RrcULAR MI'sl{TING
A Ragulnr Meeting of the City Council. of. the City of Clermont wan bald in the
council Chnmbers on Tuenday, January 27, 1976. The mooting, wan calla(] to order
at 7:30 P.M. by Mayor Claude E. Smoak, Jr., with the following memberu present:
Councilman Blackburn, Schrocdal, and Byrd. Other officials preuant• were: City
Manager llopkinu, City Attorney Baird, City Clerk Carroll, Director of Community
Sarvicea Smythe, Finance Director W111inms, Building Official Nagel, and Chief
of Police Tyndal. Others present were: Mr. and Mro. W. 0. Boone, Sister
Rosanne Moran, and the Messrs. Lucas, Czech, Fleming, Wrightam, Ritchie, Brooka,
Sargent, White, Beals, and Black. A roprenentative of the Sentinel/Star was
also prcuent.
The Invocation wan given by Councilman Byrd, followed by repeating of the Pledge
of Allegiance in unison by those present.
The Minutes of the Regular Meeting held January 20, 1976 and of the Special
Meeting held January 23, 1976 were approved as written.
Mayor Smoak announced the first order of business to be a Public Hearing to
consider a request of William Delaney for a Variance to the Zoning Ordinance.
City Manager Hopkins advised that following further research of the Ordinance,
it had been determined that a Variance was not necessary for the construction
which Mr. Delaney desired to do on his property, and the filing fee posted by
him had been refunded.
Mayor Smoak announced the next order of business to be a Public Hearing to
consider a request of the East Coast Migrant Head Start for a CUP to operate a
nursery school for migrant children under the age of three at the Blessed -
Sacrament Catholic Church. Sister Rosanne Moran of the Frans
iscan Order
appeared before Council in support of this request, and advised they were in
agreement with the five conditions as recommended by the Planning & Zoning
Commission following their consideration of the request in Public Hearing on
January 6th, the same being:
(1) The nursery school must be approved by the
Blessed Sacrament Catholic Church.
(2) The nursery must meet all state requirements.
(3) If an outdoor play area is provided, the area
must be enclosed by a fence at least four (4)
feet high.
(4) The structure or use cannot be expanded except as
granted by the City Council under a Conditional
Use Permit.
(5) Must conform to all provisions of zoning and other
applicable ordinances.
City Manager Hopkins advised that the conditions had been met. Mayor Smoak
inquired if there be anyone present who desired to address the matter from the
floor, and there being none, motion was made by Councilman Byrd, seconded by
Councilman Schroedel and carried that the request be granted as presented and
including the conditions as recommended by the P & Z Commission. Councilman
Blackburn offered and moved the adoption of A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA, GRANTING A CONDITIONAL USE PERMIT
TO ALLOW FOR NURSERY SCHOOL FOR MIGRANT CHILDREN and the motion was seconded
by Councilman Byrd and carried. The RESOLUTION was read in its entirety by
Mayor Smoak and the number 267 assigned to it.

