82-186 82-187 82-188 ® CITY 0P CGRRMONT MINUTES REGULAR MEETING November 23, 1982 A Regular Meeting of the City Council of the City of Clermont was held November 23, 1982 in the City Council Chambers. The Meeting was called to order by Mayor Hoskinson at 7:30 p.m. with the following Councilmen in attendance: Michael Conley, Hal Turville, and Bob Pool. Other City Officials present were: City Manager Forbes, City Attorney Baird, Finance Director Saunders, and Julie Brandt. The Invocation was offered by Mayor Hoskinson, followed by repeating of the Pledge of Allegiance by all present. CITY MANAGER'S REPORT FLUORIDE GRANT It was reported that the City has been informed that to complete the fluoride grant it must have the City Engineer prepare a cost estimate for installing fluoride equipment in the City's three water wells (including engineering fees) for State approval. After some discussion, A MOTION WAS MADE BY COUNCILMAN LNUINLLK UKAW UI' A UuaI c31119MIL ruil in InLLuw I. --- ---- TRUCK PARKING - CITY HALL PARKING LOT It was reported that trucks parking in the City Hall Parking lot had damaged the new fence installed on the property of an adjoining business and complaints had been received regarding the trucks blocking the view of the businesses. It was discussed that truck parking no longer be allowed in the City Hall Parking Lot. Councilman Conley stated that the City received no benefits by allowing the parking. Mayor Hoskinson stated that he felt that "storage parking" was a reasonable use of the area, otherwise it would just be a vacant lot. He sug- gested that "No Overnight Parking" signs be placed in the lot. After some discussion, A MOTION WAS MADE BY COUNCILMAN CONLEY, SECONDED BY COUNCILMAN TUR- VILLE T0, AFTER A REASONABLE WARNING PERIOD OF TWO 41EEK5, NO LONGER ALLOW TRUCK PARKING IN THE CITY HALL PARKING LOT. After further discussion, Councilman Pool called for the question AND THE MOTION CARRIED BY A THREE TO ONE VOTE, WITH MAYOR HOSKINSON VOTING NAY. LOUISE ARNETT TRUST - $300 GIFT TO CITY FOR FAMILY MONUMENT CARE It was reported that a letter had been received from Attorney Tom Dougherty stat- ing that Louise Arnett had left in trust $300 to the City of Clermont for the periodic cleaning of the monuments in Oakhill Cemetery belonging to Mr. George Faulke and herself. It was discussed that the City may not wish to accept this money because the City does not clean monuments, and if the City would clean two monuments, then it should clean others. After some discussion, A MOTION WAS MADE BY COUNCILMAN CONLEY AND SECONDED BY COUNCILMAN TURVILLE TO NOT ACCEPT THIS MONEY BECAUSE THE CITY DOES NOT WANT TO SET A PRECEDENT IN THIS MATTER. City Attorney Baird stated that he felt the recommendation was appropriate. Mayor Hoskinson stated that he had a moral feeling to carry out Mrs. Arnett's wishes but agreed that the City was in no position to do it. The Council discussed the fact that in the future it may be best if the City checked into the cost of having all the monuments cleaned. Councilman Conley called for the question, and the MOTION CARRIED BY A THREE TO ONE VOTE WITH COUNCILMAN POOL VOTING NAY. MAYOR'S REPORT SAND BUILDUP AT CORNER OF HOOK AND HIGHWAY 27 Mayor Hoskinson requested that City Manager Forbes bring the sand build up problem at the corner of Hook Street and Highway 27 to the attention of the Department of Transportation. The sand on the pavement makes the area very slippery. City Manager Forbes stated that he would take care of this matter. OLD BUSINESS VARIANCE REQUEST 760 EAST DESOTO STREET - LINCOLN PARK APARTMENTS ® CITY 0P CLrIMIONT MINUTES REGULAR I4EETING November 23, 1982 Mr. Arthur T. Lowery appeared before the Council to discuss his request for a variance to build an eight unit apartment building instead of the sixteen units originally requested. Mr. Lowery specifically asked for a "density" variance. The sixteen units which prosently exist on his property slightly exceed the density requirements allowed by the City's Zoning Ordinance, Councilman Tur- ville questioned Mr. Lowery regarding available parking spaces for the tenants. Fie also asked Mr. John Flowning who was in the audience to explain the original development plans for the apartments. Mr. Flemming stated that upon the death of Mr. Preston Maynard, the original developer of e apartment complex, he be- came Administrator of the Estate for Mrs. Maynard. At that time, the are the a between the two existing apartment buildings was designated as a garden and play area