REGULAR MEETING 
A Regular Meeting of the City Council of the City of Clermont was hold In 
the Council Chambers on Tuesday, April 20, 1976. The meeting was called to 
order at 7:30 P. M. by Mayor Claude E. Smoak, Jr. with the following members 
present: Councilmen Beals, Byrd, Schroedel and Blackburn, Other officials 
present were City Manager Tiffany, Director of Community Services Smythe, 
City Attorney Baird, Chief of Police Tyndal, Building Official Nagel and Deputy 
Clerk Dollar. others present were: Mr. and Mrs. Eric Stasuk, Messrs. Fleming, 
Sargent and Czech. Mr. Joe Sanchez, representative of tile. Sentinel/Star 
was also present. 
The Invocation was given by Councilman Byrd, followed by repeating of the 
Pledge of Allegiance in unison by those present. 
Mayor Smoak officially introduced Gordon D. Tiffany, newly employed City 
Manager of Clermont, stated Mr. Tiffany came to Clermont from Glencoe, Illinois 
where he was Administrative Assistant, that he is married and has two children 
and his wife and children are expected to arrive in Clermont on Wednesday. 
Mayor Smoak then welcomed Mr. Tiffany to Clermont and hoped his stay would 
be both productive from a personal and professional standpoint and his living 
accommodations satisfactory. 
The Minutes of the Regular Meeting held April 13, 1976 were approved as written. 
Mr. Eric Stasuk appeared before Council and presented a sketch of a Bicentennial 
mural which he and his wife wish to paint for mounting on the side of the Jenkins 
Auditorium. He advised his mural would be 8' high by 12' long, would be done 
in red, white and blue colors, with four stars on the left edge, and inside 
the stars would be portraits of famous Americans and the mural would be mounted 
on tempered masonite and anchored to the building. He estimated the cost 
of material to be quite less than $100.00. Motion was made by Councilman 
Blackburn, seconded by Councilman Beals and unanimously carried that -------- 
With regards an offer from the Little League of Groveland to purchase 12 lights 
replaced at the tennis courts and 28 lights to be replaced at Bishop Field at 
$5.00 each, and Director of Community Services Smythe's recommendation that we 
accent this offer, motion was made by Councilman Schroedel seconded by Council 
Director of Community Services Smythe reported that approval had been received 
from the Bicentennial Commission for Clermont to be recognized as a Bicentennial 
Community and that upon receipt of this recognition the order was placed for 
the Bicentennial Plaque. 
City Attorney Baird reminded Council members that Financial Disclosure Statements 
are due May 15th and must be filed with the Clerk of the Circuit Court with 
a copy to the City Clerk. Deputy Clerk Dollar was requested to make a note to 
have financial disclosure forms included in the next weekly package to Council 
members and also to see that each member of city advisory boards is furnished 
with a copy of the financial disclosure form with a memo stating they are to be 
filed by May 15th. 
Councilman Beals commended the city forces and DAV organization on the excellent 
job of clean up and renovation of the Highlander Hut. Director of Community 
Services Smythe advised that an agreement between the city and the DAV covering 
the rules and regulations for this building is being prepared and will be forthcoming 
very soon. Councilman Byrd stated that Mr. Wrightam extended an invitation 
to Council members to visit the building. 
Mayor Smoak announced the League of Cities Meeting to be held in Tavares Civic

Center on Wednesday, April 21, 1976 at 7:00 P. M. and that James Hoskinson, 
Lake County Commission Chairman will be the guest speaker, his topic being 
Tax Equalization. 
Director of Community Services Smythe reported that he had no Status'ROport 
on the sewer connection for the South Lake Press, but that work is being done 
on finding a solution to the problem.. 
In a memo to Council (attached) Mr. Smythe advised that the city has withhold 
$2,059.88 ('5% of the final estimate) pending disinfection of the Seminole 
Well from the contractor, Locke Well & Pump Company and that the contractor 
has requested that $500.00 rather than $2,059.99 be withheld and that this 
request has been reviewed by FmHA and they concur in the reduction from

With regards the Michael s-Stiggins litigation, Mr. Smythe recommended that 
the $30,232.00 Final Payment from the HUD grant, which at this time has been 
credited to the Utilities Fund Construction Account (19-119) be transferred 
to a Special New Account (19-119A) and held for the purpose of courts costs 
and attorney's fees during litigation, easy and rapid correlation and costs 
when negotiating a settlement and if the final outcome should not be favorable 
to the city, a substantial amount of money would be available to pay the - 
additional costs, and requested Council's direction in this matter. Mayor 
Smoak stated he thought this was a businesslike way of doing business and if, 
in fact, the litigation should not be favorable to the city, this money 
will not have been used on projects simply because we have the money. Motion

