A Regular Meeting of the City Council of the City of Clermont was held in the
Council Chambers on Tuesday, May 14, 1974. The meeting was called to order at
7:30 P. 14. by Mayor Claude E. Smoak, with tho following members present: Councilmen
Oswalt, Schroedel and Byrd, Absent: Waller. Other officials present were: City
Manager Hopkins, City Clerk Carroll, City Attorney Vason, City Controller Fleming,
Director of Community Services Smythe, and Chief of Police Tyndal. Other present
were: Mesdames Sheldon and Oswalt and the Messrs. Czech, Carden, Schumann, Smith
and representatives of McDonald's Restaurants, Inc.
The Invocation was given by Councilman Byrd, followod by repeating of the Pledge
of Allegiance in unison by those present.
The Minutes of the meeting held on April 23, 1974 were approved as written.
Mayor Smoak announced the first order of business to be a public hearing to consider
request of McDonald's Restaurants, Inc. for a variance to the requirement in the
Zoning Ordinance of 1000 feet apart for outdoor advertising/billboards, whereby
they could utilize an existing billboard adjacent to Highway #27. There was no one
present who voiced objection to this request, whereu on motion was made b Councilman

Mayor Smoak announced the next order of business to be the Bid Opening on bids
solicited for the application of approximately 49,000 square yards of slurry seal
mix for asphalt street resurfacing. City Manager Hopkins reported that a single
bid had been received from the J & B Slurry Seal Company of Florida @ $.328 per square

Mayor Smoak reported that he, the City Manager and Councilman Schroedel, had met
with officials of the Little League, the Mens Softball League and the newly
organized Girls Softball League, in an effort to draft a schedule whereby all three
organizations could utilize the existing ball fields, and, that the meeting had
been successful with the first girls softball game having been played this date.
City Manager Hopkins submitted his report, both orally and written, and a copy is
attached hereto.
With regards the request of the Orlando Yacht Club for permission to have limited
overnight camping at Jaycee B each on May 18th and 19th during their sailing regatta
on Lake Minneola in order to provide security for their boats, motion was made by
Councilman Oswalt. seconded by Councilman Schroedel and carried that the request
With regards the request of Mr. Jim Beasley, sponsor of the Clermont High School
Junior -Senior Class, that the Jenkins Auditorium rental fees be waived fpr the
two nights the building was used for the Junior -Senior Class Play rehearsals, motion'
was made b Councilman Byrd, seconded b Councilman Oswalt and carried that the
request be grante .
With regards the recommendation of City Manager Hopkins that Osceola Street, between
8th Street and West Avenue, be closed to through traffic because of the excessive
dust problem existing there which could only be controlled by a complete rebuilding
of the street inasmuch as it does not have sufficient base for just resurfacing,
it was consensus of Council that no action be taken at the present time, and that
the City Manager obtain approximate cost figures for rebuilding the street.
With regards the recommendation of City Manager Hopkins that the pier at Jaycee
Beach be torn down prior to the summer's activities at the beach inasmuch as it is
considered unsafe, there was no action taken. Mayor Smoak requested that City Manager
Hopkins submit some alternatives for Council's consideration such as approximate
cost figures for a permanent concrete installation -driving in new piling and
resurfacing the present dock -no installation at all, etc.