Mr. 11. E. (Gene) Lucan appeared before Connell in support of it letter pro-
vioualy submitted to Council, wheroln he protested notice from the. city to mow
hin vacant property or alsc it would bo mowod by city cruws and invoiced to
him. The letter further reflected that, though ho wan it city resident, he did
not receive city oorviees [inch an natural ran, water, cable tv, trash and garbage
pickup; That several yearn ago he had requested water nar.vice and hnd been turned
down because of the expense, but noted recently that now water lines were to be
extended to (look Street and further south on highway ll 27. Mayor Smoak inquired
of Mr. Lucas if lie now desired natural gas, water, nod cable tv services, and lie
replied in the negative. Mayor. Smonk inquired if he desired city garbage and
trash pickup, and he replied thnt he did. Mr. Lucas wno assured that this service,
same as afforded all other city residents at a cost of $4.00 per month would be
started immediately. Mr. Lucas was further advised that, according to existing
ordinances, he would be required to keep hi,n property mowed and free of debris
as required of all other city residents and an inspected and determined by the
City Health Officer.
Mr. R. D. Wrightam, representative of the local DAV Organization, appeared
before Council and requested use of the Highlander Hut for their regular monthly
meetings. It was the suggestion of City Manager Hopkins that inasmuch as there
was an increasing use demand for Jenkins Auditorium, and the possibility that all
organizations desiring use of it could not be accomodated, that a possible
arrangement could be formulated with the DAV whereby in exchange for use of the
Highlander Hut without cost, they would maintain a schedule for use of the
building by others, collect necessary fees for use of the building as might be
established by Council, etc., a similar arrangement as exists now with the Chamber
of Commerce for use of the Jenkins Auditorium. This suggestion was accepted by
both Council and Mr. Wrightam, and tha matter was referred to City Manager Hopkins
to develop a formal proposed agreement. Councilman Byrd advised that following
a recent visit to the building, he noted it was in need of routine maintenance.
This matter was also referred to the City Manager for attention.
Officer Elbert Richie of the local American Legion Post, and Officer R. D.
Wrightam of the local VFW Post, were present to present plaques from their res-
pective organizations to City Manager Hopkins in recognition and appreciation
for the many gratuities extended while serving the citizens of Clermont as their
City Manager. The plaques were graciously accepted by Mr. Hopkins.
City Manager Hopkins submitted his report both orally and written, and a copy is
attached hereto.
With regards recommendation of the City Manager that an interim audit covering
the first three months of fiscal year '75-'76 be authorized conducted by Green-
lee, Paul 6 Furnas in lieu of an immediate cash audit, motion was made by
Councilman Blackburn, seconded by Councilman Schroedel and carried that this
recommendation be accepted.
With regards inquiry by City Manager Hopkins as to input from Council to be
forwarded to the Lake Soil and Water Conservation District in their long range
plan, it was the suggestion of Mayor Smoak that they be advised the city would
welcome their assistance in implementing any practice which will maintain water
quality, but specifically and limited only to, spray irrigation, and, with regards
their proposed review of all subdivision and drainage plans, that this should
be on a volunteer basis and not a mandatory one.
Mayor Smoak introduced and extended welcome to George Williams, recently employed
as Finance Director of the city.
City Attorney Baird reported that the City of Clermont has been named as a party
defendant in a suit involving an incident several months ago wherein it has
alledged there was a wrongful death action on part of the city and the Clermont
Police Department; That the city's insurance carriers had been notified, That

Councilman Schroudal reported briefly on what ho opined to be on optimistic
meeting of Council. and the Lake County Pollution Control hoard at which time
they toured the alto proposed na a possible location for the city's effluent
disposal; That while the board members appeared to be in favor of the location,
it would be necessary to have certain engineering studies performed before they
could make a commitment.
Councilman Byrd reported briefly on what he opined to be a very informational
and beneficial meeting of Council and the trust officers of the city employees
pension trust fund, at which time the annual accounting of the fund was reviewed;
That he wan of the opinion the fund was in better shape that ever before, and
that the trust officers were doing a good Job.
Finance Director. Williams reported he had audited tlae invoices and their docu-
mentation as being presented for payment, and found no departures from the city's
purchasing policies or budgetary matters related thereto, whereupon motion was
made by Councilman Blackburn, seconded by Councilman Byrd and carried that the
bills be paid.
City Manager Hopkins reported that bids had been received on the texture coating
of the Jenkins Auditorium and the Chamber of Commerce Annex as follows:
Bishop & Black Painting, Inc. @ $4325.00
Colorcrete of Central Fla., Inc. @ $6675.00
Western Waterproofing, Inc. @ $4356.00
and recommended that the bid be awarded to Bishop & Black Painting, Inc., the
low bidder. Motion was made by Councilman Byrd, seconded by Councilman Blackburn
and carried that the recommendation of the City Manager be accepted and the bid
be awarded to Bishop & Black Painting, Inc. @ $4325.00.
Councilman Blackburn inquired if an attempt had been made in obtaining more
comfortable seating for the Council Chambers as had been discussed in the past,
and he was advised by City Manager Hopkins that brochures had been obtained which
he would furnish to the Council for their consideration.
With regards recommendation of City Manager Hopkins that the proposal submitted
by Dr. William M. Howard for actuarial services with regard to the pension plan
for employees of the city for the next two years be accepted, motion was made by
Councilman Schroedel, seconded by Councilman Blackburn and carried that the
recommendation be accepted. A copy of the proposal is attached hereto and shall
become a part of these minutes.
With regards an additional appointment needed to be made to the Building Code
Board of Appeals, motion was made by Councilman Blackburn, seconded by Councilman
Schroedel and carried that Lawson Wolfe be appointed to membership on this board
for a three year term, as had been recommended by City Manager Hopkins.
City Clerk Carroll recommended that the following named persons be appointed
to serve on the election board of the Special Election to be held on March 9, 1976:
Mrs. Pat Grant, Mrs. Alice Pelfrey, Mrs. Goldie Wilson, and Mr. A. M. Johnson.
Motion was made by Councilman Blackburn, seconded by Councilman Schroedel and
carried that the recommendations be accepted, and that the provision be included
that substitutions be made should they become necessary.
With regards by the local Jaycees for use of Bishop Field on which to sponsor a
circus on April 23rd, motion was made by Councilman Blackburn, seconded by Council-
man Schroedel and carried that the request be granted provided that all provisions
as required for carnivals and circuses held there previously have been met.

