A Regular Meeting of the (City Council of the Cl.ty of Clermont wall held in the Council
Chambers on Tuenday, March 16, 1976. Tha mooting wan called to order at 7:30 P.M. by
Mayor. Claude P:. Smoak, Jr.., with the following memberu prevent: Councilman Blackburn,
Schroodel, rand Byrd. Other offlciale present wero: Acting City Manager Smythe, City
Attorney Baird, City Clerk Carroll, Finance Director W1111amn, find Chief of Police
Tyndal. Others pronant were: The Menoro. Beals, Wootoon, Jameson, Pace, Czech,
Crowson, Sargent, Mobley find Shepard. A reprenentative of the Sentinel/Star was also
pronant.
The invocation was given by Councilman Byrd, followed by repeating; of the Pledge of
Allegiance in unison by those prevent.
The Oath of Office wan administered by Mayor Smoak for the position of Council Member
1n Croup No. 1 to Councilmon-Elect Charles B. Beals, find he thereupon floated at Lila
Council table and made welcome by members of the Council.
The Minutes of the Regular Meeting held March 9, 1976, and of tine Special Meeting
held March 10, 1976, were approved as written.
Elder Ira L. Wootson of the Church of Cod in Christ appeared before Council to again
request permission to occupy their new church building prior to meeting the require-
ments for buffer strips and parking, however he did not have the necessary firm com-
mitment in writing from the congregation as to a definite time schedule for meeting
the necessary requirements, in order that Council might consider the matter. It was
the suggestion of Council that Acting City Manager Smythe furnish the exact specifi-
cations in writing as to what must be completed to meet all necessary requirements to
Mr. Wootson, that Mr. Wootson present these to his congregation for a firm commitment
in writing to submit for Council's consideration at their meeting to be held on March
23rd.
Mr. C. A. Mobley, President of the South Lake Babe Ruth Leaue I
g , appeared before Council

port of their previously submitted request in writing that the city furnish the 1'
necessary funds for materials to remodel the concession stand at Bishop Field, with
the necessary construction supervision and labor to be donated by members of the League.
A plan of the proposed construction was submitted to Council for their consideration.
In conjunction with this request, Council also considered a report submitted by Acting
City Manager Smythe as to his recommendations for improved lighting of Bishop Field
within the funds limit as allocated in the '75-'76 budget wherein the 28 existing in-
candescent lamps on the infield would be replaced with quartz lamps, and the switch
gear enlarged to accomodate 60OAmp wiring, which would eliminate the gross power over-
load that presently exists. Council was in agreement with Mr. Mobley's request and
the City Manager's recommendations, whereupon motion was made by Councilman Blackburn,
seconded by Councilman Schroedel and carried that the budgeted funds up to $4,000.00
be released for the improved lighting as recommended by the City Manager, and $500.00
be released for materials to remodel the concession stand as requested by the South
Lake Babe Ruth League. It was the opinion of Councilman Byrd that with the ever
increasing costs for electrical energ
y, it might be prudent to restrict ball games held
at Bishop Field to daylight hours only.

Acting City Manager Smythe submitted his regular report, both orally and written, and
a copy is attached hereto.

With regards Council's desire to eliminate the necessity of the Chamber of Commerce
Secretary returning to the Jenkins Auditorium during late night hours to collect rental
fees, motion was made by Councilman Byrd, seconded by Councilman Beals and carried that:
(1) Persons desiring to rent the building for commercial use and who has
established a reliable background from previous use of the building,
may utilize a time period up to, but not exceeding, seventy two (72)
hours following use of the building, in which to satisfy the required
fees with the Chamber Secretary during regular business hours of the
Chamber office.

