LAKE COUNTY POLLUTION CONTROL BOARD
City Manager Forbes reported that the Lake County Pollution Control. Board
at their meeting of January 11, 1982, gave approval of: the City's land -
spreading compliance schedule.
LANDSPREADING FINANCING
City Manager Forbes stated that the financing with the Farmers home Admia-
istra Lion continues to be favorable for the City.
LAKE COUNTY LEAGUE OF CITIES
City Manager Forbes stated that Cl.ernnout will. be hosting the Lake County
League of Cities Meeting and url;ed all Council Member!; to attend if possible.
PUBLIC SAFETY BUILDING
City Manager Forbes staled that: the Fire Door to the Public Safety Building
Is dry rotting, and reconunended Lhat quotes be obtained for a metal door.
Tt was recommended that the MinuLes be researched for the initial rationale
for installing a wooden door rather than metal. The consensus of the
Council was to allow the City Manager Lo obtain quotes and return to the
City Council with a recommendation before further action is taken.
CITY ATTORNEY'S REPORT
BROOME STREET PAVING
City Attorney Baird reported that two easements have not been obtained, and
suggested that a resolution be prepared to proceed for condemnation. A

MAYOR'S MPORT
EAST CENTRAL FLORIDA REGIONAL PLANNING COUNCIL
Mayor Noskinsoa reported that the ECFRPC is organizing a Disaster Prepared-
ness Program and requests that a representative for the Clermont area ba
appointed. It was suggested that Thelma Waters be appointed or a City staff
member. The Mayor will look into the matter.
COUNCILRAN TURVILLE
_ANIMAL CONTROL
Councilman T'urville reported that he has received complaints of dogs running
loose in the Ryan/Chestnut area. ilia City Manager stated he will look into
the matter.
COUNCILMAN THOMAS
STREET CLOSING
Councilman Thomas made inquiry of the proposed street closing on West Avenue.
The public hearing and further discussion will be held at the Regular Council
Meeting of January 26, 1.982.
COUNCILMAN CONLEY
WATER SYSTEM IMPROVEMENTS
Councilman Conley inquired of the status of the water system improvements.
City Manager Forbes stated that the well has been drilled to nearly 800'
and the water quality has proven to be good, but testing is still in progress
for quantity.
COUNCILMAN POOL
WA'L'L•'R CONSERVATION
Councilman Poo! suggested that the Council hold a workshop concerning water
conservation and management in order to re-educate citizens on the importance
of conservation.

Attached .is Ordinance No. 221-C which eumnds Chapter 3, Section 3-5
of the Municifkjl Code of ordinances regarding the consrmyation of
alcoholic beverages on public property.
Presently Section 3-5 of the Municipal Code only prohibits drinking
alcoholic beverages in public parks and playgrounds. The proposed
amendment is more eouprehensive and prohibits the consumption on all
public properties.
'rho proposed amendment has been recomronded by the Police Chief, and
allods the City Council to grant exceptions from this ordinance for
special activities in designated facilities.

No alcoholic of intoxiefllnnlf beverages may be sold, con-
sumed, or Nerved, or permitted to be sold, consumed or

Sec. 3.5. Consumption, possession, distribution, etc., upon pub-
lic parks and playgrounds prohibited; penalty.
It shall be unlawful for any person to consume, possess,
distribute or in any other way have. In his possession any
Intoxicating beverage as defined by the laws of the State of
Florida, upon any public park and/or playground owned,
operated, lensed or otherwise under the control of the City EXISTING ORDINANCE
of Clermont, Lake County, Florida, where youth activities
are being carried on.
Any person being found in violation of this section shall be,
upon conviction, subject to a fine not to exceed one hundred
dollars ($100.00) or imprisonment for a period of not more than thirty (30) days, or by both such fine and imprisonment.

Whereas, on the 4th clay of December, 1979, the above
described parties entered into an Agreement for the fiscal
year 1979-80 to begin comprehensive study of the water resources
of the Green Swamp area which encompasses the entire Upper
Palatlakaha River Basin, and,
Whereas, pursuant to that Agreement, the parties named
above ,joined Logether to begin a study which was estimated
to take 3 years Lo complete, and
Whereas, it is necessary to make -provisions for the
operation and funding of the study for the second two years,
Now Therefore, the aforementioned parties agree to the
following:
1. Clermont agrees in each of the fiscal years 1981 -82
a. Collect funds for the study

5. It is hereby agreed that this Agreement may be amended
or terminated at any time by written notice of any party to the

