7:90 p.m. by Mayor Hoskinnon, with Lhe following Councilmen 111 attendance:
Michael Conley, Robert fool, Dennis Thonuu:, and Hill. T'urvill.e. Other City
Officials present were: City Manager Forbes, City Attorney ;laird and City
Clerk Rozar.
The Invocation was offered by Dennis Thomas, followed by repenting of the
Pledge of Allegiance by all present.
MINUTES
A motion was made by Councilman Conley, seconded by Councilman Thomas
and unanimously carried that the minutes of the May 11, 1982 meeting
be approved as presented.
CITY MANAGER'S REPORT
PARKS AND RECREATION
City Manager Forbes stated a few of the proposals the Parks & Recreation
Board have made for the areas surrounding Lake Winona. He suggested that
he present a site plan at a later meeting for Council review.
WEST BEACH CONCESSION
City Manager Forbes reported that a letter has been received requesting
that concessions be allowed to be sold at West Beach from a mobile unit
because the existing concession stand is not functional at this time.
Council consensus was for the interested parties to appear at a Regular
Meeting to present their intentions so the Council may determine whether
the proposal is in the best interest of the City.
TELEMETERING PARTS - UTILITIES DEPARINENT
City Manager Forbes related the request of Utilities Director Davis to
be authorized to purchase spare parts for the telemetering system. If
there is an equipment failure, the City would be forced to operate each
well manually until repair parts are received, which could take up to
six weeks. A MOTION WAS PfADE BY COUNCILMAN THOMAS SECONDED BY COUNCIL-
MAN CONLEY AND UNANIMOUSLY CARRIED THAT THE UTILITIES DIRECTOR BE AUTHOR-
IZED TO PURCHASE TELEMETERING SPARE PARTS IN THE AMOUNT OF $5845 TO BE
PAID THROUGH THE CAPITAL It1PROVEMENT FUND.
JAYCEE BEACH
City Manager Forbes reported that the weeds in the beach area were sprayed
today, and there will be an eight day waiting period before the beach may
be used. The west side of the dock may be used, however.
CITY ATTORNEY'S REPORT
UTILITIES EASEMENT
City Attorney Baird explained that during negotiations for an easement for
the placement of waterlines over a portion of property owned by Mr. Jay
Porter, it was learned that a storm drain already exists on the property,
without the obtaining of an easement. He reported that Mr. Porter is will-
ing to give the easements for both utility lines at a cost of $2000. Mr.
82-79 Baird stated that this is a fair offer, and recommended acceptance. A MOTION

CENTRAL FLORIDA LEAGUE OF CITIES
Mayor Iloskinson related the request of the CPLC for suggestions on various topics
NINE CENT GAS TAX
Mayor Hoskinson related a letter received from Public Works Director, Mike Willett•,
of Lake County, regarding the County's consideration of taking the option of the
ninth cent tax on gas. Council consensus was for the City Manager to send copies
of the letter to all Councilmen for their review, before taking a stand on the matter
COUNCILMAN POOL'S REPORT
DEPARTMENT OF TRANSPORTATION
Councilman Pool reported concern of the traffic hazard at the intersection of highway
27 and highway 50 and suggested that a letter be sent to the DOT for recommendations
of making the exits safer, i.e. by using speed bumps. .{
REPRESENTATIVE EVERETT KELLY
Representative Kelly appeared before the Council to update them on the results of the
legislative session and the affect of the additional one cent sales tax on the City
of Clermont.
CLERMONT HOTEL: Nick Buttitta
Mr. Buttitta appeared before Council to report that the hotel does appear to have the
best potential use as an adult congregate living facility and requested that he be
allowed four months to materialize these plans, and will report back to Council in
60 days on the progress. After extensive discussion, considering the good -faith shown

Sue Mecanick appeared before Council requesting a variance to construct an off -site
sign in a C-1 Light Commercial Zone. Several citizens in the audience spoke in favor
82-81 and in opposition of the sign. After extensive discussion, A NOTION WAS MADE BY
COUNCILMAN TURVILLE, SECONDED BY COUNCILMAN CONLEY AND UNANIMOUSLY CARRIED THAT THE
SIGN VARIANCE BE DENIED.
VARIANCE REQUEST: 1937 Brantley Circle Margaree Gardens
Bill Maguire of Executive Design Builders appeared before Council requesting a variance
for the property owners who are requesting to build a screened porch, leaving a rear
yard of 15'4" whereas, a rear yard of. 25' is required. After extensive discussion,

