REGULAR MEETING
A Regular Meeting of the City Council of the City of Clermont was hold in the
Council Chambers on Tuesday, June 25, 1974. The meeting was called to order at
7:30 P.M. by Mayor Claude E. Smoak, Jr, with the following members present:
Councilmen Byrd, Schroedel, Oswalt and Waller. Other officials present were: City
Manager Hopkins, City Attorney Vason, City Clerk Carroll and City Controller
Fleming, Others present were: Mrs. and Mrs. James E. Faris and the Messrs. Carle,
Hov1s, Schumann, Sargent, Williams, McRae, Wicks, Davis and Adair. A representative
of the Sentinel/Star was also present.
The invocation was given by Councilman Byrd, followed by repeating of the Pledge
of Allegiance in unison by those present.
The Minutes of the meeting held June 11, 1974 were approved as written.
Mayor Smoak announced the first order of business to be a Public Hearing to
consider the request by Herman Bedsole for a Variance to Section 26-45 of the
Zoning Ordinance (Side Yards on Corner Lots) in order to construct a swimming pool
on his property described as Lot 14, Block 5, in Sunset Heights Subdivision. There
was no one present who voiced objection to this request, where u on motion was made

Mayor Smoak announced the next order of business to be a Public Hearing to consider
request of Jane Wichenback fora �hriance to Section 26-23 (E) (3) and Section 26-45
of the Zoning Ordinance (Setbacks in the R-3 Zone and Side Yard on Corner Lots).
in order to construct an addition to her residence located on portions of Lots
26 and 27 in Block 51 of Crestview Subdivision. There was on one present who
voiced objection to this request, whereupon motion was made by Councilman Schroedel,
seconded by Councilman Waller and carried that the request be granted.
The Messrs. Richard Wicks and Ray McRae of the Lake Sumter Community Health Center,
appeared before Council to apprise them of the services offered to alcoholics
in Lake and Sumter Counties at the "Halfway House" operated by them in Sumterville.
Mr. R. L. Carle, Trust Fund Officer of the city's pension fund in the First National
Bank of Leesburg, appeared before Council to answer any questions which Council might
have with regards an earlier memo submitted to them of the pension fund investments,
and, to be apprised by Council of their objectives for the trust.
Mrs. James Faris of the local "Meals on Wheels" project, appeared before Council to
advise as follows; That their organization, comprised of 33 local volunteers, had
met and determined that inasmuch as the program was operating successfully by volunteers
and donations from local people and organizations, they did not desire to participate
in any State and/or Federal Funding programs; and, That their organization was most
appreciative for the initial funding in order to get the project started, but had I
operateddsuccessfully since that time without further State and/or Federal monies.

City Manager Hopkins submitted his report, both orglly,and-written, and a copy is
attached hereto.
Mayor Smoak reported briefly on a communication which he had received from The
Honorable Vince Fechtel, Jr; State Representative, with regards House Bill Number 3418 -
Financial Disc�Osure, wherein he advise the effective date, as they now understood
was July 1, 1974 and that only those who are candidates after that date would be
required to file a report within 10 days after qualification, with appointees to
commissions and boards filing within 30 days after they are appointed to a new term,
and those not up for election or whose terms continue thru the end of this year
would not report until next May for the year of 1974.

Council and the P u Z Commission. It was consensus that such sessions were beneficial
and should be continued.
Councilman Schroedel reported the resignation of Mrs. Branham, Cooper Memorial
Librarian, effective July 31st, and, that the initial summer program for children at
the Library had been highly successful.
Councilman Schroedel introduced AN ORDINANCE UNDER THE CODE OF ORDINANCES OF THE CITY
OF CLERMONT, LAKE COUNTY, FLORIDA, AMENDING SECTION 25-17 (A) (2) (1) OF THE CODE
OF ORDINANCES: PROMULGATING A MINIMUM BASIC MONTHLY SEWER SERVICE RATE FOR SCHOOLS,
KINDERGARTENS, AND DAY NURSERIES: PROVIDING AN EFFECTIVE DATE: PROVIDING FOR
SEVERABILITY: PROVIDING FOR PUBLICATION and the Ordinance was read for a first reading,
by title only, by City Attorney Vason.
With regards report from City Manager Hopkins that he had been unable to get an
answer from the Pool family as to whether or not the city could acquire a new well
site from them, Mayor Smoak requested that the Manager submit a firm recommendation
for Council's consideration at next meeting.
Mayor Smoak adjourned the meeting at 9:30 P. M.