Date: January 20, 1982
On September 9, 1960, the City Council granted a Conditional Use Permit
to Condev Developers, Inc. to construct a thirty-eight unit Senior Citizens
Apartment Project on property that abuts the Lakeview Hills development.
However, the developers had second thoughts on building at this site due to the
extensive grading, road,and sewer and water improvements that would be required.
ror these reasons they investigated other properties in the City that would be
more suitable for their needs; and obtained a site on 12th Street just north
of the sewage tr&--itment plant.
On July 28, 1981 the City Council adopted Resolution No. 370 which approved a
Conditional Use Permit for the 12th Street site. Item 10,of this Resolution
requires the City to revoke Resolution No. 358 (the C.U.P. for this project
in Lakeview Hills) once FmHA approval is obtained for this project.
Sind FhM approval has been obtained and permits issued for this development,
the attached resolution simply revokes their first C.U.P.

Attached is the inter -local agreement with various county agencies to
complete the third and final year of the Upper Palatlakaha Study.
As you are aware, the Upper Palatlakaha Study was formed by the City of
Clermont to investigate the water quantity and quality of this area and
prepare the data necessary for a water management plan.
Each year of the study we are required to sign the attached agreement
that requires the City to provide $8,000.00 (already budgeted), and
manage the financial affairs of the study.
I recommend that the City Council authorize Mayor Soskinson to sign
the attached agreement.

City Manager Forbes explained that a resolution has been received from
the Department of Transportation requesting authorization of the City
Manager to sign the Utility Indemnification Agreement for the installa-
tion of utility lines under highway 50 during the proposed four-laning.

City Manager Forbes reported that the Lake County Pollution Control Board
at their meeting of January 11, 1982, gave approval of the City's land -

LANDSPREADING FINANCING
City Manager Forbes stated that the financing with the Farmers Home Admin-
istration continues to be favorable for the City.
LAKE COUNTY LEAGUE OF CITIES
City Manager Forbes stated that Clermont will. be hosting the Lake County
League of Cities Meeting and urged all Council Members to attend if possible.
PUBLIC SAFETY BUILDING
City Manager Forbes stated that the Fire Door to the Public Safety Building
is dry rotting, and recommended that quotes be obtained for a metal door.
It was recommended that the Minutes be researched for the initial rationale
for installing a wooden door rather than metal. The consensus of. the
Council was to allow the City Manager to obtain quotes and return to the
City Council with a recommendation before further action is taken.
CITY ATTORNEY'S REPORT
BROOME STREET PAVING
City Attorney Baird reported that two easements have not been obtained, and
suggested that a resolution be prepared to proceed for condemnation. A

appointed. It was suggested that Thelma Waters be appointed or a City staff
member. The Mayor will look into the matter.

ANIMAL CONTROL
Councilman Turville reported that lie has received complaints of dogs running
loose in the Ryan/Chestnut area. The City Manager stated he will look into
the matter.

Councilman Thomas made inquiry of the proposed street- closing on West Avenue.
The public hearing and further discussion will be held at the Regular Council
Meeting of January 26, 1982.

WATER SYSTEM IMPROVEMENTS
Councilman Conley inquired of the status of the water system improvements.
City Manager Forbes stated that the well has been drilled to nearly 800'
and the water quality has proven to be good, but testing is still in progress
for quantity.

WATER CONSERVATION
Councilman Pool suggested that the Council hold a workshop concerning water
conservation and management in order to re-educate citizens on the importance
of conservation.

The City of Clermont dues not regulate teLevision rates, as they
arc pre-empted by the FCC.
DONATION TO POLICE AND FIRE. The City has received a donation
of $100 from Mr. and Mrs. Frank Gallagher. to be used for Police and Fire
Services. The Gallaghers live at 437 Lakeshore Drive.
PUBLIC DEPOSIT PROTECTION. Effective January 1, 1982, a new
state law is in effect which requires the State Treasurer's office to
assume the complete responsibility for the administration of Public Deposit
Protection. The Florida Security for Public Deposits Act now requires the
state to hold collateral in safekeeping for public funds. For this reason,
we are releasing escrow funds from local banks and assigning the escrow
rights to the state treasurer.
ORGANIZATIONAL MEETING. Tuesday's Council Meeting is our Organ-
izational Meeting at which the Council should make appointments to various
City Boards and Commissions, as well as a Mayor pro tem.
Please refer to the attached sheet for the various appointments
which must be made, and contact me if you have any questions.
Enclosed are letters requesting appointments and re -appointments
to the Planning and 'Zoning Commission. Henry Czech has requested re -appoint-

in military service, U. S. Air Force, during World War II. My
duties consisted mainly as instructor in aircraft mechanics.