Arthur Roberts, EnquEre, appeared before Council. requesting for Mr, Bill
MnLtick, a variance requiring a front yard setback of 15' rather than 25'
in order to construct a canopy over a pump station inland and a rear yard
setback of 15' rather than 25'. There were no objections from abutting
82-83 property owners, and after extensive discussion, A MOT'fON WAS MADE BY

THAT THE VARIANCE BE GRANTED.
REZONING 11EQUEST: Ordinance No. 145-M, 501 Almond Street
A rezoning request was related to the Council for the changing of an R-2
Medium Density District to an R-3 Residential/Professional District. City
Attorney Baird assured Council that in his opinion, this rezoning would not

Tom Dougherty appeared before Council requesting that he be allowed to utilize

There was much discussion regarding a letter from the property owner's attorney,
Dick Langley, who stated that his client would keep the grass cut and fence this
property. Councilman Pool stated that he had discussed the matter with the owner
A.E. Langley who had requested six months to fence the property. The Council
was concerned that it would take six months to fence the property and wanted to
82-86 know when the building would be torn down or repaired. A MOTION WAS MADE BY
COUNCILMAN THOMAS TO TABLE THE MATTER UNTIL THE FIRST MEETING OF THE COUNCIL IN
JUNK. City Attorney Baird will convey the concerns of the Council to the
property owner, and in turn the intentions of the property owner.
BROOME STREET ASSESSMENT ROLL
City Attorney Baird explained that no further publications, notices or hearings
are required. The original assessment roll continues in force with a credit
being given to each parcel for the differences in the actual costs and the
estimated costs. The total costs were $28,171.05, of which the property assessed
82-87 is liable for two-thirds which calculates as $18.888 per front foot. A MOTION

TUESDAY'S MEETING. Under Visitors with Business, Representative
Kelly has requeste to be placed on the Agenda of our meeting to dis-
cuss sales tax. Mr. Buttitta will also be present to discuss his plans
for the Clermont Hotel. In addition, we have three variance requests
to consider.
PARKS AND RECREATION BOARD. This Saturday the Parks and Recreation
Board will be conducting registration for our Summer Recreation Programs
in Jenkins Auditorium from 10:00 a.m. until noon. Citizens may also
register at City Hall.
Due to her growing Jazzercise business, Barrie Rakow has resigned
from the Parks and Recreation Board. Barrie has been instrumental in
assisting with our summer programs and we will certainly miss her efforts.
Attached is a list of recommendations she has made to the Board.
STATE ROAD 50. As you requested, enclosed is a letter to the State
DOT regarding litter signs for Highway 50.
FARMERS HOME ADMINISTRATION (FmHA). The Finance Director and I will
be meeting with representatives of FmHA in Gainsville on Friday, May 28th
to discuss the City's proposed water rate increases. Enclosed is a letter
sent to them by Mayor Hoskinson, outlining our request for a lower rate
structure.
WATER SYSTEM IMPROVEMENTS. All new water lines have been installed
and we are working on the restoration of the right-of-way. Only the well
remains to be completed. The completion date for the entire project is
June 30, 1982.
UTILITY DEPARTMENT. We are concerned that during the week of May
8th through the 14th, Clermont residents used 12.1 million gallons of
water. The St. Johns Water Management District has allocated the City
10.3 million gallons per week under their voluntary restrictions.
SPARE PARTS FOR TELEMETERING SYSTEM. The City's new telemetering
system has been installed on our water wells, and we are now operating
on a one pressure system. The telemetering system relays messages
through the telephone lines from the water tank to the wells. It reg-
ulates which water well is pumping, tells the wells when to pump and
for how long, and rotates the wells being pumped so that no well will
be pumping continuously for more than two hours. This system includes
alarms when wells are not pumping properly or the water level in the
storage tanks becomes too low. Equipment in the Utility Department
shows which well is pumping and the exact water level in our storage
tanks.