Inasmuch as the existing fcen for use of the Jenkinn Building were established by
Council in 1967, it wan the nuggention of Councilman Blackburn that the Acting City
Manager review those fcen in conjunction with the increased cents for maintenance of
the building today an compared with 1967, and report back to Council. Mayor Smonk
advised that inasmuch no the building had been renovated by the city to meet a need
of: the local people, he would be in favor of keeping the fees as minimal an Possible
in order to encourage use of the building. It was the nuggention of Mayor Smonk
that the Acting City Manager obtain a classification breakdown of the various users
of: the building.
Mr. Dave Crowson of Dawkins 6 Associates, Inc., appeared before Council to answer
any inquiried that he could with regards the water and sanitary sewer improvement
program now underway. With regards the installation of a pump and motor at the
Seminole Well, different from that called for in the specifications and without ben-
efit of a change order approved by Council, Mr. Crowson advised that a verbal
agreement had been effected between the contractor, the engineers, and the city ad-
ministration for a change in the BPM'S that were in the specifications in order to
correspond to the other existing pumping units in the city, but that a change in the
motor size had not been considered. Mr. Crowson was requested to evaluate the in-
stalled equipment and submit a recommendation to Council for its acceptance or
rejection, and, obtain the cost difference of the installed equipment to that as had .
been specified. With regards inquiry as to the engineers recommendation for use of
cast iron pipe in the water line extension south on Highway #27, as opposed to PVC
pipe now used by many municipalities at less coat, Mr. Crowson advised that the cast
iron pipe had a greater pressure class rating which would provide a safety factor in
this particular location inasmuch as there was an appreciable elevation difference
between the pipe and the static water level in the Highland Avenue elevated tank.
He further advised that the ability to withstand pressure stresses was reduced by
approximately 50% in PVC pipe over a ten year period. Mr. Crowson did not advise,
however, that PVC pipe would not be acceptable in Clermont.
City Attorney Baird reported to Council that following his review of the city's
position with Michaels-Stiggins, Inc. with regards the problems arising from the
sanitary sewer percolation ponds as proposed by them, it was his conclusion that
the city has a cause of action against them and would recommend that litigation be
commenced. Motion was made by Councilman Blackburn, seconded by Councilman Beals
and unanimously carried that the City Attorney's recommendation be accepted and he
be authorized to proceed.
City Attorney Baird reported to Council that following his review of the sanitary
sewer connection problem at the South Lake Press building, it was his opinion that
the city's obligation had been fulfilled at the time the collection line had been
layed and a building line sewer lateral installed at the northeast corner of the Press
property. He further opined that following this installation, sewer service had been
made available by the city and there was no provision for the waiving of the monthly
sewer charge. It was the opinion of Councilman Byrd that because the collection line
had been installed at a higher elevation than the existing plumbing in the Press
building thereby making it impossible for a hookup to this line, the city had not made
the sewer service available and was still obligated to do so. Mayor Smoak inquired
as to the desire of the property owner, and he was advised there had been no com-
munication from them since July of 1975 at which time they had requested an immediate
refund of the sewer assessment and monthly sewer charges. Mayor Smoak thereupon
requested that Acting City Manager Smythe obtain the present desire of the property
owner, in writing, and the matter be considered at the meeting to be held on March 23rd.