With regards the recommendation of City Manager Hopkins that the trees on the
Johnson property north of Osceola Street be removed, except a row around the
perimeter, inasmuch as an abundance of them have been killed as a result of the
spray irrigation, it was consensus of Council that this be done.
City Attorney Vason reported that the latest cost estimate received informally
for an out of court settlement of the Johnson property condemnation suit was
approximately $54,000.00, and that it was his recommendation to proceed with a
court hearing. Council was in agreement with this recommendation. Mayor Smoak
advised that he would again contact Mr. Johnson personally in an attempt to
settled the matter out of court.
Controller Fleming reported as follows: That of the budget ed figure of $164,145,000
of ad valorem taxes to be collected, $161,287.80 had been collected Iodate; That
of the $876,000 sanitary sewer assessments levied, $531,000 had been collected to
date, and, That he had invested $188,000 in 90 day certificates of deposit with
the Orlando Bank and Trust Company at 10.38% interest.
Mayor Smoak reported as follows: That the Stop Sign was missing from the
intersection of 12th Street at Lake Shore Drive; That the residents in the area of
Peter Pool Park had requested that signs designating "Caution -Children Playing"
be placed in that area, and, That inasmuch as this was "Law Enforcement Week"
he wished to personally commend the Chief of Police and the other department members
for the job which they are doing in Clermont. Mayor Smoak further urged that all
citizens take an "Look out for your neighbors property" attitude in view of the
increasing number of theft and vandalism cases.
Councilman Schroedel reported as follows: That he had attended the board meeting
of Cooper Memorial Library and it had been reported they were to receive a grant in
the amount of $900.00 to be used for a summer program; That he would like to see
the installation of the two traffic lights proposed for the intersections of
East Avenue and Bloxam Avenue with State Road #50 as quickly as possible rather
than wait for the DDT's widening program to be started inasmuch as these two
locations were already four-laned, however, Mayor Smoak advised that these install,A- .
tions were to be "part and parcel" to the DDT's widening project; That the plantings
along the south side of the Winn Dixie shopping center were badly in need of
attention and cleaning out, and the City Manager advised that they had been contacted
regarding this matter, and, That he had received several complaints of numerous
pigeons being a nuisance in the boathouses along Lake Shore Drive and would like
the City Manager to investigate this matter. Mr. Hopkins agreed to do so.
Motion was made by Councilman Oswalt, seconded by Councilman Byrd and carried,
that the bills be paid.
Councilman Oswalt offered and moved the adoption of a RESOLUTION authorizing the
expenditure of federal revenue sharing funds. The motion was seconded by
Councilman Schroedel and unanimously carried. The resolution was read in full by
City Attorney Vason and the Number 233 assigned to it.
Councilman Schroedel offered and moved the adoption of AN ORDINANCE UNDER THE CODE
OF ORDINANCES OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA, AMENDING SUBSECTION
F OF SECTION 26-24 OF THE CLERMONT CODE OF ORDINANCES: AMENDING SUBSECTION F
OF SECTION 26-25 OF THE CLERMONT CODE OF ORDINANCES: ALLOWING AND PERMITTING CHILD
CARE CENTERS AS A CONDITIONAL USE IN C-1 AND C-2 ZONING DISTRICTS: REPEALING
ALL ORDINANCES IN CONFLICT HEREWITH: PROVIDING FOR SEVERABILITY: PROVIDING AN EFFECTIVE
DATE: PROVIDING FOR PUBLICATION and the motion was seconded by Councilman Byrd.
The Ordinance was read for a second and final reading by City Attorney Vason, by
title only, and upon roll call vote on passage of the motion the result was:
Ayes: Oswalt, Byrd, Schroedel and Smoak. Total Ayes: Four. Nayes: None. Absent:
Waller. So the Ordinance was adopted and Number 106-C assigned to it.

With regards the possible purchase of the old Exchange Dank Building and/or
accepting the purchase option offered by them, motion was made by Councilman Oswalt,
seconded by Councilman Byrd and carried that the offer be declined. Councilman
Schroedel voted, Naye, on the motion.
With regards the possible purchase of the Mohawk Grove Property for an effluent
disposal site and/or accepting the purchase option as offered by Ralph A. Roane,
motion was made by Councilman Schroedel, seconded by Councilman Oswalt and carried
that the offer be declined.
In order that the city's personnel policy be brought uptodate following the
Fair Labor Standards Act Amendments whereby it is mandatory that wages at time-and-a-

these provisions.
With regards the recommendation of City Manager Hopkins that the city 's pension
plan be amended to provide for full vestment in the program by employees with
ten years of service, Mayor Smoak requested more time to read and study the report
before any action is taken, and the matter was thereby postponed.
With regards the request of the Lake County School District for financial assistance
in the amount of $500.00 to help fund a summer arts and crafts program, motion
was made by Councilman Byrd, seconded by Councilman Oswalt and carried that
the request be granted and the funds be authorized provided that a swimming program
is included.
City Manager Hopkins reported that City Hall would be closed on Monday, May 27th
in observance of Memorial Day.
The meeting was adjourned by Mayor Smoak at 9:00 P. M.

