MINUTES
January 13, 1981
A Regular Meeting of the City Council of the City of Clermont was
held in the Council Chambers on Tuesday, January 13, 1981. The
meeting was called to order by Mayor Hoskinson at 7:30 P.M. with
the following Councilmen in attendance: Mike Conley, Bob Pool and
Dennis Thomas. Other City Officials present were:
City Manager Forbes, City Attorney Baird, Finance Director Saunders,
and City Clerk Rozar.
The Invocation was offered by City Manager Forbes, followed by
repeating of the Pledge of Allegiance by all present.
The Minutes of the Regular Meeting held December 23, 1980 were
approved as presented.
CITY MANAGER'S REPORT
DER MEETING
City Manager Forbes reported he had attended a meeting with the
Department of Environmental Regulations and recommended that
the City write a letter to the county informing them of the
City's desire to proceed with the 201 program.
City Manager Forbes reported that the DER responded favorably
to the sample test boring results of the Inland Grove property
as a lands readin site for the City's

effluent. He stated that the next step would be to further
pursue for purchase of the property.
LAKE COUNTY LEAGUE OF CITIES
The City Manager informed Council that the next meeting of the l
Lake County League of Cities will be held in Tavares, on Wednesday,
January 21, 1981. 1(I
FINANCE DIRECTOR'S REPORT
Finance Director Saunders stated there is an NCR Manual Billing
Machine, an addressograph and customer file cabinet that is no
longer being used since the computer has been installed. He
recommended that it be declared surplus and be advertised open
81-01 for bids. A MOTION WAS MADE BY COUNCILMAN POOL, SECONDED BY
COUNCILMAN THOMAS AND UNANIMOUSLY CARRIED TO DECLARE THE NCR
MANUAL BILLING MACHINE, ADDRESSOGRAPH, AND CUSTOMER FILE CABINET
SURPLUS MATERIALS TO BE ADVERTISED FOR BIDS.
MAYOR'Fi REPORT
Mayor Hoskinson read a proclamation declaring support to the
President's declaration of January as National Blood Donor Month.
ORDINANCE NO. 215-C
Mayor Hoskinson explained that this ordinance is not a rezoning,
but a clarification of the boundaries of the Central Business
District. The City's previous Zoning Ordinance described the
Central Business District by a meets and bounds description.
This ordinance redescribes this district by legal description.

ORDINANCE NO. 214-C
Mayor Hoskinson explained that this ordinance changes the zoning
of the property facing Minneola Avenue from Seventh Street to
Lake Avenue from C-2, General Commercial to an R-3, Professional/
Residential District. This property is located behind the library
and the predominant uses on this part of the block are now
residential. This change would use rear lot lines as zoning
boundaries to reduce any zoning conflicts across the street where
single family homes exist•.

ORDINANCE NO. 213-C
Mayor Hoskinson explained that this ordinance would rezone property ;
that faces Chestnut Street from C-1, Light Commercial to R-3,
Professional/Residential. Correspondence was read from George
Mayfield, and George Hovis, representing Sara Woodruff and
Leonard H. Baird, Sr. in opposition to this proposal. Several
property owners were present, voicing their opposure to the
rezoning. After extensive discussion, A MOTION WAS MADE BY
81-04 COUNCILMAN POOL, SECONDED BY COUNCILMAN CONLEY, AND UNANIMOUSLY
CARRIED THAT ORDINANCE NO. 213-C BE NEGATED.
ORDINANCE NO. 216-C
Mayor Hoskinson explained that this ordinance would rezone the
north 20' of Lots 69 and 76, Clermont Heights Subdivision from
R-2 to a C-2 General Commercial zone. This rezoning would
ensure that the First Federal could construct a building
with access from Highway 50 and meet the City setback requirements.
81-05 After discussion, A MOTION WAS MADE BY COUNCILMAN THOMAS, SECONDED
BY COUNCILMAN POOL AND UNANIMOUSLY CARRIED THAT ORDINANCE NO. 216-C
BE ADOPTED. Ordinance No. 216-C was read by title only.
Councilman Thomas requests for record; Bob Thompson, his business
partner, is the selling agent for this property.
BIDS FOR FILL DIRT: DIKE, WASTE TREATMENT PLANT
City Manager Forbes stated, the dike is necessary to improve the
efficiency of the polishing ponds at the Waste Treatment Plant.
At the November 25, 1980 meeting of the City Council, author-
ization was given for the construction of a dike at the Waste
Treatment Plant at a cost not to exceed $13,200, and funding
81-06 to come from the Improvement, Repair and Replacement Fund. This
motion was made by Councilman Byrd, Seconded by Councilman Cole
and unanimously carried.
Bids for hauling fill dirt to the Treatment Plant for the dike
were mailed to 20 area companies, and published in local news-
papers. Two bids were received as follows:

EARLY RETIREMENT: JACOB T. ODOM
City Manager Forbes reported that Jacob Odom has submitted
written request for early retirement, and after reviewing
the retirement benefits available, requests Option Four.
This option provides 50% Joint Survivor benefits. Mr. Odom
has been in the employ of the City since October 27, 1958,
and is currently Streets Foreman.
81-08 Mr. Odom was commended by the Mayor and a MOTION WAS MADE BY
COUNCILMAN CONLEY, SECONDED BY COUNCILMAN THOMAS, AND UNANIMOUSLY
CARRIED THAT MR. JACOB T. ODOM BE GRANTED EARLY RETIREMENT.
REGIONAL HOUSING MOBILITY PROGRAM
City Manager Forbes related a letter from the Regional Planning
Council regarding a housing Mobility Program. He stated that
the Regional Planning Council has been invited to submit an
application to the U.S. Department of Housing and Urban Develop-
ment to conduct a Regional Housing Mobility Program. This
program is designed to produce intergovernmental cooperation in
the administration of low income Housing Programs, and to provide
- information and counseling regarding housing assistance and
opportunity. They are requesting that the City show support for
this program. A letter of endorsement stating the City will
cooperate with the Regional Planning Council, not committing the
City to take action, would be appropriate. After some discussion,

I represent the owners of the following described real property in Clermont, Florida
Lots 1, 2, 12, 13 and the Gast 43.26 feet of Lot 11, in Block
85, in the City of Clermont.
" You have this property listed on your records in the name of Sara. Woodruff Eagle,
et al.
The owners of the property object to the rezoning of the property from C-1 to R-3
and wish to make [he objection known to the City Council of Clermont. In tha letter
sent to the owners, the statement is made that the purpose of the rezoning is to
insure "...conformance with the City's Comprehensive Plan...". The Comprehensive
Flan 1 obtained from the City of Clermont lists five (5) Highway Commercial Standards.
C-1 zoning meets four (4) out of five (5) of the commercial standards much better
than R-3 would.
The letter sent to the owners also states that the proposed rezoning "...would be in
the best interest of property owners and the City...". From what I can determine
not a single person owning property South of Chestnut Street has requested the re-
zoning.
It also should be noted that the building setback requirements along Highway 50 are
reasonable setback distances as long as the commercial property runs from highway 50
to Chestnut Street. However, it does not take much computation to determine that
if the depth of the C-1 property along highway 50 is reduced by one-half, the pro-
perty owner in effect has had his or her property condemned without just• compensation.

Dear Mr. Forbes:
On behalf of Leonard ll. Baird, Sr., objection is hereby made to the rezoning of
Lots 3, 4 and 17, in Block 72 from C-1 to R-3.
In my opinion the proposed rezoning does not fall within the Comprehensive Plan of
the City of Clermont but instead is contrary to the Comprehensive Plan. Also, the
proposed rezoning is against the best interests of the property owners, affected by -'2
the rezoning and certainly does not represent the feelings of the citizens of the
City of Clermont.
The proposed rezoning will create commercial building sites that will be impractical
to build on with the present setback requirements and will place the City of Clermont
in a position of having to grant or deny requests for setback variances for commercial
construction in the future.