for consideration at the next meeting to be held on March 23rd. Mayor Smoak reported
he had received a communication from Mr. Orrin Wnrd, Mayor of Mlnneoln, expressing
sincere appreciation to Council for the excellent cooperation extended to them in
thu recent Resolution adopted by Council, in support of their request that the Minneola
Pont Office be maintnined and not phnued out an had been proposed.
Councilman Schroedel reported that he hnd been contacted with regards a dangerous
traffic control problem existing at the internocLion of hook Street and Lake Shore
Drive, and inquired if nomething could be done about it. Acting City Manager Smytha,
in conjunction with Chief of Police Tyndal, was requested to investigate the matter
and submit his recommendations to Council for their consideration at the next meeting.
Mayor Smoak reported that following many hours spent by Council in the serious con-
sideration of the hundred plus applications for the position of City Manager, that
unanimous agreement had been realized and he would thereby entertain a motion for
appointment. Motion was made by Councilman Blackburn, seconded by Councilman
Schroedel and unanimously carried that Mr. Gordon Tiffany be employed as City Manager
effective April 19, 1976 at a salary of $15,000 per year with an increase of $500.00
at following new fiscal year.
With regards the proposal submitted by Acting City Manager Smythe for a bicentennial
time capsule housing and plaque, motion was made by Councilman Blackburn, seconded
by Councilman Schroedel and carried that the proposal be accepted and authorization
granted to proceed with the base construction, but that the order for the plaque be
deferred pending approval of the city'a bi-centennial committee by the National Com-
mission in order to include the bi-centennial emblem on the plaque.
Councilman Blackburn offered and moved the adoption of A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA, PROVIDING FOR CERTAIN BURIAL
BENEFITS FOR EMPLOYEES OF THE CITY OF CLERMONT and the motion was seconded by Council-
man Schroedel and carried. The Resolution was read by Mayor Pro-Tem Byrd, by title
only, and the Number 273 assigned to it.
Councilman Blackburn offered and moved the adoption of A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA, AUTHORIZING THE OPENING OF CERTAIN
SAVINGS PASS BOOK ACCOUNTS AT THE EXCHANGE BANK OF CLEIU40NT AND DESIGNATING THE REQUIRED
SIGNATURES OF CERTAIN CITY OFFICIALS and the motion was seconded by Councilman Schroedel
and carried. The Resolution was read in its entirety by Mayor Pre-Tem Byrd and the
Number 274 assigned to it.
Councilman Blackburn offered and moved the adoption of A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA, SUPPORTING RESOLUTION NO. 26-76 OF THE
CITY OF BOCA RATON, FLORIDA ENACTED FEBRUARY 10, 1976, REQUESTING THE FLORIDA LEGIS-
LATURE TO TAKE COGNIZANCE OF THE EXPRESSION OF PUBLIC OPINION OF MUNICIPALITIES and
the motion was seconded by Councilman Beals and carried. The Resolution was read by
Mayor Pro-Tem Byrd, by title only, and the Number 275 assigned to it.

Dear Mayor Smoak:

Pursuant to your request, I have reviewed the City's files and researched the appli-
cable law in regard to the problems arising from the percolation ponds proposed by
Michaels-Stiggins, Inc.
My investigation to this point reveals the following factual situation:
1
1. Preliminary Engineering Report rendered by Michaels-
Stiggins, Inc. called for disposal of treated efflu-
ent into the canal between Lake Palatlahaha and Lake - -- --?
Hiawatha.
2. Disposal of treated effluent into the canal as proposed
was prohibited by environmental agencies.
3. Alternative proposed was to utilize percolation ponds.
Ardaman and Associates report of subsurface soil inves-
tigation of proposed polishing ponds establishing the
feasibility of the proposed percolation ponds. d
4. Construction of percolation ponds ($25,600.00).
5. Evidence of inefficiency of percolation ponds.
6. Alternative disposal approaches developed by City of I'
Clermont (Borrow pit, Johnson property, spray irrigation,
etc.) (93,053.00)
7. Account rendered by Michaels-Stiggins, Inc., as currently
unpaid: 836,272.17

The above factual situation leads to the conclusion that the City of Clermont has 1..
a cause of action against Michaels-Stiggins, Inc., and Ardaman and Associates.
The nature of the action is breach of contract and negligence. At the present
time, I feel liability could be established on the part of Michaels-Stiggins, Inc. I'
and Ardaman and Associates for the costs expended in construction of the percola-
tion ponds.

Additional damngea In the nature of conts expended In connection with the borrow
pit, the Johnson property and the aprny IrrignLion are a different matter. It may
be that these costs would have been necessary if the percolation pond alternative
was not put into effect. If, on the other hand, there were additional approachen
to consider at the time the percolation pond alternative wan accepted, and those
other approachen were not accepted bailed upon the Ardmunn report on the feasibility
of the percolation ponds, the City may be able to collect additional damages.
A better understanding of the possibilities of establishing liability for these
damages can be gained in the early stages of litigation by the utilization of legal
discovery procedures.
I would recommend at this point the filing of an action against Michnels-Stiggina,
Inc. for damages and include in the action a demand for costs expended both for the
percolation pond and for the additional expenses in connection with the borrow pit,
the Johnson property and the spray irrigation.