respect to thin particular type of incident, it would be his conclusion that for
incidents of this type for which the city has no control, particularly over old

the cant iron pipe, that a precedent should not be set in the satisfying of n
claim of thin type which has been presented to Council for consideration. It
was consensus then, there wan no legal. means by which the city could mnke reim-
burscment as requested, whereupon motion was made by Councilman Blackburn, seconded
by Councilman Byrd and carried that the claim be denied.
With regards delinquent taxes owed on the Johnson property acquired by the city
and prorated between Mr. Johnson and the city, a communication was received from
former City Attorney Vases, who suggested that immediate remittance be made in
order to prohibit further interest penalties. This matter was referred to City
Attorney Bnird for investigation and report buck to Council.
Councilman Blackburn reported briefly on the recent meeting of the Lake County
League of Cities at which Mayor Smoak had been reelected as President for another
one year term, and City Clerk Carroll had been elected as Secretary/Treasurer.
Mayor Smoak called a Special Meeting of Council to be held in the office of the
City Manager on Monday, February 2nd at 7:00 P.M. to consider appointment of an
interim acting city manager, such meeting to be followed by a work session of
Council to formulate a procedure for prompt and adequate selection of a City
Manager from the numerous applications received, and to review the agenda for
the Town Ball Meeting to be held on February 6th.
The meeting was adjourned by Mayor Smoak at 9:30 P.M.

CITY MANAGER'S REPORT
27 January 1976
Interim Audit
In accordance with instructions received at the City Council meeting on
January 20, 1976, Greenlee, Paul and Furnas was contacted regarding an
interim audit. Rather than conduct a cash audit, it was the auditor's
suggestion that a segment of the annual audit be done early. It is
recommended that Greenlee, Paul and Furnas be authorized to conduct the regular
audit for the first three months of FY 1975-76 (October, November, December
1975), This work would not be repeated at the time of the annual audit.
The overall cost of the complete audit will not be significantly greater
by conducting the audit in two parts.
Lake Soil & Water Long Range Plan
In a memo dated January 12, 1976 we transmitted the rough draft of the
Lake Soil and Water Conservation Districts Long -Range Plan. Any Council
input would be appreciated so we can formulate comments to the District
by January 31st.

It is recommended that Bishop and Black Painting, Inc. of Clermont,
the low bidder, be awarded the bid in the amount of $4,325.00
for both facilities.

NOTICE TO BIDDERS
The City Council of the City of Clermont will consider sealed bids
for the following:
Sandblast exterior to remove loose paint and apply
finish coat of waterproof textured coating to the
Jenkins Auditorium Building and Chamber of Commerce
Annex located at 691 Montrose Street, Clermont, Florida.
Specifications and bid blanks may be obtained from the office of the
City Clerk during regular business hours.
Sealed bids will be received by the City of Clermont at the office
of the City Clerk, City Hall, Clermont, Florida, until 2:00 P.M.,
Thursday, January 22, 1976, and then at said office publicly
opened and read aloud. The bids will be considered by the City
Council at a regular meeting on Tuesday, January 27, 1976, at
approximately 7:30 P.M. in the Council Chambers located at the
corner of DeSoto Street and West Avenue.
The City of Clermont reserves the right to reject any and/or all
bids, in the whole or part; to waive any informality in any bid,
and accept any bid which in its descretion, may be for the best
interest of the City of Clermont.

