REGULAR MEETING
A Regular Meeting of the City Council of the City of Clermont was held in the
Council Chambers on Tuesday, February 25, 1975. The meeting was called to order
at 7:30 P. 14. by Mayor Claude E. Smoak, Jr. with the following members present:
Councilmen Oswalt, Byrd, Schroedel and Blackburn. Other officials present were:
City Manager Hopkins, City Attorney Vason, City Clerk Carroll, City Controller
Fleming, Deputy Clerk Dollar, Community Services Director Smythe, and Chief of
Police Tyndal. Others present were Messrs. Schoeller and Stewart of T. W. Stewart
& Associates, Inc., Mr. and Mrs. W. F. Perry, Mr. and Mrs. Roy Tanney, Mr. and
Mrs. IL Forrest Kimball and Ms. Jill Slark.
The Invocation was given by Councilman Byrd, followed by repeating of the Pledge
of Allegiance in unison by those present.
Mayor Smoak requested that an addition to the Minutes of the February 11, 1975
council meeting be made to the effect that Council did not elect to participate at
this time in the Community Development Act inasmuch as sufficient time had not been
allotted for careful study and consideration of the program prior to the filing
deadline.
The Minutes of the Regular Meeting held February 11, 1975 were then approved as
amended.
Mayor Smoak announced the next order of business to be a Public Hearing to consider
the request of Marvin & Thelmas Jones for a variance, however, City Manager Hopkins
advised that they had requested the matter be continued until the next regular — -
meeting whereupon motion was made by Councilman Byrd, seconded by Councilman
Schroedel and carried that this Public Hearing be continued until Marc ii, i975.

consider request by Al Earls for the re -zoning of Lots 1 thru 5 in City Block 7
from C-1 to C-2. It had been the recommendation of the Planning and Zoning Commission
that this request be denied without prejudice, following a public hearing and consider-
ation of this request by them on February 4, 1975. Mr. and Mrs. Tanney, Mr. and Mrs.
Kimball, and Ms. Jill Slark, abutting property owners, appeared before Council
in opposition to the request. There was no one present who voiced approval for
grantinq the request. Motion was made by Councilman Blackburn seconded by Councilman

opinion of some time wherein there was a definite need for Conditional Use in
commercial zones, and hoped that the Clermont Code of Ordinances would be revised
to allow for this.
Council, sitting as the Housing Board of Adjustments and Appeals, considered the
request of Isaac Rivers wherein he sought an extension of time to make the necessary
repairs to a dwelling at 532 Chestnut Street which had been condemned by the city
on April 22, 1974, and, to occupy the dwelling while he would be making the necessary
repairs. In view of the considerable time lapse already without the necessary repairs
having been made, motion was made by Councilman Schroedel seconded by Councilman
Oswalt and carried that a 90 day extension be granted that substantial progress

Messrs. Schoeller and Stewart of T. W. Stewart & Associates, Inc. appeared before
Council to elaborate on their findings of the preliminary study of the city's
operation, and to submit their proposal for being engaged to correct what they
have determined to be the problem areas of the city at a cost of $16,000.00.
It was consensus of Council that additional time was needed to study their
proposal, whereupon motion was made by Councilmen Blackburn seconded by Councilman

City Manager Hopkins submitted his report both orally and written, and a copy is
attached hereto.
With regards the tennis courts at the elementary school which are without lighting
and no commitments made for same, it was the opinion of Mayor Smoak that if Council
opted to have lights installed, that coin operated boxes also be installed
controlling the lighting and thereby requiring the users of the courts to pay for
the electric service. Councilman Oswalt advised he would be opposed to the city
contributing in anyway unless Council was advised in writing that the courts were
available for all public use.
With regards the estimated cost submitted ,to Council for construction of a basketball

It was the suggestion of Mayor Smoak that Council consider holding more than the two
regularly scheduled meetings each month in view of the fact there are numerous
important and pressing issues, changes, functions, etc. to be considered by them,
which was being done now, but which also necessitated too lengthy meetings.
To better acquaint Council with any possible working problems of the city, he
further suggested that open discussion type forums be held between Council and depart-
ment heads of the city.
With regards the resignation submitted by City Attorney Vason with assurance that
he would continue until such time as his successor is appointed and then assist
him in any way he could for an orderly transition, it was accepted by Council with
regret and with sincere appreciation to him for his many services rendered while
serving as City Attorney. Council inquired of Mr. Vason if he would continue to
serve as the city's legal representative thru completion of the bond revenue
requirements for the new water supply and sanitary sewer improvements already started,
and he agreed to do so. A necessary motion to effect this was then made by
Councilman Oswalt seconded by Councilman Byrd and unanimously carried
Miss Patrice Jones appeared before Council and requested permission to sponsor a
dance in Jenkins Auditorium on March 28, 1975. Motion was made by Councilman Byrd,
seconded by Councilman Blackburn and carried that this request be granted provided
that all rules and regulations pertaining to dances held in the auditorium are met.
City Manager Hopkins was requested to arrange for 15 minute interviews by Council
of each local attorney who indicates an interest in serving as city attorney, for
Wednesday evening on March 5th in the Council Chambers beginning at 7:00 P. M.
Motion was made by Councilman Schroedel seconded by Councilman Byrd and carried that
the bills be paid.
Councilman Oswalt offered and moved the adoption of a RESOLUTION pertaining to the
sewer improvements to be made in the Minnehaha Estates. The motion was seconded by
Councilman Byrd and unanimously carried. The RESOLUTION was read by Mayor Smoak,
by title only, and the Number 253 assigned to it.