February 12, 1976, has been made and we comment as follows.
Enclosed you will find a highlighted excerpt from Certainteed PVC Solvent
Weld Pipe showing that a Schedule 40 pipe has an ASTM D-2241 pressure
class of approximately 180 psi. ----..
Also enclosed is a schedule of pressure class pipe ratings excerpted from
the recently adopted AWWA Standard 75-900 for poly -vinyl chloride pipe
(PVC 1120). The pressure class for ASTM pipe ratings and that of AWWA
are different in that the factor of safety used by the AWWA is higher than
that acceptable to ASTM. Consequently, a Schedule 40 PVC pipe would be
the approximate equivalent of a 100 psi AWWA pressure class.
In the present application, the 6-inch line will be installed at an eleva-
tion approximately 90 feet above mean sea level while the overflow eleva-
tion of the Highland Tank approximates 305 feet above mean sea level thus
producing a 215 foot total static head differential. This equates to a
93 psi static pressure difference which when coupled with surges (customarily
100%) indicates a requirement of 200 psi pressure class rating. Using the
AWWA standard for 6-inch pipe, this indicates a minimum wall thickness of
.473 inches to provide the 200 psi rating as contrasted with the wall thick-
ness of .280 inches for the Schedule 40 pipe.
In view of the rolling terrain in Clermont and the appreciable elevation
difference between the pipe as installed and the static water level in the
elevated tank, we would recommend that a 200 psi pressure class pipe based
on AWWA specifications be employed in this particular application. This
will provide for the safety factor anticipated by the waterworks industry
as well as surges which will occur in this dead end line and also allow for

Dear Ted:
During the course of construction of the subject well and prior to
placing the order for the pump and motor, you suggested to the City the
installation of a 1750 rpm pump instead of the 1150 rpm unit called for
in the specifications. Your recommendation for using the higher -speed
unit was based in part on the fact that it would correspond to existing
pumping units in the City and would have five pumping bowls instead of
seven as would otherwise be required with a slower speed unit. This was
agreed to by the City and is reflected on the shop drawings; however, no -- --
change order was ever processed reflecting this understanding between you
and the City.
To accommodate this pumping speed change, the electric motor had to be
revised from 1150 to 1750 rpm which was done. Additionally -- upon a
separate determination by you -- the horsepower requirement was modified
from 150 hp to 125 hp which information was included in the shop drawing
submittal of April 23, 1975. This change in horsepower requirements was
unobserved until the power supplier placed an inquiry relating to electri-
cal load requirements.
Although the shop drawings reflect that both the horsepower and the
rotational speed requirements of the pump had been modified, this does
not constitute an approval for a change. Such information is clearly
presented on the face of the shop drawing so that there can be no misunder-
standing of this fact.
It is apparent that a pump and motor different from that called for in

Bob Hopkins verbally inquired of our engineering firm as to the situation.
On approximately March 1st, I received a phone call from Mr. Dave Crowson
relating the facts as follows:
1. During design, shop drawing period an engineering determination was
made to change the RPM of this well from preliminary RPM of 1100 to
1750. This was considered due to the fact that our existing 150 HP
Motors are of the higher R.P.M. and at some point in time it may be
necessary to interchange them for one reason or another. Also it
would reduce the number of bowls in the pump from 7 to 5. We were
consulted in regards to this change and agreed. The contractor
then requested of the manufacturer (US Motors - Peerless Pump) some
new specs for a "Balanced" pump and motor installation and when
this was furnished it was approved by the engineers with apparent
disregard to horsepower or by mistake.
2. Locke Well & Pump is willing at this point to refund between $500
and $600 which is the price difference of the motors. They also
would install the 150 HP motor at this time for $2000 plus if we
so desire.
I have made search of the files and I cannot find a change order or
correspondence relating to the RPM change. This appears to have been a
verbal exchange. It would have been proper to institute a change order
for this but it was probably assumed that cost would remain the same and
it was not necessary.
I further believe that we are entitled to some adjustment in cost for
the reduction in the number of bowls in the pump from 7 to 5.
I am greatly disturbed that the engineers approved payment for these items
when they were not items of equal value as those originally bid.
At this point I have no recommendation as I am waiting for a written response
from Dawkins & Associates on this matter, and am making further investigation
into the energy consumption of the different HPs to see which would be the
most economical. J '%