This is a sophisticated system. If there is an equipment failure,
we would be forced to operate each well manually until repair parts are
received. Because it could take up to six weeks to receive spare parts,
Utility Director Davis has requested that we order the spare parts recom-
mended by the manufacturer (see the attached memo). If there are no
Council objections, we would request to be allowed to order the parts and
pay for them with Capital Improvement Fund monies.
LAKE AVENUE WATER TANK. The Utility Department drained the Lake
Avenue water tank this week and plugged the line that was used to fill the
Lank. We have discussed with the Farmers home Administration our request
to place the removal of this tank on our present water project, and are
now inviting bids for this work.
JAYCEE BEACH BOAT RAMP. At Tuesday's meeting we should try and make
a decision regarding the charging of fees at the boat ramp. The question
naires on this matter have been tabulated as follows: 26 in favor of pay-
ing a fee, 9 are opposed, and 4 had no opinion of this matter.
TOWN HALL QUESTIONNAIRE. The questionnaire distributed at City Hall
and the Town Hall meeting generally rated City services favorably. A
tabulation of the results are shown on the attached sheet.
ABANDONMENT OF CITY WELLS. All pumps, motors, and related equipment "
have been removed from the City's four unused water wells. These wells
have been logged by the St. Johns Water Management District. Once the
log results are obtained, a quote for this work will be given by our water
well contractor, Mechanical and Chemical; and the project can be added to
our present water system improvements contract.
LAKE APOPKA NATURAL GAS DISTRICT. The regular meeting of the Board
of Directors of the Lake Apopka Natural Gas District will be held at the
the district office in Winter Garden on Monday, May 24, 1982 at 10:00 a.m.
FIRE DEPARTMENT. On Saturday, May 15, 1982, our 1963 fire truck was
in a minor accident while responding to a fire. The truck was on West
Avenue and crossing Highway 50 when it was hit by a car traveling on High-
way 50. Fortunately, there were only minor injuries. The fire truck is
completely operable, however, it may cost $3,000.00 for body work repairs.

were issued by citizens regarding the litter on State Road 50 in Clermont.
I am sure you can understand that we are concerned about the appearance of
our City. For this reason, it would be appreciated if your agency could
place "No Littering" signs along this highway. They could be placed at the
. intersection of Ilighway 50 and 561 and Highway 50 and 27.

Dear Mr. Mitchell:
The City of Clermont appreciates the assistance that your agency
has provided to our City by financing the City's Water and Sewer
System Improvements. The cooperation of Fm11A will allow us to
construct the needed improvements and at the same time keep costa -
as low as possible for Clermont's elderly residents.
District Director Ron Whitfield and other FmItA officials have been
courteous and responsive to our needs. However, the City is con-
cerned that the Letter of Conditions for receiving funds for our
Sewer System Improvements requires the City to adopt a rate sched-
ule which is higher than necessary. Pain would require adoption
of a rate schedule with a minimum fee for 3,000 gallons of $5.00,
and $1.00 for each additional 1,000 gallons.
The City of Clermont requests that you reconsider this matter and
allow the City to adopt a rate schedule with a minimum fee of $3.50
for the first 3,000 gallons, and .900 for each additional thousand
gallons.
This request is based on the following facts:
1. The +', nl willing to pledge Sales Tax
moui l w improvements.
2. The City's Improvement, Repair, and Replacement Fund
(IRR) has met the funding requirements of our Bond
Resolutions, and now has a balance of over $150,000.
This will allow the City to discontinue financing
this fund and provide us with an additional $38,500
per year in utility Operating Funds.

Our water system will be operated by a telemetering system which
will tell our pumps when to run and shut down. There are many
electrical parts within the system. If one part fails, the entire
system may not operate properly.
Since it takes six to eight weeks to get some of these parts; I -
would recommend that we order the attached spare parts list as
soon as possible. The total cost is $5,845.00.

Since the City is now accepting State Funds for the Jaycee Beach Boat Ramp, we can't
discriminate between resident and non resident users of the beach and boat ramp
facilities. The City can charge fees for the use of these facilities; however,
everyone must be charged the same. Beach fees are earmarked to go into the City's
Parks and Recreation Account for beach improvements. In the past, beach fees have
been charged on weekends and holidays from Memorial to Labor Day.

