December 28, 1982
A Regular Meeting of the City CounC.l.l of. the Clf.y of Clermont was
held December 28, 1982 i.n the City Council Chamhers. The Meet,Lng
was called to order by Mayor lloskinson tit 7:30 p,si, wLth the follow-
ing Clouncil.nien ll, attendance: Iial. Turville, Boh Pool, and Michael
Conley, Other City Official.", present were: City Mteu"l;cr Forbes
and Deputy City Cto rk Brandt.
The invocati.on was offered by Mayor Iloskinson, foll.owed by the re-
peating of the Pledge of Allegiance by all present.
MINUTES
A motion was made by Councilman Turvi.11e, seconded by Councilman
Conley and unanimously carried to approve the Minutes of the Regular
Meeting held December 14, L982 as presented.
CITY MANAGER'S REPORT
HOLIDAY GARBAGE C01,I,LiCTION
The Council Members and citizens present in the audience were reminded
of the revised collection schedule for this week due to the New Year's
Holiday.
ORGANIZATIONAL MEETING
It was reported that the first Council Meeting in January will be the
Organizational Meeting for the Council, and at this meeting appoint-
ments will be made to the various City Boards and Commissions.
MAYOR'S REPORT <)_
Mayor lloskinson stated that lie had enjoyed serving the City of Clermont
during the past two years, and thanked the citizens for allowing him the
privilege.
COUNCILMAN CONLEY'S REPORT
Councilman Conley stated sentiments similar to Mayor Hoskinsons-and
thanked the citizens for allowing him the privilege and honor of being
able to serve them during the past two years.
COUNCILMAN TURVILLE'S REPORT
Councilman Turville stated that lie had been by the new well site on
Minnehaha Avenue and asked if the landscaping around the building was
complete. He felt that more shrubbery was needed to make the site more
aesthetically pleasing. After some discussion, it was the consensus of
the Council to have further landscaping done at the new well site. Mr.
Forbes stated that he would take care of this matter.
VISITORS' uni BUSINESS
MR. NICK BUTTITTA - CLERMONT HOTEL
Mr. Nick Buttitta appeared before the Council to give a status report
on the Clermont Hotel. On July 27, 1982 the Council granted Mr. Buttitta
a 150 day extension to obtain permits and begin renovations at the hotel
or legal action would be taken. This extension expired on December 27,
1982 and no permits were obtained or renovations begun. Mr. Buttitta
stated that because of certain economic conditions he had filed for Chap-
ter Eleven reorganization which gives him 180 days to come up with a
plan for his assets. He stated that he was 120 days into.thp, required time
frame and asked the Council for a sixty day extension on the hotel prop-
erty. Mr. Buttitta stated that he would be able to make the final de-
termination as to what will happen to the hotel at the end of the sixty
days. After some discussion, A MOTION WAS MADE BY COUNCILMAN CONLBY TO

After further discussion, it was decided that City Attorney Baird will
need to give a legal opinion on beginning condemnation proceedings while

MR. .JACK SARGENT - ANNUAL RHWORT LAKE APOPKA NATURAL GAS DISTRICT
Mr. Jack Sargent, Clermont's representative on the Board or Directors
of the Apopka Natural Gas District appeared before the Council to give
the District's Annual Report. Mr. Sargent gave a brief history of the
district which began in 1959. It was noted that when Mr. Sargent went
on the Board in January of 197S, the district was delinquent in three
interest and seven principal: payments, but by the end of PY 1978 all
payments were brought up to date. It is the district's expectation
that by the end of FY 1984, or shortly thereafter, it will have re-
serves covering all outstanding bonds. Mr. Sargent noted that customers
and revenues continue to increase. lie stated that the past year was a
good year for the district. Not excellent, but good. At the conclusion
of his report, Mr. Sargent requested that lie be re -appointed to the Board
of Directors of the Lake Apopka Natural Gas District.
OLD BUSINESS
RESOLU'PION NO. 417 - POLICY ON TRIMMING OR REMOVAL OF SHORELINE
VEGETATION ON CITY OWNED PROPER'l'Y
Councilman Turville stated that lie wished to clarify a statement which
was printed in the "Little Sentinel" section of this morning's Orlando
Sentinel. Resolution No. 417 is concerned with City owned lake front
property, not private property. lie stated that Resolution No. 417
was written to restate and clarify the City's policy on trimming and
removing shoreline vegetation on City owned property. Mayor Hoskinson
asked that if the average high water mark was changed by local regula-
tory agencies, can the policy still be enforced. City Manager Forbes
stated that this would not cause any problems because a new resolution
82-202 could be drafted. After some discussion, A MOTION WAS MADE BY COUNCIL

