06-10-1969 Supporting DocumentsMINUTES No xx x 59 REGULAR MEETING A Regular Meeting of the City Council of the City of Clermont was held in the Council Chambers on Tuesday, June 10,1969. The Meeting was called to order at 7:30 P.M. by Mayor Don E. Smith with all members present. Other officials present were: City Manager Johnson, City Clerk Carroll, City Controller Fleming, City Attorney Langley and Chief of Police Tyndal. Others present were: Mr. and Mrs. Travis Cork and the Messrs. John L. Jones, Henry Czech, E.L.Schumann, C.A.Mangold, James C. Freeman and Richard Williams. Representatives of the local Press and the Orlando Sentinel were also present. The Invocation was given by Mr. Jones. The Minutes of the Adjourned Meeting held on May 27, 1969 and of the Special Meeting held on May 29, 1969, were approved as written. Mayor Smith inquired of Council if it be their desire to hear Mr. James C. Freeman who had requested to appear before the Council on this date, but had requested after the Agenda deadline. Motion was made by Councilman Cochran, seconded by Councilman VanderMeer and unanimously carried that Mr.Freeman be invited to approach the Council. James C. Freeman appeared before the Council inquiring of them as to why he did not receive a letter mailed from the Building Department to local licensed Master Plumbers, though he was a local licensed Master Plumber. City Manager Johnson agreed to investigate this matter, but was of the opinion this was strictly an oversight. Mr. Freeman further inquired of Council matters pertaining to Electrical Examinations. City Manager Johnson submitted his report, both orally and written and a copy is attached hereto. Motion was made by Councilman VanderMeer, seconded by Councilman Cochran and unanimously carried that the recommendation of City Manager Johnson to appropriate the sum of $1300.00 for use by the Cooper Memorial Library Association, such funds to be paid the last part of August 1969, be authorized. Mrs. Jean Cork appeared before the Council representing Cooper Memorial Library, and expressed appreciation to the Council for the action just taken to give them financial assistance, but advised the Council that this sum would not be adequate for the operation of the Library until the next fiscal year, and urged their consideration for a larger appropriation. Motion was made by Councilman VanderMeer, seconded by Councilman Bratton and unanimously carried that the City Manager's recommendation to construct an addition of one room to the building located at Kehlor Park from the remaining un-appropriated $1250.00 in this fiscal year's Contingency Fund, be authorized. City Clerk Carroll read a letter from Mr. Tim K. Johnson, Booking Agent, of Howgy-in-the-Hills, Florida wherein he requested use of the Jenkins Auditorium for a teen-age dance on July 10, 1969. Considerable discussion took place regarding this matter, whereupon motion was made by Councilman Oswalt, seconded by Councilman Cochran and unanimously carried that this request be denied. City Attorney Langley advised the Council that the Amendments to the City Charter had become Law as of Wednesday, June 4, 1969. LLA r 1. .,. MINUTES N2 s*47A Councilman Bratton offered and moved the adoption of AN ORDINANCE UNDER THE CODE OF ORDINANCES OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA, A14ENDING THE ZONING REGULATIONS BY REDEFINING THE DE- FINITIONS PROCEDURETHE FORUSES OBTAININGPERMITTED VARIANCESTRANSITION CHANGES: LIh1ITINGPROVIDING TRANSFER OF VARIANCES, LIMITING THE COMMENCEMENT OF GRANTED VARI- ANCES, PROVIDING AN EFFECTIVE DATE and the Ordinance was read in full for a second reading. The motion was seconded by Councilman Oswalt and upon roll call vote on passage of the Ordinance the re- sult was: Ayes: VanderMeer, Oswalt, Cochran and Bratton.Total Ayes: Four. Nayes: None. So the Ordinance was adopted and the Number 45-C assigned to it and a copy ordered posted. Motion by Councilman VanderMeer, seconded by Councilman Oswalt and unanimously carried that Registered Letters with return receipt re- quested be mailed to all persons having been granted variances to the Zoning Ordinance but who do not have construction completed for which they received the variance, notifying them that such construction must be completed within one (1) year from date Ordinance Number 45-C becomes Law, or, the variance grant shall become null and void. City Attorney Langley presented a rough draft amending the Electrical Code Ordinance for the Council's consideration. It was consensus of Council that the Chairman of the Electrical Board be present at the next regular meeting to answer pertinent questions regarding the pro- posed changes in the Code, before any action is taken. City Attorney Langley presented a rough draft amending Ordinance Number 29-C for the Council's consideration. Motion was made by Councilman Cochran, seconded by Councilman Oswalt and carried, that this matter be tabled. City Attorney Langley advised the Council that upon his research of Section 14-36 of the Code, it was his recommendation that no changes/ amendment to this would be necessary in order to take necessary action or assess penalties for the de -facing of signs throughout the city. It was consensus of Council that no action be taken on this matter. Motion by Councilman Oswalt, seconded by Councilman Cochran and carried, that the bills be paid. A copy of the bills follows these Minutes. The policies governing use of the Jenkins Auditorium was discussed at length by the Council. Motion was made by Councilman Oswalt, seconded by Councilman VanderMeer and unanimously