ADJOURNED MEETING
An Adjourned Meeting of the City Council of the City of Clermont was
held in the Council Chambers on Tuesday, April 28, 1970. The meeting
was called to ordr at 7:35 P. H. by Mayor Pro-Tem Bratton, with
the following members present: Vanderl•1eer, Cochran and Oswalt. Other
officials present were: City Manager Johnson, City Clerk Carroll,
City Attorney Langley and Chief of Police Tyhdal. Others present
were the Messrs. C. A. Mangold, Henry Czech, E. L. Schumann, Howard
Young, Jim Hoskinson and Doctors T. D. 'r:eaver and Paul Watson. Representa-
tives of the local Press were also present.
The Invocation was given by Councilman Vandertleer.
The Minutes of the Regular fleeting held on April 14, 1970 were approved
as written.
Doctors Heaver and Watson and Howard Young appeared before the Council
with regards the possibility of obtaining an airport for the South
Lake County area, preferably in a cooperative effort with the City of
Groveland, and inquired of Council's endorsement of such a project.
They advised that financial assistance from federal funds would be
available for such a project, but that the initial step needed to be
an official committee appointed to contact officials from the Federal
Aviation Authority.
Mayor Smith arrived at this time, and the meeting was turned over to
him.
Mayor Smith thereupon appointed the following to serve as a committee
to investigate further the possibilities of obtaining an airport for
the South Lake County area: City Attorney Langley, Dr. T. D. Heaver,
Dr. Paul Watson and two representatives from the City of Groveland,
which Mr. Langley was asked to contact. The Committee to report their
findings back to the Council at a future date.
Lake County Commissioner Jim Hoskinson was present to answer any
questions and/or inquiries which the Council might have with regards
the proposed Lease Agreement of the city dump. The Lease Agreement was
read in full by the City Attorney. Motion was made by Councilman
Oswalt, seconded by Councilman Vanderlleer and unanimously carried that
Mayor Smith be authorized to execute the Lease Agreement with the Lake
County Board of Commissioners and a copy of same is attached hereto
and becomes a part of these Minutes.
City Manager Johnson submitted his report both orally and written and
a copy is attached hereto.
It was consensus of Council that the City Manager be instructed to
notify the Town of Minneola of the increase for fire protection from
the present $300.00 annually to $825.00 annually in a three year contract,
such increase to become effective at the expiration of the present five
year contract which is May 1, 1971.
Motion was made by Councilman Cochran, seconded by Councilman VanderMeer
and 'unanimously carried that the City Manager be authorized to execute
allother out -of -city fire protection agreements at an annual fee of
$10.00 for a five year period, such five year fee payable in advance.,
and becoming effective at end of the present five year agreements, May 1,

would meet with the Bond Attorneys in Jacksonville on 4lednesday,

ADJOURNED MEETING
Mayor Smith reported on his trip to Tallahassee recently wherein he
had attended meetings of Mayors of Municipalities throughout the
State of Florida with regards bills pending in the present session of
Legislature which would affect municipalities.
City Clerk Carroll read communications as follows: From Mrs. Eleanor
Caswell, Librarian of Cooper Nemorial Library wherein she expressed
appreciation to the Council for their recent letter of commendation to
her for her services at the Library; From Judge L. R. Huffstetler, Jr.
wherein he expressed appreciation to Mayor Smith for having shown interest
in attending the first county -wide meeting to assess interest in
developing a comprehensive crisis intervention center for all of Lake
County.
Motion was made by Councilman Vanderlleer, seconded by Councilman Br.atton
and unanimously carried that the Council accept a Warranty Deed for
Lots 18 and 19 in city Block 76, City of Clermont, from the Official
Board of Cooper Memorial Library, and without any restrictions whatsoever,
City Attorney Langley wished it a matter of record that he had not
seen, nor had been instructed to investigate, this deed. City Manager
Johnson advised that the deed had been delivered to him and was in his
office.

INDUCTION: PROVIDING PENALTY FOR VIOLATIONS HEREOF was introduced by
Councilman Oswalt and read in full for a First Reading by City Attorney
Langley.
The Fleeting was adjourned by Mayor Smith.

LEASE AGREEMENT
THIS LEASE AGREEMENT MADE AND ENTERED into this day of
April, A. D. 1970, by and between the City of Clermont, a municipali-
ty, in Lake County, Florida, hereinafter called the City, and
Lake County, a political subdivision of the State of Florida,
hereinafter called the COUNTY.
IN the consideration of One Dollar ($1.00) in hand paid by
the County to the City, receipt whereof is hereby acknowledged
and the further consideration hereinafter set forth, the City
does hereby demise and lease unto the County the following described
garbage disposal area located in Lake County, Florida and owned by
the City:
PARCEL NO. 1 : Tracts 17,18,31 and 32 in Section
27, owns ip 22 South, Range 25 East, in Groveland
Farms, a subdivision in Lake County, Florida according
to the plat thereof recorded in Plat Book 2 pages 10
& 11, Public Records of Lake County, Florida.
PARCEL NO. 2 : That part of Tract 16 in Section 27,
Township Rance 25 East, in Groveland Farms,
a subdivision in Lake County,Fla., according to the
plat thereof recorded in Plat Book 2 pages 10 & 11,
Public Records of Lake County, Florida, bounded and
described as follows: From the Northwest corner of
Section 27, Township 22 South, Range 25 East; in Lake
County, Florida, run thence North 88 degrees 54' East
311.57 feet; thence run South 15 degrees 40' East
690.2 feet; thence run East 51 feet; thence run South
25 degrees 18' 30" East 302.06 feet to a point hereby
designated as point "A"; from the said point "A", run
thence South 70 degrees 26' hest to a point on the
East line of the said Tract 16, the same being the point
of beginning of the Tract herein described. From said

For a period of FIVE (5) YEARS. County shall have the option
to renew this lease under the same terms and conditions for an
additional period of FIVE (5) YEARS, provide&!however that County
has fulfilled their obligations as set forth herein.
During the term of this lease the City shall have the
right, as part of the consideration herefore, to use the faci-
lities of the garbage disposal area for the purpose of dumping
garbage and trash without charge and with the further agreement
that the County will, at the final termination of this lease,
return said property to the City in a clean sanitary condition.
The parties hereto agree to the following stipulations to
control during the term of the lease:
1. The COUNTY agrees to supply an attendant at the
garbage disposal area during the established working hours which
shall be. -.agreed upon.
2. The garbage disposal area will be closed to the public
during off -working hours, but the City will be furnished with keys
so that city employees may enter the area whenever necessary.
3. The existing gate will be taken down and reinstalled
well inside the property boundaries (approximately 600 feet)
allowing a small trench to be constructed outside the main com-
pound for use of individuals who may desire to use the dump during..
off hours.
4. Present dumping area shall be reduced or limited to that
which is necessary for handling the existing incoming loads.
5. To comply with air and water pollution laws, all
burning of trash and garbage will be prohibited during the term of
this lease.
6. The COUNTY agrees to clean up the entire site for the
purpose of disposing of existing debris and promiscuous dumping.
7. No salvaging will be permitted except with the mutual
consent of the County and the City.
8. The COUNTY shall have the right to charge any com-
mercial garbage collection agency duly franchised to operate within
Lake County, such fee as shall be determined for use thereof by
commercial garbage collecting agencies to help defray the cost
of operating the same.
THIS LEASE is executed in duplicate and shall be binding
upon the respective parties hereto during the term hereof.
IN WITNESS WHEREOF, the parties hereto have caused this
Lease to be executed in their respective names by their duly
authorized officers, all as of the day and year first above
written.
