MINUTES
REGULAR COUNCIL MEETING
JULY 13, 1993
A regular meeting of the City Council of the City of Clermont was held Tuesday, July
13, 1993 in the Council Chambers. The meeting was called to order at 7:30 p.m. by
Mayor Pool with the following Council members present: Council Member Cole,
Council Member Ivey, and Council Member Norquist. Other City officials present
were City Manager Saunders, City Attorney Baird, Finance Director Van Zile and
Deputy City Clerk Whitlock.
INVOCATION
The Invocation was offered by Council Member Ivey followed by the repeating of The
Pledge of Allegiance to the Flag by all present.
MINUTES
The minutes of the Regular Meeting held June 22, 1993 were approved as presented.
.CITY MANAGER SAUNDERS' REPORT
Labor Day Fireworks Display
City Manager Saunders stated that Mr. Vickers of APC Fireworks has proposed to
provide the 1993 Labor Day fireworks display at Jaycee Beach for the same price
($2,500) and same amount of fireworks as last year, with the addition of one large
rocket.

A motion was made by Council Member Norquist, seconded by Council
Member Cole, and carried unanimously to retain APC Fireworks for
$2,500 to provide fireworks for the 1993 Labor Day_ festivities.
Lake County Interlocal Recycling Agreement
City Manager Saunders stated that this is the third year that Clermont can enter into
an interlocal agreement with Lake County for a recycling grant. We should receive
approximately $9,000 next year which is about the same as this year. The proposed
agreement is the same as the last two years.·

A motion was made by Council Member Ivey_, seconded by Council
Member Cole and carried unanimously to enter into the Lake Count_
Interlocal Recycling Agreement for 1993-94.
Workshop Meeting
City Manager Saunders asked to set a Council Workshop at 7:00 p.m. on July 15 for
budget review. Council Members agreed.
MAYOR POOL'S REPORT
Excessive Noise at jaycee Beach
Mayor Pool reported that he had received telephone calls about loud noises involving
a performance at Jaycee Beach Pavilion on Sunday. He asked if the noise ordinance
included a decibel rate. City Manager Saunders stated that no decibel rate is included
in the ordinance, but he will investigate solutions including a listed decibel rate and
discuss it at an upcoming workshop.
Council Member Ivey suggested the possibility of requiring a permit from the City
Manager for any performances at Jaycee Beach.
MAYORAL PROCLAMATION
Mayor Pool stated a City election is scheduled for Council Seats II and IV which are
currently held by Council Member Turville and Council Member Ivey. If more than
two candidates qualify for one of the seats, a Primary election will be held on
September 28 with a General election being November 2.
The qualification period begins August 9 and ends August 13. He encouraged all
interested parties to participate. Mayor Pool read the Mayoral Proclamation in its
entirety.

UNFINISHED BUSINESS
Utility Agreement
City Manager Saunders stated that the utility agreement with Johns Lake Estate is in
its final form, however, if any further changes are made, he will bring it back to
Council. No changes have been made to the estimated financial projections that were
discussed at the last meeting.
Council Member Ivey questioned Item//6 of the agreement regarding the City
guaranteeing a total of 171 connections to Zyderveld from the water system after
Phase II is completed. He asked if the City could cancel this guarantee if ZOM
discontinues building. City Manager Saunders stated the City is assuring that the
water system will have the capacity to serve 171 connections for ZOM, however, if
they discontinue building, a new agreement would be pursued.

A motion was made by Council Member Cole, seconded by Council
Member Ivey., and carried unanimously to approve the water system
agreement with ZOM.
Final Reading of Ordinance #278-C
Mayor Pool stated Ordinance #278-C was presented for final reading, and he read it
by title only. He stated that the existing code requires home owners to provide
garbage containers. The section in Chapter 10, Section 10-4 (c) requiring home
owners to provide containers will be deleted and a new section will be inserted which
states that the City will provide the garbage containers, which will be the only
acceptable containers.
Council Member Ivey stated that some residents are concerned with how large the
proposed containers are. City manager Saunders stated that Otto Industries is
developing a 35 gallon container that will be available. He stated that the Sanitation
Supervisor is currently tabulating the numbers required.

A motion was made by Council Member Ivey_, seconded by Council
Member Cole, and carried unanimously by roll call vote to adopt
Ordinance #278-C.
High Lift Unit Attachments for Garbage Trucks
City Manager Saunders stated that the manufacturer of the new garbage containers,
Otto Industries, has recommended high lift units manufactured by Automated Refuse
Equipment for use on the side loaders. They will sell the units at dealer cost ($2,943
per unit), and two units will be needed. There are other lifts available for about the
same cost, however he recommended that the regular bidding be bypassed in order to
purchase the manufacturer's recommended product.

A motion was made by Council Member Norquist, seconded by Council
Member Cole, and carried unanimously to purchase two high lift units
from Automated Refuse Equipment for $2,943 each.
City Manager Saunders stated that other cities using these high lift units will be
contacted to determine what spare parts should be kept on hand. Backup warning
devices were discussed, and City Manager Saunders stated that most City equipment is
equipped with the devices. Automatic braking devices for garbage trucks are also
being investigated by City staff.
MISC. COMMENTS
Steel Can Recycling
Mr. Winters asked if the City takes metal cans for recycling. City Manager Saunders
stated the City has taken metal cans for about two months. Council Member Norquist
suggested an article be included in the next Newsletter regarding all the acceptable
recycling materials.