The information on the percolation ponds needed by Mr. Baird to complete his
investigation has been forwarded.
A request for written response on the merit of PVC pipe for municipal water systems
has been directed to Dawkins & Associates via Dave Crowson on two occasions.
Copies of these letters are attached. To date no written answer has been
received.
My recommendations for precluding night collections at the Jenkins Building are
as follows:
1. Any commercial user of this building may be required to deposit
an amount equal to the required percentage of estimated gross
receipts, determined by the Secretary of the Chamber of Commerce.
This deposit will be adjusted according to substantiated gross
receipts based on required percentage, no later than 72 hours after
the event and during regular business hours.
2. Any commercial user of this building may be required to deposit
with the Clermont Police Department at the close of the event an
amount predetermined and made knowledge thereof by the Secretary
of the Chamber of Commerce to the Police Department. -- -
This second alternative would only be offered to those groups with
reliable backgrounds from previous experience at this building.
Elder Ira Wootson from the Church of God in Christ has been furnished a plan showing
the necessary information for sodded parking areas and buffer strips and he hopes to be
able to appear before council and make a proposal authorized by the church.

I knew if I waited a couple of days I could write on letter instead of six.
First subject is the flow meter for the Seminole well, As previously discussed,
the City will provide meter and install with city forces. Can the cost for
all or part of this item be included in loan if we so desire? We are proceed-
ing inrtnediately to acquire this meter.
Secondly, in regards to Change Order #1, we feel the added cost is too great.
We will make the connection and furnish the necessary material to make this - -
change. Please prepare deduct change order and notify the contractor of our
intent and instruct them to substitute 6" CIP for a" CIP on DeSoto Street
between Lake Avenue and 7th Street. We will coordinate with them and have
connection ready when they are.
Thirdly, I have given much thought to the problem of the motor substitution
on the Seminole Well. All conclusions come up bad. Please give me your
continents and recommendations in writing as we discussed on the phone and I
then plan to have City Council help me with this decision.
Fourthly, the Mayor has requested that you follow up in writing wi=,'
and comments I requested in my letter of February 12, 1976 regardi
when used for municipal water systems.
Fifthly, I feel it might save some wasted effort if approval were obtained
from this office prior to a change order being compiled. I fully agree to
the engineering change in proposed Change Order #1 , but as Paragraph Two
of this letter indicates, economics sometimes rules. Furthermore, I feel it
is imperative that Council approve all change orders.
All arrangements have been made for interim financing except for signature(s)

After thorough research of this lighting system it is very evident that
additional lighting cannot be added to the existing 400 Amp wiring and
switch gear. It is grossly overloaded now evidenced by the somewhat regular
"blowing" of fuses and computing and comparing the present load to the
rating of switch gear.
I had originally planned to add 28 lights, 1-85' pole and relocate 3 existinq
poles to bring the outfield up to semi -pro, municipal standards and rewire
same as I have indicated above. This would be impossible without complete
revamping of service and switch gear to accommodate 600 Amps with design
semi -pro lightingto mwhich,at a requiresture time 128 lightsthe andiafield 1200 Amp serivicei or
enclosure.
Preliminary costs are as follows:

1 - 85'Class II Pole FOB Clermont 900.00

As an alternative I would propose that the incandescent lamps on the infield
be replaced with quartz lamps. These are 28 in number and would cost
approximately $1120.00 and also that the switch gear be enlarged to the
600 Amp rating for the above approximate cost of $2500, making this alternate
cost approximately $3620, which would improve illumination and make it a
much safer and reliable system.

Attached you will find my proposal for the time capsule housing and plaque.
The 24" x 12" Bronze Plaque will cost $107.50 plus freight and will read as
follows:
TIME CAPSULE
Scaled by the Clermont UiCentennial Committee
on July 4, 1976 to be opened by the Tri-Centennial
Committee on July 4, 2076.
It is somewhat doubtful whether the DiCentennial emblem can be used on the
plaque because as of this date we have not been approved by the National
Commission. This approval is required by the Plaque manufacturer before
they can apply the emblem.
The material for the reinforced concrete box should not exceed $150.00 with
labor being furnished in house. I have been unable at this point to obtain
the cost of the stainless steel capsule which is being furnished by Konsler
Steel Co.
At this time I would like permission to order tho plaque as recommended
because of the U - 10 week delivery,