TEXTURID.COATING SP(CIFICATIONS
I. General. The work under this contract includes all labor, materials,
services, equipmont and scaffolding required to complete the surfacing of
the project in accordance with the drawings and specifications.
Scaffolding shall be constructed and maintained in strict accordance with
applicable laws and ordinances.
II. Materials. The portland cement base surfacing and waterproofing

The contractor shall use a complete mechanical waterproofing outfit.
Each outfit shall consist of a five Ii.P. gasoline engine to operate a
revolving paddle -type agitator in a stationary mixing drum, having a
batch capacity of at least 100 pounds of coating material, a compressor
and blower unit, a spraying gun, and at least 50 feet of air hose to
furnish air from compressor to gun.
The contractor shall carry on the work at such places and also in such
order of precedence as may be found necessary by the City.
III. Preparation for Coatin All flashing, hangers, fasterners, trim,
or other fixe supports s own on the plans shall be in place prior to
applying base coat or finish coat.
Dirt, dust and loose particles shall be removed from the masonry by wire
brushing or other means prior to coating. Glue -bound water paint,
calcimine, whitewash, oil, paints and grease must be completely removed
by sandblasting.
Small cracks or imperfections which may be present in the surface masonry
and which cannot be filled by spraying with coating, shall be thoroughly
cleaned of all loose particles, wetted and then filled with a thick paste
by mixing the dry coating and water.
Surfaces to be coated shall be inspected by the contractor and any
unsatisfactory condition shall be corrected prior to the application
of any material.
IV. Application.
General. The surface to be coated shall be uniformly dampened with water
just prior to applying coating.
In applying coating the work should be laid out to permit the completion
of an entire wall surface in one operation. If this is impractical, the
coating shall be carried to some natural stopping point.

Coating shall be kept at a uniform consistency by frequent agitation
in the machine mixer drum.
Coating shall not be applied to surfaces when the temperature is below
40 degrees F.
Coating shall not be applied to surfaces which contain frost.
The finish coat shall be "Colorcrete" as manufactured by Colorcrete
Industries, Inc., Holland, Michigan, or its duly Authorized Standard
Mixing Plants and Distributors, or the equivalent, and shall be
applied in strict accordance with the manufacturer's directions.
Sample of the finish coat in color specified shall be applied on the
job site by the Authorized Coating Contractor -Applicator, for the
approval of the City.
Smooth Finish Coat. This finish coat shall be sprayed on the surface
n an even pattern. A slightly dimpled texture is obtained due to the
nature of the mixture and action of the spraying equipment.
Exterior. Sandblast existing building, removing all paint and foreign
mat— ter Trom the masonry that is possible without pitting surface.
Protect surfaces not to be sandblasted. Care shall be taken to protect (i
existing plants and shrubs. Owner to be responsible for the removal
or trimming of plants and shrubs which interfere with sandblasting
operations.

As t:he Council wi11 recall, Dr. Iloward, in a letter dated June 26, 1975,
set forth a basis for charges for actuarial services with regard to the
pension plan for employees of the City of Clermont for the next two years.
(See attached letter from Dr. Howard).
Thi,t matter was considered by the Council on July 27, 1975 and referred
to the City Manager and Controller for study.
On September 18, 1975 the Controller and I met with Dr. Howard to discuss
his proposal.
There arc many factors involved in determining actuarial service and the
factors and service vary from city to city. The City of Clermont has three
separate pension funds - Fire, Police and General Employees. In performing
an actuarial evaluation for these funds, some of the factors that must be
considered include:
1. The total number of employees -
2. The age and length of service of each employee.
3. The classification of each employee
4. Termination and retirement of employees
5. Employees under thirty years of age and less than three years of service"
6. The salaries of the employees and increases during the year
7. Service retirement benefits
S. Disability retirement benefits
9. Survivor benefits
10. Maintain a valuation based on investment funds yielding 5%
All of these functions must be considered for each employee in order to
determine the contribution the city must make in order to maintain the fund.