SUBJECT: PRELIMINARY STUDY, CITY OF CLERMONT,__fLOR1f1A
As a result of our survey, there appears to be two general areas to
which the t

The first area involves the organization of the City government.
Some of the problems uncovered by the survey are as follows:
Some personnel are definitely overworked while others are not being
fully utilized.
Some personnel are overpaid and some underpaid based on the technical
skills and educational requirements required to do a particular job
and also based on the present composition of the job duties, authority
and responsibility.
Some functions which properly fall within the jurisdiction of the city
government are not being serviced properly, and some functions are
being serviced in an inefficient manner due to the current organization
structure and to the lack of well defined policies and procedures.
Poor hiring policies and procedures result in hiring personnel who are
overqualified or underqualified and also result in unnecessary turnover.
Some functions within the city government are currently arranged in
such a manner so that conflicts can arise which contribute to a
disintegration of smooth functioning of the government and to conflict
among the employees.
Poor morale exists in some departments primarily due to a lack of
proper organization and lack of active dynamic response to need for
purposeful and meaningful changes in the organization.
At times the City Manager has had to resort to the subterfuge of
glorified job titles in order to justify an adequate salary for a
position within the government.
Lack of formal policies and procedures for review odpersonnel

Some employees appear to be reporting to more than one supervisor,
which indicates that a precise chain of command does not exist.
This is a difficult situation for an employee and can create administra-
tive problems as well as poor morale.
A proper study of the current functions which fall within the juris-
diction of the city government needs to be made and decisions as to
the level of service needed to adequately support these functions
needs to be made.
A study of the current personnel needs to be made to determine the
technical, educational and physical capabilities which currently
exist and how they may be more fully utilized.
An organization chart with proper chain of command needs to be drawn
and each position within the chart needs a thorough adequate job
description written out completely outlining the technical, educational
and physical requirements required for each job as well as the job
duties, authority and responsibility and the pay scale for the position.
The personnel currently employed by the city would be then matched to
the revised positions to the degree that is necessary. Entirely new
positions may be created and some current job titles may be eliminated.
Additional training may be required by some personnel to adequately- --- .:----
fulfill a position and in some cases, perhaps new employees would have
to be acquired due to the absence of skills in the present personnel.
The government would be organized in such a way as to ensure the max-
imum efficiency, minimize the duplication of effort and the possible
conflicts and to ensure adequate servicing of all functions required
by the city at a minimum cost.
By products of the improved organization would also include better
hiring policies, eliminating the possibility of overhiring or under -
hiring for a position and reducing turnover. Another benefit through
regular review of the employees would be to detect weaknesses within
the organization and correcting them.
And, of course, the reorganization would distribute the work load
equitably and ensure fair pay for work performed and ensure that the
city is not paying more than the position is worth.

The second problem is the lack of long range planning.
It is fairly apparent that the City Manager prepares the budget pretty
much single-handedly primarily based on what happened last year plus
what input he gets from the department heads as to what capital acqui-
sitions they would like to have. Little or no direction from the
City Council as far as what capital improvements are most desirable,
or what level of service is desirable for functions performed by the
city comes from the council to the City Manager. The City Manager
seems to be making these decisions pretty much by himself. This may
be due to general satisfaction on, he part of the city council based on
lack of complaints from the citizens.

Community Services at the direction of the City Manager, is preparing
a survey of the streets and an overall plan for maintaining and
resurfacing the streets. At this time, it appears that the annual
cost for maintaining the streets will be much more expensive than the
amount currently being expended. The council should have known about
this long before now and should also have knowledge of the impact of
population growth on the water, sewage, garbage collection, trash
collection, street cleaning and police department functions. The police department's physical facility is quite cramped for space iow
and growth within the department will certainly aggravate the situation.
As you may have noticed, long-range planning is one of the functions
not currently being serviced properly under the current organization
structure. However, it is such an important function,weffeel
or justified
in segregating it as a separate entity.imperative