for the tenants' children and that there never was any plan for development of the middle two lots. Councilman Turville asked Mr. Lowery if there were any deed restrictions on this property, and he stated that there weren't any. City Attorney Baird stated that the only issue to be decided by the Council was if they were going to grant the "density" variance. Fie explained that 24,000 square feet of area was needed to meet the zoning requirements. Mr. Lowery's property is 900 square feet short of the requirements, and if Mr. Lowery only built seven units, no variance would be required. City Manager Forbes stated that the entire complex should be considered, not individual lots for the density requirements. It was clarified that if this variance was granted, it would be only a variance from the City's density requirements. All other requirements of the City must be met, including proper parking ingress and egress. Mayor Hoskinson called for any 82-189 continents from the audience. After much discussion, A MOTION WAS MADE BY COUNCIL- .._.. __... _.. ...- - ---- -- ...r n �rin i-� Tn I'll ,InTC Tn NEW BUSINESS VARIANCE RE UEST FOR 1699 PEIJZANCE ROAD LOT 6 & SW 20' LOT 5, BLOCK 2, RIVIERA HEIGHTS -LOT 47IDTF1 VARIANCE AT BUILDING SETBACK LINE - Attorney George Hovis appeared before the Council to request a lot width variance on property located at 1699 Penzance Road. Mr. Hovis explained that this property is located in an area which contains several odd shaped lots that do not comply with the City's present zoning and that existing structures on other lots in the area do not in many cases conform with the City's present zoning setback and lot width requirements. The present zoning regulations present a hardship because there is no land available to meet the required 100' lot width at the building setback. Mayor Hoskinson, for the record, read a list of people who opposed the granting of this variance: Thurman G. Lillard, Jr. of 1636 4th Street, Mr. George Schroedel of 1626 4th Street, and Mr. Charles K. Wynn of 1721 Penzance. Mr. Saunders then listed seven budget amend- ments which are required for this reason. Also, three budget amendments were recommended to be made and funded from the City's Cash Reserves. The following amendments to the 1982-1983 Budget are needed to meet this requirement: 1. Public Works Account Number 541-6300 Capital Outlay - Streets and Side- walks should be increased $67,525. This is the balance of monies bud- geted last year for work that will not be completed until the current year. 2. Public Works Account Number 541-4630 Repair and Maintenance - Street Signs should be increased $389.32 for materials ordered last year but not received or invoiced until the current year. 3. Public Works Account Number 572-4640 Repair and Maintenance - Parks and Trees should be increased $56.81 for supplies ordered last year but not received or invoiced until the current year. 4. Public Works Account Number 572-4610 Repair and Maintenance - Buildings should be increased $2,871 for painting the Jaycee Beach Pavilion. It was budgeted last year but not completed or invoiced until the current year. 5. Fire Department Account Number 522-5240 Minor Equipment should be in- creased $170.00 for equipment ordered last year but received and in- voiced in the current year. 6. Administration Account Number 513-6400 Capital Outlay should be increased $9,889.00 which included $5,675 Building Renovation, $3,264 Mechanical & Electrical Improvement, and $950 Miscellaneous allowance for City Hall renovations. These expenditures were authorized in the previous year but were not completed or invoiced until the current year. 7. Police Department Account Number 521-6400 should be increased $18,483.25 for the purchase of new radio equipment authorized in the previous year but will be received and paid for during the current year. In addition to the above amendments, I recommend the following two budget amendments be made and funded from the City's Cash Reserve: 1. Public Works Account Number 541-6300 Capital Outlay - Streets and Side- walks be increased $5,000.00 for storm drain installation. This expen- diture was authorized in the previous year. This was the City's share of the Broome Street construction which was charged to this account. This amendment will restore this line item to the original amount set aside for repair- ing existing streets. 