carried that the use of Jenkins Auditorium be limited to bona fide citizens of the City of Clermont, or, sponsored by bona fide organizations of the City of Clermont, excepting governmental agencies as authorized by the City Manager. Motion was made by Councilman VanderMeer, seconded by Councilman Oswalt and unanimously carried that the recent action taken by the Council esta- blishing a fee of $35.00 for the use of Jenkins Auditorium when dances are held, be amended to the general rates of $2.00 per hour with a minimum of $6.00 and a maximum of $12.00 plus any other applicable charges; that at the time that an application is filed for any dance, regardless of the sponsoring group and/or individual, a cash deposit of $50.00 be made as surety against breakage or damage to the buildingaa6d/or fixtures; that at his discretion, the City Manager may require a cash deposit of a like amount regardless of the purpose for which the building is to be used. Policy of Lhe; Jenkins Auditorium building is under the direct ontrol of the City of Clerniont 2. For the convenience of: the residents and visitors of this city the hlermont Chamber of Commerce offices located at the Jenkins Auditorium will handle the schedulin9 of :;ll Lctiv'ities at the building. All such reservations or bookings shall be in accord- ance with all ordinances and provisions of regulations set forth by the City of Clermont 3. All applications for the use of the Jenkins Auditorium will be presented in smiting in reasonable advance notice of the date required 4. Normal hours of operations for the building: Mondays through Saturdays, 9 A.N. to 5 P.N. and shall be closed on Sundays and legal holidays and evenings except for specific bookings. The main auditorium will be opened only for specific bookings 5. All applications submitted shall not be confirmed until payment of the required fee is made to the Chamber office 6. Fees for consecutive bookings shall be 50N upon application and the balance before half of the meeting dates have been used 7. The City Council of Clermont reserves the right to cancel any and all meetings and to give applicants of such meetings one week's notice of change when possible 8. Bottled gas or other inflammables are not permitted on the premises 9. All applicants for permits will be held responsible for any damage or losses as a result of their use of the auditorium 10. Scheduling of any one room in the auditorium does not permit the use of other meeting rooms i II. No signs, banners or decorations that in any way might deface and damage the building, interior or exterior, or grounds shall be allowed. If applicant is desirous of decorating, such decorations shall be approved by the City Manager prior to their use 12. Applications for the use of the auditorium by minors must be filed by adults and chaperones provided for the occasion sufficient to fully supervise the activity. In no event shall less than four chaperones be provided. The names of the chaperones shall be listed on the application I� 12,. The use of the auditorium is limited solely to local groups, organizations and/or individuals. Governmental agencies or agents may be excepted from this regulations at the discretion of the City Manager -------••---------------------------------------- TIIE FOLLOWING SHALL DE THE DESIGNATION FOR THE PURPOSE OF PRIORITY USE AND FEES OR RENTAL 1. Government groups, including local, county, State and Federal; local hospital and blood banks; Youth activities which are free of admission fees; properly chaperoned;and open to the general public upon the authorization of the City Manager 2. Service groups or organizations which, through the use of the auditorium are offering educational, cultural, spiritual or welfare programs free of admission to the gereral public and of non -political nature 3. Groups whose program function is intended to give pleasure and/or professional or business advancement free of admission to the general public and of a non -political nature 4. Groups and/or individuals renting the auditorium for any purpose other than those outlined above or where attendance is limited to membership or invitation 5. Gatherings of any nature when admission fees are charged and/or - when meals are served for a fee 6. Groups or individuals renting the auditorium for political purposes 7. The holding of regular scheduled religious services in the Jenkins Auditorium is prohibited -2- RENTAl. S GENE iznL: When any group, organization or individual files an application for the use of the auditorium for the purpose of holding a dance, the application must be accompanied by a cash deposit to the Chamber of Commerce Secretary as surety against damage or breakage to the building or fixtures. This deposit will be returned within five (5) days following the dance less deduction for damage or breakage, if any GROUP I. No rental fee far building, but a "set up" charge may be charged when such service is required GROUPS 1I,III. Regular fees with a maximum of $12.00 daily for an individual organization GROUPS IV,V,VI. Regular rental fees without maximum FEE SCIIEDULE ( q ) Main auditorium: $2.00 per hour with a minimum of $6.00. Won -profit organizations at a maximum of 512.00. Commercial uses: No limit _ ( D ) When admissions are charged or food/other items sold, there will be an additional charge of 20'5 of the gross revenue, but not to exceed $20.00 for non-profit organizations. When used commercially, the 20' shall apply on the total gross revenue ( C ) Set -Up fee: Per Table 0 $.50 Per Chair @ $.05 ( 0 ) Conference Rooms: Rental of 50¢ per hour with a minimum of $1.00.