1. Boat fee should be higher..... charges for beach on weekend is fine.
Keep beaches for Clermont residents..... don't accept any funds.
2. Just have curb side garbage pickup to eliminate all the driving around.
3. A regular day for trash pickup would alleviate unsightly trash lying
around for several days.
4. The City is well managed.
5. Please make sure the hospital takes down the old signs that the new
ones replaced.
6. Please repair/repaint- the wooden "Danger" sign on the west side of
Center Lake.
7. Sandbar at Jaycee Beach prevents our boat launching, we need 2-1/2
to 3' of water minimum.
8. Why are some lot owners not required to mow vacant lots? Property
on north 12th is badly overgrown as is City property by Treatment
Plant to the north -(I believe it is City property).
9. We consider that we have a very well run town and appreciate living here.
10. There are too many dogs running loose all of the time.
11. Barking dogs are a problem.
12. Beach fees should be $1.00 for adults and 250 for children.
13. The swim area should be deeper ..... I don't mind paying a fee if the area
is properly maintained ...... perhaps designated days for trash pickup
would eliminate the problem of trash remaining in the same areas for
weeks at a time.
14. After several years of looking over Florida ---- we chose Clermont because
of its many advantages. We have not regretted our choice. The City seem
to be well managed ---though the "management" seems a bit naive at times.
15. Palms block view at 5th and Montrose Streets going west ---block view of
approaching traffic from north.
16. The present price of water is high enough ---- I do not approve of any
further increase.

residence located at 640 East Lakeshore Drive and owned by Gene
Langley.
Several years ago a fire severely damaged this home and since
that time, it has been vacant and never repaired.
We have sent Mr. Langley several letters on this building (see
attached letters), and to date no response has been received on
whether this building will be repaired or demolished.
Council direction is requested on this matter.

Thank you for talking with me last week about your lovely home
at 640 Cast Lake Shore Drive which was destroyed by fire sev-
eral years ago.
I'm sure you can understand that the house standing vacant and
damaged is somewhat of a nuisance to the neighbors, due to the
trespassers and vandals which the building attracts and from
and from an aesthetic point of view.
In fact, we have received numerous complaints from neighboring
property owners concerning the appearance of the property as
well as the presence of trespassers, rats and snakes.
Attached is a list of violations which must be corrected within
120 days. If you cannot make the necessary repairs within this
time, or if you believe that this request is unreasonable, you
may appeal this decision to the City Council, acting as the
11ousi.ng Code ❑oard of Adjustment and Appeals, within fifteen (151
days after receiving this letter.

Subject: Property located at 640 East Lake Shore Drive, Clermont
Dear Mr. Langley:
Complaints have been registered in regard to the physical condition of
the property located at the above address.
Investigation of the property was made, in the company of several of the
adjacent property owners. The outside area of grass, trees, landscaping
and driveway, to be appropriately described, has a look of abandonment
and neglect. The loss by fire, and the vacating of the house, have ap-
parently made this secluded property the object of vandals, and the
house has deteriorated to the point of possible condemnation by -legal
proceedings. The buildings are being frequented by transient derelicts,
and evidence of occupation by numbers of juveniles has been observed.
There has been a constant harrassment of window -peeking, noise, and
revelry in the late hours of the night.
We wish to arrange a meeting and inspection to evaluate the possible
avenues that could be pursued to eliminate these conditions.

LOCATION: 501 Almond Street - Southeast corner of Almond
Street and Disston Avenue
ZONING: Presently R-2 Medium Density. Applicant has requested
that this property be rezoned to R-3 Residential/Pro-
fessional in order for this CUP to be approved.
REQUEST: A Conditional Use Permit in order to establish a
lawyer's office in the existing building on this
property.
COMMENTS: This CUP cannot be considered by the City Council
unless the applicant's request for rezoning is granted.
CUP REQUIREMENTS: The R-3 Professional/Residential district allows
single and multiple family residences as permitted uses.
Professional offices are also allowed, but only by a -
Conditional Use Permit. The reasoning behind this is
that many small professional offices are no more inten-
sive a use than is an apartment. However, a CUP is
required before any office is allowed in this zone to
insure that the office will be compatible with the
surrounding neighborhood. The Clermont Zoning ordin-
ance states that a Conditional Use Permit can be grant-
ed only if the following conditions are met:
1. The proposed use is desirable at the particular
location.
2. The use will not be detrimental to the health,
safety, or general welfare of persons residing or
working in the vicinity.
3. The proposed use will comply with the regulations
and conditions in the City Codes for such use.
4. The Conditional Use will not adversely affect the
officially adopted Comprehensive Plan for the City.
In granting a CUP, the City may impose conditions it
deems necessary and desirable to protect the general
welfare in accordance with the intent of the Zoning
Ordinance.

