11-26-1974 Supporting DocumentsMINUTES I\;!1 1083 REGULAR MEETING A Regular Meeting of the City Council of the City of Clermont was field in the Council Chambers on Tuesday, November 26, 1974. The mooting was called to order at 6:30 P. M. (instead of 7:30 P. M. due to the delay in arrival of the Mayor, City Manager and City Attorney who were detained on other city business) by Mayor Claude E. Smoak, Jr. with the following members present: Councilmen Blackburn, Byrd, Schroedel and Oswalt. City Officials present were: City Manager Hopkins, City Attorney Vason, Deputy Clerk Dollar, Chief of Police Tyndal and Director of Community Services Smythe. Others present were: Mesdames Smoak and Sheldon; Mr. and Mrs. W. Perry, Mr. and Mrs. John Mitchell; The Messrs, Minor, Crowson, Gay, Hardin, Prior, Britt, Beals and Dean. A representative of the Sentinel/Star was also present. The Invocation was given by Councilman Byrd, followed by repeating of the Pledge of Allegiance in unison by those present. Councilman Oswalt submitted changes to the minutes of November 12, 1974, as follows: With regards to Dickson Shores Subdivision Plat, "whereupon motion was made by Councilman Blackburn, seconded by Councilman Oswalt and unamimously carried that the final plat of Dickson Shores Subdivision be accepted sub,iect to submission of an inset ma of the ro osed subdivision in relation to its surroundin areas w t regaEr s tie aut or Nat on for NICK ones to continue further orawings for construction of a swimming pier at Jaycee Beach, the motion be amended as follows: "Motion was made by Councilman Byrd, seconded by Councilman Schroedel and carried that Mr. Jones continue with further drawings and cost estimates up to time of appli- cation, as authorized in the agreement with Mr. Jones on September 24th at a fee not to exceed $300.00 and that all plans be resubmitted to Council before re uestin M..+1.... �.,� +he-r by Cniinr, man RVN _ SPCon P V OeRC1 man Black - as Mayor Smoak announced the first order of business to be a Public Hearing to consider request presented by John B. Mitchell for Closing of that portion of Crystal Lake Drive between Lot 9 in City Block 4 and Crystal Lake. There was no one present from the floor who objected to the request. As an abutting property owner, Councilman Byrd requested permission to vacate his seat, whereupon he read a letter (copy of which is made a part of these minutes) wherein he officially registered objection to the request as it was presented and advertised. However, he stated that he was not sure that he objected to closing the street if the property owners affected could agree on a joint petition for closing of the street. No action was taken on the granting of this request for street closing, but a suggestion was made to Mr. Mitchell that if the property owners could come to an agreement on the street closing, Council would consider such a request. Mayor Smoak announced the next order of business to be the consideration of a request from Mr. and Mrs. 0. Koppius for rezoning from the existing R1A to C2 and M1 on the following described property. Our present tank price is .327 per gallon plus tax. 2. High Test Gasoline: (100+ Octane) Tank wagon price on date of delivery less a discount of none per gallon. Our present tank price is .362 per gallon plus tax. 3. No Lead Gasoline: (91 Octane) Tank wagon price on date of delivery less a discount of none per gallon. Mr. D. L. Crowson of Dawkins & Associates, Inc., advised that four proposals (bid tabulations and analysis of which are attached to these minutes) were received as follows: Farm & Home Machinery Co. $ 108,420 Locke Well & Pump Co. 84,900 Meridith Corp. 92,011 Singer -Layne Atlantic Co. 107,731 and that it was the engineers recommendation that the low bid of Locke Well and Pump Company in the amount of $84,900 be accepted and the contract be awarded to them for the performance of the work. Bonds in the amount of $3231100 ($156,000 for total water improvements and $168,100 for sanitary sewer improvements) will be purchased by Farmers Home Administration to fund the entire project. Interim i'inancing will be obtained from the State of Florida Revolving Loan Fund ($136,100) and local sources for the balance. With regards the matter of Effluent Disposal and the wishes of the Lake County Pollu- tion Control Board that the City obtain a professional engineer to advise on how to best utilize the existing disposal area for maximum loading; also to advise what this loading rate would be, the subject was discussed with Mr. Crowson and arrangements made for Dawkins and Associates, Inc., to compile the report for presentation to the DPC. The City Attorney, Mayor and City Manager attended a trial in Ocala before Circuit Judge Wallis Sturgis on the case of the Minnoola Citrus Shoppe (Crystal Lake Apart- ments) vs. the City of Clermont on this date. City Attorney Vason reported that the judge ruled in favor of the plaintiff and the Judge will enter a peremptory writ directing the City to issue the plaintiff a building permit under the zoning regulations as they existed on the date the permit was applied for. Deputy Clerk Dollar read a communication from William H. Stone, Associate Municipal Judge dated November 13th wherein he requested Council consider his resignation as Associate Judge retroactive to November 1, 1974, as he had recently accepted the position of Assistant Public Defender, and according to the Ethics Commission of the Florida Bar his position as Associate Judge constitutes a conflict of