CLERMONT, LAKE COUNTY, FLORIDA, AMENDING THE OFFICIAL ZONING
MAP OF THE CITY OF CLERMONT, FLORIDA REFERRED TO IN SECTION
26-1 OF ORDINANCE NO. 208-C APPENDIX "A" OF THE CODE OF
ORDINANCES; REZONING TIIE REAL PROPERTY DESCRIBED HEREIN FROM
A C-1 LIGHT COMMERCIAL ZONING CLASSIFICATION TO R-3 PROFESSIONAL
RESIDENTIAL ZONING CLASSIFICATION; PROVIDING FOR SEVERABILITY;

SECTION 4.
This Ordinance shall be published as provided by law and it shall become
law and shall take effect immediately upon its Second Reading and Final Passage.

SUBJECT: Regional Housing Mobility Program
Recently, the East Central Florida Regional Planning Council
received an invitation from the U.S. Department of Housing and
Urban Development (HUD) to submit an application to conduct a
Regional Housing Mobility Program to carry out two basic acti-
vities. The first is to work with local governments to produce
intergovernmental cooperation in the administration of the Section
8 Existing housing assistance program, while the second is to
provide information and counseling regarding housing assistance

vited to participate in the Regional dousing Mobility Program,
the East Central Florida Regional Planning Council has an oppor-
tunity to get funding to assist local governments better manage
their housing assistance programs. To receive funding under
this program the Regional Planning Council needs only to submit
an acceptable application to HUD.-- ---._
One requirement of an acceptable application is to show that
there is suff�c�.+� evidence of local Government c_Q_ eration and

statement of endorsement from local governments. Such an en-
dorsement only needs to state that the local government will
cooperate with the Regional Planning Council. By supporting the
program, local governments are not committing themselves to

For your convenience, a suggested coordination agreement has
been enclosed. With a January 16, 1981 deadline for submitting

o rezoning but simply a clarification of the boundaries of the Central
Business District. The City's previous Zoning Ordinance described the
CBD by a meets and bounds description. This Ordinance simply redescribes
this district by legal description so no future misunderstandings will
arise over the exact boundaries of the district.
2. Ordinance 214-C. Ordinance 2.14-C changes the Toning of the properties
facing Minneola Ave. from 7th Street to Lake Avenue from C-2 - General
Commercial to an R-3 - Professional -Residential District. This property
in located behind the Library and the predominant uses on this part of
the block are now residential. Tilts change would use rear lot lines as
zoning boundaries to reduce any zoning conflicts across the street where
single family homes also exist.
3. Ordinance 213-C. This Ordinance rezones properties that face Chestnut
Street from C-1 - Light Commercial to R-3 - Professional -Residential.
This change was also proposed by the P & 'L to use rear lot lines as
zoning boundaries which will eliminate the undesirable effects to
residential homes on Chestnut Street should businesses develop along
this property.

Plan of the City, which sets standards for commercial and residential uses.
The Ilighway Commercial Standardu set forth Ln the Comprehensive Plan are
as follows:
1. Ilighway commercial. development should consLst of only those u:;us
which depend upon, and are designed to serve, vehicular traffic
and which require high visibility.
2. Ilighway commercial uses should be concentrated in selected locations
with particular emphasis on access. Frontage roads should be used
whenever possible to protect the carrying capacity of the adjoining
highway.
7. Design of the highway oriented commercial uses should include
setbacks adequate to accomodate frontage roads, landscaping, and
future street widening;.
4. Consideration should be given to highway safety, roadside
attractiveness, and ganural, amenity of adjoining uses.
5. Commercial uses should be adequately buffered from residential
uses.