council to forsee and understand the ramifications of population
growth and the deterioration and obselesence of the current property
and equipment so that the most economical method of coping with these
problems can be devised. This study would probably lead to a further
modification to the organization structure and help identify wheter
the city should plan for capital expenditures and personnel to accomplish
the desired results of sub -contract the work, or more reasonably a
combination of both would be the most economical. Such planning can
conceivably save the city many thousands of dollars.
We propose that our firm be allowed to undertake the project of
organizing the city government to eliminate the current problems and
to provide adequate flexibility for the future. In addition to the
benefits mentioned earlier, several things would be done during the
reorganization which should result in a considerable cost savings to the
city. As part of the reorganization we would centralize the purchasing
function and establish purchasing policies and procedures.
We would ❑lso establish a vehicle cost accounting system which would
enable the city to retire and replace equipment in the most economical
manners.
Also, careful scrutiny will be made of the feasibility of additional
support for internal servicing of the engineering and maintenance
functions of the city, although not conclusive, our initial survey
indicates that some form of professional engineering capability is
needed.
Finally, our engineers while on the scene, would have time to familarize
themselves with the current status of the property and equipment and
current percentage of capacity of the various departments and will be
in a position to make a recommendation on the amount of funds which
should be reasonably allocated to long-range planning and decide how
the function of long-range planning should be serviced by the organi-
zation, that is whether it is properly a function of the city council
or should be a part of the administration of the city government.
We would appreciate a prompt reply so that we can schedule our
engineering staff accordingly. We anticipate being able to complete
the work within eight weeks of your acceptance of our proposal.

Isaac Rivers - 532 Chestnut Strout
Oatet February 19, 1975
Attached is correspondence from the auilding Official regarding
Mr. Isaac Rivers' property at 532 Chestnut Street.
Mr. Rivera residential unit was initially inspected on April
22, 1974. The dwelling was considered repairable and Mr. Rivers
decided to proceed on that basis. The 120 days time for the
performance of the work expired on August 27, 1974.
As the Building Official pointed out, the city did not move
against the property owner at the expiration of the 120 days
becaudoingstherworkvers was himself andairing becausehofdtileling for existingktis own so,

conditions.
In view of the considerable time which has elapsed since the
initial inspection, the lack of progress in repairing the
dwelling and the fact that Mr. Rivors wants to move into the
dwelling while he completes the necessary work, the city has
notified Mr. Rivers that the work must be completed without
delay and the dwelling cannot be occupied until the repair
work is completed or he must appeal our decision to the Housing
Board of Adjustments and Appeals.
Mr. Rivers has appealed our decision under Section 105, Hard-
ship of the Southern Standard Housing Code.

Please consider this letter as my formal resignation from the position as City
Attorney for the City of Clermont, effective immediately.
As each day passes it becomes increasingly apparent that the pressures of a _.
burgeoning private practice preclude my serving the City with the quality,
efficient, and expeditious legal service to which the City is accustomed and entitled.
Please be advised that I will cooperate and assist in any way possible with my
successor to effectuate an orderly transition.
I have enjoyed serving the City of Clermont these past two years and sincerely
appreciate your having given me the opportunity to do so.
CITY MANAGER':; R1IPORT
C1,OOD INSURANCE,
in a letter dated February 10, 1975 from J. Robert Hunter, Acting
Federal Insurance Administrator, we have been advised that the
sale of flood .insurance has been authorized in Clermont effective
February 18, 1975. Policies of flood insurance may be obtained
from any licensed property insurance agent or broker.
MINNEIiAIIA ESTATES SANITARY SEWER
The plans and specifications on the Minnehaha Estates sanitary
sewer improvements have been approved by the Farmers Home
Administration. Application has been made to the Florida DeparLmemt
of Pollution Control for a construction permit.
TENNIS COURTS - ELEMENTARY SCHOOL
According to Richard Langley, the new tennis courts at the
elementary school should be ready for play in about 30 days.
A Laykold or similar surfacing and lighting is needed to complete
the project. To date, commitments for these two aspects of the
project have not been made.
FLORIDA LEAGUE OF CITIES CONFERENCE
Reservations for the League meeting on March loth and llth must
be made by February 28th. If any Council member plans to attend,
we need to know so reservations can be made.
BASKETBALL COURT
There is still interest in constructing a single basketball court,
preferably at Jaycee Beach. We have developed the following cost
estimate for a 42' W x 40' L x 4" Thick minimum size single court

SPECIAL MEETING
Following a work session of Council held on March 5, 1975 to interview
attorneys for the position of City Attorney, a special meeting of Council was
called at 8:13 P. M. by Mayor Smoak and Councilmen Blackburn, Schroedel
and Oswalt. Absent: Councilman Byrd. City Manager Hopkins was also present.
The purpose of the special meeting was to take action on the T. W. Stewart
& Associates' proposal.
The proposal was discussed. Motion was made by Councilman Blackburn,
seconded by Councilman Schroedel that the proposal made by T. W. Stewart
& Associates be rejected. Upon roll call vote on the motion the results
were: Ayes: Blackburn, Schroedel, Oswalt and Smoak. Total Ayes: Four.
Nayes: None. Absent: Councilman Byrd. The motion carried.
The Council expressed their appreciation to T. W. Stewart & Associates
for their work and their preliminary report. It was felt that the preliminary
report revealed some problem areas to be investigated. The City Manager
reported that this was being done and that Council would be kept informed
as to the findings.