3. Salaries and Benefits should be increased due to revised information received from our actuaries for required contributions to our General Employees Pension Fund. The original contribution amount for the current year was $31,582. However, this actuary assumption did not include all current employees. The last day to qualify for the December 7th Council Election is 5:00 p.m, on Monday, November 22. 1982. CITY SERVICES DURING HOLIDAY. Next Thursday and Friday City Hall will be closed far the Than'ksgsving Itoliday. Garbage will be collected on Friday and Saturday. Homes that normally receive garbage collection on Thursday will be picked up on Friday, and Friday's collection will be on Saturday. FLUORIDE GRANT. This week we contacted Linda Greis of the State Depart- ment o-fieaTtFanifc Ttehabilitative Services regarding the status of the City's grant to place fluoride in our water supply. I was informed that the City must now take the following steps to com- plete this project: 1. The City Engineer must prepare a cost estimate for installing fluoride equipment in our three water wells. This cost estimate must also include Engineering fees. 2. Once the cost estimate is approved by the State, we may proceed to complete plans and specifications, and apply for DER permits for this project. 3. When bids for this work are opened, the State will approve the final bid award and we will then receive grant funds for this project. The present State Budget for this program goes until June and the State is approving funding on a first come, first serve basis. I would recommend that the Council immediately authorize the City Engineer to prepare cost esti- mates for this project. UTILITY DEPARTMENT. One thing that the Utility Department would like to mention regarding the Fluoride Program discussed above is that the City should construct a well housing over the Seminole Well to protect the water system equipment. Some of the equipment is deteriorating badly because it is left out in the weather. This week the Utility Department has been excavating and repairing sewer lines clogged by tree roots. They worked on this problem at 8th and Juniata Streets and on Lake Avenue just south of Chestnut Street'. On Thursday water lines were flushed. FINANCE DEPARTMENT. We have received revised sales tax projections from the State. The new estimates show an average reduction in the local portion of the sales tax collection of about 9%. However, so far this proposed reduction has had little effect on our budget projections. The 1982-1983 Fiscal Year Budget projected $111,280 in revenues from the State, whereas $110,858 is the latest projected figure. Please note, in the year end financial report which i 1 Page -2- Weekly Memo November 18, 1982 was submitted to you last week, I noted that sales tax and interest earnings must be carefully monitored this year. POLICE DEPARTMENT. Last Thursday, the Police Department held another Crime Watch Seminar for the citizens who live in various sections of the south side of the City. We have hired a School Crossing Guard for the Highway 50 and Bloxam Avenue intersection. HIGHLANDER HUT. During the past few years we have remodeled and/or repainte�C -most facilities, and they are now in good condition. In the last two years, we have reroofed and repainted the exterior of the Highlander Hut. This year we plan to remodel the interior by installing a dropped ceiling, replacing the heating system, and painting. It has been many years since any work was done to the interior of the building, and this facility needs the improvements. I will keep the Council informed on this matter. PUBLIC WORKS DEPARTMENT. The Public Works Department has been repair- ing sidewalks at Seventh and Broome Streets and on Montrose Street near Crystal Lake. TRUCK PARKING. For several years trucks have been using the City Hall Parking Lot as a truck stop for overnight parking. We have not com- plained about this situation since there are few places for truckers to use in the area. However, more and more truckers are beginning to use the lot, and they are causing some problems for nearby business owners. I would recommend that we post "NO TRUCK PARKING" signs in our parking lot. I would like your direction on this matter at Tuesday's meeting. SALES TAX. There was an article in Friday's paper regarding checks being he d back in most Lake County Cities for failure to send required I documentation to the State Department of Revenue. This documentation includes the resolution setting our millage and budget ads. The City of Clermont did send the required information months ago; and I have resolved this matter with the State.
