09-21-1976 Supporting DocumentsMINum-'s M 1332 REGULAR MEETING A Regular Meeting of the City Council of the City of Clermont was held in the Council Chambers on Tuesday, September, 21, 1976. The meeting was called to order at 7:30 P. M. by Mayor Claude E. Smoak, Jr., with the following members present: Councilmen Blackburn, Schroedel, Byrd, and Beals. Other officials present were: City Manager Tiffany, City Attorney Baird, City Clerk Carroll, Finance Director Sanchez, Director of Community Services Smythe, and Chief of Police Tyndal. Others present were: Mr. & Mrs. W. B. Perry, Mesdames Sheldon & Hanks, Messrs. Fleming, Sargent, and Searles. Mr. Joe Sanchez, representative of the Sentinel/Star was also present. The invocation was given by Councilman Byrd, followed by repeating of the Pledge of Allegiance in unison by those present. The Minutes of the Regular Meeting held September lh, 1976 were approved as written. CITY MANAGER'S REPORT City Manager Tiffany reported that officials of DOT had advised open cut across State Road 50 would be permitted in the utilities relocation project, provided the work schedule is coordinated with the highway contractor's schedule; That the bid letting for the highway project is scheduled for September '77 with construction to start shortly thereafter; and, That the DOT Planning Department had advised that consideration had been given for a traffic lite at the intersection of State Road 50 & Bloxam Avenue during the design phase, but was rejected as not warranted by traffic volume or special conditions, and, if it be the desire of Council to pursue the matter further, it would be necessary that the request be made through the County Commission. Mr. Tiffany was requested to pursue the matter further with the County Commission, Mr. Tiffany advised Council that he was desirous of partici- pating in the International City Managers Retirement Corporation Deferred Compensation Plan, and inquired if they would be agreeable to authorize the percentage of contribution to that pension plan for his position, in lieu of the existing contri- bution to the city's pension fund, the percentage figure being 3.5%. Council was in agreement with this, whereupon motion was made by Councilman Blackburn seconded by Councilman Beals and carried that the percentage of funds allocated to the pension fund for the City Manager be contributed to the ICMA Plan. LEASE AGREEMENT - COUNTY OWNED PROPERTY Inasmuch as City Attorney Baird had been unable to contact the County Attorney to ascertain the acceptance of the proposed lease agreement by the County Commission, this matter was postponed. RESTORATION OF SOVERIGN IMMUNITY TO MUNICIPALITIES City Manger Tiffany reported that Mr. Ray Sittig, Executive Director of the Florida League of Cities, had advised the League was presently in favor of awaiting results of a test case in court before pursuing the matter of restoring soverign MINU MS N91,333 immunity to municipalities, and in view of this, the resolution as requested to be prepared for presentation at the State League Convention in October had not been prepared. Mayor Smoak advised that he would approach the subject at the League Directors Meeting at the convention, and would therefore urge that he have such a resolution available to him. PROPOSED ORDINANCE NO. 154-C Councilman Deals introduced AN ORDINANCE• UNDER THE CODE OF ORDINANCES OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA, RESTRICTING THE USE OF AIRDOATS: REPEALING ALL ORDINANCES IN CONFLICT HEREWITH: PROVIDING FOR SEVERADILITY: AND PROVIDING AN EFFECTIVE DATE, and the Ordinance was read for a first reading by City Clerk Carroll, by title only.