OATH OF OFFICE ADMINISTERED
At this time Mayor Hoskinson recessed the Council Meeting and the newly
elected Council Members Ann Dupee, Lester Cole, Charles Beals, and Bob
Pool were sworn in by Deupty City Clerk Brandt. Mayor Charles Beals
presented plaques of appreciation to out -going Mayor James Hoskinson
and Councilman Michael Conley.

Mayor Charles Beals reconvened the meeting and stated that the chair
was open for nominations for Mayor Pro Tem of the Council. Council
Member Hal Turville nominated Council Member Robert Pool for the
position. With no further nominations from the floor, nominations were

City Manager Forbes explained that :in the punt, the City has sold
the sludge to grove owners, and that this has been in :innovative

REQUEST TO [is]: BISHOP 1:11:I,D - FLORIDA PROFESSIONAL, BASEBALL SCHOOL
City Manager Forbes reported that Mr. Denny Doyle of the Florida Pro-
fessional Base ball School was again requesting the use of Bishop
Field from February 21st to April 9, 1983 from 8:30 a.m. to 3:30 p.m.,
Monday through Friday for professional instruction of youth in baseball
fundamentals. The dates and times have been cleared with the Babe Ruth
League and the High School. In return for the use of the field, the
school will make a $200 per week donation to the City for each week of
use. Mr. Forbes stated that they have used the field in the past, and
there were no problems; and recommended that they be allowed to use the
field as requested, and that the monies received be placed in the City's
Recreation Account for future improvements to the City's ball fields.

CHAMBER OF COMMERCE LEASE - OFFICE SPACE IN JENKINS AUDITORIUM
It was reported that the Chamber of Commerce's third and final option
period in the three year lease for office space in Jenkins Auditorium
was up for renewal. In the past, the Council has requested that their
rental fee for the space cover part of the cost of utilities used in
the building. The Chamber has offered to increase their office rental
82-206 fee from $40 to $45 per month for the third year of their lease. A

MANHOLE REHABILITATION PROJECT
Mayor Beals reported that Altair Maintenance Services had been hired in
March of 1982 to repair manholes damaged by hydrogen sulfide in the sew-
age and agreed to honor their bid price :for a period of one year from the
original contract signing, or until March 11, 1983. In early December
eleven additional manholes were found to need repairs for the same reason;
and Altair Maintenance Services agreed to repair these manholes at a cost
of $7,010.58 with a one year work guarantee. After some discussion, A
MOTION WAS MADE BY COUNCILMAN TURVILLE TO ALLOW ALTAIR MAINTENANCE SERVICES
TO REHABILITATE THE ELEVEN MANHOLES AT A COST OF $7,010.58. At this point,`
City Manager Forbes explained that he had met with Mr. Herb Rittger of
Altair Maintenance late yesterday afternoon and upon inspection found two
deep manholes which were repaired last year to have an improperly adhering
final protective coat after a second re -inspection. In light of these
developments, Mr. Forbes recommended that the rehabilitation of the eleven

STREET MAINTHNANCE PROGRAM
It was reported by City Manager Forbes that an inventory of till City
Streets had been completed, and the street:S rated good, fair, or poor
according to twelve types of defects. It was recommended that those
streets receiving the lowest t•at:ing be ovcrlayed w1th I1otmLx as part
of the FY 1982-1983 Street Maintenance Program. After some discus-
sion, it was the conselisus of the Council to go ahead with the Street
Maintenance Program as exp.l.a:i.ned in the City Manager's Mmno to the
City Council dated December 22, 1982 till Let bids for the asphalt
work which will be submitted to the Council on January 25, 1983..