RECOMMENDATIONS: If this request is granted we would recom-
mend that the following conditions be met:
1. One parking space shall be provided for every 200
square feet of office space.
2. If, at a future date, the parking at this location
proves inadequate, the applicant understands and
agrees that the City may require additional park-
ing, impermeable parking, or rescind this CUP.
3. No further expansion of the use or additions to
the building shall be permitted except as ap-
proved by an additional CUP.
4. All applicable rules and regulations shall be met,
including final site plan approval and landscaping.
5. This property may be used only as an attorney's
office. No other business operation can be conducted
from the building. This CUP is not transferable to
any other business use, person, or corporation.
6. A final Certificate of Occupancy cannot be issued
until all of the above conditions are met.
7. This permit shall expire if construction has not
begun within one year of the date of this Condition-
al Use Permit.
8. if any of the above conditions is violated, :the
applicant understands and agrees that the City may
revoke this Conditional Use Permit by resolution.

proposed buildings, signs, driveways, off-street parking areas, loading
and unloading, highways, water courses, and other topographic features
of the site. ,
3. A description of the proposed operation in sufficient detail to set forth
its nature and extent.
4. Plans or reports describing method of handling any traffic condition
created by the proposed use.
5. Landscape architectural plans.
6. Complete legal description of property involved, including a survey.
PLANNED UNIT DEVELOPMENT - If Conditional Use Permit Application is for a Planned Unit
Development (PUD), see also section 26-68 (E) of the Code of Ordinances.
The applicant should become familiar with the regulations of the City of Clermont regarding
zoning requirements applicable to particular zoning classifications.

Several days ago we sent you a letter concerning a rezoning request at

COMMENTS:
Any request for rezoning must bo analyzed very care-
fully to insure that it meets the standards set in
the City's Comprehensive Plan. Attached is a rezoning
checklist that you may wish to use when analyzing such
requests.
The following conditions should be taken into cons.id- ,
oration when reviewing this application:
1. PRESENT ZONING. Lot 127 is zoned R-2 and provides
a buffer between property zoned C-2 to the east
and residential uses. Whenever possible, the
change between commercial and residential zoning j
should be made on rear lot lines to avoid the neg-
ative effects that can arise when commercial uses
fl
abut residential development. The problems we I
have had at the Winn Dixie Plaza are good examples.
Ilowever, R-3 Res idential/Professin, I Zoning could E
also serve as an adequate buffer between the lower y
density residential and commercial uses. j
2. RELATIONSHIP TO ADJOINING PROPERTIES. We must also
analyze the effects the proposed rezoning may have
on adjoining properties, since a single rezone in
a neighborhood can set a precedent for other zoning
changes in an area. If this property is rezoned
1-3 to serve as a buffer between the C-2 and R-2
uses, it may be just as logical that the property
to the south be rezoned in this manner. The City
must also consider whether rezoning this property
would constitute SPOT ZONING, since it would be a
single lot zoned R-3 in an area zoned either C-2
or R-2.
Spot zoning is zoning a relatively small area dif-
ferently from the zoning of the surrounding area,
usually for an incompatible use and to favor the
owner of a particular piece of property. Spot
zoning is not legal if it is not in accordance
with the City's Comprehensive Plan. The "spotness"
is in the arbitrary and inappropriate nature of
the change rather than, as is commonly believed,

in the size of the area. You should take into con-
sideration the standards set in the Compr.ohens.ive
Plan for 11-3 zoning discussed below, and the changes
which have occurred in this area for the past several
years.
3. PRESENT ZONING'S COMPA'1'ID'ihITY WI'1'I1 COMPREHENSIVE
PLAN. The present R-2 PAedium Density zoning is con-
sistent with the City's Comprehensive Plan.
The Plan states that areas suitable for medium den-
sity residential development are:
A. Areas comprised of large undeveloped lots, particu-
larly if they are located adjacent to major thor-
oughfares.
D. Areas between low density development and high density
residential or commercial areas.
C. Areas already developed medium density residential.
4. PROPOSED ZONING'S COMPATIBILITY WITH COMPREHENSIVE - -
PLAN. The Comprehensive Plan sets the following
standards for property zoned R-3 High Density Resi-
dential:
j A. Medium and high density development should be encour-
aged in close proximity to major thoroughfares and
neighborhood shopping centers.
B. Areas surrounding the CDD or adjacent to major street
thoroughfares.
C. Areas close to major retail centers.
D. Areas already developed high density.
The City has two main alternatives in considering this
request:
j1. Grant this proposed rezoning change if we believe that
it meets the standards set in the Comprehensive Plan ,
and that the adjoining residential property would be
adequately buffered.
2. Deny this request, since a residential use already
exists on this property, and the present R-2 zoning
acts as a buffer between commercial and residential
uses.

