ADJOURNED MEETING
An adjourned meeting of the City Council of the City of Clermont was
held in the Council Chambers on Tuesday, September 22, 1970. The
meeting was called to order at 7:30 P. hi. by Mayor Don E. Smith with
all Council members present. Other officials present were: City
Manager Johnson, City Controller Fleming, City Clerk Carroll, City
Attorney Langley and Chief of Police Tyndal. Others present were:
The Misses Valerie Hutchingson and Betty J. Frye, Mrs. Marth Groschen,
Mrs. Rudolf Pretsch, Mr and Mrs. 0"Brien Etheredge and the Messrs.
Donald Ware, C. A. Mangold, E. Ray Jones, E. L. Schumann, Ernest
Collins and Christy Christenson. Representatives of the local Press
were also present.
The Invocation was given by Councilman VanderMeer.
The Minutes of the meeting held on September 8, 1970 were approved
as written.
Miss Valerie Hutchingson appeared before.the Council and requested
permission for the Clermont High School Cheer -Leaders to sponsor a
teen-age dance in the Jenkins Auditorium on October 2nd. Miss
Hutchingson further advised that Mr. Lofgren, Principal of Clermont High
School was the adult sponsor for this dance, but was unable to be
present. Motion was made by Councilman VanderMeer, seconded by
Councilman Cochran and carried that this request be granted provided
that all necessary rules and regulations as set forth for use of the
Auditorium for dances are met.
Mr. Donald Ware, co-owner of the Crest Restaurant, appeared before the
Council and requested extended closing hours for the Crest Restaurant
and Lounge on Fridays, Saturdays and Sundays until 2:00 A. M. It was
consensus of Council that the City Attorney be instructed to prepare
the necessary Ordinance amending existing Ordinance!No. 23-C to allow
restaurants holding licenses under the State Beverage Department of
Florida, consisting of 4,000 square feet or more, serving meals and
providing for the seating of 200 or more people, to sell, serve and
permit to be consumed alcoholic and intoxicating beverages until 2:00
A. M. 7 days per week.
With regards the Council taking any action on the passing of a
Pornography Ordinance, as had been requested by Attorney General Faircloth,
City Attorney Langley recommended that any action on this matter be
deferred until after the general election, and the Council was in
agreement with this recommendation.
With regards the proposed Open Space Land Trade for construction of
a sanitary sewer system, Mr. Langley reported that he, City Manager
Johnson, Mayor Smith and Floyd Groo had met with a Mr. Martin, aide
to Sentor Gurney, soliciting the help of Senator Gurney in expediting
the land trade and that the meeting was a favorable one.
Mayor Smith read a letter from the Pilot Club of South Lake County
wherein they announced a public program on Drug Abuse to be presented
in Jenkins Auditorium on October 19, 1970 at 8:00 P. M. and urged
all city officials to attend.
Mayor Smith advised of the Orange Blossom Breakfast, spronsored by
Michaels Engineering Company, to be held in the Jenkins Auditorium
on Wednesday morning, September 23rd, and urged all present to attend.

City Clerk Carroll read communications as follows: From Mr. John N.
Halstead of 466 Pitt Street, and, Jimmy D. Reed of 643 Drew Street,
wherein they objected to any pumping down of Shady Nook Lake; From
Mr. J. M. VanderMeer wherein he requested the closing of an alleyway
from Bloxam Avenue to Highway #50.
Councilman Cochran presented and moved the adoption of a RESOLUTION
pertaining to changes in the various rates and fees for service and
connection charged in the Water Department and the RESOLUTION was
read in full by City Attorney Langley. The motion was seconded by
Councilman VanderMeer and unanimously carried. The Number 169 was
assigned to it and a copy ordered posted.
Councilman VanderMeer offered and moved that it be passed, AN ORDINANCE
PROVIDING A BUDGET OF EXPENSES FOR THE GENERAL OPERATION OF THE
GOVERNMENT OF THE CITY OF CLERMONT FOR THE FISCAL YEAR OF 1970-71 AND
MAKING APPROPRIATIONS THEREFORE: PROVIDING A TAX LEVY ON ALL PROPERTY
IN THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA FOR THE YEAR 1970 FOR
THE GENERAL OPERATION EXPENSE OF THE CITY OF CLERMONT, LAKE COUNTY,
FLORIDA. The motion was seconded by Councilman Cochran and the
ORDINANCE was read in full for a second and final reading by Councilman
Oswalt. Upon roll call vote on passage of the ORDINANCE, the result
was: Ayes: VanderMeer, Oswalt, Smith, Cochran and Bratton. Total
Ayes: Five. Nayes: None. So the ORDINANCE was adopted, the Number 26-M
assigned to it and a copy ordered posted.