ORGANIZATIONAL MEETING
Several months ago Mrs. Margaret Woathcrboe expressod an interest
in being appointed to the I'I:uucing and Zoning Conunission, Attached
are letters from Joe Washuta and Buck Evans requesting reappoint-
ment to the P $ Z.
SEABOARD COASTLINE RAILROAD
The Seaboard Coastline Railroad is planning to abandon the railroad
tracks from Winter Garden to Groveland (19 miles of track). This
would eliminate rail service through Clermont.
DEPAR'I'MEN'I' OF TRANSPORTATION DIVE YEAR WORK PROGRAM 19B3 - 1988
We have received a notice from the County regarding a Public Hearing
With the State Department off ransportation on their five year con
struction plan. The DOT is 1ow reviewing

Meeting.
If we have any comments or requests, a representative of the City
should attend this meeting, however, we can forward our comments to the
County who in turn will present them on our behalf. I would suggest
that we discuss the completion of the four lining of ilighway 50 to
Groveland with the DOT officials.
GENERAL. REVENUE SHARING AND CITY FINANCES
The world of municipal finance is changing rapidly. You may recall
that the City's Revenue Sharing funds were reduced by $12,899 this
year due to the 1980 census, the five year residency requirement to
obtain the full $25,000 homestead exemption has been declared uncon
stitutional, sales tax revenues are falling behind projections and
adding to this, a petition to amend the State Constitution has been
filed limiting the revenues of City governments.
A quickly approaching problem for the City is the Federal Revenue
Sharing Program which will expire on Sit is

eptember 30, 1983 unless

roauthorl.zcd by Congress. I would not take the reauthorization
of this program for granted since it flies in the face of the
Prosident's "New Federalism" initiative. 'rho key date to keep
in mind is May 15, 1983. This is the date when the first Budget
Resolution for I:Y1984 must be passed. To assure funding funds
for Revenue Sh:n•ing must be included in this first Budget I1e80-
lution.
-file CLty will receive $47,057 from the program this fiscal year,
most of which will be used to finance capital improvements, rho
elimination of the program would greatly reduce the City's ability
to purchase new equipment.
Revenue shortfalls in the 1982-1983 budget may require a budget
amendment to appropriate additional revenues from cash reserves.
STATE CONSTITUTIONAL AMENDMENT
It appears that the Citizens for Tax Relief have obtained enough
signatures to place a Constitutional Amendment on the 1984 Ballot.
'This amendment would set revenue constraints for municipalities.
According to the last "Florida Finance Officers Newsletter" some
of these restrictions include: - ---
1. No annual adjustment of revenues can exceed 5% of the
ad valorem taxes obtained during the proceeding fiscal
year.
2. The initial revenue limit shall begin at 11Y1980 (base
year) plus any subsequent changes for new construction
only.
3. Revenue limits may be exceeded only by voter approval
for specific purposes and for a specific period of
time.
In as much as this amendment could easily be adopted by referendum
in 1984, all Council Members should be aware of its ramifications.
CLEANING MONUMEN'rs IN OAKHILL CEMETERY
As requested by the Council, we have inspected monuments in Oakhill
Cemetery and had many of them cleaned by a young Clermont Boy Scout,
Chad Matthews. Mr. Matthews worked six hours .for the City as part
of his Community Service Project. We were very pleased with his
help.

The next meeting of the Clermont Chamber of Commerce will be held

Thank you for your letter dated December 28, 1982 regarding
the public hearing on DOT'S five year work program.
Enclosed is a copy of Resolution No. 392, adopted by the City
Council in March of 1982. This Resolution requests that DOT
include in its five year plan the completion of four-laning
Highway 50 from Clermont• to Groveland.
You are aware that the present four-laning of Highway 50 will
extend only one mile west of Clermont, and is far short of
reaching the City of Groveland.

Subject: Manhole Rehabilitation
Date: December 22, 1982
Each year the Utility Department conducts an inventory of sewer
manholes, and this year eleven manholes were found to be in need
of repair due to damages caused by hydrogen sulfide in the sewage.
You may recall that last year the City contracted with Altair '
Maintenance Services to repair damaged manholes. They were awarded
this contract from the bids received by the City; and agreed to honor
their bid price for a period of one year from the original contract
signing, or until March 11, 1983.
I would recommend that the City allow Altair Maintenance Services to
rehabilitate the manholes specified in the attached letter at a total
cost of $7,010.58. All work will be done according to City specifica-
tions dated March, 1982, Altair's bid proposal dated March 2, 1982;
and a one year guarantee of all work will be required.
The City has $12,000 budgeted for this project. I would also recom-
mend that the City Staff be allowed to prepare bids for the cleaning
of sewer lines using a sewer jet cleaner. By hiring a contractor to
clean those lines in greatest need of maintenance; the City could
then utilize the remainder of the project funds.

work on the manholes previously completed and our crew is
presently reworking all defects. We are prepared to complete
all rework to the satisfaction of the city prior to starting
any new repairs.