We contacted a number of other cities regarding their costs, but it was
impossible to draw any conclusions regarding comparisons due to the number
of factors.

Dr. Howard has been a professor at the linivorsity of Florida for tiro past
twenty years in tilt, College of Business Administration. Ila has been an
actuarial consultant to various Florida cities for the past sixtaan years.
At present Dr. Howard performs actuarial services for fifteen cities. Ho
has also been a consultant to Hercules Chemical Company for seventeen years,
Dr. Iloward has been a consultant to Clermont for the past fifteen Years and
as such is very familiar with the city's program. The rate for 75-76 is
$625.00. This fee is considered to be reasonable based on the value of and
need for the service. Dr. Howard is very qualified in this field and the
solvoncy of our plan is due in largo part to his expertise.
Therefore, it is recommended that the city approve Dr. Howard's proposal
for continued service.

Dear Mr. Hopkins:
The purpose of this letter is to set forth a basis for charges for
actuarial services with regard to the pension plan for employees
of the City of Clermont for the next two years. For the past year
or two we have not had a formal basis for determining charges.
Changing price levels and other factors have led me to review a
number of aspects of the actuarial services which I provide for a
number of Florida cities. I have found that my charges have gotten
rather seriously out of line -- on the low side -- for some cities,
with the result that I am realizing a rather low return on the time
I spend on consulting services.
The time required for actuarial valuation of a pension plan depends
on the number of employees, the number of classifications of employees
included in the plan (fire, police and general), the complexity of
pension plan benefits (service retirement benefits, disability retire-
ment benefits, survivors benefits) and whether or not employee contri-
butions are required. On the one hand, your pension plan is complicated
by the separate reporting on firemen, policemen and general employees
required by Chapters 175 and 185 of the Florida Statutes. On the other
hand, the plan provides benefits which require relatively simple calcu-
lations and it does not require employee contributions.

A schedule of charges I have prepared produces an annual fee for
actuarial services for the City of Clermont of $800'plus travel expense
based on 45 employees. This is a rather significant increase over the
$487 for which I recently sent you a statement. So I propose that, in
addition to travel expense, the fee be increased to $625 for the
1975-76 fiscal year, $750 for the 1976-77 fiscal year and the schedule
of charges to which I have referred thereafter. If the price level
continues to increase as it has in the recent past, I may revise the
schedule before the 1977-78 fiscal year. But I would expect the charge
to be the same except for changes in the price level.

If you would like to consider having the plan valued biennially,
rather than annually as in the past, with consulting services
available continuously, I would be pleased to submit a proposal on
that basis. The charge might be one-fourth to one-third less.
There are advantages to annual valuation, particularly during periods
of rising prices, but seine cities do have their pension plans valued
biennially.
The charges proposed cover essentially the same actuarial services I
have provided in the past: annual actuarial valuation of the pension
plan including a report on the results in a form which is useful to
City officials and acceptable to the director of the Police and Fire
Pension Trust Fund in Tallahassee; an annual visit to Clermont at a
mutually convenient time to discuss various aspects of the plan and
related matters with City officials; verification of calculated
retirement benefits as employees retire; and the usual correspondence
and telephone calls occasioned by the normal administration of the
plan. The proposed charges do not cover special studies requiring
additional calculations or additional written reports that may be
requested. The arrangement may be canceled by either party with
reasonable notice.
Actuarial valuation of the plan is to be based on employee data to be
provided by the City of Clermont and on financial data included in the
report of the trustee of the plan or the City's annual audit report
which includes figures on the assets of the plan. Consulting services
provided by professors at the University of Florida are subject to
approval by the Board of Regents. I would appreciate learning your
opinion on the appropriateness of this proposal and would be glad to
answer any questions you might have with regard to it.