The slurry seal work by J & D Slurry Seal Company has been completed, The streets
which were scaled are as follows:

In a letter dated June 19, 1974 the Environmental Protection Agency has advised that our
second payment of $53,400.00 on the sewer system has been approved. We should get the
money within the next two weeks.

We have also been advised by EPA (letter dated May 30, 1974) that the Operation and
Mantenance Manual has been approved. I have written to EPA inquiring about the final
inspection and final payment, but have not received an answer as yet.
Preston Davis of the Department of Public Utilities has qualified for certification as
a Certified Operator of a water purification treatment plant. Preston now holds a
C license in water treatment as well as a B license in sewage treatment.

On June 20th and 21st, I attended it short course in Winter Park regarding the
new legislative guidelines on public employee relations. The topics of' the session
were the 1974 Amendments to the Fair Labor Standards Act and IIB 2028 passed by the
last session of the legislature on collective bargaining. Both of those items will
have far reaching effects on Florida's cities and Clermont will be no exception.
The minimum wage, overtime and collective bargaining will have a significant fiscal
impact.

During the past three weeks the Police Deparment has been issuing notices on junk
vehicles. Since the first of June, 37 junk vehicles have been removed from public
and private property.
We have also begun a program regarding the proper parking of recreational vehicles,
boat trailers, and the like. We have reproduced the ordinance and the Police
Department is distributing copies to violators. We also plan to publish the
applicable sections of the ordinance in the newspaper for greater dissemination of
the information.
At 8 PM tomorrow evening, June 26th a public hearing will be held at the Ag Center in
Tavares on the proposed Fire Plan for Lake County.

a welding repair shop in a C-2 zone.
Permission is being requested to conduct this use in the C-2 zone as
provided in Section 26-25 (H)(1) of the zoning ordinance.
Section 26-25 (H)(1)
Other similar enterprises or business may be permitted which,
after consideration by the Planning and Zoning Commission
and approved by the City Council, are not more obnoxious or
detrimental to the district than the uses herein provided,
however, the City Council may make such finding, which
finding shall 'be conclusive:
This request was considered by the Planning and Zoning Commission on
July 2nd. No recommendation.
This request will be on the July 9th agenda.

Dear Mr. Hopkins;
I would like verification from the City of Clermont
that it is acceptable for me to locate my welding
repair shop at the southeast corner of Highway 27 and
Pitt Street.
This property is presently zoned C-2. It is my in-
terpretation of Section 26-25 of the Clermont Zoning
Code that, since I would be repairing trucks, grove
machinery, installing trailer hitches, and doing
general repairs, this would he an accepted use. There
would also be a small machine shop to supply machine
replacement of broken parts.

To The Clermont City Council:
The idea of a Western Sidoialk Flea Market Days, sponsored by the
Chamber of Commerce, has been explained to the undersigned. The
general concept consists of:
1. The date planned would be August 9 and 10, 1974 from
9 A.M. to 5 P.M.
2. Montrose Street between 7th and 8th would be closed
off. If demand required it, alternative plans could
also include closing Montrose Street between 8th and
West Avenue. Either or both of these would be for the
two days only.
3. A lane will be left open down the middle of the street
for police and fire access.
4. Everyone wishing to participate would be encouraged
to wear Western clothing during the event.
5. Merchants, civic clubs, church groups and other local
organizations will be given the first opportunity to sign
up for a booth space. After two weeks, flea market par-
ticipants in Webster and Orlando will be invited to par-
ticipate.
6. Advertising •;ill be done in the local paper, Orlando j
Sentinel and on WWFL.
7. Music will be provided, (possibly live). The radio
station WWFL will be requested to broadcast from downtown.
8. A small fee will be charged for the booth space to help
offset the cost of advertising.