I was disappointed that the final protective coat was still not
adhering to the two deep manholes. I would suggest that you have
a manufacturer's representative investigate this problem.
The city appreciates your prompt attention to this rehabilitation
work, but we are disturbed that all of the manholes were still not
acceptable after our second re -inspection.
Please notify my office as soon as the manholes listed above are
repaired so we can schedule another final inspection.

Date: Decomber 22, 1982
We have completed un inventory of all City streets tnnl rated the
condition of the pavement.. Every street in the City was inspected
according to twelve types of defects (examples of defects arc trans-
verse cracks, rutting, deficient drainage, etc) and gi.vcn a name ri-
cal rating. The pavement condition was then ranked as good, fair,
or poor.
We arc recommending that the streets with the lowest ranking he over-
layed with Ilotmix this year. unclosed is a list of these streets and
a map showing the areas we are recommending to be overlayed.
Much of the pavement we are recommending to he overlayed is double
surface treated and has never been overlay" with liotmix asphalt.
Beginning next year, we will probably utilize a scaling program to
increase the life of our streets.
We are also participating in a study sponsored by the American Yuhlic,,. _
Works Association which will help us to optimize our investments for
street maintenance.
I would recommend that the maintenance of those streets on the
attached list be approved for the City's 1982 - 19H PY Street Main-
tonance Program.
We have requested bids for the asphalt work, and the bids will be
submitted to the Council at our second meeting in January.

Sludge Bids

For the past three yyears the City has awarded bids for the disposal
of sludge produced by the Clermont Waste Treatment Plant. The City
has sold the sludge to grove owners and the successful bidder was
required to transport the sludge from the plant at his own expense.
This has been an innovative approach because most cities have a
difficult time just disposing of their sludge. The City of Clermont
has actually been selling its sludge and making money on this pro
duct, and at the same time eliminated the problem of hauling it to
a disposal site.
In the past, we have only received one bid for the sludge, and this
year no bids were received. In this matter the City has three options:
1. Rebid the specifications for sludge disposal.
2. Do not rebid this project, but place ads in the newspaper ----`'+
that the sludge is available free of charge to any citizen
who wishes to haul it away.
3. Pay a contractor to haul the sludge away from the plant.
I would recommend rebidding the present specifications before consider-
ing options two and three.

Subject: 1982 - 1983 Street Maintenance Program
Date: December 22, 1982
We have completed an inventory of all City streets and rated the
condition of the pavement. Every street in the City was inspected
according to twelve types of defects (examples of defects are trans-
verse cracks, rutting, deficient drainage, etc) and given a numeri-
cal rating. The pavement condition was then ranked as good, fair,
or poor.
We are recommending that the streets with the lowest ranking be over-
layed with Hotmix this year. Enclosed is a list of these streets and
a map showing the areas we are recommending to be overlayed.
Much of the pavement we are recommending to be overlayed is double
surface treated and has never been overlayed with Hotmix asphalt.
Beginning next year, we will probably utilize a sealing program to
increase the life of our streets.
We are also participating in a study sponsored by the American Public
Works Association which will help us to optimize our investments for
street maintenance.
I would recommend that the maintenance of those streets on the
attached list be approved for the City's 1982 - 1983 FY Street Main-
tenance Program.
We have requested bids for the asphalt work, and the bids will be
submitted to the Council at our second meeting in January.

Baseball School

Enclosed is a letter from the Florida Professional Baseball School
requesting the use of Bishop Field from February 21st through April
9th, 1983, from 8:30 a.m. to 3:30 p.m., Monday - Saturday. They
will be using the field for the professional instruction of youth
in the fundamentals of baseball.
In return for the use of the field, the school will make a $200
per week donation to the City for the weeks their program is in
operation. They have cleared the dates listed above with the High
School and Babe Ruth League.
Last year this school used Bishop Field and caused no problems. I
would recommend that the Council approve their request to use Bishop
Field on those dates mentioned above.