Regarding the Michael s-Stiggins litigation, City Attorney Baird advised that 
the suit against Michael s-Stiggins has not as yet been filed; however, some 
meaningfull dialogue has taken place. He further stated he met last week 
with principals involved with Michaels-Stiggins corporation and their parent 
organization from California, with their attorneys, with their insurance 
agents and with principals and attorney for Ardmann and Associates. 
Mayor Smoak inquired as to the progress on the construction of the new water 
and sewer improvements and when the projects are expected to be completed. 
Mr. Smythe advised that he did not have a report on these projects this evening, 
but that everthing is going along on schedule and he did not think completion 
would go beyond six months. 
With regards an invoice from Dawkins & Associates in the amount of $4,130.83 
relating to water main extension on Grand Highway, Hook Street and U. S. 27 
and a memo to Council from Mr. Smythe (memo attached) in which he stated he 
raised the question, should the engineers' fee be based on estimated footage 
of extension related to contractor price, or to the actual cost of extension 
performed by the city. Mr. Smythe stated he furnished all the pertinent 
invoices, correspondence, documents and contract to the City Attorney and 
received the following opinion: "The contract refers to fees based on actual 
construction costs which in my opinion would mean the actual cost of the 
extension rather than the contract price of Central Florida Underground. It 
would be my opinion therefore that the fee should be based on the total cost 
of construction by the City of Clermont in accordance with the engineers 
specifications" It was City Attorney Baird's recommendation that the city 
communicate with the engineers and epxlain the position the city is taking 
and requested a revised invoice. Mr. Smythe requested Council direction in

With regards the Lake County Planning Department Comprehensive Work Program 
the item was tabled until City Manager Tiffany has had an opportunity to review 
the material from the County. 
With regards the recommendation of the PEZ Conmission that the zoning ordinance 
be amended to include private recreational facilities as a permitted conditional 
Use in the R1AA zone, the item was discussed at length with feelings expressed 
for an ordinance and other feelings expressed that an ordinance was not 
necessary, that property owners should be permitted private recreational facili- 
ties. 
City Manager Tiffany commented that he found himself agreeing with everything 
that has been expressed on both sides concerning this amendment, but suggested 
that he and Mr. Smythe be requested to look into this matter a little further. 
He further stated he thought there are ways to regulate this particular use 
without going to the rather cumbersome CUP route. Motion was made by Councilman 
Beals seconded b Councilman Byrd, and unanimous) carrie that the matter be 
tabt 1 the next regular meeting. 
City Manager Tiffany reported that the bid opening for the construction of new 
pier to replace the existing pier at Jaycee Beach was held in his office on 
Monday, April 19, 1976 at 5:03 P. M. The following bids were received: 
1. Wise Marine Construction $33,560.00 
2. Vulcan Enterprises, Inc. 37,500.00 
3. Hubbard Construction Co. 27,880.00 
4. Delta Marine Constructors, Inc. 19,875.00 
He advised there was some concern regarding the low bid, as low as it was, with 
no knowledge of this particular contractor, but research was done on the con- 
tractors' bac!%§round and capabilities and from information received from some 
of the people for whom they have done work, they are reliable contractors. 
The County Board of Commissioners delegated the City the authority to award 
the contract to the low bidder. City Manager Tiffany advised he recommended 
that the contract be awarded to Delta Marine Constructors, Inc. with the addition 
of a requirement of a performance bond with an additional cost on the contract 
of $400.00. Motion was made by Councilman Beals seconded by Councilman Blackbur

Mayor Smoak advised that $8900 had been budgeted this fiscal year to participate 
in a potential grant from the State of Florida. He stated that this grant was 
not forthcoming and while we have a contractor here for the pier, he would like 
the City Manager to investigate the possibility of revitalizing the boat dock 
located several hundred feet west of the swimming pier and inquire of the con- 
tractor the cost of revitalizing the boat dock and breakwater at the launch area.

rather than the $2,059.88 be withhold. it is the contractor's position 
that $500.00 is more than ample to take care of the required disinfection.. 
This request has been reviewed by FmHA and they concur in the reduction

Since the deduct Change Order No. 2 has been approved we will have 
overpaid Locke Well & Pump Company $863.12 for total contract. If we

