plan approval, landscaping, parking and sign regulations. 4. This property may be used only as a mobile home park with a maximum of 32 units. Only one mobile home per lot is permitted, as shown on the site plan. 5. -The final Certificate of Occupancy cannot be issued until each of the stated conditions has been met. 6. This permit shall expire if construction has not begun within one year of the date of this CUP. 7. If any of the stated conditions is violated, the ap- plicant understands and agrees that the City may revoke this CUP by resolution. 8. There must be a minimum setback line of twenty (20) feet from the center line of interior streets. 9. There must be a minimum building setback line of twenty-five (25) feet from City streets. 10. Setbacks from lot line shall be five (5) feet minimum (except in the case of corner lots, in which case the setback shall be seven and one-half (72) feet on the side street.) Rear, five (5) feet minimum. 11. There shall be a buffer strip along the rear and side property lines of the trailer park except where such property lines are common to street rights -of -way.
