02-10-1970 Supporting DocumentsMINUTES N4 645 REGULAR MEETING A Regular Meeting of the City Council of the City of Clermont was held in the Council Chambers on Tuesday, February 10, 1970. The meeting was called to order at 7:30 P. M. by Mayor Don E. Smith with Councilmen VanderMeer and Bratton present. Other officials present were: City Clerk Carroll, City Controller Fleming and Chief of Police Tyndal. Others present were: flr. and Mrs. R. M. Frye, Mr. and Mrs. Clarence Bishop and the Messrs. C. A. Mangold, Henry Czech, E. L. Schumann and Claude Smoak. Representatives of the local Press were also present. The Invocation was given by Councilman VanderMeer. Mayor Smith submitted a report of the City Manager, both orally and written, and a copy is attached hereto. City Attorney Langley and Councilmen Cochran and Oswalt arrived at this time. Mr. R. M. Frye appeared before the Council with regards the status of an Easement which he holds on property abutting Lake Winona, but which property had been included in a recent Quit -Claim Deed from the City of Clermont to Mr. Lynn Brotherson. Considerable discussion took place regarding this matter and it was consensus of Council that the matter be referred to the City Attorney for further investigation and Mr. Frye was advised that he would be contacted by the City Attorney regarding the matter. Motion was made by Councilman Cochran, and seconded by Councilman Bratton that the City Manager be authorized to award a contract to the low bidder for the recasing of the Grand Highway Well with 12" casing for its entire depth, or, slightly over 600 feet, and, at an approximated cost of between $8,000.00 and $9,000.00. Upon roll call vote on passage of the motion, the result was: Ayes: VanderMeer, Cochran and Bratton. Total Ayes: Three. Nayes: Oswalt. Absent: None. The motion carried. City Attorney Langley advised that a final Hearing on the injunction against the City by Mr. Gus Reis had been set for February 17, 1970 at 10:00 A. M. in the office of Judge Hall and that it would be necessary for a member of the Michaels Engineering firm to be present as well as himself, a member or members of the City Council and the appraisers whom he had engaged to appraise the Reis property. Councilman Cochran introduced AN ORDINANCE UNDER THE CODE OF ORDINANCES OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA, PROVIDING FOR THE LICENSING OF DOGS WITHIN THE CITY: REQUIRING OWNER OF DOGS TO KEEP THE SAME UNDER THEIR CONTROL: PROVIDING FOR THE IMPOUNDMENT OF UNLICENSED AND/OR UNCONTROLLED DOGS, PROVIDING RABIES PROTESTION PROCEDURE: PROVIDING PENALTIES FOR VIOLATION HEREOF: PROVIDING AN EFFECTIVE DATE and the Ordinance was read in full by the City Attorney and Councilman Oswalt for a first reading. City Controller Fleming submitted a bill from Michaels Engineering Company in the amount of $22,400.00 for survey work from February 1969 through December 1969 to be included with the regular bills presented to the Council at this meeting for payment. Motion was made by Councilman Cochran, seconded by Councilman Oswalt and carried that the bills be paid. A copy is attached hereto. MINUTES No. 646 Mayor Smith read a letter of resignation from City Manager Johson, such resignation to become effective December 31, 1970. The letter. was acepted by the Council, a copy is attached hereto and becomes a part of these Minutes. Councilman VanderMeer reported to the Council that he was of the opinion that now is the time to do any work needed to be done on the Little League fields, and that lie would contact the City Manager regarding this. Smith, Mayor City of Clermont Florida Dear Mayor Smith, At the end of this year, 1970. 1 will be 1n excess of sixty six years of age and, in my opinion, about re?dy to "turn out to pasture". I bill, therefore, appreciate your considering this letter as my resignation from the office of City Manager :Lo become effective December 31. 1970, or shortly thereafter. I state "or shortly thereafter" as 1 du not have to relinquish my duties on exactly that date. i. ; am needed I will gladly stay on for a few extra months. I will also continue in an advisory capacity at a nominal fee if requested. with cr without a fee I will always be willing ani available for any assistance I may be able to extend to the City Cnuncil or nay successor. In my opinion, it should not be necessary for you to engage my successor for more than a c,onth or six weeks prior to rev retirement, and two weeks should be ample if I ar retained in an advisory capacity. My twenty years association with Clermont City government has been most pleasant. I shall re;,eiber, with pleasure. my close association and friendship with my fellow employees and the many fine individuals who have served as Mayor and Councilen during my tenure in office. Regardless of the opinions of soave, 1 know that considerable sacrifice is made by the individuals acceotino these offices. The planter boxes under the "Welcome to Clermont" signs have --een filled with soil and are ready for planting. I believe the Mayor hopes to have some of our local organizations sponsor this. Our engineers advise that the State Health Department is presently reviewing our plans and specifications for the sewer system. ide e:tpect to have their approval in the near future. After making a study of the report from the State Geologist and consultations with the U. S. Geological Survey and several well drillers our engineers recommend that the Grand llighway well be recased vith a 12" rasing for its entire depth or slightly over 600 feet. Tie cost of this project Will be between $8,000.00 and $9,000.00. 'he engineers have every reason to believe that :his will eliminate the pollution problem. However, there is, of course, no guarantee. It is also possible that the :rater may contain hydrogen sulphide. In til opinion we have little choice in the matter. It certainly sums foolish to dig another shallohw '.jell at some other location when we already have three which are bad. 'ir. '.'testbrook has asked for three bids on this project and I will open them in my office next Friday afternoon. I need, and request, your authorization to award this contract to the low bidders. As previously stated, the cost will be betreen $8,000.00 and $9,000.00. The Ilater Department budget contains funds for this project. I was somewhat surprised to read in the minutes of the last meetin^ that I had been authorized to directed to get bids for lighting a soft ball field. My sirprise was due to the fact that I had neither requested or recommended this expenditure. This item was not budgeted nor do We have available funds in the budget. Furthermore, although we have not received our audit, I anticipate very little if any surplus from our last fiscal year. 1, also call your attention to the fact that We must spend some ten to twelve thousand dollars for the replacement. of land we Will use for our sewer plant.