With reference to your letter dated February 16, 1976, please find attached 
our invoice for engineering services relating to the preparation of plans and 
specifications for the water main extension south from State Road 50 along 
Grand Highway, Hook Street and U. S. Highway 27 to the City limits. 
As you know, the City had originally expected that this extension would be part 
of the overall waterworks improvement program now under contract with Central 
Florida Underground, Inc,; however, this extension was separated out of the main 
program with City forces performing the work of construction. 
Our fee is based upon 11.5 percent of the net construction cost in accordance 
with our Contract dated June 28, 1973, FmHA document 442-19 and Table 1 of 
Attachment I thereto. The net construction cost of $35,920.25 (see attached 
estimate) has been determined from unit prices as presented in the bid proposal 
of Central Florida Underground, Inc, -- Contract dated January 6, 1976, 
Also, please find enclosed four (4) copies of the permit application and draw- 
ings for construction of this (later main extension. Upon execution in the 
appropriate places, please forward the entire package which includes a letter of 
transmittal suggested for City of Clermont letterhead to the Florida Department 
cf ERvironmental Regulation for review and approval.

Attached Is an invoice from Dawkins and Associates, Inc. for services 
relating to water main extension on Grand Highway, (look Street and US 27, li 
Originally the engineer made an estimate For this project of somewhere 
near $41,180. Because of this rather high ostimate the City elected on 
January 13, 1976 to install approximately 1800' of this 4000' job with 
material on hand and with city forces. The engineers were notified 
by letter of this decision on January 16, 1976 and instructed to prepare for 
implementation of Item 1 with DER Permit for total extension. 
On February 5, 1976, the engineers were notified to prepare a change order 
for the southerly 2200' portion of this line at contract prices with 
Central Florida Underground.

This they did, but by the time we received the change, order we had elected 
to substitute PVC pipe for C. I. pipe, reduce the 2200' to 1275' and proceed 
with the remainder of this extension with city forces. I instructed 
Dawkins and Associates on February 18, 1976 to void the change order, continue 
with permit application to DER and when this was completed to bill the 
city for services.

I raised the question, should their fee be based on estimated footage of 
extension related to contractor price or in fact related to actual cost 
of extension performed by city which will be approximately $11,200? 
I furnished all the pertinent invoices, correspondence, documents and 
contracts to the City Attorney and received the attached opinion. 
If it is consensus of Council to pursue this matter as recommended by the 
City Attorney, please give me that direction.

I am in receipt of your letter of March 30, 1976 regarding the invoice from 
Dawkins and Associates, Inc., for services relating to the water main extension

The contract refers to fees based on total construction costs which in my opinion 
would mean the actual. cost of the extension rather than the contract price of 
Central Florida Underground. It would be my opinion therefore that the fee should 
be based on the total cost of construction by the City of Clermont in accordance 
with the engineering specLfLcation. 
I would recommend that you communicate with Dawkins and Associates, Inc. and ex- 
plain to them the position that we are taking; in this matter and request that they 
submit a revised invoice.

Thousand Eight Hundred flighty Dollars (427,880.00). 
1. Remove existing pier to your satisfaction. 
2. Furnish and install a new prestressed concrete 
pier 8.0' X 200.0' according to your sketches. 
3. Deck slabs will be 8.0' wide in lieu of 4.0' 
to eliminate an unnecessary joint. 
4. Connect new pier to existing concrete with a 
prestressed concrete ramp. 
We assume that the City has secured all necessary permits and we 
are prepared to furnish a Performance Bond if desired for 1%.

DETAILED SPECIFICATION RCOUIREME•NTS 
MISCELLANEOUS CONCRETE WORT: 
SCOPE: 
Work Included: 
The work intended in this division consists of the supplying of all labor, 
materials, equipment, form work and reinforcing necessary to place, finish, 
and properly cure the concrete as detailed and set forth on the drawings. 
The installation of all bolts, inserts, etc. though provided in other 
divisions of the specifications shall be properly ;et under this division. 
(a) Fill solid with concrete all reinforced vertical block cells as noted 
on the drawings. 
(b) Form 
and pour 
reinforced i concrete beams, floor slabs, and footings 
detailedas 
(c) Form and pour concrete thrust blocks, and pipe supports as required. 
(d) Testing of concrete, test cylinders required for testing by independent 
testing laboratory shall be the responsibility of the Owner. 
2. MATERIALS 
Concrete: 
All concrete shall be a "Transit Mix" by an established firm. Materials, 
equipment and mixing methods shall be in strict accordance with the latest 
recommendations of the Portland Cement Association for the production of 
the following strength concretes based upon ASTM tests at the end of 28 days. 
Footings, and slabs on grade, 
Beams and filled cells: 3,000 lbs. per sq. inch 
Reinforcing Steel 
Shall be of the size and shape called for on the drawings and shall conform to 
the requirements of the "Standard Specifications for Billet -Steel Bars for the 
concrete reinforcement: ASTM Designation A-15." 
Cold drawn wire or welded wire fabric for concrete reinforcement shall be of 
N10 size, 6" x 6" spacing, placed as called for on the drawings and shall 
conform to the requirements of the "Standard Specifications for cold -drawn steel 
wire for concrete reinforcement: ASTM Designation A-82". 
Form Materials 
Generally: Materials for form work shall be new or shall meet with approval 
of the Engineer. 
Footing,: Earth forms wherr earth will retain shape; dressed lumber forms 
where earth is soft and subject to cave-in. 
Exposed construction: Dressed lumber, or forming plywood, whichever produces 
a minimum of Joints and best exposed surface. 
E_pansion_Joints 
Asphalt impregnated fiber, 1/2" thickness, 6" high, as manufactured 
especially for expansion Joint purposes. 
3. WORKMANSHIP_ 
Handling and Placing— 
This Contractor shall ascertain before pouring concrete that all inserts, 
bolts, conduit, piping, etc., are in place or that openings are formed for future 
installation of same,