interest. Councilman Schroedel introduced AN ORDINANCE PROVIDING A BUDGET OF EXPENSES FOR THE GENERAL OPERATIONS OF THE GOVERNMENT OF THE CITY OF CLERMONT FOR THE FISCAL YEAR 1974-75 AND MAKING APPROPRIATIONS THEREFORE: PROVIDING A TAX LEVY ON ALL PROPERTY IN THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA, FOR THE YEAR 1974 FOR THE GENERAL OPERA- TION EXPENSE OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA, and the ORDINANCE was read for a first time by City Attorney Vason by title only. With regards to a request from the Library Board of their desire to receive, in writing, assurance that Lots 18 and 19 in City Block 76 would be restricted to library related usage and/or purposes, and which matter was referred to City Attorney Vason for legal consideration and recommendation, a DECLARATION OF RESTRICTIVE COVENANT was presented to Council by City Attorney Vason. Motion was made by Councilman Schroedel, seconded by Councilman Blackburn and unanimously carried_ that the DECLARATION OF With regards the further consideration of expansion plans for the city hall building and the receipt of a firm commitment from the present tenants, Council reviewed a proposal submitted by the present tenants, Hovis, Baird and Dougherty. It was con- sensus of Council that the proposal was a firm commitment from the present tenants and instructed City Attorney Vason to draw up the necessary lease, effective upon ex- piration of the existing lease, for presentation to the Council for consideration and final approval at the next council meeting. With regards the Pension Investment Guides presented by Dr. H. Russell Fogler in a letter dated November 15, 1974, motion was made by Councilman Oswalt, seconded by MINUTES M 1086 City Manager Hopkins, in a memo dated November 22, 1974, tolled Council Is attention to an opinion of the Attorney General that, where not authorized in the Charter, muni- cipalities do not have the authority to contract with out -of -city residents and business owners for fire protection. He further advised that the city charter does not provide the authority for the City of Clermont to exercise extraterritorial powers of this nature and that at the present time the City has 62 contracts for outside of city fire protection which expire on May 16, 1976, and that the amount of money paid to the City in advance for the last eighteen months of service is $1,170.00. In view of the Attorney General's opinion, he recommended that the city cancel the contracts and refund the $1,170.00. Motion was made b Councilman Oswalt, rnrnndnd by Councilman Blackburn and carried tha_Cthc CTtq�lttorney Mayor Smoak referred to a letter from Municipal Judge Waters wherein he recommended changes to the city charter and code as it is affected by the implementation of the New Traffic Infractions and the Myer Act and asked the City Attorney to take these recommendations into consideration in reviewing the changes to the charter and code being considered by his committee. In his letter Judge Waters also suggested the abolishment of the position of an Associate Jud a and that in lieu of the salary paid to the Associate Judge, an expense account of 3250.00 be provided for the Municipal Judge. Dear Mr. Grant: This is in response to your recent letter in which you posed substantially the following questions: 1. MAY THE CITY OF MARIANNA, FLORIDA, UNILATERALLY EXTEND FIRE PROTECTION BEYOND ITS MUNICIPAL BOUNDARIES? 2. MAY THE CITY COMMISSION OF THE CITY OF MARIANNA AND THE BOARD OF COUNTY COMMISSIONERS OF JACKSON COUNTY, FLORIDA, ENTER INTO AN AGREEMENT WHEREBY THE CITY WOULD PROVIDE FIRE PROTECTION IN SOME OF THE UNINCORPORATED AREA OF THE QUESTION ONE Z.-, AG:) 074-211 this office was presente& . i-ch a factual situation ;n which the City of Avon Park, Florida, apparently desired to unilaterally extend its fire protection beyond municipal bound- aries. COnst•.--%jhich prohibits the exerci4i0 of extraterritorial powers by municipalities except au provided by general or special law --the City of Avon Part: could not extend its fire protection beyond municipal boundaries unloss authorized to do so by general or special law. No such law was found in that instance which would provide the authority for the unilateral action which the City of 'Avon Park was apparently contemplating; and no question was asked or opinion expressed as to whether the City of Avon Park could enter into an agreement with the county in which it is located to furnish fire protection to some portion of the unincorporated area thereof. According to your letter, the only provision of the charter of the City of Marianna, enacted by Ch. 21368, 1941, Laws of Flor- ida, as subsequently amended, which authorizes the City of Marianna to extend its fire protection extraterritorially is that provision which relates to protecting the municipal air- field located outside municipal boundaries. I assume there is no other provision of the charter or any special act which authorizes additional similar extensions. Also, since, as stated in AGO 074-211, I know of no provision of general law which all thorizes municipalities to unilaterally extend fire protection beyond their boundaries, your first question is answered in the negative. QUESTION TWO I am of the opinion that Jackson County and the City of Marianna may enter into an agreement whereby the city may provide fire protection to some portion of the unincorporated territory of the county. Section 125.01(1)(p), '.S•, provides that the legis- lative and governing body of a