An adjourned meeting of the City Council of the City of Clermont was held
in the Council Chambers on Tuesday, September 24, 1968. The meeting was
called to order at 8:00 P. M. by Mayor Don E. Smith with all members
present. Other officials present were: City Manager Johnson, City Clerk
Carroll, Controller Fleming, Superintendent Sheldon, Chief of Police
Tyndal, City Attorney 'Langley and Building Inspector Snyder. Others
present were: The Messrs. C. A. Mangold, Fred L. Addison, Floyd Groo,
James Westbrook and the Rev. Mr. Seitz. Representative of the local
Press were also present.
The invocation was given by the Rev. Mr. Seitz.
There was an addition to the Minutes of the Meeting held on September loth,
as follows: In the Standards set up for Municipal Policemen, as reported
in the Municipal Newsgram, 200 hours of basic training is required.
The Minutes were then approved as corrected.
Immediately prior to opening of Bids on Garbage Packers, Trucks, and
Petroleum Products, City Manager Johnson recommended that no bids be
accepted until such time as he had inspected same thoroughly, making certain
that all bids were in accordance with specifications submitted. Immediately
prior to opening of Bids on construction of a new well, City Manager
Johnson recommended that no Bid be accepted until such time as the City
Engineers could investigate same, making certain the bids were in accordance
w ith specifications submitted.
City Manager Johnson opened bids as follows:

Motion was made by Councilman VanderMeer, seconded by Councilman Beals, and
carried that these bids be referred to the City Manager for study, and
report his recommendations to the Council at their next meeting.

Motion was made by Councilman Cochran, seconded by Councilman VanderMeer

Motion was made by Councilman Beals, seconded by Councilman Cochran and
carried that these bids be referred to City Manager Johnson for study

Motion was made by Councilman Beals, seconded by Councilman Oswalt and
carried that these bids be referred to Michaels Engineers for their study
and report their recommendations to the Council at their next meeting.
City Clerk Carroll read a communication from Miss Paula Cochran, President
of the Senior Class of Clermont High School, wherein she requested per-
mission to use the Jenkins Auditorium on November 8, 1968 for the annual
Homecoming Dance. She further agreed that any regulations set for use
of the building would be honored. Motion was made by Councilman Oswalt,
seconded by Councilman VanderMeer and carried that the request of the
Clermont High School/GRARrbe granted.
City Clerk Carroll read a communication from Mr. H. A. Vonderahe, wherein
he requested a renewal of Lakeftont Easement from October 7, 1968 for
ten years on "That portion of Lake Front, between Lake Minnehaha and
Lake Shore Drive, lying directly South of Lot 13, Clermont Heights".
Motion was made by Councilman Oswalt, seconded by Councilman Prior and
carried that this request be granted and the necessary Easement be
executed.
City Clerk Carroll read a communication from Adele Roberts, Division Manager
of Blue Goose Growers, Inc. wherein he expressed thanks and appreciation
to the City Manager and Council for courtesies extended to them in handling
the paving of the area adjacent to their local packing house.