Equipment used in the transportation and mixing of concrete shall be thoroughly 
cleaned prior to its use. 
When depositing concrete has begun, it shall be carried on as a continuous 
operation until the placing of that section is complete. Concrete shall be 
placed in layers so that it does not flow for any appreciable distance, and 
worked thoroughly to eliminate air pockets. Transport concrete from mixer to 
place of final deposit rapidly. Use all precaution to prevent separation. 
Partially hardened concrete shall not be placed in the work. No concrete shall 
be allowed to "free fall" more than five feet. 
If for any reason it is impossible to place concrete in its final location 
within ninety (90) minutes after said concrete has had water initially placed 
in the mix, then this concrete shall be rejected for use in this construction. 
Concrete shall be poured as dry as practicable and in no case wet enough to 
cause any accumulation of water on the surface. 
During placing of concrete, it shall be thoroughly rodded or vibrated around 
all reinforcement and into inaccessible areas so as to provide a dense and 
homogeneous mass free from voids or honey combs. 
After concrete has been placed and its initial set started, the concrete shall 
be kept moist by sprinkler or ponding to insure proper curing as directed by 
the Engineer. Curing shall be continuous for not less than seven (7) consecutive. 
days. 
Expansion Joints: 
Expansion Joints for concrete shall be placed as shown on the drawings, Joint 
size shall be 1/2" with top of expansion felt located 1/4" below top of finish 
surfaces. 
Reinforcement: 
Reinforcing steel shall he delivered to the site and properly stored until such

In columns In water there shall be not less than 2" of concrete between the 
reinforcing and the exposed surface. 
In all other instances reinforcing shall be protected by a minimum of 1 1/2" 
of concrete. 
Reinforcement shall be accurately placed and secured by means of metal chairs, 
spacers, and/or ties to insure the above coverage. Splices in reinforcing 
shall be a minimum of 18" and shall be securely tied together at the joints. 
Welding of reinforcement shall be discouraged and prior approval obtained from 
the Engineer before proceeding to do any welding deemed necessary. 
When reinforcing is in place and secured, the Contractor shall notify the 
Engineer so that his approval of the installation may be securer] prior to 
the pouring of concrete. 
Form Work: 
Form work including earth forms for footings, shall be wet down -rrior to 
lack-ri Rconcrete. 
All forms shall conform to the shape, lines, and grades, and dimensions of 
the concrete as called for on the drawings. Joints in forms shall be horizontal 
or vertical where the appearance of the finished surface is of importance. 
Lumber once used in forms shall have nails withdrawn and surfaces to be in --. 
contact with concrete thoroughly cleaned before being used again. 
Curing: 
Exposed surface of concrete slabs shall be kept. wet by sprinklers, pending, 
or by covering with Vis-Queen and periodic wettings for a period of at least 
seven (7) days. 
Finishing 
Floor slabs shall be finished only by experienced finishers in the following 
manner. 
Slabs to be finished as a concrete floor - wood float finish, sloped to drain. 
Slabs to be finished as concrete walks - steel trowel finish, brush lightly with 
fine fiber broom. 
All exposed edges of concrete shall have a 3/4" chamfer 
Should poured concrete beams, slab edges, etc., have exposed "honeycomb", areas 
shall be wet down and grouted and rubbed to produce smooth finish. 
Unless a separate item for reinforcing steel is included in the proposal, 
it will be included in the cost of concrete. 
Prestressed concrete slabs shall be constructed of 5000 psi concrete (28 day) 
in a yard being a member of PCI, Slabs shall be straight and free of irregularities.

Precast piling (0" x 0") shall be straight with sufficient roinforcing 
extending from top to ombed and tie the stool into the lintel stool, piling 
shall be long enough to include (4'-0") - four feet of embedment into 
the sand bottom of the lake at the deepest and.