Emerald Lakes Park, where I have been active in the community.

WHEREAS, the DEPARTMENT is constructing, reconstructing or otherwise changing; it portion
of the State highway System designated by the DEPARTNIEN,P as Job No. 11070-6515 , Road No.
50 between 1.46 mi. West fffYWSR 561 to SR 561 , which shall call for flit
adjustmcul, relocation and/or installation of CITY Water & Sewer facilities along, over
and/or under said highway,
AND WHEREAS. Ibr, plans for flit said construction, reconstruction or other changes to lie
made, as above described, have liven reviewed by the DEPARTMENT and the CITY, said above
described utility relocation to hereinafter he designated as "Utility Work."

JOINT PROJECT providing for such work,
NOW, THEREFORE, the premises considered, and in consideration of the sum of One Dollar
each to the, other in hand paid, the receipt whereof is hereby acknowledged, and in fnrlher
consideration of the mutual covenants hereinafter contained, it is agreed by the parties as follows:

3. All of the work on the JOINT PROJECT is to be done according to the plans and
specifications of the DEPARTMENT which plans and specifications are, by reference hereto, made a i

part hereof. The CITY will be responsible for verifying the accuracy I
underground survey information, and will also be responsible for any changes to the CITY'S plans_

construction is in compliance with the plans and specifications hercinabove referred to, and shall

6. All udjustmeut, relocations, repairs and incidentals required to be performed to the

7. All services land work under the construction contract shall be performed to the
satisfaction of the DEPARTMENT1" S Director, Division of Road operations, and lie shall decide all
questions, difficulties and disputes of whatever nuUnrr., which may arise under or by reason of such
contract for "Utility Work"; the prosecution laid fulfillment of the services thereunder, mad the
character, quality, amount and value thereof; and his decision upon all claims, questions and disputes
thereunder shall be final and conclusive upon the parties hereto..
0. The CITY agrees that it will, upon the execution of this agreement furnish to tine
DEPARTMENT as a deposit for the estimated payment of said "Utility Work" in the amount of

terms of Paragraph 11 is less than said deposit, u refund of any excess over and above said final billing

said deposit, said final billing will be paid by the CITY pursuant to Paragraph 11 hereof.
9. Upon completion and acceptance of the work, the CITY shall own, control, maintain, and
be responsible for all CITY utility faciltics involved, according to the terms of the standard permit
required by the State Statutes for occupancy of public rights of way. The CITY further agrees that it
will maintain and keep in repair, or cause to be maintained and kept in repair, all of such constructed
facilities or utilities within the right of way of said State Road, to comply with all provisions of law
and of the DEPARTMENT'S manual with amendments and specifications for traffic control routing
and parking and to conform with the regulations of the DEPARTMENT pertaining thereto.
10. The CITY shall defend, save and hold harmless the DEPARTMENT from any and all
legal actions, claims or demands by any person or legal entity against the DEPARTi LENT arising out
of the participation in this Agreement by the CITY or use by the CITY of the completed "Utility
Work."
11. Upon completion of the work, the DEPARTMENT shall, at the earliest date practicable,
furnish the CITY with two (2) cOpies'of its final and complete billing of all cost incurred in
connection will, the work performed hereunder, such statement to follow as closely as possible the
order of the items contained in the job estimate. The final billing shall show the description and site of
the project; the dale on which the first work was performed; the date on which the earliest item of

Dear Mr. Forbes:
Pursuant to Teleprompter Southeast, Inc., Ordinance 105-M, Section 5(c),
Subscriber Rates, please be advised that the Company intends to increase -
its monthly service charges from $8.25 to $8.50 for basic primary service,
a 3% increase, $10.95 to $11.95 for pay primary service, an 8% increase,
and $2.50 to $3.50 for pay secondary service, a 28% increase, effective
April 1, 1982. It should be noted that the City of Clermont does not reg-
ulate Pay TV rates, as they are pre-empted by the FCC.. A copy of that
ruling is enclosed for your reference.
Teleprompter has not increased its basic service charge since July 1, 1979.
Since that time, costs have continued to climb to the point where Teleprompter
can no longer absorb these increased prices.
However, we do have some very exciting news in that we will be expanding
our services. We will be adding additional channels, including a full
news channel, a children's entertainment channel, a black entertainment
channel, and a Christian channel.
In addition to our Showtime service, we will also be offering Home Box Office.
our subscribers have been advised of the change in rates and the new services,
by an insert in their January statements. Should you have any questions