Councilman Prior read a News Release which he had received regarding
possible riots/demonstrations on Election Day this next November 5th,
and called to the Council's attention the anti -riot law passed by Congress
which should be upheld in its strictest sense to prevent the electoral
process from being tampered with. Councilman Prior submitted this
release to the Clerk, and it shall become a part of these Minutes.
City Manager Johnson submitted his report, both orally and written.
Controller Fleming reported to the Council that all delinquent water
accounts (excepting those who indicated they would be absent from the
city for a continuous length of time) had been shut off after the delinquent
date of the 20th of the month, and that numerous complaints had been
received in the City Hall and several of them directed to the receiving
clerks. He further reported that it had been past policy to discontinue
service after becoming delinquent on the 20th and it was his recommendation
that this policy be continued, however, he requested consensus of the
Council regarding this. It was the consensus of Council that 20 days
was ample time for payment of the water bills and that Mr. Flemings's
recommendation be accepted. Councilman Oswalt inquired of Mr. Fleming
if the policy was to discontinue all delinquent accounts, or just
certain accounts and Mr. Fleming replied it affected all delinquent
accounts excepting those who indicated they would be absent from the
City for a continuous length of time.
City Attorney Langley presented a RESOLUTION regarding the city's
acceptance of HUD'S offer of loan and read the RESOLUTION in full. Motion
wasmade by Councilman Prior, seconded by Councilman Beals and carried
that tthis RESOLUTION be adopted.
City Attorney Langley submitted an Easement Agreement between the
Seaboard Coast Line Railroad Company and the City of Clermont covering
relocation of an existing grade crossing at East Ave, and advised that
such an agreement was in order, and was ready to be executed by the Council
President and the City Clerk. Motion was made by Councilman VanderMeer,
seconded by Councilman Cochran, and carried, that the Council President
and City Clerk be authorized to execute this Easement Agreement. Council-
man Prior abstained from voting and advised he did not wish to vote on
this matter until such time as the Council is in receipt of the
specifications for this crossing, such specifications as required by the
Railroad Company.
City Attorney Langley reported that the necessary papers for the incorpora-
tion of the Lincoln Park Day Care Center had been mailed to the Secretary
of State for approval.
Motion was made by Councilman Beals and seconded by Councilman Oswalt
that a grant in the amount of $200.00, previously authorized by the Council
to be paid to the Lincoln Park Day Care Center, be rescinded. Considerable
discussion followed and Mayor Smith requested it be a matter of record
that, in his opinion, if such action be taken, it would do more harm to
the City of Clermont than good and he thereby strongly opposed any such
action. Upon roll call vote on passagecof the motion, the result was:
Ayes: Oswalt and Beals. Total Ayes: Two. Nayes: VanderMeer, Cochran and
Prior. Total Nayes: Three. The motion failed to carry.
City Attorney Langley explained in detail the proposed contract between
Michaels Engineers and the City of Clermont regarding construction of
a 16" water supply test well and requested consensus of the Council
regarding same. It was the consensus that this contract was in order,
whereby motion was made by Councilman Prior seconded by Councilman Beals
and carried that this contract be executed by the City Manager, the City
Clerk and the Council President.

Councilman Cochran reported he had received complaints regarding the
unsightly conditions existing at and around Dom's Garage at the intersec-
tion of 5th Street and Highway 150. City Manager Johnson advised that
he would investigate this matter.
Councilman VanderMeer reported he had received a complaint regarding
the condition of the sidewalks between 10th Street and West Avenue on
Montrose Street.
Councilman Prior inquired of the City Attorney as to the qualifications
for a candidate to run for a city office inasmuch as he had failed to
find these in the City Charter. Mr. Langley advised these would be
set forth by State Statutes and he would look into the matter and report
later.
Councilman VanderMeer reported he had been advised by County Engineer,
Gordon Hays, that any time county crews are digging clay, clay would be
available to the City for 30C per yard and would have to be hauled by
city crews and trucks.
City Attorney Langley was requested to contact the necessary authorities
regarding refusal by the State to issue a license to William Hunt of
Meeker Garden Supply Store for the spraying of citrus in Clermont and
report back to the Council.
Motion by Councilman Prior, seconded by Councilman VanderMeer and
carried that the meeting be adjourned.

Yippee leader, Jerry Rubin, who heads the Youth Interna-
tional Party, has threatened election day demonstrations across
the country on November 5, which he said will necessitate call-
ing out the National Guard,
Bill Heriong, candidate for Congress, today called on
Attorney General Clark to take action under the federal anti -
riot law to prevent election riots threatened by Rubin.
In a letter to Clark, Bill Herlong said;
--under the anti -riot law passed by Congress last year, I
am sure you are aware that it is now a federal offense for
persons to cross state lines to incite riots. After the Chicago
debacle last month, we cannot fail to take seriously the threats
of election day violence. I urge you, as Attorney General, to
use the law Congress enacted to bring an end to this inter -state
peddling of violence. The American electoral process must not
be tampered with, riots designed to keep citizens from voting
must not be permitted,-1 concluded Herlong.
CITY MANTGER'S REPORT
t:ork by City crews for the past two weeks has consisted primarily
of odd jobs. Such work included the mowing and cleaning of street
prs;rlcaaa.ys, parks and other city owned property, patching and
repairing streets, painting street directional lines and parking
area, repairing the driveways in the cemetery and similar miscellaneous
i u:ms. Construction of Second Street started today.
we have again been promised that county crews will haul clay for
our little lsague ball fields this week.