SPECIAL MEETING
A Special floating of the City Council of the City of Clermont, Florida was held
in the office of the City Manager on Wednesday, December 11, 1974; Thn meeting
was called to order at 5:00 P, fl. by Mayor Claudo E. Smoak, Jr. with the following

P'ayor Smoak announced the purpose of the meeting was to consider request by
officals of the local VFW Post for permission to use "Bishop Field" during the
week of December 15th thru Decomber 21st for a carnival.
Inquiries of the carnival representative were made by Council as follows:
Mould an approximate area of 300' x 500' be of sufficient size for the carnival
in order that the infield not be used at all, and he replied that the size area
r,rould be more than enough;
Could . show proof of ample insurance coverage, and he submitted a certificate
of insurance in the amount of $1,000,000,000 for Mayor Smoak's persual;
Would there be any animals with the carnival, and he replied there would not be,
strictly amusement rides and concessions;
Would the noise factor be obnoxious and what hours would the carnival be operating,
and he replied they hoped to operate from 4:00 P. M. to 11:00 P. M. daily with
one matinee beginning at 1:00 P.M., and that the noise factor would be at a
very minimum with the amusement ride of the Roller Coaster making the most i
noise.
Flould there be any living units with the carnival, and he replied there were about
six trailers, all modern and self-contained.
Would there be any toilet facilities provided; and he replied there mould be at
least two, "Mr. John" portables;
What were the provisions for electric power, and he replied they supplied their
entire power supply with diesel generators;

Did they have any provisions for daily refuse removal, and he replied they could
remove it daily with their own equipment, but would prefer "Dump -All" service
if it is available;
Inasmuch as there was no guarantee to the VFW Post in his proposal other than
a percentage of the "take", would he agree to a cash advance,and he replied that
he would submit to them a $300.00 cash advance against the 15% of the 'take",
and would pay them $7.50 for each concession.
Based on the statements made by the carnival representative, motion was made by
Councilman Schroedel seconded b Councilman Blackburn and carried that ermission
be granted for use of Bishop Field fora carnival, provided that 50.00 be paid
by the carnival for cleaning up of the area following its departure.
Mayor Smoak adjourned the meeting at 5:30 P. M.

flith regards the outstanding invoice from Singer Layne/Atlantic for work done on
the Highland Well, City Manager Hopldns reported that following his restudy cf
the contract documents, conference with Mr. Crowson, the engineer, and reviewing
o" the tapes of the Council meetings held on May 28th and June llth at which time
ti:e Highland Well project was discussed, it was his determination that no mention
,was made of an adjustment to the city if the hole was not drilled to a 1000
feet -that the specifications called for approximately 1000 feet, and that he had
understood the objective to be that of finding adequate quality and quantity of
water which was accomplished at the 914 foot level. With regards the casing,
the city agreed to $9.87 per foot if the casing eras used, which it vras not.
With regards the 6" casing vs the 8" casing, Mr. Crowson advised that aside from
tine cost of the casing, the cost of drilling with one size as opposed to the other
would be of no appreciable difference. He thereupon advised that he felt the
contractor had fulfilled his obligation in good faith as per the contract and
negotiations which had been made. Motion was made by Councilman Byrd, seconded

With regards the matter of extending fire protection beyond the city limits
of Clermont, City Attorney Vason reported that following his study of the Home Rule

SPECIAL MENTINC
A Special Meeting of the City Council of tho City of Clermont
was held in the office of the City Manager on Monday, February
2, 1976. The meeting, was called to order by Mayor Claude B.
Smoak,Jr., at 7:25 P.M. with the following members present:
Councilmen Byrd, Schroodol, and Blackburn. Others present
ware: City Manager Hopkins, City Clerk Carroll, and City
Attorney !laird.
Mayor Smoak advised the purpose of the meeting was to consider
an appointment of an acting City Manager, effective at the close
of business on February Gth, until a permanent successor to the
city manager's position has boon chosen.
Motion was made by Councilman Blackburn, seconded by Councilman
Schroodel and carried that Robert G. Smythe, Director of Com-
munity Services, be appointed as interim acting city manager,
effective at the close of business on February G, 1976.
The meeting was adjourned to a work session of Council by
Mayor Smoak at 7:33 P.M.