My appeal to your Board is based on my contention that this decision creates a
hardship on me for the following reason, or reasons:

Seven (7) copies of all necessary floor plans, plot plans, and other pertinent infor-
mation are attached hereto, on paper size 8;" x 14" minimum size.
I submit that I qualify for this variance because I have an exceptional and unique
hardship on my particular parcel of land that is not shared by property owners in my area.
A strict application of the zoning ordinance deprives me of the reasonable use of my land
and the granting of this variance will not alter the essential character of the area.

on the North and South boundaries of the subject property inasmuch as such
property is irregularly shaped and has streets abutting all sides. Presently
the structure on such property and certain pump islands are not hn compli-
ance with setback requirements but have been grandfathered in by applicable
law. Plans of the owner, if a variance is granted, would include the razing
of the present structure and pump island, and construction of more modern,
aesthetically pleasing structures thereon.
The subject property is a triangular, odd -shaped parcel without
comparable simularity within the City. Any type of upgrading and commercial
usage will of necessity require a variance of the set -back requirements. The
contemplated purchaser from applicant has determined, after detailed survey-

on the property if a different building plan had .
been chosen. The City Zoning Ordinance states that
a variance may be granted when such variance will
not be contrary to the public interest and when,
owing to conditions peculiar to the property, and
not the result of actions of the applicant, a lit-
eral enforcement of the ordinance would result in
unnecessary and undue hardship.

This Subdivision is certainly going to be one of the beat in the
Central Florida area. This letter is just to review a few points in
the final plat approval process of which you should be aware.
As you know, the final plat was approved on the condition that a
Thousand Dollars ($1,000) should be held in escrow by the City until
the sidewalks are completed on both aides of the entrance way, and
posts put up on Settle Street. This work should be completed by - =-
October 1, 1981, in order to avoid the forfeiture of Bond. Also,
please remember that no Building Permits can be issued for this pro-
ject until the Florida Power hook-up has been completed, and the
Lift Station has been thoroughly tested on a full cycle. The owners
of odd shaped lots should also -be made aware of the Citv's zoning
regulations, to insure that the deli n a house to be built on their
lots to meet the C1ty s zoning regulations.

Please be advised as per my commitment to the City of
Clermont, in addition to my responsibility, we have been
engaged in extensive research on the feasibility of the
above -mentioned hotel.
To date we have met eight times at the hotel with various
interested, bonified organizations, to study the possibility
of converting the existing premises to fit their use. After
meeting and studying the interested organizations along with
discussions with Mr. Negal from the City and Mr. Mark Edwards
from the County Health Department, we are going to proceed
in the direction of a H.R.S.-licensed Congregate Living
racility.
In doing so, this will take the full cooperation of the City,
County, State and, naturally myself. The conversion will not
be difficult and will add to the uniqueness of the original
vintage of the City. It will also finalize the termination
of the town "hang out" by transients. I further feel the
City will now have the facilities to house the middle-class
retirees adding to it the flexibility and desireability to
care for its own.
As you know, I will be attending the May 25, 1962 Council
Meeting to further explain my findings and I am looking
forward to such an occasion.
Also further be advised as per your request, I have secured
the back of the premises and razed the car -port to ensure safety.

This will confirm the results of our consultation of May 11, 1982, re-
garding the property at 525 Eighth Street, Clermont.
From an Adult Congregate Living Facility licensing viewpoint, the building
contains sufficient space and bathrooms to make an ACLF feasible. The final
capacity which could be authorized would depend a great deal on how much of
the building you convert to common living space, i.e., living room, enclosed.....
sunporches, recreation areas, diningroom. Certainly, some of the larger bed-
rooms could accomodate three people, and bathrooms located between the larger
rooms could accomodate six (6) people as prescribed by our regulations. While
the two -floor structure might have some effect on who would wish to reside in
the facility, it does not affect licensing as long as fire and safety regu-
lations are met.
As you continue planning, I am certain you will wish to conduct a market
analysis as well as consult our Health Department and Fire Department re-
garding applicable codes since the approval of these departments is necessary
for ACLF licensing.
I am enclosing an index of facilities licensed in our sixteen (16) County
