Box 120219, Clermont, Florida hereinafter referred to as the CITY and Robert Thompson and Jerome Kocielko, Clermont Oaks Office Park, P.O. Box 120978, Clermont, Florida In an effort to mitigate the impacts resulting from development on the subject property the City requires certain land use and site development related issues be addressed upon that certain "property" described by legal description on Exhibit "A", attacheq here~o and incorporated herein ( hereinafter called the "Property"). The property owner shall provide a ten (10) foot wide landscape buffer along the western property boundary. The buffer shall include a hedge of shrubs and live oak trees planted 40 foot on center. In addition, either a six (6) foot masonry wall shall be provided along the inside perimeter of the ten (10) foot buffer to run the entire length of the western property boundary of Lot #5 or a 29 foot wide landscape buffer (4 foot high, 3: 1 slopes with 5 foot planting area to include hedge and tree requirements) shall be required. 1 . . . . .. ~.R BOOK 028 PAGE 1 901 The Lakeview Hills Homeowners Association shall have 45 days to make a recommendation as the to option of the wall along the western property of Lot 5 or the landscape berm buffer. If no consensus is reached, then the buffer berm shall be required. Chain link fencing along US 27 and Brogden Drive shall be prohibited. The construction of a gas station/convenience store within the Clermont Oaks Office Park shall be prohibited. The agreement is a binding contract, entered into by ROBERT THOMPSON and JEROME KOCIELKO and the CITY freely and with consideration, and may be enforced by ROBERT THOMPSON and JEROME KOCIELKO or the CITY in any court of competent jurisdiction, or by any other method agreed to by the parties or allowed by law.