CITY MANAGER'S REPORT
Vie have been advised that we are "in the money" for PL 92-500 funds to be used
for the development of plans and specifications for effluent disposal, At 11 A.M.
May 21, 1974, at the Sheraton -Orlando Jet Port Inn, 3835 Beeline Expressway,
Orlando, a public hearing will be held to hear statements and comments from the
general public on the proposed fiscal year 1975 funding. The City of Clermont
is in the upper 20 percent in the priority standings and is designated to receive
$63,030.
In a memorandum released April 30, 1974 the Federal Communications Commission
advised that• the application of Tele Prompter of Florida, Inc. to serve South
Lake County with cable TV has been approved. The Winter Garden office of
Tele Prompter advises that the contractor is making final corrections to the system
and service should be available within the next thirty days.
In December 1973 the Orlando Yacht Club held the Tangerine Regatta on Lake
Minneola. They would like to hold a similar regatta on May 18th and 19th. They
have requested permission to have limited overnight camping at Jaycee Beach. The
primary reason is to provide security for the boats. Recommend approval.
Last week the Clermont High School Junior/Senior Class Play was held at Jenkins
Auditorium. The auditorium was used on Wednesday and Thursday for rehersals
and Friday and Saturday for performances. Mr. Jim Beasley representing the
junior and senior classes has requested that the auditorium rental fee be
waived for the two rehersal nights. Recommend approval.
On May 30th, Bob Smythe and I met with Lake County officials regarding the landfill
situation. Lake County is attempting to locate a site in South Lake County which
would be large enough to serve the needs of this area for sometime. It was felt
that the old "dump" east of town would not be a good site because of its limited
size and close proximity to the Citrus Tower. It is anticipated that the County
will seek an extension on the closing of the Clermont site, but vie have no firm
information in this regard at this time. Since Clermont is not in a position to
operate a landfill, vie must coordinate our efforts with the county.
For sometime we have been receiving complaints about the condition of Osceola
Street between. Eighth Street and West Avenue. The street is not paved and the dust
is excessive. Vie recently removed old railroad ties from the road bed and improved
the driving surface. With a better surface, the traffic, the dust problem and the
complaints have increased. Vie had hoped that there was sufficient base to allow
for surface treatment but sufficient base does not exist. In order to pave the
street to accommodate the trucks to and from Blue Goose would be an expensive project
Projects like this are normally funded by assessments to abutting property owners.
The feasibility of this approach is questioned since the railroad abuts the
street on the south. Since the primary objection is the dust caused by traffic
and since other routes for traffic are available and since the cost of improving
the street would be rather expensive and assessments unlikely, it is recommended
that Osceola Street at Eighth Street be blocked to through traffic.
For the past couple of years the swimming pier at Jaycee Beach has been deteriorating
and has now reached what is considered to be an unsafe condition. Periodic repairs

are expensive and the condition persists. During the last couple of budget
considerations, a new pier was discussed but never recommended. It never reached
a very high position on the priorities. Since the pier is now considered unsafe, it
is recommended that it be torn down prior to the summer's activity. If there is
sufficient interest in a now pier, one can be appropriated in the 74-75 budget
and constructed prior to next summer.
On Saturday, May lath the Clermont Police Department will cooperate with the Pilot
Club, Kiwanis Club and Jaycees in sponsoring a Bike Safety Rodeo from 9 A. M. - 1 P.M.
at the municipal parking lot next to the Elks Club. Everyone who owns a bicycle
is invited to participate.
Pending the final determination on the condemnation of the Johnson property, we
have delayed removal of the citrus trees. Vie have been using the property since
the order of taking for spray irrigation and have, as a result, killed many of
the trees. Since the condition of the grove is such as to not be a factor in
reaching a monetary determination and a final determination may be sometime
in the future, permission is requested to remove the trees on the property south
of Osceola Street. We plan to leave a row of trees around the perimeter.
And one final note. The new trash truck has arrived and will be in service this
week.

school district will be offering a recreation program this sunmier
in Clermont, but will nerd some financial assistance from the
city.
The assistance will be necessary in the arts & crafts program. The j
total amount for materials and wages for an aide should not exceed
£500. The program will start on June 'irlt:h and last for 7 weeks.
It will be conducted at the elementary and juniur high schools. I

Tower Chemical Company will consider giving option to purchase
Mohawk Grove, 122 acres+
P.. 90 day option to purchase for 5500,000.00 upon payment
of $25,000.00.
P. Additional payment of $25,000.00 made before expiration
of first 90 day option period will extend the option to
purchase for an additional 90 days at a purchase price
of $510,000.00.
C. Purchase is to close within 45 days after exercising option
to purchase. Both payments stipulated in (A) a.nd (B) above
to be paid on or before exercising option to purchase.
Said payments to apply in full against purchase price at closing.
Purchase price to be $500,000.00 if option (A) above is exercised.

Ralph Roane has advised that 122 acres of his property is being sold
and would like to give the city the opportunity to purchase this site
for spray irrigation. The property is located approximately 1/2 mile east
of the east city limits (Grand Highway). It is east and northeast of the
Citrus Tower.
Mr. Roane is asking $4,000/acre or $488,000.00. He wants cash or cash
to existing first mortgage. The mortgage balance is $462,143.22. The
balance would be payable $15,000.00/year (May 15th) including 2% interest.
It is recommended that a work session be scheduled to discuss the offer.
Attached is a drawing with the property outlined in red.

The Exchange Bancorporation, Inc., the present owner of the old
Exchange Bank of Clermont property, has authorized me to offer the City of
Clermont a ninety day option on the property upon payment of $1,500.00.
The option term shall begin May 15 and expire August 15, 1974.
In your letter of April 16, you inquired about mortgage terms.
I am authorized to offer the property to the City of Clermont for
$127,500.00 with a $20,000.00 down payment and a mortgage for twenty years
at 6 per cent interest on the balance. Amortization payments can be
arranged with monthly, quarterly, seem -annually or annually.