Councilman Oswalt offered and moved that it be passed, AN ORDINANCE
UNDER THE CODE OF ORDINANCES OF THE CITY OF CLERMONT, LAKE COUNTY,
FLORIDA, GRANTING AN ELECTRICAL POWER FRANCHISE TO FLORIDA POWER
CORPORATION, ESTABLISHING THE TERMS AND CONDITIONS THEREOF, PROVIDING
All EFFECTIVE DATE. The motion was seconded by Councilman Bratton
and the ORDINANCE was read in full for a second and final reading by
City Attorney Langley. Upon roll call vote on passage of the ORDINANCE
the result was: Ayes: Bratton, Cochran, Smith, Oswalt and VanderMeer.
Total Ayes: Five. Nayes., None. So the ORDINANCE was adopted, the
number 27-M assigned to it and a copy ordered posted.
AN ORDINANCE UNDER THE CODE OF ORDINANCES OF THE CITY OF CLERMONT,
LAKE COUNTY, FLORIDA, AMENDING ORDINANCE NO. 42-C BY CORRECTING AN
OMISSION THEREIN AND ALSO AMENDING SAID ORDINANCE BY CHANGING THE ZONING
OF THE WEST ONE-HALF OF LOT 9 AND ALL OF LOT 10 IN BLOCK 1, FROM R-1
TO R-2 ZONING CLASSIFICATION was introduced by Councilman VanderMeer
and read in full for a first reading by City Attorney Langley.
Mr. O'Brien Etheredge an adjacent property owner to Forty Pines Sub-
division appeared before Council wherein he objected to Council designating
the Zoning of R-2 for Forty Pines Subdivision, and submitted a petition
to them requesting that it be Zoned as R1-A. Mr. Etheredge further
advised the Council that existing city ordinances with regards junk,
sales of automobiles and commercial business being conducted in a
residential area, were being violated at the George Gallup property in
Forty Pines Subdivision and he thereby requested that Council action
be taken to prevent this. This matter was referred to the City Manager
for investigation.
Councilman VanderMeer inquired if any information had been obtained
on the size, cost, etc. on a pavilion located at Lake Placid and he
was advised in the negative, however, Councilman Cochran advised that
he would obtain this information.

Councilman Oswalt inquired if any information had been obtained with
regards conditional use permits and he was advised in the negative,
however, Councilman VanderMeer advised that he would obtain a copy of
the County's Code regarding conditional use permits.
Upon request of Councilman Cochran, the City Manager advised he had
obtained the elevations of Lakes Shady Nook and Minneola which were
as follows: Lake Shady Nook @ 96.35 and Lake Minneola @ 95.73. Consider-
able discussion took place with regards the pumping down of Shady Nook
Lake. Mrs. Martha Groschen and Mr. C. C. Christenson appeared before
Council urging that it be lowered. Mr. E. Ray Jones appeared before
Council urging that inasmuch as the procedure for pumping down Shady
Nook Lake would be to empty the water into Crystal Lake, that every
effort be made to keep Crystal Lake at its present level and he was
assured that it would be. Motion was made by Councilman Bretton,
seconded by Councilman Cochran and unanimously carried that a Water
level of 93.5 be established for Shady Nook Lake and the matter of
pumping down to that level be referred to the City Manager.
Motion was made by Councilman Bratton, seconded by Councilman Oswalt
and carried that the City Clerk be instructed to have the following
Legal Notice published:
NOTICE OF PUBLIC HEARING on Closing an alley
in Forty Pines, a subdivision in the City of
Clermont.
A copy of the Legal Notice is attached hereto.
Mayor Smith reminded the Council of the State Leagte of Municipalities
Convention to be held in Miami on October 24th, 25th, and 26th
and urged that reservations be turned in as ugickly as possible for
those planning to attend.
The Meeting was adjourned by Mayor Smith.