county, to the extent not incon- siscent with general or special law, may "(n) Er.cer into agreements with other govcr n::to:aal agencies within or outside the boundaries of zhe county for joint per- formanc::, or rformance by one unit in behalf of ._ other, of any of either agency's ...._,.orized functions; see g125.01(1)(d), id., empowering the legislative and governing body of a county to provide fire protection. S U M M A R Y Except to the extent authorized in its municipal charter or other special law, the City of Marianna may not unilaterally extend fire protection beyond its munic- ipal boundaries. Hopkins and also by legal notice datedNovembor 14, 1974 of the following: Request by John B. Mitchell for the closing of that portion of Crystal Lake Drive Uetween Lot 9 6n City Block 4 and Crystal Lake. The purpose of this letter is to officially register my objection to the request as it was presented in Mr. Hopkins" letter and also in the legal notice. I own property adjacent to Mr Mitchell's property, and I believe that the value of/ly property might be damaged if his request is granted. The legal description furnished by Mr. Hopkins and the legal notice is insufficient upon which to make a sound judgement. I request that a survey of the property be required, and that I be allowed to examine the survey before City Council considers this matter. Also attached .is a copy of the c.ity's fire protection contract-. Our Charter does not provide the authority for the City of Clermont to exercise extraterritorial powers of: I:his nature so it appears that we are contracting with out -of -city residents and business owners without authority. At the present time the City has 62 contracts for fire protection. These contracts expire on May 15, 1976. The amount of money paid to the City in advance for the last eighteen months of service is $1170.00. In view of the Attorney General's opinion, it is recommended that the City cancel the contracts and refund the $1170.00. it is further recommended that the $1170.00 be transferred from Account 3-720 Contingency -Community Services to Account -- --- 2-720-Contingency-Public Safety to cover this expenditure. I believe that I can manage 43 court oil a full year basis without the luxury of an associate judge. I have boon subjected to many extra expenses, attending seminars, transportation, telephone calls, extra time in are -trial reviews, etc., that instead of the $500 for the associate ;judge; I would nuggest an expense account of G250 for the municipal judge, not to be included as salary. Hopkins C44-5-05 City Manager Gentlemen: The City opened bids November 20, 1974, at 2:00 p.ln. in City Hall for the construction of a water supply well at the southwest corner of the intersection of Seminole Avenue and South Twelfth Street. Four proposals were received and a tabulation of those bids is enclosed for your review and records. The low bid was submitted by Locke Well and Pump Company of P. 0. Box 2927, Orlando, Florida in the amount of $84,900. The other bids ranged from that figure upward to a high bid of $108,420. Our estimate for this work was $88,000. The work anticipated by this construction consists of the drilling of a twelve -inch well producing a yield of 1,500 gallons per minute pumped directly to the existing water distribution system and will supply the southwest quadrant of the City affording increased pressures, better fire -fighting capability and firming the supply during periods of peak demand. As is pointed out in our Engineering Report, the well supply for the town, during peak periods, is presently marginal at best and this additional supply is badly needed to meet peak requirements and keep pace with the rapid growth of the community. The low bid in the amount of $84,900. has been examined to ensure its accuracy as to extension and summation. The exhibits, made by the Contractor as required by the Information for Bidders and other appli- cable portions of the Bid Documents, all appear to be in order as is the experience and financial capabilities of this firm. The Proposal and Proposal Guaranty Bond are properly executed and a check on the previous work and references indicate that this Contractor is capable and qualified to do this work. The increase in cost reflects the sharp and continued rise of tine cost of casing and labor associated with the construction of these specialty types of water supply wells. It is to be anticipated that any delay in putting this work to contract will, in view of fuel and possible steel shortages, make like improvements even more difficult to fund. (BOBBIE) DEAN MINUTES M 1087 SPECIAL MEETING A Special Meeting of the City Council of' the City of Clermont was held in the office of the City Manager on Monday, December 2, 1974. The meeting was called to order at 5:05 P. M. by Mayor Claude E, Smoak, Jr, with the following members present: Councilmen Byrd, Schroodel, Oswalt and Blackburn. Other officials present were: City Manager Hopkins, City Clerk Carroll, Chief of Police Tyndal and Sgt. Mitchell Rogers. Mayor Smoak advised the purpose of the meeting was to prepare the Ballot Box for the General Election of the City of Clermont to be held on Tuesday, December 3, 1974. Motion was made by Councilman Byrd, seconded by Councilman Schroedel, and carried that the Ballot Box be declared in order, that it be locked and turned over to Police Chief Tyndal, along with the Registration Rolls of Precincts 15 and 38, for delivery to the Clerk of Election on the morning of the General Election.