We believe that this retuning request meets the above five (5) ntandards. Since
the property to the South of LION requeuL rmnalnn rcnldentlal, there is still all
ndequnte amount of R-2 Zoning to buffer the Commercial uses from residential
property. We would still be hailing our zoning boundries on rear property lines,
nlso.
At the some time, you must consider that any further encroachment of Commercial
2onlnl; to the South would probably not be acceptable. Further vueronchment
toward Almond Street would reduce the R-2 property to such a small width that
realdential homes could not be built and meet City setback requirements. Tile
owners must also be made aware of the fact that any homen built on the property
zoned I1-2 will be required to meet all City setback requirements.

legal officer, hereinafter roforred to ns "City Attorney", pursuant to Article
IV, Section 30, Charter of the City of Clermont.
2. DUTIES. The City Attorney shall perform the following duties:
a. ATTEND COUNCIL MEETINGS. Attend all City Council and Planning
and Zoning Commission nw etings in Lhcir entirety for the purpose of giving
the Council and Commission ally legal advice requested by Its members.
b. ADVISE COUNCIL. Advise the Council or its committees or any
City officer when thereto requested or when deemed necessary by the City
ALLorney, upon all legal question:: arising in the conduct of the City businma:.
c. PREPARE ORDINANCES. Prepare or revise ordinances and resolutions
when so requested by the Council, or any Council member or any committee thereof.
d. PREPARE LEGAL INSTRUMENTS. Prepare for execution all contracts
and instruments to which the City is a party and shall approve, as to form,
all bonds required to be submitted to the City.
e. PROSECUTE OFFENDERS AND DEFEND OFFICIALS. Prepare, when
authorized by the Council, all charges and complaints against, and shall appear
in the appropriate Court in the prosecution of, every person charged with the
violation of a City ordinance or of any regulation adapted under authority of
the Charter. Represent City officials in the appropriate Court or before the
appropriate agency in actions or proceedings concerning their duties and
responsibilities as City officials.
f. MAKE REPORTS.
(1) Report to the Council a I I business transacted on behalf of

It. rf.EP RECORDS.
(I) Suits. Keep a complete record of all stilts in which the
City had or has an interest, giving the names of the parties, the Court
where brought, the nature of the action, the disposition of the case, or its
condition if pending, and the briefs of counsel.
(2) Opinions and Titles. Keep a complete record of all
written opinions furnished by him and of all certificates or abstracts of
titles furnished by him to the City, or any department or official thereof.
3. RETAINER FEE. The City Attorney shall receive the sum of $500.00
per month or such sum as Council may designate from time to time as com-
pensation for his services, which shall include the following:
a. Attendance at regularly scheduled City Council meetings,
Planning and Zoning Commission meetings.
b. Preparation of ordinances, resolutions, contracts and other
legal instruments at the request of the City Council, or individual members.

C. Formal and informal legal opinions regarding the business of
the City requested by the City Council, Planning and Zoning Commission, and
other officers of the City.
It. ADDITIONAL COMPENSATION. The City Attorney shall receive the sum
of $40.00 per hour for services rendered in connection with the following:
a. Civil and criminal litigation in State and Federal Courts in
which the City is a party or has an interest therein as requested by the
City Council.
b. Formal legal opinions requiring extensive research in State
and Federal statutes, case law, regulations and research in the public records
as requested by the City Council.
c, Reprosentatlon and nppnarances before administrative agencies
nod regulatory boards on a Poderal, Stnty or County level, at the request of
the City Counel1.
d, Praeeodlnq•; In cnnnectlon wlth the, financing of Public Improve-

As most of the Councilmen are aware, I have been a regular attended
at City Council meetings. Therefore, I am aware of the procedures of
the Council with especial reference to their actions in area ro-zoning

Ceneral City Employees are not eligible for normal retirement until they have

Chapter 1.6 of the Municipal (lode of Ordinances does allow early retirement
for an employee who has ten years of credited service and has attained his
60th birthdMy. Early retirement must be. approved by the City Council after
receiving a recommendation from the City Manager.
'L would recommend that early retirement be granted for Jacob Odum since he
has been a City employee for over 22 years.
